sometimes I wonder if gerard knows how much burn bright means to queer people. I'm thinking about last year when I went to the first ever pride event in my city and somebody had brought a rope with many different straps of fabric tied to it, they take it to different pride events and people write messages on a piece of fabric and tie it to the rope for other queer people to see. I wrote my favorite lyrics from burn bright, "not ashamed of what I am" on one side and "be afraid of what am" on the other. every time I listen to that song it's like somebody finally Gets me.

There is currently a strike for Palestine taking place from February 18th, 2024, to February 25th, 2024. During this time, I will only be posting about Palestine on this account and doing what I can to spread awareness. If you are able, I highly recommend participating in the strike in whatever way you are able - something is always better than nothing. "Palestinian plaintiffs and their legal representatives on Friday [January 26, 2024] presented a powerful case in federal court accusing President Joe Biden and other top US officials of complicity in Israel's genocide in Gaza.
People around the world tuned in for the long-awaited hearing in Oakland, with plaintiffs appearing in person and over Zoom in an unprecedented effort to hold the Biden administration accountable for its actions in Gaza.
The Center for Constitutional Rights (CCR) filed the lawsuit in November 2023 on behalf of Defense for Children International–Palestine, Al-Haq, and eight Palestinians in the US and Palestine. The complaint accuses President Joe Biden, Secretary of State Antony Blinken, and Secretary of Defense Lloyd Austin of failing to live up to their legal responsibilities under the 1948 Genocide Convention and the 1988 Genocide Convention Implementation Act.
The United Nations convention classifies complicity in genocide, or the intentional destruction of a people in whole or in part, as a crime under international law and requires that states take measures to prevent such atrocities.
[Note: This is a big reason why politicians almost never call it a genocide, btw. Because if a country recognizes that it's a genocide, then they actually are legally required to do a bunch of things to stop it, under international law.]
The historic lawsuit contends that the Biden administration has failed to uphold its obligations by continuing to provide diplomatic and military support for Israel's brutal campaign in Gaza. Plaintiffs are asking the court to stop Biden from sending more weapons and munitions to Israel that are being used to kill Palestinians en masse.
The hearing before the US District Court for the Northern District of California took place just hours after the International Court of Justice issued provisional measures against Israel in a landmark case brought by South Africa.

Court contends with questions of jurisdiction and responsibility
In evaluating the allegations, questioning in Friday's hearing revolved around the so-called political question doctrine, by which federal courts regularly refrain from ruling on political matters seen as best resolved by the president and Congress.
The Department of Justice argued that according to the doctrine, the court has no jurisdiction to rule in the case.
"If the court condemns United States foreign policy toward Israel, it could cause international embarrassment and undermine foreign policy decisions in the sensitive context of the Israeli-Palestinian conflict," defense counsel Jean Lin told Senior District Judge Jeffrey S. White.
Katherine Gallagher of the CCR countered that the court does, indeed, have a responsibility to step in: "Here, the question is a legal one, whether the actions undertaken by the United States failed to uphold the obligation to prevent genocide, and that is an active obligation that requires that the United States not provide the means by which a genocide is being furthered."
"There is no discretion for any state to evade its obligations, its legal obligations. These are not policy decisions," she said.
Palestinian plaintiffs share powerful testimonies before the court
After legal arguments in the case, Judge White heard two hours of gut-wrenching testimony from Palestinian plaintiffs and a renowned Holocaust and genocide expert.
Rubin Presidential Chair of Jewish History at Wake Forest University Dr. Barry Trachtenberg shared his remarks before the court in spite of vehement US government opposition.
"To have an event fall under the 1948 Convention on Genocide requires both action and intent, and here we see that very, very clearly in a way that seems really quite unique in history," he stated, noting that there is now an opportunity to stop Israel's unfolding genocide in real time to prevent further loss of lives...
Judge White said he would take the testimonies to heart as he evaluates his constitutional responsibilities, describing the case as "the most difficult judicial decision" he has ever had to make."

Note: I know a lot of people are really not gonna appreciate that last line. I'm not thrilled with it either. But it is worth noting that having a federal court overrule the US president's huge foreign policy and military decisions would be an absolutely massive deal/precedent
This is a case that deserves to be ruled on with an incredible amount of seriousness, if only because if you're a federal judge who's going to make that call, your written decision/legal justification needs to be unimpeachable
That said, if the judge uses jurisdiction to pass the buck here and avoid his legal and human responsibility to do what he can to stop a genocide, I'm gonna be pissed

"Speaking to Al Jazeera, Omer Bartov, a professor of Holocaust and Genocide Studies at Brown University, says Israeli officials, both in Netanyahu’s coalition and in the opposition, have been speaking more openly about making Gaza unlivable for Palestinians.
“There have been ongoing statements in recent days … which seem to indicate a particular plan the Israeli government seems to want to implement, which is not only to create unbearable conditions for the population of Gaza, but actually to speak about removing the population,” he said.
“Or as one minister [far-right finance minister] Smotrich said, to encourage them to leave Gaza either to the Sinai Peninsula or to other countries that would welcome them,” Bartov said.
“Or that Israel would rule that area and as this particular minister said, there should be discussions about settling the Gaza Strip,” he said, adding if the current trajectory continues, the world is witnessing an operation of “ethnic cleansing under the mantle of humanitarian action”.

American Muslim leaders carried on a campaign launched earlier this month against President Joe Biden over his handling of the Gaza conflict.
#AbandonBiden campaign was first launched by Muslim leaders from Michigan, Minnesota, Arizona, Wisconsin, Florida, Georgia, Nevada and Pennsylvania.
Saturday’s plan to actively campaign against Biden in all 50 US states was announced in Chicago, Illinois at the end of a national convention organised by the Muslim American Society and Islamic Circle of North America.
The leaders say they intend to guarantee Biden’s loss in the upcoming 2024 election over his refusal to call for a ceasefire in Gaza, where Israeli attacks have killed more than 21,000 people, mostly children and women.
“The president betrayed us because he violated the value of dignity and life. What’s the point of voting for you when you deny 2.2 million [in Gaza] people water?” said Hassan Abdel Salam, a spokesperson for the campaign.

Today the Euro-Mediterranean Human Rights Monitor Observatory stated that Israel dropped over 25,000 tons of explosives on the Gaza Strip as part of its ongoing extensive war since October 7th, equivalent to two nuclear bombs.
The Euro-Mediterranean Human Rights Observatory, based in Geneva, highlighted the Israeli army's acknowledgment of targeting more than 12,000 objectives in the Gaza Strip, setting a record in the number of bombs dropped, surpassing 10 kilograms of explosives per person.
With the advancements in bomb quantity and effectiveness, while maintaining a consistent amount of explosives, the quantity dropped on Gaza could be equivalent to twice the power of a nuclear bomb.
Additionally, Israel deliberately employs a mixture known as "RDX" (Research Department Explosive) commonly referred to as "the science of complete explosives," with a power equal to 1.34 times that of TNT.

This means that the destructive power of the explosives dropped on Gaza exceeds what was dropped on Hiroshima, taking into account that the city of Hiroshima covers an area of 900 square kilometers, while Gaza's area is no more than 360 square kilometers.
Furthermore, Israel has been documented using internationally banned weapons in its attacks on the Gaza Strip, particularly cluster and white phosphorus bombs. White phosphorus is a highly toxic incendiary substance that rapidly reacts with oxygen, causing severe second and third-degree burns. The Euro-Mediterranean team has documented cases of injuries among the victims of Israeli attacks that resemble the effects of dangerous cluster bombs, as they contain small high-explosive submunitions designed to penetrate the body and cause internal explosions, resulting in severe burns that melt the victims' skin and sometimes lead to death. These submunitions also cause peculiar swelling and toxin exposure in the body, including transparent shrapnel that does not appear in X-ray images.
The Euro-Mediterranean Human Rights Observatory has emphasized that Israel's destructive, indiscriminate, and disproportionate attacks constitute a clear violation of the laws of war and the rules of international humanitarian law, which stipulate the obligation to protect civilians in all circumstances and under any conditions. Killing civilians is considered a war crime in both international and non-international armed conflicts and can rise to the level of a crime against humanity.
The 1899 and 1907 Hague Conventions, along with the 1949 Geneva Convention in its latest formulation, established fundamental human rights during wartime to limit the deadly health consequences of internationally banned weapons, some of which could lead to the "genocide" of civilians.

Article 25 of the Hague Regulations concerning the Laws and Customs of War on Land prohibits "attacking or bombarding towns, villages, dwellings, or buildings which are not defended."
Article 53 of the Fourth Geneva Convention states that "any destruction by the occupying power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations."
According to Article 147 of the Fourth Geneva Convention, the destruction of property that is not justified by military necessity and on a large scale is considered a serious violation that requires prosecution. Such practices are also classified as war crimes under the Rome Statute of the International Criminal Court.
The Euro-Mediterranean Human Rights Observatory has called for the formation of an independent international investigative committee to assess the magnitude of explosives and internationally banned weapons used and continue to be used by Israel against civilians in the Gaza Strip.
This committee would hold accountable those responsible, including those who issued orders, made plans, executed actions, and took measures aimed at achieving justice for Palestinian victims.
