The Supreme Court on Monday declined to hear the case of a former Kentucky high school student and supporter of Donald Trump who said he'd been the victim of "cancel culture" after a video of his interaction with an elderly Native American man went viral in 2019.
That decision leaves in place a lower court's dismissal of a massive libel lawsuit filed by Nicholas Sandmann against Gannett, the parent company of USA TODAY, and other media organizations for their coverage of the incident.
Sandmann argued he was defamed by their reports on his confrontation with Native American rights activist Nathan Phillips at the Lincoln Memorial in January 2019.
INDIGENOUS PEOPLE'S MARCH AND MARCH FOR LIFE, STANDING NOSE-TO-NOSE
A video of Sandmann, then 16 and a student at Covington Catholic in Northern Kentucky, standing nose to nose with Phillips went viral and unleashed a firestorm of internet criticism that the student’s conduct was racially motivated, which Sandmann denied. Phillips was attending an “Indigenous People’s March” while Sandmann was walking in a “March for Life” event.
Sandmann filed lawsuits against eight media organizations, including the New York Times, ABC News, CBS News and Rolling Stone magazine, seeking a combined $1.25 billion for their coverage of the event.
A federal judge in Kentucky dismissed the suit in 2022, ruling that Phillips’ statement that Sandmann “blocked him and wouldn’t allow him to retreat” – as reported by the media – was Phillips' opinion for which they could not be sued.
The Cincinnati-based 6th U.S. Circuit Court of Appeals upheld the judge's dismissal.
In Sandmann's unsuccessful petition to the Supreme Court, his lawyer said the case has "come to epitomize the high-water mark of the `cancel culture.'"
Sandmann, his lawyer said, was transformed “from a quiet, anonymous teenager into a national social pariah, one whose embarrassed smile in response to Phillips’ aggression became a target for anger and hatred.”
That happened because of the media’s “careless failure” to investigate Phillips’ description of the encounter, his lawyer told the court.
A TEEN WITH A 'MAKE AMERICA GREAT AGAIN' HAT BECOMES A CONSERVATIVE CAUSE CELEBRE
The suit became a cause celebre for conservatives and talk show hosts.
Then-President Trump defended Sandmann and his fellow student on Twitter, claiming that they had been "smeared" with false reports by the media.
In a speech at the 2020 Republican National Convention, Sandmann accused the media of trying to “cancel” him because he backed Trump.
In the 2019 video that went viral, Sandmann was shown wearing one of Trump’s “Make America Great Again” campaign hats while smiling at Phillips, who was beating a drum and chanting.
Some social media at the time claimed the incident was racially charged on the part of the white teenager, which Sandmann and other witnesses disputed. Sandmann sued, saying the news coverage had unfairly defamed him.
But the suit was narrowed by the judge to focus only on whether the quote attributed to Phillips was defamatory.
“The media defendants were covering a matter of great public interest, and they reported Phillips’s first-person view of what he experienced,” U.S. Senior Judge William Bertelsman wrote when dismissing the suit in 2022.
When Sandmann appealed to the Supreme Court, the media outlets waived their right to respond.
The Washington Post, NBC and CNN had previously settled with Sandmann.

Prolifers don't actually want to save babies. They want to control women's fertility. In our modern capitalist hellscape, more babies = more cheap wage slaves. It's no coincidence that the overturn of Roe coincided with this push to have less kids or none at all among millennials and Gen Z. The capitalists saw that their labor pool was evaporating and wanted to force the production of more future workers. The sanctity of life means nothing when we let people die cuz they can't afford housing or medicine. Sanctity of life means nothing when cops can murder and get away with it. Sanctity of life is a bullshit phrase when we wage war and bomb people for money. Choke on a cock and die. I'm tired of being nice. It's my uterus and if I want it to collect cobwebs, that's my business. If I want to abort whatever parasite has taken root inside it, that's my business too.

The national March for Life in Washington, D.C., has become an annual pilgrimage for hundreds of thousands of pro-lifers every January. But since the overturning of Roe v. Wade by the U.S. Supreme Court last year, and the subsequent passage of Michigan's widely permissive Proposal 3 in November's election, the issue of abortion has taken on a new urgency at the state level. In response, pro-lifers in Michigan are turning their attention to Lansing next month as the epicenter of a new legal and spiritual battleground. The first Michigan March for Life is set for Nov. 8, 2023, at the state capitol in Lansing, coinciding with the one-year anniversary of the passage of Proposal 3, which placed abortion rights on a pedestal in the Michigan state constitution.

How an abortion can affect a womens health
The risk of complications for the woman increases with advancing gestational age.
Below are descriptions of the risks that have been associated with abortion.
Pelvic Infection: Bacteria (germs) from the vagina or cervix may enter the uterus and cause an infection. Antibiotics may clear up such an infection. In rare cases, a repeat suction, hospitalization or surgery may be needed. Infection rates are less than 1 percent for suction curettage, 1.5 percent for D&E and 5 percent for labor induction.
Incomplete abortion: Fetal parts or other products of pregnancy may not be completely emptied from the uterus, requiring further medical procedures. Incomplete abortion may result in infection and bleeding. The reported rate of such complications is less than 1 percent after a D&E; whereas, following a labor induction procedure, the rate may be as high as 36 percent.
Blood clots in the uterus: Blood clots that cause severe cramping occur in about 1 percent of all abortions. The clots usually are removed by a repeat suction curettage.
Heavy bleeding: Some amount of bleeding is common following an abortion. Heavy bleeding (hemorrhaging) is not common and may be treated by repeat suction, medication or, rarely, surgery. Ask the doctor to explain heavy bleeding and what to do if it occurs.
Cut or torn cervix: The opening of the uterus may be torn while it is being stretched open to allow medical instruments to pass through and into the uterus. This happens in less than 1 percent of first trimester abortions.
Perforation of the uterus wall: A medical instrument may go through the wall of the uterus. The reported rate is one out of every 500 abortions. Depending on the severity, perforation can lead to infection, heavy bleeding or both. Surgery may be required to repair the uterine tissue, and in the most severe cases a hysterectomy may be required.
Anesthesia-related complications: As with other surgical procedures, anesthesia increases the risk of complications associated with abortion. The reported risks of anesthesia-related complications is around one per 5,000 abortions.
Rh Immune Globulin Therapy: Genetic material found on the surface of red blood cells is known as the Rh Factor. If a woman and her fetus have different Rh factors, she must receive medication to prevent the development of antibodies that would endanger future pregnancies.

Margaret Sanger: A Racist, Ableist Eugenicist
In honor of the March for Life taking place yesterday, here’s a friendly reminder that Margaret Sanger was a racist, ableist eugenicist.
In her article My Way to Peace, she outlined this 3-step plan to prevent “fifteen or twenty millions of our population” from tainting society:
Sterilizing anyone with mental or physical disabilities and putting them to work on segregated farms for the rest of their lives.
Putting poor, illiterate, drug-addicted, or sex-working individuals to work on state-run concentration farms, which they would only be allowed to leave if they reformed and accepted sterilization.
Institute mandatory birth-control training for women with serious illnesses like heart disease, to discourage them from having children.
In that same document, she specifies that she includes those “barred from entrance by the Immigration Laws of 1924” and their descendants among the undesirable groups that should be sterilized and segregated—said immigration laws barred Asians and imposed severe restrictions on the number of Africans and Arabs allowed to enter the country.
Her support for this plan actually resulted in 30 states passing laws allowing for forced sterilization: “At least 70,000 people in the United States were forcibly sterilized under the laws promoted by Sanger and her associates. Far more, especially women prisoners and women on welfare, were surreptitiously sterilized.”
She went on to say in A Better Race Through Birth Control that “women of subnormal mentality, however lacking they may be in vision and altruism, would prefer to avoid the pain and responsibilities of procreation, if the satisfaction of sex could be divorced from reproduction.”
In her article In Defense of Assassination, she said, “Exterminating warfare is also waged against the savage members of the human race wherever they oppose the establishment of conditions necessary for the development of the more highly organized types.”
In fact, Sanger’s eugenicist beliefs are so blatant that a Planned Parenthood center in NYC actually removed their founder’s name from their clinic because they didn’t want to be associated with her eugenicist policies—an ironic decision, as they continue to advocate for some of the methods of eugenics Sanger supported.
While Sanger’s ultimate mission of segregation and forced sterilization has failed, her eugenicist beliefs continue to succeed in more subtle ways. For instance, in NYC in 2013, more Black babies were aborted than born, at a rate of 67.3 per 1,000, a rate vastly higher than any other racial group. While that rate decreased to 32.6 in 2020, the disparity between races increased, with Black babies being aborted over 5 times more often than their white counterparts.
The fact that Margaret Sanger supported the forced sterilization and enslavement of POC, drug addicts, sex workers, and disabled individuals has been suppressed for decades, so as not to complicate the message that she is a champion of women’s rights. Ignoring these facts—ignoring her own words—allows these evils to continue uncontested. We cannot remain in ignorance. We cannot meaningfully separate Planned Parenthood’s current actions from their founder, especially as the racial disparities are only growing more extreme. Regardless of how you feel about abortion, it’s eugenicist roots are a vital piece of information to have when considering it.
Now that Roe v. Wade has been overturned, the March for Life has turned even more attention to mitigating the damage done by Margaret Sanger’s eugenicist beliefs. Specifically, to ensure that all pregnant women and their families have easier access to several kinds of support, so they can make a truly informed decision instead of believing that abortion is their only option.
With every woman, with every child.
