"The Yurok will be the first Tribal nation to co-manage land with the National Park Service under a historic memorandum of understanding signed on Tuesday [March 19, 2024] by the tribe, Redwood national and state parks, and the non-profit Save the Redwoods League, according to news reports.

The Yurok tribe has seen a wave of successes in recent years, successfully campaigning for the removal of a series of dams on the Klamath River, where salmon once ran up to their territory, and with the signing of a new memorandum of understanding, the Yurok are set to reclaim more of what was theirs.

Save the Redwoods League bought a property containing these remarkable trees in 2013, and began working with the tribe to restore it, planting 50,000 native plants in the process. The location was within lands the Yurok once owned but were taken during the Gold Rush period.

Centuries passed, and by the time it was purchased it had been used as a lumber operation for 50 years, and the nearby Prairie Creek where the Yurok once harvested salmon had been buried.

Currently located on the fringe of Redwoods National and State Parks which receive over 1 million visitors every year and is a UNESCO Natural Heritage Site, the property has been renamed ‘O Rew, a Yurok word for the area.

“Today we acknowledge and celebrate the opportunity to return Indigenous guardianship to ‘O Rew and reimagine how millions of visitors from around the world experience the redwoods,” said Sam Hodder, president and CEO of Save the Redwoods League.

Having restored Prarie Creek and filled it with chinook and coho salmon, red-legged frogs, northwestern salamanders, waterfowl, and other species, the tribe has said they will build a traditional village site to showcase their culture, including redwood-plank huts, a sweat house, and a museum to contain many of the tribal artifacts they’ve recovered from museum collections.

Believing the giant trees sacred, they only use fallen trees to build their lodges.

“As the original stewards of this land, we look forward to working together with the Redwood national and state parks to manage it,” said Rosie Clayburn, the tribe’s cultural resources director.

It will add an additional mile of trails to the park system, and connect them with popular redwood groves as well as new interactive exhibits.

“This is a first-of-its-kind arrangement, where Tribal land is co-stewarded with a national park as its gateway to millions of visitors. This action will deepen the relationship between Tribes and the National Park Service,” said Redwoods National Park Superintendent Steve Mietz, adding that it would “heal the land while healing the relationships among all the people who inhabit this magnificent forest.”"

I'm serious when I say the United States is actively hostile to children. Constant school shootings our leaders refuse to do anything about. Child Protective Services that overwhelmingly do nothing of the sort. No healthcare. Our education system is abysmal. Very few areas in the public that are safe for children to be in. Large swaths of states making gender affirming care for trans kids a felony. Child marriages are legal in a lot of states. Treating kids like property parents have every right to do whatever they want to, to the point where the U.S. is one of the very few countries that refused to ratify the U.N.'s Convention On The Rights Of The Child explicitly on the basis that treating children like people erodes the rights of American parents. And now states are enacting laws that overturn child labor laws like it's the goddamn Victorian Age. And even before those laws were made, it turns out that migrant children have been working in factories for a lot of companies, including the supposedly socially-minded Ben and Jerry's.

As complicated as adult life is, I would never want to be a kid again, with no say or agency in my life and completely helpless to the whims of the adults around me.

This is a big deal. No, $48,692.05 is in no way, shape or form a fair price for the many thousands of acres of traditional Chinook land that were never ceded but were taken by settlers anyway. However, the fact that this funding from the 1970 Indian Claims Commission settlement is being released to the tribe is the strongest move toward regaining recognition in years.

As a bit of background, the Chinook Indian Nation are some of the descendants of many indigenous communities who have lived in the Columbia-Pacific region and along the Columbia to the modern-day Dalles since time immemorial. They saw the arrival of the Lewis & Clark party to the Pacific Ocean in 1805, but shortly thereafter were devastated by waves of diseases like malaria and smallpox. The survivors signed a treaty to give up most of their land in 1851, but it was never ratified by the United States government. While some Chinookan people are currently part of federally recognized tribes such as the Yakama Nation, the Confederated Tribes of the Warm Springs Reservation, and the Confederated Tribes of the Grand Ronde Reservation, the Chinook Indian Nation--comprised of the Lower Chinook, Clatsop, Cathlamet, Willapa, and Wahkiakum--have remained largely unrecognized.

That changed briefly in 2001. On January 3 of that year, the Department of the Interior under the Clinton administration formally recognized the Chinook Indian Nation. In July 2002, the Bush administration revoked the federal recognition after complaints from the Quinault Indian Nation, as the Chinook would have had access to certain areas of what is now the Quinault reservation. This meant that the Chinook, once again, were denied funding and other resources given to federally recognized tribes, to include crucial healthcare funding during the COVID-19 pandemic.

The Chinook Indian Nation has been fighting legal battles to regain federal recognition ever since the revocation. The funding released to them in this month's court decision doesn't make them federally recognized, but it is a show of legitimacy in a tangled, opaque system that indigenous people across the United States have had to contend with for many decades. Here's hoping this is a crack in the wall keeping the Chinook from recognition, and that they get more good news soon.

It's kinda shocking to me how few people seem to know how prevalent the 'my great grandmother was cherokee' myth is and how it's almost never actually true, especially when it comes with things like 'never signed up' or 'fell off the trail' or 'courthouse burned down destorying the documentation' etc etc.

People just don't even seem to know the history like.. when the Trail happened. My great great great grandfather was 2 years old during Removal in 1838, so peoples 'my great grandmother hid in the mountains!' is so clearly wrong. And we have rolls. From before and after removal, rolls done by cherokee nation and others by the government, rolls that were not stored in one random flammable courthouse. It's not difficult to find the actual evidence of ancestry.

And just.. there are lots of ways those family stories get started. It was a practice during the confederacy to claim cherokee ancestry to show one's family had 'deep roots in the south' that they were there before the cherokee were removed. Many people pretended to be cherokee and applied for the Guion-Miller payout just to try to steal money meant for cherokees - 2/3rds of the applicants were denied for having 0 proof of actual cherokee ancestry. [We even see lawyers advertising signing up for the Miller roll just to try to get free money.] And the myth even started in some families in the cherokee land lotteries, where the land stolen from us was raffled off, including the house and everything that was left behind when the cherokees were removed. We have seen people whose families just take these things stolen from the cherokee family and adopt them into their own family story, saying that they were cherokee themselves.

If you had some family story about being cherokee and you wanna have proof one way or the other, check out this Facebook group run by expert cherokee genealogists that do research for free. Just please read the rules fully and respect the researchers. They run thousands of people's ancestries a year and their average is only around 0.7% of lines they run actually end up having true cherokee ancestry.

Federal regulators on Tuesday [April 23, 2024] enacted a nationwide ban on new noncompete agreements, which keep millions of Americans — from minimum-wage earners to CEOs — from switching jobs within their industries.

The Federal Trade Commission on Tuesday afternoon voted 3-to-2 to approve the new rule, which will ban noncompetes for all workers when the regulations take effect in 120 days [So, the ban starts in early September, 2024!]. For senior executives, existing noncompetes can remain in force. For all other employees, existing noncompetes are not enforceable.

[That's right: if you're currently under a noncompete agreement, it's completely invalid as of September 2024! You're free!!]

The antitrust and consumer protection agency heard from thousands of people who said they had been harmed by noncompetes, illustrating how the agreements are "robbing people of their economic liberty," FTC Chair Lina Khan said.

The FTC commissioners voted along party lines, with its two Republicans arguing the agency lacked the jurisdiction to enact the rule and that such moves should be made in Congress...

Why it matters

The new rule could impact tens of millions of workers, said Heidi Shierholz, a labor economist and president of the Economic Policy Institute, a left-leaning think tank.

"For nonunion workers, the only leverage they have is their ability to quit their job," Shierholz told CBS MoneyWatch. "Noncompetes don't just stop you from taking a job — they stop you from starting your own business."

Since proposing the new rule, the FTC has received more than 26,000 public comments on the regulations. The final rule adopted "would generally prevent most employers from using noncompete clauses," the FTC said in a statement.

The agency's action comes more than two years after President Biden directed the agency to "curtail the unfair use" of noncompetes, under which employees effectively sign away future work opportunities in their industry as a condition of keeping their current job. The president's executive order urged the FTC to target such labor restrictions and others that improperly constrain employees from seeking work.

"The freedom to change jobs is core to economic liberty and to a competitive, thriving economy," Khan said in a statement making the case for axing noncompetes. "Noncompetes block workers from freely switching jobs, depriving them of higher wages and better working conditions, and depriving businesses of a talent pool that they need to build and expand."

Real-life consequences

In laying out its rationale for banishing noncompetes from the labor landscape, the FTC offered real-life examples of how the agreements can hurt workers.

In one case, a single father earned about $11 an hour as a security guard for a Florida firm, but resigned a few weeks after taking the job when his child care fell through. Months later, he took a job as a security guard at a bank, making nearly $15 an hour. But the bank terminated his employment after receiving a letter from the man's prior employer stating he had signed a two-year noncompete.

In another example, a factory manager at a textile company saw his paycheck dry up after the 2008 financial crisis. A rival textile company offered him a better job and a big raise, but his noncompete blocked him from taking it, according to the FTC. A subsequent legal battle took three years, wiping out his savings.

In fact, one in six food and service workers are bound by noncompete agreements. That's right - one in six food workers can't leave Burger Kings to work for Wendy's [hypothetical example], in the name of "trade secrets." (x, x, x)
