Justice Ketanji Brown Jackson has written her first majority opinion for the Supreme Court.
The opinion released Tuesday in a dispute between states over unclaimed money is one of roughly a half dozen she is expected to write by the time the Court finishes its work for the summer, usually in late June. The 23-page decision was unanimous, though all the Justices didn’t join the whole opinion.
The Justices sided with a group of states that said that Delaware had improperly received hundreds of millions of dollars in unclaimed funds over more than a decade that should have been shared among the states.
Each Justice typically writes at least one opinion from the seven separate two-week arguments sessions the Court holds from early October to late April. But in January and February, for example, the Court has only seven argued cases each month, meaning there are not enough to go around.
Jackson, 52, joined the high court in June following the retirement of Justice Stephen Breyer. She is the first Black woman to serve as a Justice and just the third Black person on the court. The others are Justice Clarence Thomas, the longest-serving among the nine Justices, and the late Justice Thurgood Marshall.
Jackson’s first majority opinion came in a case involving two products sold by the money-transfer company MoneyGram: the company’s “teller’s checks” and “agent checks.” Customers can buy the checks at banks and credit unions.
When teller’s checks and agent checks aren’t cashed, the Dallas-based MoneyGram sends the abandoned funds to Delaware, the state where MoneyGram is incorporated. But other states pointed to a federal law about abandoned money orders, traveler’s checks and “similar written instruments.” The law says that when those go uncashed, the funds from them go back to the state where they were purchased.
The states argued that MoneyGram’s teller’s checks and agent checks counted as “money orders” or “similar written instruments” and that they were due money.
In ruling against Delaware, Jackson noted that teller’s checks and agent checks operate “like a money order” and that the unclaimed funds were being sent back “inequitably” solely to Delaware.
In a statement Brenda Mayrack, the director of Delaware’s Office of Unclaimed property, said the state is “disappointed in the ruling.”
The case now returns to a federal judge the court has appointed to oversee the dispute, a “special master,” for additional proceedings.
Jackson wrote her first dissenting opinion in November, in support of a death row inmate from Ohio who failed to win Supreme Court review of his case.
Lawyers for the inmate, Davel Chinn, argued that the state suppressed evidence that might have altered the outcome of his trial.
Jackson wrote that she would have ordered lower courts to take another look at the case. Only Justice Sonia Sotomayor joined Jackson’s opinion.

767: Randy Wakeman - I've Been Around for a Long, Long Years
Randy Wakeman has been around for many decades and was often seen lecturing and performing at magic conventions. Nonetheless, I have always seen him as an “underground” magician who appeals to the true sleight-of-hand experts. He is one of those guys who has “been there, done that, has the t-shirt” as he was one of the regular performers about the Chicago Bar Magic Scene before the turn of the last century. He has written several books on magic (card magic mostly) and is still relevant in our community as a performer, teacher and author.

While at the recent Senior Tour close-up convention in St. Louis, The Magic Word spoke with Randy as part of the convention report content. He was preparing for a workshop, so we didn’t get a chance to go in-depth as I had wanted. But we agreed to get together at the 4F convention in Buffalo a couple months later. True to his word, we sat down to complete our chat which results in this episode. The content of our chat in both places was a little disjunctive, so the editing required us to put the second conversation first then plug in the chat in St. Louis and finish with our talk while in Buffalo. This sounds more confusing that it actually is, but I know you will understand and enjoy our chat.

Like you mentioned in another post, this isn't specifically about oppenheimer or any narratives it portrays but the wider discussion that's been resurging around usamerican imperialism, nuclear weapons and the military/militarization in general. And this is so very long so I apologise.
The fact of the matter is, even after all the "lessons" learnt from bombing Hiroshima and Nagasaki, the us wanted to do further testing to see the full extent of the impact of nuclear weapons. These tests were carried out in the Marshall Islands in the Pacific, which was already heavily militarized by this point.
As usual when it comes to military interventions and imperialism by core nations, these tests were framed as a necessity "for the greater good", and to "end all wars", even framing its supposed necessity through religious narratives (which, well, christian missionary efforts).
There were 67 tests conducted from 1946 to 1958, and some of the weapons tested like the Bravo bomb dropped on March 1, 1954 over Bikini Atoll were many times more powerful than the ones used in WWII. As expected, these tests completely destroyed the Marshall Islands, from the ocean to the atmosphere to the land. So much radioactive fallout, so much devastation and literally uninhabitable to any living being.
I want to talk specifically about one of the most atrocious aspects of this whole ordeal which is that while the usamerican authorities evacuated the Marshallese people in Bikini and Enewetak during the 1948-52 testing period (operations sandstone, greenhouse and ivy) to nearby islands, they failed to do so for operation castle series begun in 1954. The relocated populations suffered as well, since there weren't enough resources on the islands they were resettled in to sustain this extra population, and of course, the nuclear fallout would affect them even though no weapons were directly tested in these islands.
The impact of the bravo bomb detonated over Bikini was mainly on the people from Rongerik, Rongelap and Ailinginae atolls, who were not evacuated until after the bomb was detonated at which point they were already exposed to high levels of radiation. In fact, the Rongelapese people were basically used as human test subjects as they were relocated back to Rongelap in 1957 where they remained until 1985 when they had to evacuate themselves.
The us actually declared Rongelap safe and that there were no long term effects from nuclear fallout in order to relocate them. Edward teller himself has gone on interviews to declare how little of an impact the bravo test has had on human lives. Iirc the documents regarding the tests were only declassified in the 70s, so Marshallese people were deliberately kept in the dark about the cause of the illnesses they were experiencing due to nuclear fallout. Here is Lijon Eknilang, a Rongelapese survivor talking about her experiences:
In June 1957, when we did return, we saw changes on our island. Some of our food crops, such as arrowroot, completely disappeared. Makmok, or tapioca plants, stopped bearing fruit. What we did eat gave us blisters on our lips and in our mouths and we suffered terrible stomach problems and nausea. Some of the fish we caught caused the same problems. These were things that had not happened before 1954. Our staple foods had never made us ill. We brought these problems to the attention of the doctors and officials who visited us. They said we were preparing the foods incorrectly, or that we had fish poisoning. We knew that was impossible because we had been preparing and surviving from these foods for centuries without suffering from the problems that appeared after 1954.
It has always been interesting to me that even the people who were not on Rongelap in 1954, but who went there with us in 1957, began to experience the same illnesses we did in later years. Foreign doctors and other officials called those people the “control group,” and we were told the sickness of that group proved our illnesses were common to all Marshallese. We did not believe that, and we learned only recently that the “control group” had come from areas that had also been contaminated by radioactivity from the weapons tests.
The usamerican authorities to this day do not acknowledge how serious and how much of an impact the nuclear weapons have left on the Marshall Islands and its people. There is no acknowledgement of the fact that people outside of the Enewetak, Utrik, Bikini and Rongelap atolls during testing were affected even when they show effects of radiation. There is no acknowledgement of just how much destruction they've brought upon these islands (also keeping in mind that animals were not evacuated). And of course, there is no acknowledgement of the fact that none of this was necessary in the first place (even if it can ever be called necessary). It was basically a large scale human experiment done for the sake of science and the "greater good", with little to no concern about the impact it would leave on the people of Oceania.
Oh, and there's also a huge crater left on Enewetak from the testing that's basically leaking nuclear waste into the soil, still contaminating the flora and fauna in area and beyond. There's so much spending by the us military in the Pacific region, especially now with the whole AUKUS agreement, but nothing has been done to properly contain this waste. Or actually address the violation of Marshallese people's human rights due to nuclear weapons testing. There has never really been any talks of reparations either, and whatever money and resources the us has spent has been woefully inadequate.
While the testing stopped decades ago, this is only a part of the ongoing militarization of Oceania by the US (and associated core and semi-periphery nations). Of course, this is all framed as selfless efforts by the us to prevent wars (which it always seems to be doing), for the greater good of humanity, to take us into further advancement and so on. Lastly, to mention a sliver of the role science has played in all of this: they were celebrating the discovery of new elements after the ivy mike detonation (1952), while people were suffering the impact of ongoing nuclear testing, and iirc, they were actually hoping to discover new elements from these nuclear reactions, so who's to say that these weapons were not made as a part of the race to discover elements, aka scientists' version of a dick measuring contest.

PSA ABOUT PHONE SCAMS FROM GOVERNMENT OFFICIAL IMPERSONATORS
So. I almost fell victim to a really elaborate phone scam. Now that I've had time to process it, it's deeply unsettling how convincing the scammers were, and I don't know how far they might've gotten if it hadn't been for a tumblr post that I'd read recently, warning about these strategies. For the life of me I can't find that post now which is a shame because it explained the strategies very well, but I'll try to reiterate the main points I remember that helped me realize in time that I was being scammed. Hopefully no one else has to go through this but in case they do, may this help you recognize the red flags MUCH earlier than I did. (if anyone knows of the post I'm talking about please let me know! It went into a lot of good detail of what to watch out for)
I'll try to summarize how it went down first. I was called by someone claiming to be from the FTC. They gave me a badge number and a case number. They said a package being shipped to me from Mexico was intercepted, and contained illegal drugs and huge amounts of money, that my name was used to open accounts at multiple banks, and that my name was also used to try and claim some property in some random city/state I'd never been to. Of course this was immediately alarming to me and I start freaking out, but they then reassured me that after a background check they determined this is most likely a case of identity theft.
The convincing part was how much effort they seemed to put into asking if I could remember any instance where my identity might've been compromised; like they were legit trying to investigate the case in order to catch the actual culprit. So of course I'm trying to be as helpful as I can. They haven't asked me anything specific like bank accounts or SSN, so no obvious red flags.
Then they go into the steps I needed to take in order to establish I'm not the actual criminal who tried to ship drugs across the border, that it really is a case of identity theft. They describe to me ADR (alternate dispute resolution), which I quickly looked up and seems like is an actual legal thing. Basically they were saying that if I chose this option I don't have to hire my own lawyer/show up in court/etc, that the US Marshal will on my behalf establish to the court this was a case of identity theft.
They transfer me to someone supposedly at the Department of Justice, who also gives me a badge number. This person goes into more detail about the steps I need to take, that because my identity has been used to open up all these bank accounts and shipping drugs to multiple countries, etc - that I would need to be assigned a new SSN. And to do that, they needed to know which accounts were actually mine; so they asked me to verify exact amounts in my bank accounts, and anything else that was directly tied to my SSN such as credit cards.
They kept reiterating that I needed this new SSN so that they can monitor my old one and be able to catch whoever is using it for all these illegal activities. They emphasized I should stay on the line, and to also not tell anyone about this ongoing investigation because the identity thief could be anyone I know. I'm still not getting suspicious at this point because they keep emphasizing they don't want to know any specific bank account #s or my actual SSN, because that would be illegal to ask for.
I then get transferred to the supposed US Marshal, again gives me a badge number. Again going into more detail on how to secure my actual accounts so they can close out/track the fake accounts. He starts getting more into detail about securing my bank account and how I needed to go to the bank in person. He emphasized that I shouldn't tell the bank teller what was going on because they could be involved in the crime, or something about money laundering, I don't remember exactly what the explanation was.
This is the point I started getting suspicious; I remembered specifically from that tumblr post that the scammers will want to keep you from revealing anything to bank employees because they are trained to recognize scams like this. I continue the conversation though, and the 'US Marshal' goes on to say, in order for me to secure/establish this account as truly mine, that I need to withdraw 50% of my funds from it in cash, and not a cashier's check. THIS is the point I realize what's going on, and I stammer out something about wanting to verify the badge numbers they gave me, and quickly hang up.
Things they did that made it believable:
- Giving me badge numbers and a case number
- Reassuring me they don't want to know sensitive information like SSN, bank account numbers, etc.
- Seeming genuine in investigating how my identity might've been compromised
- Citing actual legal pathways like ADR
- The way they slowly ramped up the urgency so as not to come off as suspicious too suddenly. They worked up my fear from a more believable scenario (that my identity was stolen and being used for criminal activities including opening a bunch of bank accounts) and used that to justify the steps I needed to take to secure my own actual accounts.
Things that should have been red flags:
- I was too panicked in the moment to notice right away but I'm fairly certain all 3 people I talked with had the same accent. What are the chances of that for 3 different employees at supposedly 3 different government organizations?
(these were things that thank god I remembered reading from that previous tumblr post)
- they kept me isolated by claiming anyone I know could be the actual culprit who stole my identity.
- They urged me to stay on the line as they continued to transfer me to the next person, keeping me from calling anyone else.
- they said not to let the bank teller find out what was going on
Things I did not know but learned, either from looking up myself or from the FTC when I called to report the incident:
- Different departments don't actually communicate very closely. So they'd never transfer me from department to department the way the scammers did. The FTC for example wouldn't be able to ask the Social security department to issue me a new number.
- Nobody from the FTC will give you a badge number or ask you how much money you have in your accounts.
Steps I took afterwards, because I'm fairly certain I never gave actual sensitive information, but in my ramblings to try and be helpful with their 'investigation' I might've said something compromising.
- Called the US Marshal office just to triple check; they almost immediately said it was a scam as soon as I mentioned 'badge number.'
- Called the FTC to file a fraud report
- Called one of the credit bureaus (Experian I think) and placed a fraud alert on my credit activity. This automatically applies to all 3 bureaus, and lasts for a year
- Changed my bank acct passwords
I feel pretty stupid in retrospect at how panicked I got, but I do feel like they were very good at manipulating my emotions to believe them for as long as I did. So as embarrassed as I am to admit I almost fell for this, again hopefully this might help even 1 other person spot the red flags early enough.
