#upstead proposal

Note
So let me get this perfectly straight… upstead was a trauma response after building a partnership that worked for years and having one of the best slow burns on tv only for one half of the character to be written so out of character it isn’t even funny and then the very first episode back we have Hailey acting like she doesn’t even care about Jay and that he’s gone not to mention could care less that her marriage is over and meant nothing to her.
Meanwhile the other rowboat of ships who still can’t seem to figure it out after idk how many years at this point gets a THIRD proposal (which hmm who does that remind me of idk maybe upstead) and they get a happy ending while Tracy gets what on her final season?? Nothing?? Is this seriously the only way that idiot of a showrunner could make two relationships work on the same show is by destroying one in a matter of seconds while continuously praising the other one and giving them everything that they don’t even deserve. Make it make sense??
FUCKING THIS!!
Help. Me. Make. It. Make. Sense.

Gwen really didn’t even give upstead a chance did she??
I wanted to see them fight for it. Relationships are so fucking hard and she was like “okay so they’re gonna lie to each other, then ignore all the problems and then ship jay off to Bolivia and that’s the end”.
They had a foundation to work from. It’s not like they got married to a stranger in Vegas like come on now. They literally could have just talked to each other and things would have been a little bit better. But no Gwen thinks Voight being the person she should lean on is the right choice.
I’m never questioning wether or not one ship or another ever deserved to survive during ANY season. But Upstead didn’t even get the opportunity to grow.
The more I remember Burzek got the multiple failed relationships and proposals, and therapy for both of them, and they learned how to co parent a daughter together that needed a stable environment all the while they both had trauma and demons to deal with both together and apart.
I would argue trauma is a integral part of both Upstead and Burzek’s relationships. And trauma is being highlighted in such distinctly different ways. We know trauma presents itself in different ways for everyone but I think it’s a disservice to the characters themselves to present it this way. Because it’s disingenuous at best.

what is your top 10 favorite upstead scenes/moments?
The shoulder touch in 5x05. It's so small and kind of not really important; but Jay's sitting at the computer and Hailey just casually puts her hand on his shoulder when she leans forward to look over him. They'd barely known each other for that long at this point but it seems so effortlessly and habitable already???
5x18 - especially the ending scene when Jay shows up at her place because he knows she doesn't really wanna be alone and he knows that she's not alright so he stays.
The ending scene in 6x07. This is the first moment when they really give voice to the thing between them and how/why it works so well. And Jay opens up to her and they head out for a beer? and it's just so fucking them.
the "we're good and we're always going to be good" scene in 6x10
6x15 Hailey’s “I’d follow you blind” scene and the look on Jay’s face and also her "i've trusted you from the day I met you" because knowing Hailey's history and her abusive father - there's probably not a lot of people, but especially men that she can say that about.
The "I'm going where you go in 6x22
7x10 - the ending in the hospital when Hailey sees that while Jay is busted up, he's okay and that smile on her face????
Is it cliché to claim their kiss in 8x03? Cause I do. You can just tell how shy Hailey is about the whole situation and how she admits to him that she doesn't wanna take the job because of him??? Oh i'm trash for them.
9x01 when Jay proposes to her in the middle of their living room.
9x09 - their wedding - sure it's mostly a voice over with just a montage of them at the courthouse; but I just love it so fucking much because running to the courthouse in their casual clothes are just so fucking them, I can't
Honorable mentions
4x21 - I think I have to mention their "first" meeting; because the way Hailey just takes charge over Voight? And the clear look of amusement on Jay's face. It's everything tbh.
"Of course I love him, he's my partner"
9x04, when she starts having that panic attack in the locker rooms and Jay grabs her hand and talks her through it?

Your top 3 Upstead kisses and why 😽
Taking this as an opportunity to express my gratitude for the incredible gif makers on here (& not just those whose gifs I use with these answers). We’re blessed by your talent and I’m grateful for every single one of you🫶🏼
1. First Kiss | 8x03: this kiss is laced with something. I could watch only this scene for the rest of my life and still get butterflies every single time. The way Jay immediately goes for tongue, the way you can tell he catches her off guard, and the moment her hand slides down his chest at the end?? Love it. 100/10
Tumblr media
2. Proposal Kiss | 9x01: I have to thank the director for this one because something about the full body shot just hits different. Her on her tip toes, his grip on her waist, THEN his grip around the back of her neck make me absolutely lose my mind. They literally hold each other as closely as possible in this scene and they’re so insane for that.
Tumblr media
3. Consummation Kiss | 9x09: there are so many kisses to appreciate in this scene, but this one is truly the most aesthetically perfect of theirs. She backs up, he chases her, his hand cradles her head then moves to her waist - it’s the perfect recipe to melt me into a puddle on the floor.

Matching rings and matching names
Tumblr media
Summary - ‘Do you wish I’d done it properly?’ he asked hesitantly.
‘Done what properly?’
‘The proposal. If I’d have done it properly with a ring?’
Post proposal, Hailey and Jay have a discussion about rings.
Notes - Happy Valentine’s Day! Thought it was the perfect time for some Upstead fluff, I hope you enjoy! AO3 Link
The air was cooling against their drying skin as Jay and Hailey laid tangled together atop her bed. The blinds into the room were open, the only light coming from the outside casting shadows across the bed. She was curled into Jay’s side, her fingertips running patterns across his chest, his hand tight around her back, his other one resting under his head as he gazed up at the ceiling.
‘Hails’, he said softly, his quiet voice breaking through the peaceful silence.
‘Hmm’, Hailey made the noise in response but didn’t slow her movements along his skin.
‘Do you wish I’d done it properly?’ he asked hesitantly.
‘Done what properly? That felt pretty proper to me’, she said with a light giggle, her laugh fanning lightly against his chest.
‘The proposal. If I’d have done it properly, with a ring?’ Her hand stilled at this and he brought his own down from behind his head to hold it, gently rubbing his thumb across her empty ring finger.
‘I don’t need a ring Jay. I just need you.’ She spoke quietly but firmly. ‘You already proposed a second time after I did, and you got down on one knee. It was a proper proposal.’ Jay hummed in response but Hailey could still feel him rubbing his thumb against her finger. She pushed herself up slightly so she could look at him. ‘It was perfect Jay. I promise. I don’t need a ring,’ she smiled, which he returned but she could still see that it didn’t quite meet his eyes. She knew the difference between when he was smiling from his heart and when he was just putting one on in an attempt to appease others. ‘Talk to me Jay,’ she whispered and patted his chest lightly in an attempt to focus him, ‘what’s brought this on?’
‘I just want-’ he started to say but stopped himself before starting again after taking a breath. ‘You’re life hasn’t been easy Hailey, and I know you don’t like talking about it,’ he added quickly knowing that Hailey would be likely to interrupt him. He had known the woman lying in his arms long enough to know that. ‘But you said it yourself, you want to have some normalcy in your life. And normalcy is an engagement ring and a wedding and everything that comes along with it. And I don’t want you to miss out on that stuff.’
‘But what if I don’t want that stuff,’ Hailey responded.
‘I just want to make sure you don’t want it because you don’t want it, not because you think you shouldn’t,’ he said quietly, tightening his grip on her hand. To most people, what Jay was saying would make no sense at all but Hailey understood perfectly.
She had never been one to follow tradition, the regular way of life. Rather preferring to do her own thing and forge her own path. But sometimes it was to her own detriment. She remembered telling Jay the story of her homecoming Junior year.
She had been asked to go by a boy in her class but had adamantly turned it down. She told herself it was because a dress was likely to show off her arms and the bruises that were usually concealed by her long sleeves. That and the fact that Homecoming was just stupid anyway. But when the night came and she stayed at home, listening to her Dad’s shouts echoing around the house, she realised she had wanted to be there. She would have been able to be a normal teenager for the night. She could have found a dress with sleeves, or put a jacket or a shawl on, no one would have noticed anything wrong. She had somehow persuaded herself that she didn’t want to go, because other girls, girls she thought she was like, also didn’t want to. That Homecoming was only for the popular girls, the airheads, not someone as down to earth as Hailey Anne Upton. Girls like her didn’t go to Homecoming, wear a pretty dress and dance awkwardly with a boy. They just didn’t.
The night she told Jay that story had been the same night they had danced in the kitchen for the first time. He had asked her to dance a few times before but she had always shook her head and given an excuse: she was cooking, she couldn’t dance, it was silly. But this time she let him take her in his arms and sway gently. She suddenly realised what she had missed out on all those other times. Because she thought Hailey Upton shouldn’t want to dance. But in reality, she did. And that night swaying slowly in her kitchen, in the arms of the man she loved, she realised it was okay to want things that perhaps didn’t fit with the persona she presented.
The same had happened the first time Jay bought her flowers. She had made a quip that he must be apologising for something but he had just said he thought they were pretty and they reminded him of her. They had sat proudly on her coffee table until their colours were dull and the petals lifeless, but she had kept one of the flowers, pressed tightly in between the pages of one of her books. She had thought it was soft when girls had kept flowers from boys, had rolled her eyes everytime it was shown in a movie or written in one of the books that she borrowed from the library as a teen, but every time she opened the book and saw the dried petals, it brought a smile to her face. And now when Jay buys her flowers, she just says thank you with a smile.
Hailey smiled at Jay, ‘thank you,’ she whispered and resumed her movements across his bare chest. Her fingers dancing lightly across the skin.
‘For what?’
‘For always checking in, for being there for me, for understanding that sometimes my head doesn’t always want the same as my heart’ she spoke softly, trying to get her feelings out coherently. ‘But I am serious, I don’t want a ring. I want a marriage. I want you and me and our life together, a diamond on my finger isn’t going to change that’.
‘Compromise?’ Jay offered.
‘What did you have in mind?’ She grinned and rested her head atop her hand so she could continue to look at him, his green eyes glistening as he smiled down at her.
‘No engagement ring but we get matching wedding bands?’ Hailey contemplated for a moment, dramatically making thoughtful noises before nodding with a smile.
‘I like that idea,’ she said.
‘You do?’
‘I like the idea of people knowing you’re mine,’ she laughed, ‘but in all seriousness, I like that idea. That we would match.’
‘Perfect,’ he leant down to press a soft kiss to her forehead, letting his lips linger a little longer than normal.
‘Not big gaudy things though, practical ones,’ she added and Jay nodded in response.
‘Practical ones it is.’
‘We could get them engraved,’ Hailey suggested quietly, half thinking Jay wouldn’t hear.
‘Really?’ He asked with a smile.
‘Mhmm’, she moved to rest her head back into the crook of his neck. ‘Just for us’ she added.
‘Just for us,’ he echoed as he brought one of his hands up to nestle in her hair. ‘And if you ever change your mind, I’ll take you straight down to the jewellers and get you a ring right there and then,’ he said with a smile.
‘I know you would. And that’s why I love you Jay,’ she planted a gentle kiss to his chest as she felt his arms tighten around him.
‘I love you too’, he whispered as the pair drifted back into a comfortable silence, the promise of a future together lingering in the air.
‘Would you mind if I took your name?’ Hailey said softly. ‘After we’re married I mean’.
‘Wouldn’t both of us being Halstead at work be confusing?’ Jay laughed, Hailey felt his chest rise and fall in time with the laughter. ‘Of course I wouldn’t mind Hailey, I’d love it.’
‘I would stay Upton at work, it would be too confusing otherwise but in our everyday life. Like I said earlier, we would match. And it’s a bit of normalcy.’
‘Hailey Halstead,’ Jay murmured. ‘That sounds pretty perfect to me.’
‘You’re supposed to share the name of the people that love you. And you love me more than anyone else ever has.’
‘Hailey Halstead it is,’ he kissed her forehead and felt her melt further into him. ‘Mr and Mrs Halstead.’
‘Now that makes me sound old,’ she giggled. ‘But Hailey Halstead, that I like the sound of’.
‘Then as soon as we tie the knot and get those matching rings, we will go to the courthouse and get matching names as well,’ he chuckled softly.
‘Thank you,’ she said as she nuzzled her face further into his neck.
‘For?’ he asked.
‘For loving me so much you’re letting me have the chance of normalcy, of having the same last name as my husband’.
‘Your husband’.
‘My husband. At least you will be soon’.

What do you think of Gwen basically calling Upstead's relationship a trauma response that was sort of destined to end?
okay. look. i really like upstead. i wanted them to work out, i really did. but i called this as soon as they got engaged.
do i think their entire relationship could be called a trauma response? absolutely not. do i think there was an element of trauma response to their engagement/marriage? absolutely yes.
there is no doubt in my mind that they genuinely loved each other before they ever even became an official couple, but hailey's proposal came out of a traumatic experience that she never properly dealt with. she was spiraling during their entire "engagement" and even though the situation itself was eventually resolved, the trauma wasn't. they got married right after the "conclusion" of the traumatic experience and both continued to experience different traumas after that without EVER dealing with it. jay went to a veteran's group around the end of season 4 and went to a few mandated therapy appointments in season 5, and then never again. hailey has never had any sort of therapy in her entire life as far as we know considering the way her past has been portrayed
i firmly believe that they got engaged/married too quickly - yes they loved each other before they were together but there is a difference in dynamic when they're finally in a relationship
keep in mind though that none of this means that this storyline is in character for jay (it isn't) or that their marriage was destined to end, but so long as they continued to not deal with their respective and shared trauma, then that's not a relationship that's sustainable. i think gwen is a clown and that it's a stretch, but there is an underlying layer of truth to it

I will never understand why people make out like Upstead getting married was a motive by Hailey purely to keep Jay close or to prevent Jay testifying against her if the Roy/North thing went sideways. Are they forgetting Jay proposed himself after Hailey did and he was the one who insisted they get married the same night/ morning after he found a way to keep North quiet…
Yeah this is one of the funniest arguments, and a pretty clear example of people only seeing what they want to see.
They were engaged before Jay knew about Roy and married after the whole thing was settled.
I know not everyone is going to like every couple, but the show made it very clear that they love each other and they wanted a permanent testament to that- and that's what was shown on screen.

what are your absolute favorite scenes from upstead season 9 and why? 😀
Ohhh...Do I have to pick? Honestly, I have loved every Upstead scene we got in S9, including the tiny crumbs and the arguments between Jay and Hailey.
But, here are my Top 3 Upstead scenes from S9:
The Wedding (9x09): This scene is everything an Upstead fan could have wished for. It was genuine and beautiful but also hot and sexy. It was a great conclusion to the Roy Walton story and the beginning of Upstead's new chapter. Absolutely loved it! 😍
Jay and Hailey at the New Apartment (9x03): As much as I love scenes where Hailey and Jay are making out, I also enjoy the scenes where they are just talking. I loved how casual and simple that scene was. They just moved into their new home, surrounded by tons of boxes, and Hailey and Jay are just having dinner. We got a little glimpse of their home life and how they spend their time outside work. I loved how Hailey reminded Jay, "You don't have to tell me anything. You can, and I'll love you all the same." And we saw Jay trusting Hailey with part of his past. I firmly believe that communication is the key to a successful relationship, and scenes like this prove how well Upstead is together.
The Proposal (9x01): Let me just say, I was not expecting a proposal from Jay. After a stressful premiere, that scene was a great way to end the episode. We saw Hailey being vulnerable, Jay being honest. They were doing "the thing that works between them"! And when Jay got down on one knee because he is so old-fashioned, I cried. The chemistry, the dialogue, everything was perfection. And to top it all off, we got the famous "You and Me, Always!" ❤️
Bonus - The Hug (9x13): Anytime we get worried Halstead, it's a blessing. The worried looks, shoulder touches, and reassuring words he gives Hailey show how much he cares about her. I was confused why Jay's phone was on silent while his wife was on a late-night run, but the way he acted when he saw Hailey was heartwarming. I thought it was funny how Hailey was so determined to find out the truth, but all Jay cared about was making sure she was okay. Fingers crossed, we get more worried Halstead in the future. 🤞🏼

Do you have a favorite Upstead moment that you think is under-rated?
One that’s coming to mind right now is when he takes her glass from her hand in the proposal scene in 9x01. It’s so. damn. smooth. And the way he lightly grabs her fingers kills me🫠

Together is a wonderful place to be

Summary - Hailey had always loved to run. It gave her a sense of freedom and when things are starting to get tough, at work and at home.  She heads down to the lakeshore, to run, or even just walk and gives her a chance to clear her head. After Voight’s death, Jay was made acting sergeant but then after a new Chief is appointed, he had an issue with Jay being in charge of his wife.  They had to make a choice.
Notes - first attempt at writing Upstead, originally for One Chicago Appreciation Week until Stellaride took over my brain. But decided to finish it anyway!
——————————————————
The cool wind blew in her face as Hailey pulled her ball cap lower to shield her eyes.  These days, the ones where you had to battle against the wind, were her favourite. The days where your lungs were burning but only due to the cold air rather than the pressure of the day.  Step by step, mile by mile, Hailey had run down this path more times than she could count.  No matter what was going on in her life, she could find solace with her running shoes on her feet, hat on her head and pounding out the miles.  For some of her happiest memories, the morning after Jay had proposed, she had come out to run. The same could be said for the worst times as well. No matter the day or the circumstances, you could find Hailey Upton running if she needed to clear her head.
Today’s run was due to both a situation at work and at home and one for which she wasn’t quite sure she had the correct solution for.
After Voight’s death in the field, Jay had been given the title of Acting Sergeant and had taken over in Intelligence.  None of the team were surprised with the decision, Jay had been the 2nd in command for as long as any of them could remember and it made perfect sense for him to take over the role.  This left Hailey without a partner so she partnered up with Kevin until Jay let them know that Torres would be joining the squad and her and Kevin took him under their wing.  Everything had been running smoothly for a couple of weeks, the busts had gone well, they had caught their offenders and Intelligence seemed to be back to its old ways with everyone knowing their place.  That was until Chief Delamere had started.  It was clear that the new Chief had a bee in his bonnet about Jay taking over the unit, no one was quite sure why until the Chief had marched into the bullpen and ordered Hailey to join him in Jay’s office.

Hailey followed him in and closed the door behind her. She could immediately tell this wasn’t going to be a meeting where they were congratulated on their hard work or on their recent capture of a high-ranking Lieutenant that the gang unit had been chasing for weeks.
‘What can we do for you Chief?’, Jay asked confidentially but Hailey could tell he was nervous. This was the first time the Chief had visited since he had taken over.
‘Are you two married?’, Delamere said bluntly. Hailey’s hands which were behind her back immediately went to her wedding ring.
Jay took a breath, ‘We are’ he said calmly.
‘As I thought, as a Sergeant of the unit, you cannot be married to one of your subordinates.  As such you have some choices, either Upton leaves the unit, you step down from command, or the marriage ceases to exist’.
Jay looked taken aback, ‘with all due respect Chief, our marriage preceded my promotion and I treat her the same as any member of the unit, you are welcome to ask them’.
‘That may be’, the Chief continued. ‘But in my Division, I will not allow it. I will be back tomorrow morning to hear your decision’. And with that he stormed out and left Jay staring at his wife with confusion.  Hailey closed the door slowly.
‘I think we should take about this at home’, she said quietly.
‘Hailey’, Jay said gently, ‘I had no idea’. Hailey smiled at him, ‘let’s talk at home’. And with that she exited the office.  She didn’t return to her desk however, walking directly to the locker room, ignoring Kim’s call of ‘Hails’.
She opened her locker and just stared inside. Her marriage and her job, they were the two most important things in her life and this new chief had basically asked her to give one up.  How could she do that. Jay was a part of her, her other half, she knew it was cheesy to say but they had been a partnership for years.  He had been there for her when times were tough, when times were good, he made her laugh, held her when she cried, to put it simply, he was her best friend.  But she was a detective in an elite unit, she had worked so hard to get here and she was good at her job.  She loved her team and her city and the thought of having to leave that was not something she could comprehend.  She glanced down at the ring on her left hand.  She had never thought she’d be the type of girl to get married, assumed she’d be married to the job until she either retired or didn’t make it home.  But then she had met Jay, they hadn’t had the most conventional of relationships, she knew that, but it was part of what made them them.
Just then Kevin called into the locker room from the corridor, ‘Upton, we gotta bounce’.

Hailey put it out of her mind for the rest of the day and as usual was waiting by the truck for Jay after shift.  They had decided that their marriage remained out of the district so they always met up outside.  As he walked out, Hailey could tell the conversation with Delamere had been on his mind all day but now wasn’t the time or place to have that conversation but he gave her a quick peck on the cheek before unlocking the truck and walking round to his side. Once inside he placed his hand on the centre console and Hailey took it without hesitation.  They didn’t hold hands every time they were in the truck having spent more time in it before they were a couple then when they had finally got together.  The drive home was quiet, no one had anything to say, they were both thinking the same thing.

When they finally made it into the apartment, before Hailey had a chance to take off her jacket, Jay’s arms wrapped around her and pulled her close. She sunk into his chest and let out a breath she didn’t know she had been holding ever since they had had the meeting this morning.  The pair stood like this for a while, both just relishing in the closeness of the other.  Jay pulled away slightly just enough to look down on his petite wife, ‘what do we do?’, he said quietly.
Hailey looked back up at him, ‘we do what we always do when something at work is getting to us, we do our thing’, she smiled as her husband smiled down at her. ‘The thing that works’, Jay said, they separated as Jay headed to pour them both a glass of whiskey.

They sat in silence whilst they both finished their drink.  They both knew what the other was thinking, they had been together long enough to know that.
Hailey knew Jay was considering relinquishing his command, that he’d rather work side by side with his wife than have her leave the unit.
Jay knew that Hailey was debating leaving the unit, that she would sacrifice herself for him and his position.
They both knew that neither of them was thinking of their marriage ceasing to exist.
Jay was the first to speak up, ‘I can step down, we can go back to being partner’s and everything will be fine’.  Hailey looked across at her husband with a defeated smile.
‘But it’s not that simple Jay,’ she said softly, ‘if you step down then Delamere brings someone else into the unit.  Someone we don’t know, who doesn’t know us, who still may not like the fact that a married couple are partners. So, you could step down and we could be forced to split anyway.  You’re the right person to lead the unit Jay.  We all know that, Voight knew it and Delamere knows it too. It has to be me’.  She took her final sip of her drink and goes to stand up but Jay grabs her hand to keep her next to him.
‘I always told Voight if he was going to transfer one of us out of the unit, it should be me’. He said.  Hailey could tell he meant every word.
‘And that’s one of the reasons I love you Jay.  But things are different now, you’re not just a detective, you’re the Sergeant. The team needs you, the city needs you’, Hailey squeezed his hand as she spoke, she knew he was about to counteract her argument with a line about only being acting Sergeant so she beat him too it. ‘Yes, you may only be acting Sergeant for the moment.  But we both know it’s just a formality. This position has always been yours Jay, Intelligence is yours.  I’ll be fine wherever I go, because I’ll have you to come home to’.  She could see she was starting to get through to him as he gave her a small smile.  ‘And besides, Chief’s don’t seem to last long round here so maybe the next chief will let you transfer your wife back in to the department.’ She chuckled softly.
‘Hailey, are you sure…’ Jay started to say.
‘I wouldn’t have said it if I wasn’t’, she said calmly.  ‘Come on’, she tugged on his hand as she got up.  ‘Let’s go to bed’.

The next morning Hailey woke before her husband, rolling over to see him still peacefully sleeping on his front, one arm thrown over her stomach.  Before getting together with Jay, she would never imagined him to be one to want to cuddle in bed but getting to know him on another level had shown how mistaken she was.  It was still dark outside as Hailey snuck into the bathroom.  She was going to head out for a run, it was one of those mornings where she needed to clear her head before facing the day, however as she reached for her mouthwash, which her neat freak partner had put back in the cupboard, something caught her eye. A full box of tampons.  She had brought them a couple of months ago, she remembered because her and Kim had been shopping with Makayla and she had questioned what they were, that conversation she left for Kim.  As Hailey stared at the box, she started to count.  She had never been particularly regular so wasn’t one to use one of those tracking apps but this was still too many days.  But she took her pill every day, religiously, without fail.  Continuing to stare at the box she remembered going to Med one day after cutting her arm chasing an offender.  She had sworn she was fine but Jay practically dragged her there and made Will take a look.  He taped it with some butterfly stitches but gave her some antibiotics just in case.  She remembered taking them in the mornings the same time she took her pills, but did she remember taking two sets of tablets on those mornings.  She couldn’t be sure. Had she forgotten? She quickly shut the cupboard when she heard Jay roll over in bed.

Sticking her head round the door she confirmed that he was still asleep, so she ignored the thoughts in her head and carried on getting ready for her run.  Leaving a note for Jay on the coffee machine, knowing that would be his first stop when he finally woke up, she headed out the door.
The Lakeshore Trail was normally her favourite place to run but today she just couldn’t get into her pace.  It’s like her feet weren’t connected to the rest of her body and the whole time her mind just kept racing.

She and Jay had enough to deal with right now without the thought that she might be pregnant to add to the mix.  After 3 miles, Hailey’s head still wouldn’t calm down so she did the only logical thing she could think of, ran straight to the nearest pharmacy and bought a test.  Her next thought was whether to tell Jay now, or wait until she knew for sure.  They hadn’t really discussed the next steps of their relationship, they fell into marriage quickly during a chaotic time and it never really let off.  She saw how good he was around Makayla and the kids they dealt with on cases, she knew he’d be an excellent father, it was her role as a mother she was less certain of.
It was no secret to anyone close to Hailey that her childhood had been less than perfect, Jay knew this better than anyone. She had never wanted to bring a child into this world unless she was sure she could give them a better life than she had.  She could never have imagined being in this position when she was a kid, in a job she was proud of, married to her best friend and most of all, happy.  The thought of having a child, someone who would depend on her completely, someone she would have to show the ways of the world, someone she would protect more than anything in the world, well, it wasn’t quite as scary as it once was.  As she carried on down the path on her way home, she was conflicted.

When she opened the door, she realised she should have checked the garage to see if Jay had left for work because he was sat on the couch putting on his shoes.  And clear as day in her hand was a pregnancy test.
‘How was your run’, Jay said without looking up. ‘You weren’t gone as long as I thought’.  At that he smiled and stood up.  Hailey saw his eyes flick down to what was in her hand and back up to her face.
‘Hails, is that a pregnancy test?’, he said slowly.  Hailey nodded, not sure what to say.
She took a breath as he continued to stare at her.  As she began speaking she realised his eyes were no longer looking at her face but were focused on her stomach instead.
‘I realised this morning I was late, and I didn’t really know what to do.  So, I went for a run as normal, but I realised after a while that I needed to know.’ She took another breath, ‘we needed to know’ she corrected herself.  ‘I bought a test, I don’t know if I am but I think I might be’.  The last part came out as barely more than a whisper.
Jay continued to stare at her, flicking between her face and her stomach. And for one of the first times since she had met him, Hailey had no idea what her partner was thinking.
‘Jay, say something’.
‘Let’s take the test’, he said.  And with that he smiled, ‘when we know for sure, we can figure out what’s next’.  It was like a weight had been lifted off her shoulders.  They were in this together, they were always in this together.  Hailey matched his smile and headed to the bathroom with Jay patiently waiting outside.
———————————————————
Leaving the downstairs office after their meeting with Platt, Hailey was feeling much better about their situation.  They had a plan.  It was nearly fool proof and the Chief would be arriving in less than 15 minutes and they would let him know what they had decided.
Jay opened the gate into Intelligence and held the door open for his wife, she smiled as she walked through and gifted him a wink to match.  They had had a turbulent 24 hours but had weathered the storm together, and Hailey knew in her heart they always would.

As expected, Delamere arrived exactly on time and motioned for Hailey to once again join him in Jay’s office.
‘So’, the Chief began after Hailey had barely closed the door, ‘what have you decided?’.  He was staring directly at Jay.  Jay gestured for him to take a seat before he answered.  Delamere ignored him and Hailey couldn’t help but roll her eyes behind his back, standing clearly made Delamere feel like he had more power in the situation.
‘Detective Upton will be leaving Intelligence’ he said.  Delamere opened his mouth to interrupt him but Jay kept going. ‘She will be transferring to work under Sergeant Platt, remaining at the 21st.  Sergeant Platt will be her supervisor and wherever she details Detective Upton will be where she works.  Sergeant Platt has kindly agreed to directly train Detective Upton in the workings of a desk Sergeant so she is currently detailed to desk duty within the 21st and as such has been loaned out to Intelligence to assist on the case we are currently working.  Detective Upton’s prior knowledge from Robbery Homicide and her time spent in Intelligence is vital to the case.  She will no longer report to me nor be working as a member of the Intelligence team, but as a Detective on loan.  If you have any questions about the arrangement, myself or Sergeant Platt would be happy to answer them but you will see here’, Jay handed him a file, ‘everything has been arranged and signed off.  So, if you would excuse us Chief, but we have a case’.  Jay smiled at the Chief who looked stunned, but as Hailey opened the door behind him he nodded at Jay. ‘Very well Sergeant.  As you were’, and with that he left.  Hailey and Jay stared at each other, in shock that their plan at actually worked.
‘Well’, Jay said as he stood from behind his desk, ‘shall we tell them?’.  Hailey nodded and took his hand.

They walked into the bullpen and called for everyone’s attention.
‘You may be wondering what the Chief was doing here’, Jay started.
‘We may be wondering why you’re holding hands in the bullpen’, whispered Adam so only Kim could hear, she giggled quietly before turning her attention back to Jay.
‘He found out Hailey and I are married and decided that she couldn’t work under me.  As such he gave us a choice, I step down, Hailey leaves or we end the marriage.  Obviously that last one wasn’t going to happen’, he squeezed Hailey’s hand. ‘We came up with a plan and have confirmed it all with Platt.  Hailey will now report to her directly, will no longer be an official member of Intelligence on paper and will only be detailed up here when and as needed.  Platt and I have agreed however that she is needed up here every day’.  The team cheered at this after the brief worry that they would be losing one of their team.  ‘But’, Jay continued, ‘Hailey will only be allowed on desk duty for the foreseeable future’, he looked down at his wife as he heard Kim take a small breath.  Of course, she would be the one to understand.  ‘Hailey will remain on desk duty until Sergeant Platt and her doctors have signed off for her return to working in the field’.  Everyone but Kim looked confused, she had her hands over her mouth and Hailey could see the tears filling her eyes.
‘I’m pregnant’, Hailey said finally, staring up at her husband with a smile on her face.  She could hear the team cheering and congratulating them but at that moment she only had eyes for him.  They could do this she thought, they were in this together, together they were going to have a baby.  And as if he could read her mind, he said quietly ‘we’re having a baby’.  And he wrapped his arms around her, just as the rest of the team ran forwards to join them in a hug.

As Hailey stood there with her friends who had become her family, holding her and Jay, she could never have dreamed a day like this would happen, but she would forever be grateful that it had.  Always grateful for the day she walked into that credit union, the man she had met because of it and the woman she had become as a result.

Why Hailey is Totally Pregnant
The foreshadowing has been so numerous and obvious. There was not even these many breadcrumbs to their first kiss. It has to mean something.
Jay and Hailey are nurturing and amazing with kids
In TV tropeland, kids are the natural next step after marriage
Upstead moves fast on everything, why would this be any different
When Hailey yawned and rubbed her eyes in that truck while doing surveillance, it was totally a tell
Maybe they both already know and have been keeping it secret and that’s why Jay’s even more panicked
The freezing river could have been but now the explosion is the perfect tropey oppty to have Hailey find out while she is in the hospital
The show has explored a lot of father/ mother/ son/ daughter cases and emotions this season both with cases and within the unit
They have worked pregnancies into other shows like SVU (but a little different since the actress was actually pregnant in most cases) and made it work well like with Rollins on SVU
Because usually each finale has a pivot point (like Hailey proposal last season) that opens up new tentacles to next season and this would definitely be a story that would do that!
How cute would they be as parents to some adorable baby
Why Hailey is Totally Not Pregnant
Because they just got married and we have not even explored how they are married. If someone had started watching the show in 9B they would not have even caught on that those two are married to each other.
Because we just went through this with Kim (albeit with tragic results), and it feels too close to that
Because we have a kid dynamic already with Makayla and parent dynamic with Burzek and this feels too close to that
They have never had a convo about kids that we have seen so this would feel like a surprise for sure
This would give us, at one point, less Hailey in the field and that feels limiting for a character that is clearly (and deservedly) a darling
While (though I love them), sometimes burzek feels like they go in circles…there is still soooo much story to explore with Jay and Hailey before bringing in the complexities of a kid dynamic-Hailey’s relationship with her father/family, Jay and his deal with Voight, their views on policing, either of them determining how they want to change or advance their careers. They could do all of this with a kid but why do both when this show hopefully will be on for 24 seasons?
Because babyproofing that apartment looks like it will be complicated😂 haha

Note
I still can't get over Jay, who couldn't possibly move on from Erin since she was the only LoVe of HiS LIFE (/sar), knew for years before he proposed to Hailey that he wanted to be with her always!! I want a Jay Halstead of my own!! (used a tone indicator because you never know how someone might interpret what you type :/)
Jay's wonderful. And Upstead is wonderful. Everything about their story is wonderful. It's two people working through their difficult pasts and their heartbreaks and learning how to have a healthy relationship together. Regardless of every hard thing in his past and every hardship from the last few seasons, he knows that Hailey is it for him. I just love these two.
