The Alberta Energy Regulator is investigating after dozens of bird carcasses were discovered at an oilsands site near Fort McMurray, Alta.
A post on the AER website on Saturday afternoon said Suncor reported around 4 p.m. Friday that 32 dead waterfowl were found at a tailings pond 29 kilometres north of the community. An update from the regulator late that night said a sweep had been completed by Suncor on Saturday and revised the count to 43 birds as well as two muskrats, one bat and one vole.
An AER inspector was immediately sent to the site to investigate, the announcement said, to ensure mitigation strategies are in place and implemented appropriately by the energy company.

Mr. Wright: Permit me to share with you a story that will further illustrate why it is necessary for this bill. In this story imagine that there’s a neighbourhood with 14 houses, representing Canada’s 14 different jurisdictions; 10 houses for the provinces, three for territories, and one is housed by the federal government. In this neighbourhood the federal government is known as the notorious national Karen, also known as Justin Trudeau, who is often found to be self-imposing his final say on every household in the neighbourhood. You know, this neighbour is the bane of the neighbourhood, just like Trudeau is to all Canadians. Time and time again he likes to meddle with the very framework that makes the neighbourhood what it is. On regular occasions Trudeau, in proper Karen fashion, likes to try to move the neighbourhood fences or, in the case of this story, constitutional boundaries to claim more and more authority, power, and land for himself.
One night, Mr. Chair, the neighbourhood goes to sleep, and in the morning they find that all the fences have been changed and now Ottawa’s property is significantly larger. When the other 13 neighbours look outside, they see that Ottawa has extended their fences through half their yards and in some cases even through the very hearts of their homes. Alberta and the rest of the jurisdictions go down to look at the fences, and they see a sign that reads: by declaration of Prime Minister Trudeau of Ottawa, our constitutional boundary fences have been moved in the name of the environment through Bill C-69, the plastic bans, no more roads, unrealistic clean energy regulations, the carbon tax, production caps; secondly, in the name of the greater good, enacting the unconstitutional Emergencies Act. And, lastly, due to the neighbourhood’s apathy in questioning Ottawa’s previous and continued overreach into your jurisdictional boundaries, at the bottom of the sign it reads: if you have any concerns with these changes, tough luck; we’ll see you in court, and we will punish you for questioning our decisions and authoritarian approach.

Adam is now prepared to battle both Imperial Oil and Alberta’s energy regulator, alleging they “covered up unprecedented failures” of the company’s containment ponds, in what is now believed to be one of the largest tailings leaks in Alberta history. “They’re both up against the wall right now. They were caught red-handed. The trust is gone. There’s no way you can come back from that. And we’ll always have what happened in the back of our mind, whenever we’re out on the land,” he said. “You can’t ever forget about something like this.”

The regulator soon concluded the water had come from tailings ponds where the company stored the toxic sludge-like byproducts of bitumen mining. Environmental samples showed high levels of several toxic contaminants, including arsenic, iron, sulphate and hydrocarbon – all of which exceeded provincial guidelines.
“But the company failed to notify the federal government and nearby Indigenous communities. In February, there was another leak, in which 5.3m litres of tailings water escaped from an overflowing catchment pond. This time, the community was informed two days later …
“For residents who are forced to live in fear about the water they can’t drink or the food that could be tainted, environmental justice remains elusive.
“‘We’re not talking about compensation. I don’t want compensation. I want them off our traditional land. This is Treaty 8 territory, where my great-uncle signed that treaty. They’re using our land, and they’re destroying us,’ said Rigney. ‘This is a battle worth fighting for. I can’t say I see the light at the end of the tunnel. But as long as I have a voice, I will keep speaking.’”

The underlying issues have not been addressed, and the AER and government are being sued for over a billion dollars. The CEO, Laurie Pushor, has clearly failed in his role to regulate the industry effectively, and the board has failed to hold the CEO accountable. Why is the minister standing by the board and the CEO of the AER?

When Kinder Morgan first announced its plans to expand the capacity of the Trans Mountain oil pipeline from 300,000 bpd to 890,000 bpd, it probably thought it was another major project. Several years later, the company had given up on the project and sold it to the Canadian federal government for less than $4 billion. For a long time, it seemed like Trans Mountain would never be completed, plagued by opposition and regulatory snags.
Despite all this, it seems the pipeline is about to go into operation this year. And U.S. refiners used to buying cheap Canadian oil might need to reach deeper into their pockets to keep buying it. The idea behind the Trans Mountain expansion was to turn Canada into a true oil exporter, reaching international markets rather than just the U.S. market, massive as it is. One reason this took so long was that the government of the province that was to host most of the pipeline was dead against it.
The John Horgan government was very environmentally minded. It would rather have Alberta stop all oil flows to British Columbia than endure the construction of the expanded Trans Mountain pipeline. That set back the project by months, and so did environmental protests against the pipeline.
Amid all this, the discount at which Canadian crude normally trades to WTI has deepened and hardened. Canadian oil was going to the United States—all the way to the Gulf Coast—and only from there could it reach international markets. It was a complicated situation. Then, when Kinder Morgan had enough and sold the project, the Trans Mountain expansion got a new lease of life—ironically, from a federal government that has made no secret of its distaste towards the oil industry. And it paid for that distaste. From an original $3.4 billion price tag, the Trans Mountain expansion bill swelled to over $23 billion. Inflation and supply chain problems were among the reasons for the sixfold increase in the cost of the project, as were construction challenges due to the geology along the route of the pipe. Oil producers have not exactly welcomed the cost overruns—there were suspicions that to make up for these, Trans Mountain Corporation would charge them higher fees for carrying their crude.
Nonetheless, producers began ramping up production ahead of the launch. Canadian Natural Resources announced plans to increase output by 40,000 barrels of oil equivalent per day by 2024. Cenovus Energy also announced plans to increase investment in production growth. Oil producers are preparing for the 890,000 bpd capacity. Prices have also responded. Following the announcement that Trans Mountain Corporation will begin filling the expanded pipeline in February, with the first crude loading from Vancouver in April, Canadian crude prices rose to their narrowest discount to WTI since August 2023. The current discount is approximately $16 per barrel.
Just a month later, the same CER ordered TMC to halt pipeline construction due to non-compliance with environmental and safety standards. A month later, the regulator decided that TMC could not proceed with the route change due to opposition from the Indigenous community through whose land the section would pass. By December, however, the CER had changed its mind and granted TMC the necessary permit to continue construction on the pipeline.
These types of setbacks have made it difficult to believe that the Trans Mountain pipeline will ever be operational, but it appears that it may be. This means more expensive oil for US refiners. They are about to face some international competition for Canadian crude.
