Seven Black Performers Who Changed The World Of Burlesque

At the height of their popularity in the early and mid-20th century, burlesque halls were overwhelmingly segregated spaces. Although women of color performed as shake dancers in nightclubs, they rarely shared the stage with white dancers. It was up to them to make a name for themselves in an industry in which their identities were easily obscured, exoticized, and even forgotten. 
Here, we're celebrating some of the Black women who broke into the world of mainstream burlesque, and in turn forged pathways for future generations of Black performers and challenged standards of beauty.
Some of these women, Eartha Kitt and Josephine Baker among them, enjoyed illustrious careers and maintain their fame today. Then there are others, like Lady Ernestine, who are known only for their stage names and little else. What all of these women have in common is the drive to prove their talent to a society that expected little of them. They changed what it meant to be a sex symbol, proudly owning their Blackness and their bodies in a way that the American public certainly didn't see every day.

Jean Idelle
A true trailblazer, Idelle was the first Black woman to perform alongside white women and is credited with breaking the color barrier in burlesque. She performed throughout the 1950s in the U.S. and Canada, often with her signature ostrich feather dance.
Although she retired in 1960, Idelle performed for the Burlesque Hall of Fame in 2012, at the age of 82 — and naturally stole the show.

Toni Elling

Born Rosita Sims, Elling began her burlesque career in 1960, when she was 32. Though she was considered a little old for a dancer-cum-stripper, Elling's sheer talent proved her doubters wrong. She took her act around the country and even overseas (as far as Japan).
Although Elling retired from performing in 1974, she has continued to work as a teacher and role model for younger generations of dancers. To this day, her overriding message is to keep burlesque artful — not overt.
Lady Ernestine

Lady Ernestine, also known as The Exotic Queen, was a prominent performer in the '50s and '60s, but unfortunately, little else is known about her today.
Marie Bryant

Bryant made her debut as a jazz club dancer when she was 15 in 1934. Only a year later, she had made a reputation for herself as an actor, singer, and dancer — a total triple threat. Bryant's career took off in several directions at once, as she performed around the country, recorded songs, and even broke into the film industry.
Although Bryant appeared in front of the camera several times, she made history as one of the first Black people to work on the technical side of a film. It was behind the scenes of a Gene Kelly picture that she started working as a dance instructor and choreographer.
Bryant continued to work with high-profile students, including Cyd Charisse, Ava Gardner, and Lucille Ball, and even opened her own studio before her death in 1978.
Eartha Kitt

Before Kitt was known for "Santa Baby" or for her role as Catwoman, she lived in poverty and faced discrimination for her mixed-race heritage. Kitt joined the Katherine Dunham Dance Company, the first ever African American modern dance company, when she was a teenager. She toured with the company as a featured singer and dancer until she was offered the chance to perform solo in European nightclubs.
She soon returned to the States and took Broadway by storm. Her performances stood out from the rest, thanks to her knowing sex appeal — one critic wrote that she "can make a song burst into flame."
Ada Overton

Overton rose to fame in the early 1900s, making a name for herself as a gifted performer who made dances like the cakewalk and buck-and-wing her own. As a dancer, she was said to be as strong as she was graceful, flaunting her modern interpretations of indigenous African dances onstage for royalty and the white elite. 
As Overton's career blossomed, she changed her first name to Aida, in honor of the Haitian spirit of fertility, and viewed her work as social activism for Black women and actresses. Overton performed until her death in 1914, at the age of 34. She's remembered as one of the first African American women to find success as a performer and she served as a role model for future generations of Black entertainers.

New York in the Roaring Twenties - a riveting true-crime novel, based on one of the most notorious unsolved murders of the era, where power, politics, and secrets conspire to bury the truth. 
Manhattan, 1923. Scandalous flatter Dot King is found dead in her Midtown apartment, a bottle of chloroform beside her and a fortune in jewels missing. Dot’s headline-making murder grips the city. It also draws a clutch of lovers, parasites and justice seekers into one of the city’s most mesmerizing mysteries. 
Among them: Daily News crime reporter Julia Harpman, chasing the story while navigating a male-dominated industry; righteous NYPD detective John D. Coughlin, struggling against city corruption; and Ella Bradford, the victim’s Harlem maid, closest confidante, and keeper of secrets. Adding fuel to the already volatile crime: a politically connected Philadelphia socialite, an Atlantic City bootlegger, Dot’s dicey gigolo lover, a sultry Boradway dancer, and a cagey sugar daddy guarding secrets of his own. 
From Broadway’s glittering lights to its sordid underbelly to the machinations of the country’s most powerful men, Julia embarks on a quest for justice. What she discovers, twist after breaktaking twist, might be even more nefarious than murder. 
Inspired by the story of the real Broadway Butterfly, we delve deep into 1920s New York City, where corruption on all ends comes to the forefront. 
We receive our story from the perspective from four different people: Frances Stotesbury Mitchell, Julia Harpman, John Coughlin and Ella Bradford. Each one is involved in the dead Broadway beauties life in some way. Mrs. Mitchell is the wife of the man that Dot King was seeing, effectively acting as his sugar baby; Julia Harpman, never having met her previously but as the only woman on the crime beat for the Daily News, attempted to cover her story and bring her murderer to justice; John Coughlin as the chief inspector on the police force that attempted to bring her murderer down and finally, Ella Bradford, a colored woman who worked for Dot King as her maid, and was the one who found her dead in her home. 
During the entire investigation, it comes to light that Dot King was seeing multiple men on the side, including that of wealthy businessman John Kearsley Mitchell III, Frances’ husband. While Frances was busy attempting to bring their social and political careers to the highest they’ve ever been. Mitchell, who went by his alias of Mr. Marshall, was supposedly very good to Dot as well as Ella, giving her money to help after the birth of her son. Julia works tirelessly in order to bring the answers. 
When the investigation is closed, and no murderer is sent to prison for the crime, Inspector Coughlin attempts to bring down the man he suspects as the murderer, a Puerto Rican man named Albert Guimares, down for something. Finding that the man, along with Dot King, were swindling innocent people out of their life savings, and doing so through the U.S. Mail, is able to get him for 3 years. 
The crime is pegged all the way down to the White House. Julia’s life is threatened continuously, even going so far as a physical attack, but she never lets up. When a mysterious blonde woman comes forth 6 years after the expose Julia wrote concludes, with information on the crime she had kept hidden, and then mysteriously dies from a fall from a balcony, and died, Julia puts it together that the man she had been seeing, along with Guimares and Mitchell were all involved in the death of Dot King, and nothing will ever come to the truth. 
This was a free book given to me by Amazon First Reads. It took me five long days in order to get through it, and while it was interesting, it definitely wasn’t my cup of tea. I do love a good historical fiction, but the book made it sound like this story was a nationwide breaking story - but I had never heard of the Broadway Butterfly before picking up this book. I attempted to look up information on the Internet, but there wasn’t much, nothing official anyway. I did find a Wikipedia page for Julia Harpman’s husband, Westbrook Pegler, who was a world-renowned reporter. But otherwise, nothing much to note.

Planets in Retrograde

So I saw this post on facebook and I thought about something I have noticed.
I have been reading tarot cards professionally for about a month now, and I allow my clients to choose from the different decks I have. And no matter what deck I use, for the past month I have noticed certain cards coming up for multiple people. In my last post I talked a little bit about The 3 of Wands. But I have also noticed The 4 of Swords, The Wheel of Fortune, Death, The Star, and The World come up for multiple people. 
Briefly, when a planet enters into retrograde, it just means that from the Earth’s perspective, the planets seem to be moving backward. And this year we have Mercury (usually about 3 times a year), Mars, Jupiter, Saturn, Uranus, Neptune, and Pluto (dwarf but still counts).
Looking at “The Ultimate Guide to Tarot” and this article written by Sara Coughlin , I saw some interesting connections. In the guide, they note planetary or zodiac associations with each card. 
The Wheel of Fortune & The 4 of Swords - Jupiter - Coughlin says this is a time of uncertainty. The Wheel of Fortune I have pulled both upright and reversed for people; so this suggests that it the good and bad luck of the card will come from unknown places. So basically get ready for a whole bunch of surprises. The 4 of Swords suggests a time of reflection and rest. This tells me to go with the flow, which considering planetary influences, I don’t think we have much of a choice but to do so.
Death & The 3 of Wands - Mars - Mars is telling us not to act impulsively. That connects too well with The 3 of Wands, however it is interesting to see Death associated with this too, as it suggests that there could be serious consequences for these impulsive actions. Note, the consequence isn’t death, but maybe rethink cursing out a supervisor as to not lose your job.
Death - Pluto - Death in the Ultimate Guide is associated with Scorpio, ruled by Mars and Pluto. Pluto is telling us to reevaluate our relationship with power. Considering how I also have drawn The Chariot for multiple people, it seems like there is going to be a lot of concern regarding power and control. Not just in our personal lives, but look at our societies and politics. 
The Star - Uranus - Uranus urges us to look within and to make changes. This is huge for me personally, as I have been on my journey of self-discovery and improvement for about 10 years now. And when ever I feel there is not much more I can do, I surprise myself. I think this is a sign for all of us to look within, and to know we have the power to make our dreams a reality.
The World - Saturn - Coughlin writes that this is telling us we need to work on restructuring our lives in order to achieve our long term goals. This also works too well not only with The World card, but also the other cards I have been seeing a lot lately.
I also feel like now is a time of rebirth. I have noticed big changes in my life and in myself this year alone and I know others are feeling it too. And it looks like the cards have also been trying to tell us.

How Your Sign Survives Mercury Retrograde SARA COUGHLIN MARCH 21, 2018, 10:30 AM PHOTOGRAPHED BY ROCHELLE BROCK. Mercury, everyone's favorite agent of chaos, will enter retrograde tomorrow, March 22. But, before you bury your head in the sand until it turns direct on April 15, you might not be in for all the inconveniences we're always warned about. According Leslie McGuirk , astrologer and author of The Power Of Mercury, every sign copes with Mercury retrograde differently — and, we promise, all 12 of them stand a chance at survival. "Can you imagine if every time it rained, everyone freaked out?" McGuirk says, alluding to the fact that Mercury retrograde is a perfectly natural cosmic pattern. "All it means is you have the chance to just be a little bit more careful and little bit slower," she adds. In other words, it isn't inherently good or bad, but some signs handle these periods with a little more, er, grace than others. ADVERTISEMENT One way to tell how a sign will cope with Mercury retrograde is to consider its symbol, McGuirk says. For example, Sagittarius, represented by the Archer or the Centaur, is heavily associated with forward movement. Mercury appears to be moving backward when it enters retrograde, so this sign may struggle with the sensation of delayed — or even reversed — movement. By that same token, a sign like Pisces, which is symbolized by the Fish, may have an easier time, since fish can swim in all directions, McGuirk explains. Regardless of your sign, "look at this time as a blessing," McGuirk says. Even if you have to work through some initial frustrations — or a uniquely retrograde-induced trash fire in your personal life — having to slow down can be a good thing. Take it as an opportunity to unplug and perform the self-care you always think you're too busy to do. And, if nothing else, keep in mind that Mercury retrograde periods only last about three weeks. Aries "Patient," "easygoing," and "meticulous" are just about the last words that come to mind when we think of you. In reality, your firebrand personality makes you predisposed to struggle with Mercury retrogrades, Aries. "They don’t like to feel as if they’re not driving the vehicle," McGuirk says. "During Mercury retrograde, we all have to realize that we have to sit in the back sometimes." It might not be fun, but it'll be valuable to spend this period reexamining your relationship with control. Sure, you might want to call all the shots, but do you need to in every situation? Sitting back and enjoying the ride can be pretty pleasant now and then. 2 OF 12 ILLUSTRATED BY MALLORY HEYER. Taurus Feeling prepared is the name of the game for you, Bull. "Taurus people like to have instructions," McGuirk explains. "They can plod along better than anybody, as long as there’s a practical understanding of what to do." Of course, there are no hard and fast rules you should follow during a retrograde, but you'll make a smoother transition if you already know you may have to take your work and decisions at a slower pace than usual. McGuirk adds that these periods can be actually pretty rewarding if you're willing to lean into your sign's predisposition for sentimentality (retrogrades can bring up the past). Gemini As you might already know, Mercury's your ruling planet, Gem — and you're so accustomed to its quirks and movements that you can usually take its retrogrades in stride. Thanks to your ruling element, air, you aren't afraid of sudden change and like to think on your feet. If anything, McGuirk says, you'll take the little communication glitches and timing setbacks of Mercury retrograde as a fun challenge. 4 OF 12 ILLUSTRATED BY MALLORY HEYER. Cancer Your shell is your friend during Mercury retrogrades, dear Crab. It's not a sign of weakness to retreat to your comfort zone if doing so means you save yourself from the needless stress that often accompanies these periods. McGuirk stresses that, as one of the Zodiac's more emotional signs, you might find it helpful to spend these three weeks in a familiar, homey setting. Having the chance to check in with yourself without any outside distractions is always beneficial to pensive Cancers, she says. 5 OF 12 ILLUSTRATED BY MALLORY HEYER. Leo Let your regal side show, Leo. It's going to be your ace in the hole during Mercury's backspin. Not only will harnessing your sign's natural nobility help you keep your head high despite any faux pas you must endure, it'll also motivate you to help others who might struggle during retrograde periods. "They have that ability to hold space for other people," McGuirk says of Leos. "They know that it will all be okay and they don’t let [Mercury] get under their skin." Virgo Along with Gemini, you have a stronger bond with Mercury than most signs, Virgo. When it's direct, it imbues you with your signature wit and curiosity. When it enters retrograde, it gives you a free pass to relax for a little while — seriously. Your detail-oriented sign is known to sweat the small stuff, especially when you feel responsible for an error, but Mercury retrograde is your regularly scheduled reminder that you aren't expected to be perfect. Libra You're the sign of harmony and symmetry, Libra — your worldview is pretty, but it might be in for an upset during Mercury retrograde. If you're feeling totally out of balance, don't stress: You're still an air sign, Libra, and harnessing that aspect of your sign will help you go with the flow, at least until Mercury is direct once again. Your ruling planet, Pluto, represents the unknown and deep transformation, but that doesn't mean you're always willing to accept major changes. The kind of internal excavation that Mercury retrograde can ask of us takes time, and a Scorpio who feels like they're being rushed is a Scorpio who's going to lash out at the first person who looks at them wrong. Sagittarius If you were to ask us what the Sagittarian family motto was, we'd guess "Forward, ho!" Your freedom-loving sign hates feeling confined to one place, time, or frame of mind. In other words, you're downright allergic to the "stuck" feeling that usually accompanies Mercury retrograde. McGuirk's advice to you is simple: "Chill out." You can find comfort in moving slowly, Sag, even if that means delayed flights and banal conversations. We know how much you value forward momentum and success, Cap, but you place nearly as high a premium on never making the same mistake twice. Aquarius When the going gets weird, the weird get going — and no one knows this better than Aquarius, the tinkerer and bohemian of the Zodiac. Consider your past projects and work from a different perspective — it just might spark a whole new set of ideas. Dr. Filomena “Mena” C. Costantino-Covert

Dr. Filomena C. Costantino-Covert (Mena), 53, of Shavertown, passed away unexpectedly on August 1, 2020 at home. She was preceded in death by her husband, Joseph Covert, who passed away on August 12, 2019; and her parents Saverio and Eugenia Costantino.
She is survived by her son Joshua; her stepson Eric Covert, wife Chrissy, and their daughter Ava Ann, Mountain Top; her sister Teresa Belles, Hanover Twp.; her brother Patrick Costantino, Wilkes-Barre; her goddaughter/niece Sara Belles, Hanover Twp.; and aunts, uncles and cousins.  
Filomena was born and raised in Wilkes-Barre. She graduated from Bishop Hoban High School in 1984; earned a B.S. from Bloomsburg University; earned a M.S. from Marywood University; and earned her Doctor of Education from Temple University in 2008.
Filomena was inspired by educating others. She taught in the math department of Bishop Hafey High School, Hazleton; Bishop Hoban High School, Wilkes-Barre; Plains Jr. High School, Plains; James Coughlin High School, Wilkes-Barre. After teaching for several years, she became the Director of Curriculum at the Luzerne County Intermediate Unit.
Friends may call from 5 to 8 pm Thursday, at Hugh B. Hughes & Son, Inc., 1044 Wyoming Ave., Forty Fort. Due to the ongoing pandemic, restrictions have been put in place by the CDC and the Pennsylvania Department of Health. Those attending the visitation at the funeral home or the funeral mass, please follow the practice of social distancing and masks are required.
A private mass will be held on Friday, at St. Aloysius at St. Robert Bellarmine Church, Wilkes-Barre, PA. The interment will be held at St. Mary’s Cemetery, Swoyersville, following the funeral mass.

Welcome to Poetry Friday, the visual edition!  Do you recognize the photographed pieces above? 
My exploration of grief began with the words that became the title of this poem, which led me to the familiar monopoly game piece.  I thought about incorporating one of the tokens in my poem (wheelbarrow), but decided to cut the stanza out.   
Grief is a house on a cul-de-sac

There is no monopoly
on sorrow.
Its properties are diverse.

A double bind,
misfortune
casts a bittersweet shadow.

The stanza I ended up cutting was:
Grief is carried in the heart:
(a heavy load
                in a wheelbarrow).
I left the wheelbarrow token in my photographs, though, as it brings to mind the stanza I cut and symbolizes how grief can feel.

Failures To Disclose And Update In Bar Admission Leads To Proposed Severe Sanction
District of Columbia Hearing Committee No. Six has issued a report in a case that began in 2009 and was heard in 2015. 
This consolidated case arises out of two separate disciplinary matters involving Respondent Scott Adkins. The first matter (Bar Docket No. 2009-D362) arises out of Respondent’s alleged misrepresentation on his 2006 D.C. Bar application and the 2008 Supplemental Questionnaire he completed prior to taking the oath of admission. Disciplinary Counsel alleged that Respondent failed to fully disclose and/or failed to update information relating to his academic discipline, civil actions in which he was involved, his criminal history, disciplinary history, employment history and past due debts.  The second matter (Bar Docket No. 2013- D117) is a three-count Specification arising out of Respondent’s alleged hit and-run while driving under the influence in Florida in 2009. Respondent was charged by the Florida authorities with multiple violations of Florida law and pleaded guilty to reckless driving (in violation of Fla. Stat. §316.1925(1)) and failing to stop and remain at the scene of an accident (in violation of Fla. Stat. §316.027(2)(a)). In particular, Disciplinary Counsel alleges that, during the disciplinary investigation, Respondent sent an email to Disciplinary Counsel that contained misrepresentations about the incident.
The attorney was also admitted in Delaware and Florida. 
The hearing
Hearing Committee Six (Andrea L. Berlowe, Esquire, Chair; Sara K. Blumenthal, Public Member; and, Dwaune L. Dupree, Esquire, Attorney Member) held an evidentiary hearing on July 6-8, 2015
Findings
the Hearing Committee finds clear and convincing evidence of violations of Rules 8.1(a), 8.1(b), 8.4(b), 8.4(c), and 8.4(d) charged by Disciplinary Counsel. Upon examination of aggravating and mitigating factors, however, the Hearing Committee recommends that Respondent be suspended for three years with a fitness requirement.
Disciplinary Counsel sought disbarment.
His answer to the question of termination from prior employment
Respondent correctly responded “yes” to Question 8, and stated that he had been terminated from his position at Lerach Coughlin in March 2005. BX B1 at 19. In doing so, Respondent stated that a “profound difference of philosophies led to [a] rift, and ultimately, [his] termination” from that position. Id. However, in his June 2009 application for admission to the Florida Bar (the “FLA Application,” discussed in ¶ 70, below), Respondent stated that he was “terminated after missing the second day of the February 2005 Bar Exam . . ..” BX B4 at 18; BX B4 at 38. Additionally, before being admitted to the D.C. Bar, Respondent did not timely update his D.C. Application to reflect that he had been terminated or suspended from three additional employers. See ¶¶ 23-35.
As to complaints against him
At the time he submitted his D.C. Application, Respondent correctly answered “No.” Id. But, while his D.C. Application was pending, he failed to update the COA regarding an investigation by the DE ODC into his November 2006 arrest for the criminal misdemeanor traffic offenses of Driving While Under the Influence (DUI) and Reckless Driving (the “First DUI Incident”). See ¶¶ 36-61.
He failed to disclose five civil actions and a number of debts.
He was admitted after a series of supplemental disclosures
on April 14, 2008, Respondent took the oath of admission to become a member of the D.C. Bar and submitted his Supplemental Questionnaire to the COA without disclosing his criminal misdemeanor convictions of DUI and reckless driving.
He then sought admission in Florida.
As part of D.C. admission
In early August 2009, Respondent attended a mandatory Disciplinary Counsel lecture on legal ethics in Washington, D.C. Tr., Vol. I, pp. 22-24. Respondent testified at the hearing that, during the lecture, he realized he had failed to report the First DUI Incident and the ensuing DE ODC investigation to the COA, as required.
Thus, on August 14, 2009, Respondent wrote a letter to Disciplinary Counsel in which he reported his failure to disclose the First DUI Incident and the ensuing DE ODC investigation (the “First Self-Report”). BX A10; BX E7.8 Respondent also informed the Delaware Bar of his First DUI Incident around that time.
As that process unfolded
On the evening of December 5, 2009, Respondent “relapsed” and stopped at a bar named Jester’s near Pompano Beach, Florida. Tr. 288; Tr. 404 (“self-medicated”). Respondent testified that he was drinking at Jester’s for “at least like two hours, maybe more.” Tr. 405; Tr. 406 (describing Jester’s as “the gin mill I was at”)...
While driving his car, a white 2006 Chrysler 300 sedan, Respondent rear-ended another vehicle, a black Mercedes.
As a result
On June 17, 2011, Respondent pleaded no contest to, and was adjudicated guilty of, reckless driving and failing to stop and remain at the scene of an accident.
In Delaware
On June 5, 2013, after conducting an investigation into the Second DUI Incident, DE ODC determined that there was probable cause that Respondent violated certain Delaware Lawyers’ Rules of Professional Conduct. BX E34. Instead of filing a petition with the Delaware Board of Professional Responsibility, however, DE ODC recommended that Respondent accept the sanction of a private admonition and probation with conditions, including random urinalysis tests (the “2013 Delaware Sanction”). 
He made false statements to D.C. ODC in reporting on the incident
Respondent’s e-mail falsely stated that, prior to the collision, there “were no cars to my front,” but then “all of a sudden, in my travel lane, a black Mercedes that was stopped in the travel lane with no lights on hit her brakes.”  Respondent’s representations were inconsistent with the accident report, and ignored the significant impairment he experienced at the time from his consumption of alcohol and his failure to wear eyeglasses or corrective lenses when the collision occurred. 
Respondent also falsely represented to Disciplinary Counsel that, after the collision, he was assaulted by a young man who threw an object at his car, causing significant injury to Respondent and putting him in fear for his safety...
Respondent also falsely represented to Disciplinary Counsel that he “chose” to leave the scene of the collision in order to “go to the nearest police station,” to report the assault purportedly committed by the passenger of the black Mercedes, but he was pulled over by the police on his “way to the nearest police station.” BX E6. Respondent repeated these statements in the Delaware proceeding, BX E 33 at 94 (“That’s why I left the scene”), and in his testimony before the Hearing Committee. 
To top it off
In sum, Respondent’s testimony surrounding the Second DUI Incident was not credible and, ultimately, whether he truthfully recounted the facts or not is irrelevant to the question of whether he failed to disclose the incident to the COA prior to taking the oath of admission, as required by the Supplemental Questionnaire and his continuing duty to supplement his D.C. Application. His testimony about the incident also never revealed, and is not relevant to, whether, following admission, he violated his duty to disclose the Second DUI Incident to the D.C. Court of Appeals, as required by D.C. Bar R. XI, §10.
The committee found that the misconduct was knowing, rejecting his claim of negligence.
As to delay
Respondent argues he was unable to submit favorable evidence and testimony regarding his arrest and conviction for the Second DUI Incident that he might have submitted had Disciplinary Counsel moved with greater alacrity to bring charges against him stemming from that incident. Specifically, Respondent claims that his now-deceased lawyer had evidence supporting his version of events, but, due to Disciplinary Counsel’s multi-year delay in bringing charges, that evidence “disappeared when [his attorney] passed away.” Tr. Vol. II, pp. 410:18-411:7. Respondent also asserts that his now-deceased mother could have supported his version of events because, though she was not present during the collision, she saw, among other things, the damage to his car afterwards. Considering all the evidence presented and the applicable law, the Hearing Committee rejects Respondent’s allegations.
As to sanction
Here, Respondent’s misconduct entails far more than omitting minor facts from his D.C. Application. Respondent’s omissions include failing to disclose: civil actions to which he was a party, including those in which he was the plaintiff; a disciplinary investigation by the Delaware Bar; several unpaid debts; professional employment from which he was terminated, at least one of which was for false and misleading conduct; and a criminal arrest and conviction. Consequently, his conduct warrants a more serious sanction than merely a brief suspension with a fitness requirement...
Respondent often was argumentative toward Disciplinary Counsel and appeared to have difficulty controlling his temper during the hearing. The Hearing Committee had to intervene when he frequently veered from relevant discussion topics.
Alcoholism did not cause the misconduct.
Ultimately
we recommend that Respondent be suspended for a period of three years for his pervasive dishonesty in the admissions process and his false testimony before this Hearing Committee. Although it is a close question, we do not find by clear and convincing evidence that Respondent engaged in “flagrant dishonesty” warranting disbarment.
Disciplinary Counsel may well challenge that conclusion on appeal. 
A concurring opinion of Dwaune Dupree
I concur in the recommended sanction included in the Recommendation of Hearing Committee Number Six (the “Report”), and write separately for two major reasons. First, I believe that the Report fails to contextualize certain facts relating to Respondent’s behavior, and does not appropriately weigh either Respondent’s addiction or his self reporting as mitigating evidence. Without providing the appropriate context, I am concerned that the Hearing Committee’s recommended sanction appears unduly lenient. Considering the facts in light of the clarifying discussion below, I find that the recommended sanction is not unduly lenient. Second, I write to highlight the important policy implications of this case. While the Board on Professional Responsibility and District of Columbia Court of Appeals ultimately are responsible for making policy decisions, I believe that the District of Columbia should adopt a policy that encourages lawyers to voluntarily report their misconduct...
The record shows that Respondent’s addiction was so serious that, for several years, he could barely hold a job, had severe financial problems, and it resulted in him being arrested for a misdemeanor crime. Based on this, I find it completely credible that Respondent would not be particularly focused on updating various changes to his Bar application, including his failures to disclose additional lawsuits (Report, ¶¶ 10a-10e), additional past due debts (Report, ¶¶ 15-16), and his terminations from three employers (Report, ¶¶ 6-7).30 While Respondent clearly had a duty to update his application, I believe that the serious challenges that he faced during that time provide some mitigation of his failure to do so.

“Is SafeSport cleaning up the sport? I’d have to say my answer, generally speaking, is yes,” said Craig Maurizi, a longtime coach and the director of figure skating at the Ice House training center in Hackensack, N.J., said on Sunday. “I think the mechanism is making people think twice before they act.” At the same time, Maurizi criticized SafeSport for the manner in which it was adjudicating a high-profile case involving him that has been going on for two decades.
In 1999, in an investigative report in The New York Times, (Craig) Maurizi accused a former coaching colleague, Richard Callaghan, of engaging in inappropriate sexual conduct with Maurizi when Maurizi was 15 and a skating student of Callaghan’s. Later, Maurizi said, Callaghan abused his position of authority to initiate a full sexual relationship when Maurizi was 18 that lasted, on and off, for years.
Callaghan, who with Maurizi assisting, coached Tara Lipinski to an Olympic gold medal in 1998, vehemently denied in the Times story that he had ever had sex with Maurizi or that he had engaged in improper behavior.
Maurizi filed a complaint with U.S. Figure Skating in 1999, but it was dismissed because it had not been filed within the required 60 days of the alleged improper conduct. On Jan. 31, 2018, Maurizi refiled his grievance, this time with SafeSport, which gave Callaghan a provisional suspension in March 2018. At the time of the suspension, Callaghan told ABC News: “That’s 19 or 20 years ago. I have nothing to say.’’ Meanwhile, it is now nearly a year after Maurizi’s complaint was resubmitted, but the case has yet to be fully resolved.
“Are they dragging their feet?” Maurizi said of SafeSport. “Absolutely.” SafeSport says it resolves cases as quickly as possible, but acknowledges a backlog from being underfunded and understaffed. A three-year grant from the Justice Department, worth $2.2 million, is intended for education and prevention programs and cannot be used to reduce the case backlog or hire investigators, Hill said.
