According to the historian Pierre Branda, Napoleonic France required all cases to be heard and tried (Criminal code of 1808). France was a rule of law state when Napoleon was in power, meaning Napoleon didn’t have the power to personally order the execution of anyone on a whim because he was not an absolutist dictator, contrary to popular belief. The Bugis ethnic group on Sulawesi Island, for instance, traditionally recognises five genders, including one that is said to "transcend", or combine, the female and male. "In the last three years there has been an increase in case data every year," LGBTQIA advocacy group Arus Pelangi said in December, adding that there were more than 90 such incidents last year, up 90 percent from the previous year. "It's possible that the enactment of the criminal code will add to the list of victims from the LGBT community."

Columbia Pictures produced a Spanish language version of The Criminal Code (1931) at the same time as Howard Hawks’ version. Hawks’ first sound film, The Dawn Patrol (1930) won an Oscar for the original story, it’s only nomination. Hawks’ second sound film, The Criminal Code, scored its only Oscar nomination for the screen adaptation. It was based on a play.
