Queer Rights are Human Rights, say Students at ‘Pride March’ in Delhi University | NewsClick
There were songs, and there was assertion that “we will love who we want.” Powerful slogans like ‘Love is Love’ and ‘Queer will not live in fear’ were heard at the ‘Pride Parade’ at Arts Faculty in Delhi University, organised by the Students Federation of India (SFI) on Wednesday.
June 1 marks the beginning of ‘pride month’ observed in honour of the Stonewall Uprising in 1969 in New York when gay and lesbian rights activists protested for a week to oppose systemic oppression of queer communities. Till 1966, it was illegal to serve alcohol to gay persons in public bars in the New York State. Similarly, homosexuality was considered an offence. In 1969, Seymour Pine, a deputy inspector raided Stonewall Bar in New York City to detain gay persons. The raid created a huge uproar among people, who protested over a week demanding queer rights. The protests are known to be a watershed moment in the movement to reclaim rights of the queer community.
On Wednesday, participants in the ‘pride march’ said queer communities in India were facing a double assault as the “politics of masculinity” had tightened its grip over the country in previous few years, coupled with predatory market forces “commoditising their feelings.”

1. In 1986, journalist Ashok Row Kavi penned an article about himself for Savvy Magazine, which became the first ‘coming out’ story from India.
2. .....but then in 1977, writer and math wizard Shakuntla Devi published “The World of Homosexuals”. Arguably the first of its kind in India, the book contained interviews with homosexual men, set against the backdrop of the Emergency years.
3. The ‘90s also saw the emergence ‘women-loving-women’ in India. This was when activist and academic Gita Thadani set up Sakhi, a women’s helpline and lesbian resource centre which facilitated cross-country networking between queer women.
4. “BOMGaY”, a 12 minute long film ...... was made in 1996. It follows several storylines of queer Indians ......remains an important part of queer cinema in India.
5. .....routinely denied accommodation by prejudiced landlords and homeowners......between 1998 and 1999, G.H.A.R (that’s Gay Housing Assistance Resource) was founded in Bombay by Sachin Jain. It set out to help LGBTQ Indians find safe living spaces...
6. Calcutta holds India’s first ever ‘Gay Pride Parade’ in 1999.
7. In 1999, a discotheque named Soul Kitchen in Delhi hosted the first “gay night”, giving members of the community the chance to meet each other in a safe space where they can be themselves.
8. The Kashish Mumbai Queer Film Festival – which is today one of India’s largest LGBTQ film fests – was first launched in 2010.
9. 2014 became a defining moment for positive legislations for the transgender community. It started in April, with the National Legal Services Authority judgement to formally recognise trans people as the ‘third gender’ on official government-issued documents.
10. In February 2017, the Ministry of Health and Family Welfare unveils a kit to promote good health and wellbeing, and – to everyone’s surprise – says that homosexuality is natural.

Today was beautiful. Today was happiness. Today was all colours mixing together to define humanity. I can't believe the smiles that walked the streets of New Delhi today is legally being denied to its citizens. The very citizens it aims to safeguard and keep content. Today I felt the safest, happiest and satisfied being amongst these people. I want this to be everyday. I want everyday to be as vibrant as today. Is it too much to want this?

“We are here to break stereotypes,” he said, “to tell Delhi that we are here and we are queer.”
He was one of several thousand participants in Delhi’s annual gay pride parade who gathered on a smoggy afternoon this month to march, cheer and dance Bhangra through the streets of the city.
If the parade atmosphere seemed even more buoyant than usual, it may have been because a major victory was in sight for gay rights in this country. In a landmark decision in August, India’s Supreme Court ruled that the country’s citizens had a constitutional right to privacy. In its judgment, the court made special note of the gay community, writing that “sexual orientation is an essential attribute of privacy.”
For lawyers building a case against a colonial-era law, known as Section 377, that criminalizes sex between men in India, the ruling was welcome news. And it has renewed some hope for the repeal of other repressive laws, including one requiring the “registration and control of eunuchs” and marital rape exceptions in the Indian Penal Code.
Depictions of gender-fluid identity are common in ancient texts found in Hinduism, Jainism and Buddhism. In Hinduism, gods transform into goddesses, or they cross-dress. Men become pregnant.
But when the British colonized India, they imported “a great discomfort with all things pleasurable and sensual,” said Devdutt Pattanaik, the author of several books on mythology. The British also declared transgender people a “criminal tribe,” he said.
Issues with public acceptance persist in India. Recently, same-sex couples said they had been barred from several restaurants in Delhi and Mumbai. Many believe same-sex marriage in India is still a distant reality, and women are often underrepresented at gatherings organized by gay groups.
On gender issues, there have been recent legal changes in India. In 2014, the Supreme Court ruled that transgender people could choose to be identified as a “third gender” with legal recognition.
But Rovin Sharma, 23, a self-described drag queen, said that gender issues are still rudimentarily understood in India. Mx. Sharma, who prefers the gender-neutral Mx. in place of Mr. or Ms., told of being forced to resign from a job recently after attempting to use the women’s restroom there.

Probably you already know why you should support and fight actively for lgbt+ community, going by your presence here. Today we are lucky to stay in close connection with the queer folks; thanks to the pride activism, most of us have an open mindset to know more and are inclusive in our behaviour towards them. But this is not the situation in majority of places. They face discrimination and infringement of basic rights on daily basis in their lives. Still we cannot deny before social media activism things were even worse. They have come a long way to decriminalisation of gay sex (which is very natural in every way you want to see), here we take a look at the long journey to decriminalisation and waiver of the notorious Section 377 In India.

What do these sculptures say? The erotic homosexual sculptures at Khajuraho Temples carry the voices that are hidden behind the so-called “Hinduism slogans” of anti-gay activists. But theses sculptures speak volumes about India’s true perspective on homosexuality: never out of natural order...until british raj happened. Read on to know what’s the jazz is all about.
If you are not from Jupiter, you have witnessed the scrapping of section 377 in the year.... the sculptures at Khajuraho are a colossal example of the accepting nature of the ancient India and its scholars. But we have more examples as such in stock.
Influence in Literature: In Rigveda (one of the four canonical sacred texts of Hinduism) enunciates the phrase Vikriti Evam Prakriti ( what seems unnatural is also natural). Other than Khajuraho there is a sculpture of one of the coolest couple, we Hindus worship. The Ardhanariswara, is the androgenous form of Shiva and Parvati and it can be found in a sculpture from Gangaikondacholapuram.
In ancient India, religion had a big role in society’s functions. The religious ancient texts have a strong bearing with the contemporary LGBT causes and recent activisms. Some scholars are of this opinion that Rigveda recognises transexuality and all dimensions of sex and gender of human life, pretty similar to the waves of universal diversities. Vatsayna’s work Kamasutra which is an enriched documentation of fulfilment, sexuality and happiness in lives, has a whole chapter on homosexual behaviour.
Hinduism has always included homosexual characters and themes to its folklores, ancient texts, epics and art. Another great creation of ancient India, Arthashastra, a treatise on economical and foreign policymaking, can be considered the Gita of Statecraft by the great scholar Chanakya. This text has mentions of a wide variety of sexual practices between a man and a woman. Though, homosexual behaviours were not legal but punishments were minor whereas few kinds of heterosexual acts used to carry more severe punishments.

Mughal men and #loveislove: Beyond every astonishment, Mughal emperors had also involved in homosexual relationships. Though they were prime authorities of the country and I doubt if anyone could point fingers at them. But definitely, these stories put us in awe and boggle our minds to think how tough those times were. Whatever be the situation we have records of Mughal emperors involving in homosexual relationships in spite of the prohibitions against it in the sharia law, religious laws for Islam.
The first Mughal emperor Babur has said in his autobiography “Babarnama” about his strong feelings for a young boy. Many reliable texts suggests of Ali Quli Khan, to have relations with a Hindu boy named Abhai Chand and eventually his father had let them be happy with each other.
There can be found a term “chapti” which refers to sex between people of same genders. Despite social and religious constructs against one’s order of love, Mughal emperors have always been on the side of inclusivity of all sorts of love.
Then what was the turning point of Indian society’s hostility towards homosexuality and LGBT?
Dual plight of colonialism and faulty system: It was the British raj who criminalised homosexuality as it was opposing their biblical beliefs on love, nature and sexuality. Very soon section 377 entered India’s legal system in 1861. In spite of rare convictions under section 377, the law was widely used to harass the LGBT activists, HIV/AIDS prevention activists and sex workers.
Indian activism pierces the veil: Shakuntala Devi is mostly known for her mathematical genius. What everyone doesn’t know is she is the first person to publish a full-length study on homosexuality in India. The nation hasn’t been through a smooth path on its way to decriminalise ‘love for everyone’. Homosexual activities was considered criminal offence under section 377 until the law was challenged in 2009’s Naz Foundation vs. the Gov. of NCT of Delhi. Delhi High Court observed that the law defies the fundamental rights provided in the Indian Constitution. But in 2013 again homosexuality was recriminalised by supreme court’s decision in Navtej Singh vs. Union of India, as an act against the order of nature.
Between these 5 long years the activists have never taken a back seat. In 2012, Asia’s first genderqueer pride parade was organised in Madurai, India, led by Anjali Gopalan, an eminent face in the country’s human rights and animal rights activism. She is also the founder and executive director of The Naz Foundation Trust.
#loveislove: Since 2012 the supreme court been listening to pleas against the decriminalisation of homosexuality. The supreme court decided to see things on contemporary society’s perspectives where a lot of new ideas have become the new normal. The bench also referred to the sculptures and paintings of Khajuraho and immediately received a comeback that modern social laws cannot be fixed upon seeing the sculptures. Later on arguments were raised that Khajuraho was made keeping in mind the Indian society and also this law is brought bi the British. Indian society cannot be guided by people who doesn’t know how the moral and social values function here. Under section 377, a same-sex relationship could kead to a 10 years imprisonment. Some of the most memorable pride moments between 2013-2018 can be the introduction of a guide titled ‘Creating Inclusive Workplaces for LGBT Employees in India’ campaigned by IBM, Goldman Sachs, Google. In 2013 the law was reinstituted, leading thousands of protesters hitting the road. This was a huge chance for political activism for the political parties to show their support for LGBT rights. By 2014, parties like Congress, CPI(Marxist) & Aam admi party had included their support for decriminalisation of homosexuality in their election manifesto. The first Bhopal Pride march of 2017 had collected almost 200 members. After a 6 year-long tug-of-war on 6th September 2018 the supreme court of India legalised homosexuality in India. But the real life scenarios are far from it. The real struggle of the LGBT community can be improved only with social campaigning for awareness. In many regional areas the police and local authorities fail to provide legal help to the distressed folks in help. This is the time we stand up for their rights with the view to live together as an inclusive and accepting society where everyone deserves a peaceful life.

Love knows no bounds — this thought, while deeply philosophical and poignant, is also quite removed from reality. For the world which we inhabit, this abstract idea of love is chained and governed by cold, material reality. The reality of class, caste, religion, and yes, gender too.
But the heart wants what it wants, right?
The month of June is celebrated as the Pride Month in the memory of the Stonewall Riots that took place in New York, USA, in June 1969. These riots sprung from a spontaneous act of rebellion against the systemic harassment of the members of the gay, and lesbian community, by the police. Till then, the LGBT (Lesbian, Gay, Bisexual, Transgender) community remained divided into factions and lived in relative obscurity. But these riots helped them unite as a cohesive unit and thus, was born the active current of LGBTQ activism (where Q stands for queer). In many official and unofficial historical accounts of the LGBTQ movement, this moment is seen as the one where the gay and lesbian community gained a political identity (1).

This alternative bit of history is still a part of mainstream considering it happened in a developed nation, but what about the 2nd most populous nation in the world, India? As we mark the end of the Pride Month, let us take a look at India’s own coming out of the closet.
India’s Rainbow: Existing In The Imaginative

Since the early days of the Indian society, ordinary Indian citizens who identified as homosexuals or those who acknowledged them to exist, tried their best to remain in the shadows, but every now and then, they would venture into the collective imagination through a mention in books, or poetry.
In 1942, the publication of Urdu writer Ismat Chughtai’s short story, Lihaaf, led to an obscenity trial wherein Chughtai was asked to apologize for her depiction of a relationship between two women as seen through the eyes of a young girl (2). Though she did end up winning the case, the story made her (in) famous as a provocative writer of corrupt books.

From then, till the early 90s, depictions of homosexuality were attempted by a few brave writers, still the society at large remained uncomfortable talking about the issue, branding it immoral and corrupt (3).
The Opening Of The Closet

India’s own Stonewall moment came almost two decades after the original one. On August 11, 1992, a few protesters from an organization called AIDS Bhedbhav Virodhi Andolan, (ABVA), decided to block the entrance of Police Headquarters in Delhi to protest the arrest of several men on the suspicion of homosexuality (4).
The organization also laid the foundation for the repeal of the outmoded Section 377, which punished anyone who had voluntary carnal intercourse against the order of man with any man, woman, or animal.
Not only was this law used as a tool to oppress and terrorize members of the LGBTQ community, but its archaic phrasing also rendered certain sexual acts between consenting heteronormative couples as illegal! Needless to say, it had no place in modern India.
In 2001, the NGO Naz Foundation filed a Public Interest Litigation (PIL) in Delhi High Court to make homosexual intercourse legal. After a prolonged legal battle of 8 years, in 2009, Delhi High Court decriminalized homosexual acts, terming the section 377 as violative of the basic rights as given in the Constitution, but this decision was overruled by the Supreme Court in 2013 (5). Finally, after a number of walk-backs and debates on the constitutionality of the law, the Supreme Court finally legalized homosexual acts by partially striking down section 377, in September 2018 (6).

Though the credit for this landmark victory goes to these foundations, and a few eminent private citizens who mobilized support to fight the good fight, one can’t ignore those countless ordinary individuals who braved moral policing and contempt of the society by participating in freedom marches and pride parades. India’s first pride parade was held as early as 1999, in Kolkata, when 15 LGBTQ activists took part in Kolkata Friendship Walk (7). This tradition was adopted by other cities of the country which soon went on to host their own Pride parades.
Abolition Of Article 377: Towards A More Inclusive Future

Though its neighbors like Taiwan have taken more radical steps such as legalizing same-sex marriage, India’s still testing the waters. But one thing is sure, the change is coming and for a lot of members of the LGBTQ community, there’s a rainbow at the end of the tunnel.
This can be evident from the fact that public personages like the athlete Duttee Chand, had no inhibition in announcing her sexual orientation to the world. And why would she, when she had such a strong community to support her (8).
More and more, acceptance is becoming the norm. It’s true that society fears what it does not understand, and now, the Indian society is collectively making an effort to understand its much-maligned faction. Stories of individuals who were accepted by their families, who are encouraged to be themselves unapologetically are increasing in numbers. Social media projects like Humans of Bombay are replete with them.
Popular media too has left behind its crude, mocking ways and is trying to portray the rich inner life of this section of the society without reducing them to cruel stereotypes.
It wouldn’t be right to say that everyone is free to love in this, post-377 India, but yes, they are no longer deemed criminals for loving someone who is of the same sex.
So, yes, with each passing day, India is surely but certainly making its way out of the closet.
