Hi, i've been having big troubles with wanting to be better at academia and stuff but im not really sure how to get started... i sorta feel like an imposter a lot but im trying to not let it affect me but sometimes i just have moments of excruciating executive dysfunction where i can't move because I want to do so many things and my body is fighting against me... Idk if i even have a question really but it feels better to tell you this... i really look up you a lot and have for a long time...

Hi nonnie! It’s incredibly brave of you to drop this in my inbox. Yes, even anonymously. It takes a lot to even type that kind of honesty out. So thank you, and I hope you take a moment to thank yourself.

Secondly, thank you for touching my heart by your kind words. I hope you realize as you look up to me that I have the same kind of feelings, as do many studyblrs–and I’m dedicated to being honest about it so you don’t feel as if you have to live up to a perfect (and impossible, and fake) standard. I go to therapy regularly despite being in a lot better place than I used to be, because it’s almost like going for a mental check-up or gym session, and my therapist helps me sort through even tiny things so I can build better habits and mindsets. But I still remember feelings of dysfunction well, and I still battle with imposter syndrome!

The most important key ideas here are attainable goals and self talk. Both of these ideas don’t come easily, they do take work, but they’re tools that make other difficult things easier over time, with persistence.

When your body is fighting you (and really, more than anything with executive dysfunction, your mind is fighting you and making your body less functional), even baby steps can be difficult. For you, it could be anything from exercising to studying to eating to showering. Big or small, it’s totally valid that you may or may not struggle with it, and it doesn’t make you desperate for attention, or fake, or pathetic.

Let’s take your desire to “get better at academia.” That could mean a lot of things, so I’m going to latch onto one facet of it as an example. If it doesn’t apply with that exact example, that’s completely okay! Just alter it to apply to what you are struggling with, or desiring.

1. Big, abstract goal: to get better at academia

2. What that means (for this example): developing better study habits

3. What kind of things constitute that? That’s still a big, abstract goal that sounds quite formidable and unattainable. List out as many things as you can that you are striving to do or would want to try. Not everything might work for you!

Managing time better

scheduling study time

being accountable via apps or with family/friends

being efficient or effective (i.e. not getting distracted

Finding study habits that work for you and for the class’ requirements

flashcards

typed computer notes

handwritten computer notes

handwritten paper notes

infographics

youtube videos

interactive online exercises

conversations with classmates, tutors, or professors

podcasts

mind maps

journal entries

presentations

self-made study guides

practice tests (self-made or provided, online or on paper)

Feynman’s technique–writing a summary of what you’re studying, and then comparing it to the actual material. Whatever is missing is what you need to focus on, because my mantra is that it will always appear on the test.

ranking the subjects or topics by what you know most to least and studying from the bottom up. I can post a more detailed guide to this if you want! just hit me up again.

Also changing the way you treat and care for yourself

setting a stable routine

eating better (this means different things for different people–maybe you need more Vitamin C, so you should focus on more fruits in your diet, or iron, so vegetables, etc… consult with a doctor or registered dietician, not a nutritionist since they don’t have to have a degree or certification)

going to bed at a routine time

if you have to choose one, make the wake up time set. that way, if you do go to bed late but wake up at that time, it’ll reset your body clock to be sleepier earlier the next day. it’ll eventually even itself out.

drinking more water

setting up or revising your skin care routine

taking measured and unmeasured breaks away from studying to allow the information to set in your brain and to give your mind and body a much-needed reprieve

setting limits on how much screentime you want yourself to add

Self-talk

This is the big one I want to impart on you before this post is over.

You can’t just try to implement these better habits. You also have to focus on what you’re thinking when you’re doing or not doing them, and how you’re psychologically treating yourself. This isn’t easy! It takes a lot of time. And that’s okay. You aren’t going to be free of this stuff overnight. I’ve been working on this stuff actively since I was about 17 and I’m still struggling with it. But I’m also much better at addressing it than I was almost three years ago.

Be aware

Recognize when you’re treating yourself harshly. Acknowledge those times you say “I’m not good enough” in the very back of your mind. Because a lot of times we aren’t even fully conscious of how much we say “I hate myself” or “I’m stupid” or “I can’t do this.”

Once you’ve done that, start calling attention to it.

Hold yourself accountable. If this were someone hurting a friend of yours, you would likely be calling them out for the whole world to know their cruel behavior isn’t acceptable. It’s the same thing for yourself! Those awful thoughts in your brain might live there from self-doubt, mental illness, or other reasons, but you do get to decide if they pilot your actions and your mentality, even if they’re whispering awful things about how you don’t have a choice but letting them be in control.

I will freely admit on here that I’m attending therapy, because I seek to destigmatize it. I’m not at rock bottom. I’m not pathetic. I just noticed some things about me that I need to change, heal, and/or improve, and I wanted a professional to help me! Much like if I sprained my ankle or got a cold and needed to see a doctor. And one of the things that my therapist told me was as much as my anxiety felt debilitating, I am the one piloting my body and I am the one who gets to decide whether my self-talk is going to change.

And do it gently.

Not “you’re an awful person for saying these things about yourself.” You don’t solve bullying with bullying, and you definitely don’t solve putting yourself down or feeling like an imposter but doing more of the same. Instead, show compassion to yourself.

Have a conversation with yourself.

“Why do I feel like this?”

“Where is this coming from?”

“What makes me say that?”

“What can I say instead?”

“What would make me feel better?”

“What could change my mindset about this problem?”

The choice is up to you how you do it. But pretend you’re pulling someone who is misbehaving or acting cruel aside, and instead of reprimanding them, you just gently put your hand on their shoulder and say, “I’m here. What’s going on? What’s causing this behavior?”

Do the same exact thing with yourself! Offer that compassionate hand. If you’re anything like me, your imposter system is probably coming from undue pressure on yourself, self-doubt, previous bad experiences, fear of failure or rejection, insecurity, anxiety, or any number of other things that could make you doubt your beauty, your talent, your work ethic, your ability to succeed.

And a lot more people have it than you think! Just don’t compare yourself to others when, even if you know them well, you can’t know them 100%. I’m sharing my experiences because I want you to know that you’re not alone. And I also want you to know that you can only fix yourself, you can only control yourself, and the same goes for others–they have no business (and probably aren’t thinking of having any business) judging you or controlling you. If they are, screw them. Your job is to take care of and focus on yourself.

Once you know where it’s coming from, start substituting the language.

You can’t do this. “You may not be able to do this yet, but with some effort, you’ll be able to–or, you’ll be close to being able to.”

You’re a failure. “Everyone makes mistakes or fails. It doesn’t define you.”

It was just luck that got you this far. “It was hard work, passion, and effort. Keep hanging onto those things.”

You’re not good enough. “You are enough, and you don’t exist for others. You exist for yourself.”

People will get bored of you. “You don’t exist to entertain or please others.”

There’s a million more I could go through, but hopefully these examples are enough for you to apply it to your own doubts.

This might be a good exercise to journal. Because then you actually have to get the thoughts out instead of them staying scrambled in your brain. Feel free to do a bulleted guide for yourself like this one!

Etc, etc, etc… Any one of these single bullets could be an entirely distinct post, but I hope this is enough to start you off, nonnie. Hello half valid anon here (i like my nickname 😂). I got through all your fics and they were all great. Right now im just reading a lot of poi fanfics and watch fanvids cause i can't accept that the series is over 😂 --- i know what you mean about fics affecting you negatively. I had this with 13rw (the Show and some fics) everything was so dark and hopeless that i had to stop watching it. I also love to seek out fics where someone is hurt so i can feel my pain through the characters (1)

But i try to read only fics with lots of comfort so it kinda feels like i get comforted as well (dont know if that makes sense). If it makes you uncomfortable or if its unhealthy for you to write about this i completely understand and i dont mean to come of as pushing you to write. I just hope whatever you do will be the right decision for you! As for you feeling suicidal im sorry to hear that. Let me know if there is ever anything i can do to help! I wish i could say sth more comforting but Im not super good with words :( i just hope you have people in your life that support you! 💛

maybe root will grow on you too? Or maybe you can skip her scenes and enjoy John, Harold and most importanly Bear! 😂 Yeah Shaw definately looks really good. She is a bit like Reese minus the caring. At first it seems she doesnt care about anything at all but thats not exactly the Case. There was an episode with Shaw and a little girl (3x5) and i really loved it (have you seen that one?).

I really think Shaw would grow on you (especially since in the beginning she does a lot with John) but then again a lot of her later scenes include Root so im not sure. Yes i love that there were never any romantic undertones with her and John!!

i guess everyone sees chemistry different, i think Shoot and Rinch post have great chemistry ☺️

as for John being good with people: YES!! he is always so compassionate and such a great listener as well. I especially like him with children. John and the baby were so cute or John with the boy who offered to pay for him. John + Kids was always a great combination and i wished we would have seen it more often. Also regarding children we did we never got to see a John Taylor scene after Carters death? I needed that!

yes John the badass is also amazing! His character has so many different sides and i love him so much!!

i think Grace Harold was really cute but i dont really see a future for them, i mean he lied to her for so long! but then again they really loved each other so idk maybe they work it out. Im also not into John/Harold/Grace but like you said good for the people who like the ship :)

Oh boi 13rw is so cursed, can't believe I watched all of the 1st season 😬 I remember being afraid of the suicide scene making me uncomfortable but it was so cringe, unrealistic and just bad that I wasn't even that uncomfortable, I cringed when she cut her arms but that's it.

Yeah big mood I project a lot on comfort fics as well. For suicide fics, I think it also depends on how the fics adress the subject. It's something that is complicated to write. If I read a suicide fic with no recovery I'm gonna project but feel like shit. But with recovery, I can project into the recovery as well so it's better ! I read a really good ace attorney fic showing Miles recovering after a suicide attempt, it was thoughtful and didn't fall into the pitfalls of magical super fast recovery/love heals everything, and some lines stuck with me, it was really good and comforting. But yeah if it's just a suicide/suicide attempt then I don't think it's good for me (but sometimes I still read it bc I'm a Dumb Bitch).

Dw you didn't come off as pushing 💜 I'll see how I feel about continuing it or not. I have to figure out if writing about suicide is positive or negative for me 🤔 I mean I'm not portraying John's suicidal crisis as a positive thing, and he reaches out to Harold, and considers he might get better so I don't think it's bad for me ? Another problem is that I have a tendency to drop my wips to write a new shiny idea I get, and then I never finish anything gkgkffjfjf I dropped the suicide fic for the body horror fic which I dropped for the time loop fic, and there's also the hanahaki fic I started last year but I haven't touched in months, plus a bunch of random shit floating around OneDrive lmao someone stop me

I feel like the death of one of the core four + the abandonment of the library really alienated me from the show (did I already say that before ?). And here I'm gonna shamelessly derail from Carter to the library bc boiii do I have a lot of feelings about the library !! And you're here, talking about poi, so you're the perfect subject to throw these feelings at. This post really says what I feel about it (I'll put the link at the end as well if you wanna read it after you're done with this l o n g reply). It was in a way its own character and its forced abandonment/destruction really hit me (fucked me up when they broke that glass board). It says something that it's one of the few things I remember from S3 along with Carter's death and 4C. I loved it a lot, it was a cornerstone of the show. It was a safe place, a home for Harold and John (and Bear !). I love when they're together in there, I love this cracked glass board, this yellow stained glass in the windows !!! (at least I assume it's stained glass ?), these lights, Bear's cushion, the whole cozy/safe/isolated feelings, just absolutely everything. And yeah later they have the subway, idk when it's introduced I don't remember if it's early enough for me to have watched it. And maybe it's nice, I can't judge rn. But it's like trying to give me a new MC after a MCD, make him as nice as you want I'll be clutching the previous MC until I die. Gkfkfkff I went overboard and off topic but I just love the library ok

Ikr I love how he's badass but also gentle and understanding and nice to people ! I love him !!! Yeah wolf and cub is really good, also I love when John smiles to Darren at the end !! Yeah they were cute in the past. I think it's good he went back to her bc it gives closure to both of them. But I don't see their relationship working again. She grieved, probably started to move on after all these years and knowing he lied all this time probably won't make her want to go back with him. I've never been in love so what do I know lol, but were I her I probably wouldn't want to go back with him and I'd just be happy knowing he's alive after all.

Japan is the first country in the world to approve Imeglimin. The TWYMEEG approval is supported by numerous preclinical and clinical studies, including the Phase 3 TIMES (Trials of IMeglimin for Efficacy and Safety) program managed jointly by Poxel and Sumitomo Dainippon Pharma, which included three pivotal trials to evaluate TWYMEEG’s efficacy and safety in over 1,100 patients. In all three trials, TWYMEEG met its primary endpoints and objectives and was observed to exhibit a favorable safety and tolerability profile.

The Phase 3 TIMES program was a joint development effort between Poxel and Sumitomo Dainippon Pharma. The companies entered into a strategic partnership in October 2017 for the development and commercialization of TWYMEEG in Japan, China, South Korea, Taiwan and nine other Southeast Asian countries4.The approval triggers a JPY1.75 billion (approximately EUR13.3 million, USD15.9 million)5 milestone payment to Poxel. Furthermore, after product launch, Poxel is entitled to receive escalating double-digit royalties on net sales and sales-based payments of up to JPY26.5 billion (approximately EUR200 million, USD230 million)6 in accordance with sales goals.

About TWYMEEG (INN: Imeglimin hydrochloride)

Imeglimin is the first agent in a new chemical class of tetrahydrotriazine-containing molecules. It is thought that TWYMEEG shows a glucose lowering effect by both a pancreatic action that promotes glucose concentration-dependent insulin secretion and an extra-pancreatic action that improves glucose metabolism in the liver and skeletal muscle (suppression of gluconeogenesis and improvement of glucose uptake) through an action on mitochondria. This mechanism of action (MOA) has the potential to prevent endothelial and diastolic dysfunction, which could provide protective effects on micro- and macrovascular defects induced by diabetes. It also has the potential for protective effects on beta-cell survival and function. This unique MOA offers the potential opportunity for Imeglimin to be a candidate for the treatment of type 2 diabetes in almost all stages of the current anti-diabetic treatment paradigm, including monotherapy or as an add-on to other glucose lowering therapies.

TIMES (Trials of IMeglimin for Efficacy and Safety), the Phase 3 program for Imeglimin for the treatment of type 2 diabetes in Japan, consists of three pivotal trials involving over 1,100 patients, out of which the non-control individuals were administered the dose of 1,000mg twice daily. Preliminary results of the three trials were announced in press releases dated April. 4, 2019 (TIMES1), December 20, 2019 (TIMES2), and June 25, 2019 (TIMES3). – TIMES1: A Phase 3, 24-week, double-blind, placebo-controlled, randomized, monotherapy trial that assessed the efficacy, safety, and tolerability of imeglimin in Japanese patients with type 2 diabetes. – TIMES2: A Phase 3, 52-week, open-label, parallel-group trial that assessed the long-term safety and efficacy of imeglimin in Japanese patients with type 2 diabetes. In this trial, imeglimin was administered orally as combination therapy with approved hypoglycemic agents, including a DPP-4 inhibitor, an SGLT2 inhibitor, metformin, a sulphonylurea, a glinide, an alpha-glucosidase inhibitor, a thiazolidinedione, and a GLP1 receptor agonist or as monotherapy. – TIMES3: A Phase 3, 16-week, double-blind, placebo-controlled, randomized trial with a 36-week open-label extension period that evaluated the efficacy and safety of imeglimin in combination with insulin in Japanese patients with type 2 diabetes and Japanese patients with type 2 diabetes on insulin therapy with inadequate glycemic control.

hello! i’m the anon who left the 6-part ask regarding mg a few months ago (i refer to those asks bc i’m back to drop more thoughts about mg and might touch on what i previously said). i wrote this whole thing disregading word count, believing i could drop it all in one go because i managed to log in to my tumblr, but it seems i still have to break it up… lmao i don’t know how many parts this will be or if i could post it all tonight, but i will signify the very end with “6-part anon” :)

they want to be famous; that part just came along with the package. then i read in your bts post, you see mg as more wrapped up in entertainment, having star power with a bright personality, liking the limelight. reading that, i do agree, but i guess ive never thought of that before. i think wanting to be a star and wanting to be in the spotlight can seem self-centered. i hope im not coming across like im judging everyone who wants to be famous as “bad” because that’s not what i’m trying to do, but i think it’s safe enough to say that wanting to be famous means wanting people’s attention on you. i’m trying to tread carefully but i suppose i am saying that on the surface, wanting to be a big star can seem a little selfish in the sense that you want to boost your image, present your best self at all times, want people’s eyes on you and want them to think good things about you. combining those general thoughts about wanting to be a star, with my thoughts about mg in particular, is interesting to me.

There’s a lot to unpack here, isn’t there! A buffet of food for thought, for sure. I can’t possibly respond to everything written here because there’s just so many points, so I’ll write a few points. As always, take what I write with a grain of salt.

I don’t think there’s anything bad or inherently wrong with pointing out that, hey, people who are interested in a profession necessarily tied to a public image probably to show off or want attention. These things are perfectly natural to want, even for people who aren’t celebrities, because we’re (1) inherently social creatures and a lot of our survival is contingent on external success, and (2) we are brought up to feel validation from others, especially in an age where our lives are much more on display. But I can see why “selfishness” may be thrown in the mix because we often look down on attention-seekers and “popular” people, many of whom exhibit arrogant/tone-deaf behaviors. On the other hand, it’s understandable that an idol with a big public image necessitates putting their best foot forward all the time to maintain good opinion of them and to earn more money, frankly.

I’ve probably repeated myself too many times, but something I’ve been grappling with recently is this black-and-white mindset/judgment system we often have of others (very much exacerbated by social media, e.g. witch hunts). Bad is bad, good is good. I’ve thought this way for a long time of myself in an upbringing that always punished/looked down on bad behavior (or what was considered behavioral flaws, like speaking out against elders, swearing as a femme person, etc.) rather than acknowledging that “bad” behavior can be exhibited by people who also do and act “good.” In short, while I can only speak from my perspective, I think we’re programmed to subconsciously seek behavioral perfection for a number of reasons: we were raised that way by family; and/or society; we feel judged by the presence of social media and greater access into our lives; accessibility to celebrities and “perfect” public figures makes us judge ourselves by comparison; education systems that poorly address internal learning as well as external learning, etc.

In Mingyu’s case, there’s nothing wrong with seeing and continuing to see him as all those good qualities in my opinion. There’s nothing wrong with grappling with potential past problematic behaviors of your faves, as long as you’re critical and open-minded about the parties involved (which is rarely ever a fanbase at large, but the skewed authority of a fanbase is a different can of worms). Idols are human, which means dealing with the good and bad that comes with interacting humans. Contrary to popular belief (and I write this sarcastically), people CAN change. People should be ALLOWED to change. Characters are static. People are not. And it’s sad to say that this is still an issue in the K-Pop world.

As hard as it sounds, a person who bullied others in the past could still have good or pure intentions for becoming an idol. They could still feel fulfillment from making others happy; is that a bad thing? I personally don’t think so. Or maybe a person’s intentions for becoming an idol could be mixed good or bad, who the fuck knows? Not us. Honestly, I firmly believe that we fans don’t have the right to make definitive moral judgments of idols in the first place because we don’t know them personally. That, and people are extremely complex and hard to categorize, as much as we want to because it’s easier to do so. People are messy. Real life teaches us that more than the Internet does imo.

In any case, I don’t think selfishness and selflessness are mutually exclusive in the same way a person can be both good and bad. I learned that language, too, is a powerful vehicle that influences how we think. In that vein, with how compartmentalized definitions are in specific words, perhaps we think that their existence/practice is separate, i.e. being “selfish” is never being “selfless” because each word’s definition exists solely in their respective word and not the other (hopefully that makes some sense).

TL;DR: I think wanting attention and validation from others is okay and not inherently a bad thing, and people are fucking messy and rarely good without the bad (and vice versa).

Pretty sure I rambled a ton as well and probably didn’t hit that many points that you offered, anon. You ended up putting me on a thought train as well!

I dont know if youve covered this yet but im thinking one of the main reasons isshin sent ryuko to school for all her life was because he mightve feared an eminent attack from ragyo/being found out by her? And to protect ryuko he has to keep her as far away from him and his lab as possible and we see that in nuis attack as she was able to survive was because she wasnt there and even then she almost couldve been found by nui if isshin hadnt attacked her eye

I don’t think I’ve explicitly ever covered it, but I dothink the idea of Isshin wanting to separate himself from Ryuko to protect herfrom Ragyo is a plausible part of his reasoning to get Ryuko away from him.

But as I went over a bit here, I think it’s less aboutIsshin being concerned for Ryuko’s survivaland more about Isshin being concerned for Ryuko’s usefulness as a tool.

Evenif Ryuko fought Nui and lost after her father’s demise, the Life Fibers in herbody would likely prevent death—and Nui is honestly a pretty lonely character herself.I severely doubt Nui would have any interest in killing someone “just like her”;she’d probably find the Life Fibers in Ryuko’s body “cute” and “interesting” andtake Ryuko to Ragyo… and I think episodes 20 - 21 depict in horrible claritywhat would happen from there.

So, following this line of thinking, Isshin’s fears about Ragyogetting to Ryuko are certainly not unfounded.Ragyo takes Ryuko, and Isshin loses his “ultimate weapon” to the enemy. Ryukowould be screwed over, but—and probably more importantly to Isshin—so would theworld. He’d lose everything he’d fought for.

I’ve made a couple of posts on it, but my main line ofthinking for the reason Isshin sends Ryuko away is that he puts the world andthe “greater good” before her. No loving father could ever justify treating his daughter the way he does, but Isshinknows that if he doesn’t use Ryuko asa weapon, Ragyo would win. He separates himself from his daughter to preventhimself from getting too close and having second thoughts.

drj2008 recently opened me up to another facet of Isshinand Ryuko’s situation, offering that perhaps Isshin deliberately creates and utilizes Ryuko’s loneliness to make his planeven more successful. By sending Ryuko away and pushing her out of his life, hesentences her to a rough, troubled childhood—and “I want to know,” his charactersong, seems perfectly aware of this fact. Not only is “I want to know” aremorseful tune about “How long [Ryuko] had to wait for [Isshin]”; there’s alsoa line about giving Ryuko “A way that [she] can find what [she] seek[s].”

And I think there’s a veryvalid argument that Isshin knew full well that all Ryuko ever wanted was love.Without having her father’s caring support for the majority of her life, Ryuko’sdesperate for it—perhaps made even worse when you look at their past andhow he did seem, at first, to be a loving,kind, and dedicated dad.

Isshin gave Ryuko all this affection and then took it away. Ryuko’sleft feeling like something’s wrong with her, that she’s no good, that she’sbetter off alone… and this is a hugepart of her character.

So what does Isshin do? He makes his daughter the most faithful,loyal, devoted partner she could ever ask for. Not only that, he makes hisdaughter a partner just like her: a mixtureof human and Life Fiber who could understand her practically better than anyoneelse in the whole world. He makes her the “perfect” soulmate, someone to alwaysbe by her side.

And Ryuko’s so desperate for love that she takes it. She hears her dad made this strangeuniform and she accepts it without hesitation, naming Senketsu immediately andjumping to get to know him (even if she’s not especially consciously aware ofthis). It doesn’t matter that Senketsu is talking clothes and she should reallybe asking a lot more questions about his presence—all that matters is thatthere’s someone who can help her get what she wants. She doesn’t have to dothis alone anymore. She has a friend.

Really, would Isshin’s plan for Ryuko and Senketsu to bondand save the world worked nearly aswell, if they both weren’t among each other’s very first friends? Heck, youcould even take it further: maybe Senketsu’s memory loss isn’t plot convenienceas much as it’s an orchestrated ploy by Isshin to ensure that Ryuko andSenketsu are both confused and have the same level of understanding on theirsituation, inspiring them to work together.

In my eyes, Isshin didn’t just want to keep his precious “tools”away from his enemies—he also wanted them to be the very best they could. So, heoptimized his results. He manipulated Ryuko and Senketsu to make it so they’d bondeffectively. He left Ryuko alone and made her desperate for a friend. He(maybe) erased Senketsu’s memory so Senketsu wouldn’t “know too much” and couldstay on the same level as Ryuko. He teased Ryuko with the love she wanted, givingher the passion to fight—and, perhaps, even the passion to die fighting, as I would assume that Isshin expected both Ryuko andSenketsu to perish in the final battle.

Of course, Isshin clearly doesn’t feel good about what he did to Ryuko (or to Satsuki, for that matter). I think he regrets his actions tomassive extents—otherwise, a song like “I want to know” wouldn’t exist. But he’sstill much like the Dumbledore of Kill laKill, manipulating others to do his bidding and never having the strengthto be honest along the way.

Isshin’s complicated, and deeply human.

Symposium: A better way to limit Congress’ subpoena power

Ilya Somin is a law professor at George Mason University, and author of “Free to Move: Foot Voting, Migration, and Political Freedom.” Some parts of this post have been adapted from a previous piece on the Volokh Conspiracy blog, hosted by Reason.

Today’s Supreme Court decision in Trump v. Mazars establishes a vague and unwieldy four-part test for determining when congressional committees can subpoena documents from the president. The court understandably and rightly rejected both the president’s extreme view that such subpoenas are almost never enforceable and the House of Representatives’ position that the subpoena power is virtually unlimited. To avoid these extremes, the court created a complex four-part balancing test. But it would have done better to adopt a much clearer and simpler rule: that Congress can only subpoena information related to issues over which it has legislative authority. In that event, the Supreme Court’s own decisions limiting the scope of congressional power would also limit the scope of Congress’ power to subpoena information.

During oral argument, House of Representatives lawyer Douglas Letter repeatedly failed to identify any limits to Congress’ powers to subpoena the president’s records. Commentators such as Michael Dorf and Jonathan Adler argued that this was a serious error. They compared it to Clinton administration Solicitor General Drew Days’ famous mistake in United States v. Lopez, when he was unable to articulate any limits to Congress’ power to regulate interstate commerce.

In his majority opinion for the court, Chief Justice John Roberts emphasizes that “the House’s approach aggravates [separation of powers concerns] by leaving essentially no limits on the congressional power to subpoena the President’s personal records” and notes that “at argument, the House was unable to identify any type of information that lacks some relation to potential legislation.”

Instead, the court creates a four-part test for determining when Congress can subpoena information from the president. The four parts are vague in themselves, and the court offers no guidance on what to do if some of the four factors cut one way, while others support the other side. In addition, the test is not actually exhaustive. The court warns that other, unspecified considerations may also have to be weighed.

The first factor is “whether the asserted legislative purpose warrants the significant step of involving the President and his papers.” Roberts cautions that “Congress may not rely on the President’s information if other sources could reasonably provide Congress the information it needs in light of its particular legislative objective.” It is not clear how courts are to determine whether “other sources” can “reasonably provide” the information Congress needs.

Second, “courts should insist on a subpoena no broader than reasonably necessary to support Congress’s legislative objective.” Here, too, reasonableness is a vague standard that will be difficult to apply in a clear and consistent way.

“Third,” Roberts continues, “courts should be attentive to the nature of the evidence offered by Congress to establish that a subpoena advances a valid legislative purpose. The more detailed and substantial the evidence of Congress’s legislative purpose, the better.” It is not clear how much detail is enough or how close a connection there needs to be between the information requested and the legislative purpose.

The fourth factor is that “courts should be careful to assess the burdens imposed on the President by a subpoena.” The court does not explain how the burdens should be measured or how much of a burden is too much. Roberts does note that “burdens on the President’s time and attention stemming from judicial process and litigation, without more, generally do not cross constitutional lines.” But he also cautions that “burdens imposed by a congressional subpoena should be carefully scrutinized, for they stem from a rival political branch that has … incentives to use subpoenas for institutional advantage.”

Finally, the court notes that the four factors are not exhaustive, because “[o]ther considerations may be pertinent as well.” It gives little or no indication what those other considerations might be. Such vague standards are almost guaranteed to heighten uncertainty and lead to further litigation in this case, and perhaps others as well.

Ironically, Days’ defeat in 1995 is a big part of the reason why Letter need not have had so much trouble identifying limits to Congress’ power, and the Supreme Court need not have adopted a complex, open-ended balancing test today. From the New Deal era to the 1990s, many legal commentators assumed there were no longer any structural limits to congressional legislative power. But beginning in the 90s, the Rehnquist and Roberts Courts decided a series of cases that reinvigorated such limits. Among other things, the Supreme Court ruled that the commerce clause cannot be used to regulate some types of “noneconomic” activity or impose mandates on “inactivity,” that the federal government may not commandeer state governments and that there are limits to Congress’ powers under the enforcement clauses of the 14th and 15th Amendments. Most recently, in Murphy v. NCAA, the court ruled that Congress cannot pressure states to ban sports gambling, a decision that imposed crucial constraints other assertions of federal power, including attempts to coerce sanctuary cities.

These decisions create meaningful limits on the scope of congressional legislative authority, and therefore on Congress’ subpoena power. For example, Congress could not subpoena information related to Trump’s many affairs and his divorce settlements with his two previous wives. Marriage and divorce are matters largely left to state, not federal, regulation. Similarly, Congress could not use its legislative authority to investigate whether it should force state or local governments to curtail possibly unethical business dealings by the Trump family. The anti-commandeering rule forbids such laws.

Despite the Supreme Court’s recent federalism decisions, congressional legislative power remains broad. Some subjects that Congress cannot regulate directly might nonetheless be subject to investigation, because they are relevant to other matters over which Congress does have authority. But if there is a problem here, it is not the lack of a limiting principle on Congress’ subpoena power, but inadequate enforcement of substantive limits on congressional authority.

In the case of Trump’s financial records, Congress surely has the power to legislate on conflicts of interest in the executive branch, of which Trump’s business activities create many. Trump’s records are also relevant to Congress’ power to legislate income tax laws, as there may be good reason to impose special restrictions on the president and other high-ranking officials.

Congress’ motives may not be pure, a concern referenced by the court in its invocation of the fact that this case is “a clash between rival branches of government over records of intense political interest.” But political self-interest is at the heart of most legislative activity, and does not make that activity unconstitutional. There is a crucial distinction between Congress’ likely political motives here and Trump’s anti-Muslim motives in the 2018 travel ban case. Discrimination on the basis of religion is unconstitutional (even if cloaked under supposedly neutral criteria). Seeking political advantage is not.

Some fear Congress could potentially use the subpoena power to investigate issues beyond the scope of its legislative authority because it has the power to initiate constitutional amendments. A proposed amendment can legitimately deal with issues that Congress cannot legislate about under the existing Constitution. But if the amendment power is the basis for a subpoena, Congress would at the very least have to be in the process of actually considering some potential amendment. And if the supposed amendment turns out to be a sham cooked up purely for purposes of subpoenaing information, that fact is likely to leak out, and courts should be able to take notice and rule accordingly.

Congress can often use the spending power to incentivize states to take actions that Congress could not mandate directly. But, as the Trump administration has learned in a series of sanctuary city cases, the spending power, too, has substantive limits, including, among other things, that it cannot be used to coerce states and that conditions imposed on states must be related to the purpose of the grant in question.

Even if almost any information might be relevant to some type of legislation Congress is allowed to enact under current precedent, there are nonetheless limits to the purposes for which Congress can seek out the information. We would not say that law enforcement agencies’ power to acquire information is unlimited merely because almost any type of information might potentially be relevant to some kind of investigation. The agencies still have to show that the information sought in any particular case will be used for a permissible purpose. The same applies to Congress’ subpoena power.

In a far-reaching dissent, Justice Clarence Thomas claims that Congress has no power at all to subpoena “private, nonofficial documents,” except perhaps for purposes of impeachment. If his approach were to be accepted, Congress could never subpoena such information for legislative purposes – “whether they belong to the President or not.” Thomas’ argument founders on the reality that seeking information is essential to the development of most legislation, and “private” and “unofficial” information is often particularly valuable in that regard. By his reasoning, a Congress considering a new law to constrain securities fraud could not subpoena “private” or “unofficial” information related to previous cases of fraud. Some private information may be protected by individual constitutional rights, such as the Fourth Amendment’s ban on “unreasonable” searches and seizures of “papers and effects.” But no structural limit on power categorically bars Congress from seeking such data.

If Congress’ power to subpoena information is too broad, the fault lies not in the scope of the subpoena power, but in the scope of the substantive legislative power the former is supposed to facilitate. It is the latter, not the former, that has too few limits. Those who fear there are too few constraints on Congress’ subpoena power should focus their efforts on constraining its power to regulate and spend, which remains far beyond what is permitted by the text and original meaning of the Constitution.

Interview with Jeffrey Tucker on All Things Crypto, Part Two

Conducted by Wendy McElroy

The multi-faceted Jeffrey Tucker is an American writer who focuses on market freedom, anarcho-capitalism, and cryptotech. He is the author of eight books on economics, politics, and culture, a much-sought after conference speaker, and an Internet entrepreneur. Jeffrey is editorial director and vice president of the venerable American Institute for Economic Research, founded in 1933. His career has focused on building many of the web’s primary portals for commentary and research on liberty, and is undertaking new adventures in publishing today.

I have incredible good fortune, as Jeff has written the preface to my book “The Satoshi Revolution,” which will be published in early 2019 by bitcoin.com. Wendy: I was very impressed by an article in which you argued against the idea that Misesian regression theorem invalidated bitcoin as a money. For readers, the Regression theorem claims “Any valid medium of exchange (money) has to have a previous use as something else.” Could you offer an overview of your argument?

Jeff: Mises’s argument was that the root value of money traces to a conjectural history in which the pre-money form was deployed, for example, in barter. By 1949, Mises became hardened in this view: money had to originate in barter; there is no other path. From a historical point of view, this is probably correct. But it is a theoretically misleading formulation.

To understand the theory behind the conjectural history, you have to return to Mises’s original 1912 argument. Here he is more precise. In order for something to become money, it had to have a pre-existing use value. Use value. That’s not the same thing as being used in barter trade. His point was that you can’t take a useless thing and call it money and expect it to take flight.

How can we reconstruct the history of Bitcoin to discern if this applies here? From the January 2009 genesis block until October of that year, Bitcoin’s posted dollar exchange value was exactly $0. And yet we know, because we have a perfect historical record, that there were many thousands of trades being made all these 10 months. What was happening? What was going on? This was a period in which the network was being tested by enthusiasts. What does this network do? It permits the peer-to-peer exchange of immutable information packets on a geographically non-contiguous basis using the Internet so that they can come and go without corruption or compromise.

Is this a valuable service and does it work? This is what was being tested. By October, the use value of this network had proven itself, and so we began to see the emergence of a dollar/Bitcoin exchange ratio. That is to say, Bitcoin was priced as a scarce good. We can see, then, that the conditions of the “Regression Theorem” as theory are met via the services provided by the blockchain. You can also see, however, that if an economist looking at this did not understand the payment system embedded as part of the monetary technology, he or she would be completely befuddled.

To be sure, some very smart people disagree with me. My friend William Luther is blunt about his opinion about his matter. He thinks the Regression Theorem is just wrong, so it doesn’t matter if Bitcoin is theoretically compliant. He once made the argument to me and pretty much backed me into a corner. If he turns out to be correct, I’m fine with that. What matters more, my theory or existing reality? I faced that problem in early 2013 and concluded that I had, as a matter of intellectual integrity, to defer to reality, even if it meant admitting the wrongness of my position or even that of Mises’s. Shocking, I know!

Wendy: The crypto community parallels the libertarian one, in ways both good and bad. An example of the latter is the deep personal schisms with which it is rift. You are a person who stays away from internecine battles. What advice do you have to others who wish to do the same?

Jeff: I try to stay focused on the big picture and imagine that my audience is not my friend network but rather the general public. I try to serve that readership. That means no Twitter wars. No flame wars at all. Plus, I’ve seen vast destruction spread by vicious internecine battles. I’ve seen friendships wrecked, bad theory perpetrated by virtue of ego alone, massive setbacks take place in understanding and marketing. Also, there are some people who are ideologically attached to the friend/enemy distinction. Unless they are smashing someone and hitting “the enemy” they think they are not working. It’s extremely strange how some people thrive off this posture.

To be sure, I have no trouble taking a stand, as I have when libertarians have wrongly drifted left and right. Why? I like to seek greater intellectual clarity and share my thoughts with others, in hopes that I can help others understand too. I’m not seeking saints and not looking to burn witches. I try to choose my battles carefully and stay focused on doing productive work, cooperating with anyone who thinks, writes, and acts in good faith. That’s the main thing to ask yourself, not “Who have you destroyed today?” but rather, “What kind of light have I brought to the world today?”

Wendy: Different explanations of crypto’s recent plunge in price have been advanced. Some people point to increased government regulation, especially in China and in the U.S., where the SEC is taking active steps against the crypto community. Many believe the tumble resulted from a bursting bubble that was created by surging prices earlier in 2018. Still others speak of manipulation by “the whales.” These explanations are not mutually exclusive, of course. But do you favor one over the other? Do you have another explanation?

Jeff: It’s impossible to untangle all of this, and many of the factors you name are right, but let me add another issue. The amazing bull market of 2017 was fueled by wild optimism and adoption. People in the space were ready to rock. Then this optimism was massively interrupted by a terrible realization. Bitcoin would not scale. It stopped behaving like Bitcoin and started becoming more expensive and slower than regular credit cards. To use street parlance, it sucked. It was an amazing thing to have happened. It was a true calamity. And to top it off, it was completely the fault of the guardians of the code. When the code would not adapt to broader use, the optimism turned to pessimism and we experienced a huge setback.

By the way, I’ve worked for years with people who are geniuses at code but completely stupid when it comes to the user experience. It was the tragedy of Bitcoin that it fell prey to exactly this same problem. Coders desperately desire cleanliness, zero bloat, no cruft, perfect logic. It’s an old joke in the community that a coder invites you to use his new program but all you see on the black screen is a blinking green cursor. “Of course I still have to write the user interface.”

The OCD-ish mind of coders is a great thing for some purposes but this outlook has never prevailed in the commercial marketplace. In the early 1990s, there was a great battle over word processors. Microsoft kept making Word larger and larger, puffed with cruft, and the code monkeys were screaming that this was a disaster in the making. For my own part, I hated Word in those days and completely agreed that the hard-to-use light-weight programs were better.

But guess what? The market disagreed. Moore’s Law kicked it as it always does and eventually Word destroyed the competition. Why? Because it had more features that users like. Eventually the code got clean again and now Word itself has many elegant competitors. This is the normal progression of any software with a consumer focus.

Incredibly, some people with the keys to the kingdom of Bitcoin actually came to imagine that they could develop a digital money without an efficient, consumer-focussed use case. They drove a wedge between two functions: store of value and medium of exchange. This is not how much work. One function depends on the other. The freeze in the development of Bitcoin, in the name of staying light and elegant, was a fool’s errand. During all the scaling debates of 2014-16, they dug in their heels, shouting slogans, guarding their small blocks, instead of thinking about adoption and scaling when the time came.

When the time did come, Bitcoin did not perform. It fact – and it pains me to say this – it completely flopped.

Old school Bitcoiners like me were horrified to see it all happening. It was like an old friend had become possessed. When the mempools exploded, and the miners were in a position to ration trades based on price, it would cost $20 to send $2. This was in the fall and winter of 2017. It was absolutely disgraceful, and all the more so because the newly emergent “maximalists” defended this preposterous reality, acting if as this was part of the plan all along. They were like PeeWee Herman explaining that when he fell off the bike that he “meant to do that.” They flagrantly ignored even the title of the White Paper. Then the fork came in August of 2017, as it necessarily had to. But then followed a tremendous explosion of tokens of all sorts.

I don’t regret the competition, and I think this is all a good thing. I’m not a Bitcoin Maximalist. I’m a Competition Maximalist. But the absurdities of Bitcoin’s performance could have been completely avoided with just a bit of concern for the user. I would love it if we could perform a controlled experiment and see the BTC price today if the thing had properly scaled. We can’t do that. We have the reality we have.

Privately, of course, Bitcoin Core developers will admit that this was a disaster and that scaling will eventually take place on the chain. But at this point, pride and arrogance had gotten the best of them. How long will they continue to promise the Lightning Network while showing no concern for the use case? It’s time for a bit of humility.

To be sure, the Lightning Network is super great. We run a node at the Atlanta Bitcoin Embassy. I look forward to its final stability and adoption. The problem is that this was proposed as an eventual solution to the scaling problem that currently exists. Real-time technological development has to deal with problems in real time according to the time schedule of the market rate of adoption. Markets don’t obey code architects; the reverse has to be the case. Bitcoin Core forgot that at the very point it mattered most.

Wendy: Whatever the probable explanation(s), do you have a sense of when or whether crypto markets are likely to rebound significantly? Do you have a sense of what will cause a rebound or prevent one?

Jeff: Like all enthusiasts, I do expect a turnaround. Remember that I’ve been in these markets since BTC was $14. I’ve seen wild swings and long periods of nothingness. I’m prepared for anything.

Wendy: A debate within crypto parallels one I have heard between gold bugs. That is, should one take physical possession of precious metals, or they can be stored with reputable entities. In crypto, the parallel argument is whether coins should be in private wallets with undisclosed keys, or can they be stored with exchanges that do not demand possession of the keys?

Jeff: That is an interesting parallel! I think it is a valid one. I’m disappointed with the rise of what are effectively Bitcoin Banks that now dominate the market. I’ve reluctantly concluded that there is indeed a demand for financial intermediation, even within crypto. Here is a case where my own preferences are being overridden by market choice. That said, intermediation in crypto is not going to have the problems that it does in a central banking world. We have transparency. We have clear lines of ownership. We know the difference between money and a money substitute. I don’t necessarily think that intermediation is an evil thing in the crypto world.

Wendy: Any other thoughts you’d like to share on this subject?

Jeff: I would council Bitcoiners and anyone who sees the potential of this technology to be patient. Think back to railroads and how they came to be. The headlines were all about land speculation, wildcat banks, stock fraud, bankruptcies, and crashes. The reality, in the end, was a transformed world. It was true with the Internet too. People said for years that no one could make money on the Internet. The dotcom crash of 2000 seemed to prove it. Now Internet commerce leads the world. It will be a long time before crypto becomes competitive with nationalized money, and even longer before the pundit class comes around.

The important point is that we have the knowledge. We have the technology. We know now that it is possible. It can be done. There is no longer any excuse for not turning over the production and management of money itself to the market.

Also let us not forget what matters most. Bitcoin is a technology but the goal is much more grand: a better, more peaceful, more prosperous world. I’ve seen it myself how this works. When you pull down the barriers, when you provide opportunities for people to cooperate, beautiful things happen. I see it constantly at the Atlanta Bitcoin Embassy. This is a place where people from all walks of life come together in a spirit of joyful cooperation to build the future. This inspires me more than anything else and points to the kind of future that can be built by a P2P technology. It’s a microcosm of what life in the cryptocon can be like.

I just bought a house for about $180,000. I am looking for homeowners' insurance, but I am confused as to how much I should get. The second company wanted to insure me for that, but I got them to quote me on $140,000. Independent Medical Examinations: 3 Ways To Avoid Suspected Physician Bias

The function of an independent medical exam is to independently evaluate the nature and extent of injuries or condition, so as to adequately assess whether the treating physician’s conclusions about ability and disability are correct. However, independent medical exams are often treated by fact finders with suspicion.

As a preliminary matter, let’s begin by defining the landscape. Typically, the insurer defendant seeks an independent medical examination (IME). However, in some states, when the injured party disputes their treating physician’s evaluation, they may also request an examination. But the inescapable fact is that the party seeking the IME pays for the exam, which the other side may use to argue bias. What’s more, the party seeking the exam will likely call on a physician they have used in the past. In this case, the other side may argue that the motive is one of personal gain, citing the potential for the physician to warp the findings since the payor is a source of regular business. Thus, the theory goes, the expert will continue to render favorable opinions so as to keep the business.

When selecting a medical professional to conduct an IME, there are three key steps that can be taken to reduce the other side’s suspicion that the medical professional you have hired has a motive for personal and/or financial gain.

1) Acknowledge Inherent Bias

In a perfect world, there would be a way to hire a doctor for an independent medical examination without the doctor knowing who is paying the bill. However, we don’t live in a perfect world. Most medical professionals insist their opinion is not for sale, and most truly believe their assertion. However, scientists who study cognitive bias will point out that the problem with cognitive bias is we don’t always know it is influencing our decisions.

Some medical professionals have incorporated ways to deal with the problem of bias in their ethical rules. For example, the American Academy of Ophthalmology’s Rule of Ethics 16 covers expert testimony. It states, in part, “Expert testimony should be provided in an objective manner using medical knowledge to form expert medical opinions. Nonmedical factors, (such as solicitation of business from attorneys, competitions with other physicians, and personal bias unrelated to professional expertise) should not bias testimony.”

Similarly, the American Academy of Pediatrics recently issued a modified policy statement regarding ethical business practices, including the following standards for pediatricians testifying as experts in legal cases. According to the modification, physicians shall:

Lend their knowledge, experience, and best judgment to all relevant facts of the case regardless of the source of the request for testimony (plaintiff/prosecutor or defendant) Render an opinion only after reviewing sufficient medical records and documents to enable the formation of unbiased and accurate conclusions. If all medical records are unavailable for review, recuse themselves from serving in an expert capacity or acknowledge that their expert opinion is based on limited information Not exclude relevant information for any reason and certainly not to create a perspective that favors either the plaintiff/prosecutor or the defendant Provide objective, valid opinions that are well supported by their clinical experience and the best evidence-based medical literature, regardless of whether it is to be used by the plaintiff/prosecutor or defendant

When working with independent medical examiners, referencing your understanding of their ethical issues can contribute to reducing the potential for bias. Attorneys can take this even further by reiterating they are hiring the expert for their expertise, not seeking to purchase one opinion over another.

2) Anticipate Perceived Motive For Personal Gain

A certain amount of strategy must be employed to reduce the amount of material the other side can use to challenge an expert’s opinion based on a perceived motive of monetary incentive. To reduce the argument that the independent medical examiner has motive to minimize/maximize injury claims, attorneys must anticipate how a jury will perceive certain aspects of the physician’s background, as well as the grounds on which the examination occurred, and work against those biases before commencing the IME.

First, select a physician who is board certified and practicing in the field. (Some states, such as Texas, have a designated list of physicians who have met the requirements of the state, including training, testing, and certification through the Division of Worker’s Compensation.) This is not to say that a semi-retired physician whose primary work is offering independent medical examinations can’t be correct in their conclusions. Rather, this approach simply recognizes that a physician who generates their income through IMEs will face a lengthy cross-examination on that issue. This has the potential to distract a fact finder from the issues at hand.

Next, when communicating with the independent medical examiner, consider conveying your expectations in writing. When forwarding medical records, for example, make sure that the language in your communication clearly defines your expectations. The following is a sample of such language:

Dear Doctor,

Enclosed please find the medical records of the plaintiff and findings of Dr. X, the treating physician (insert detailed list of all records and findings here). Please rely on these records, as well as your medical exam, peer-reviewed literature, and the appropriate medical guidelines to formulate and support your opinions or conclusions.

I look forward to your report.

It may also be helpful to include similar language in the retainer agreement, reiterating you are paying for the doctor’s time, experience, and knowledge, regardless of what the medical opinion ultimately is.

3) Establish Ethical Fee Agreements

Fee agreements should be based on the medical professional’s normal per hour rate. The agreement should not be reduced for volume, nor increased due to the litigious nature of the examination. Under no circumstances should an expert’s fee be contingent on a particular outcome. This may implicate ethical concerns for the medical professional, as well as provide a rich area of cross-examination for the other side. A good medical professional offers their expertise, time, and experience. The opinions and conclusions themselves, however, should not be for sale.

Conclusion

When selecting and working with an independent medical examiner, respect for their credentials and experience should translate into respect for their conclusions. Attorneys and medical professionals have ethical obligations which preclude them from buying or selling medical opinions. While it is human nature to want to “win,” both lawyers and doctors have an ethical obligation to be mindful of potential biases and external motivations, and do what they can to negate them.
