Sometimes indian supreme court wins my heart like thank you for not being completely terrifying. Thank you for extending decency to unmarrid and single women. Thank you for protecting their rights. Thank you for not being like us sc in this case. Thank you for giving me happy tears first thing in the morning.

“On September 29, the Indian Supreme Court delivered a crucial decision which holds the promise of actually leading to the reproductive autonomy of Indian women, in particular through access to abortion.
While the core issue before the court was whether unmarried women could seek an abortion under the law – the judges confirmed that they can – the decision also spoke to a range of deeper concerns about abortion and women’s rights over their bodies. It could potentially even pave the way for the criminalisation of marital rape, which, at the moment, is not punishable in India....
India’s apex court in its recent decision has put women’s personal liberty and dignity at the heart of abortion rights. It has rejected the stereotype that sexuality is confined to marriage or that a woman loses her agency over her body after marriage, while recognising the wider political, social and economic structures that constrain her status in society and families. The court has cemented the woman’s place as – in the judges’ own words – the “ultimate” decision-maker on abortion.
Crucially, the court has also gone beyond just asking the state to stay out of the way of a woman’s rights. Instead, it has made clear that the state is responsible for proactively eliminating barriers to abortion access. 🇮🇳 🚨 INDIAN SUPREME COURT UPHOLDS DECISION TO REMOVE THE SPECIAL STATUS OF JAMMU AND KASHMIR
In a landmark ruling, India's Supreme Court on Monday upheld the Government's decision to abrogate Article 370 of the Indian Constitution in 2019.
The decision restores the statehood of the Union Territory of Jammu and Kashmir, and directs the Election Commission of India (ECI) to conduct legislative elections by September 30th, 2024.

I know I already made a post about this. But ICWA is LITERALLY being challenged by a white couple that wants to adopt indigenous children to erase their culture and Christianize them. The tribe, whom has a say in who can take their children, is like "Nah, we don't want our youth Christianized like you tride last time"
And the lawyer that's helping the white couple try to overturn ICWA (so that they can erase the cultures of indigenous children) is doing it pro-bono (which means he's not charging the couple anything).
AND that lawyer is a big time lawyer whose clients are usually oil and gas industries. He's literally fighting for indigenous children to be ripped from their tribes and culture so there's less indigenous people to protest big oil destroying their sacred land.

Good to see this trending even though I have no idea why suddenly today but—
A historic debate on marriage equality and legalising same-sex marriage is underway in the Supreme Court of India. The Union govt. is against it of course but the SC judges and the lawyers representing the petitioners are very progressive. The recordings of the live hearings are up on youtube and worth watching because the arguments in favor are just ✨chef's kiss✨ The verdict is yet to be out but I'm really hopeful. Anxious but hopeful. So far the CJI's statements point to a positive outcome for the queer community but let's wait and watch. It's gonna be epic🌈

hey there, i was wondering if you knew anything about when the scotus will actually review the ICWA, like what date? i keep looking it up to try and find out oabout protests happening beforehand, but ican't find anything, no date, no protests, and i'm trying to findw ways to help but so far i haven't really been able to find anything, could you perhaps point me to more information on this? i really want to help but so far i can't find many ways to help, much information on it other than tumblr posts, i've watched a few videos and signed a few petitions but i want to help more so if you know of any ways, it would be really appreciated! if not, then that's fine too and i hope you have a nice day.
October itll be up for review, there is no specific date atm. And a decision will likely be made in 2023 according to another article I read.
There are no protests or anything most likely because this is a native concern which unfortunately means that a Lot people probably have no idea it's happening. Media suppresses us a lot and people generally don't go out of their way to inform themselves about our issues.
So a way you can help is spreading awareness. Tell people.
Get them to understand that this will put all our rights as natives under threat. Housing, food, even our land, etc. You could make graphics or share some that natives made already. Go out of your way to share posts like that on a regular basis so you there's no chance anyone on your feed misses the info.
Mention wanting to protest for it. Hopefully some people will share your posts and organizers will start to take notice.

hey y'all- i just wanted to remind everyone Friday Nov 25th is Native American Heritage Day in the united states, and that
**there is a case in the u.s. supreme court (brackeen-v-haaland) which directly affects the rights of native americans and their tribal sovereignty. **
The Indian Child Welfare Act pushes for Native children to be adopted by Native families. .... When it was passed in 1978, ICWA was landmark legislation, setting unprecedented protections to address the assimilationist policies that led to state child welfare and private adoption agencies systematically removing almost a third of all American Indian and Alaska Native children from their homes. (Yes, almost a third; you read that correctly.) Eighty-five percent of those children were placed in non-Indian homes. ICWA’s constitutionality is now being challenged in a lawsuit [Brackeen v. Haaland] brought by Texas, Indiana, Louisiana and various individual plaintiffs. It is the first time a state has sued the federal government over ICWA’s constitutionality. X

The Indian Child Welfare Act is being reviewed by the SCOTUS this fall. The same SCOTUS that ruled that tribal land was just part of the state and that states had the jurisdiction to prosecute nontribal members who commit crimes on tribal land against tribal members. This reverses previous court decisions and threatens tribal sovereignty.
The ICWA was created because Native American and Alaska Native children were being kidnapped from their parents and either forced into boarding schools or adopted to white families. The act ensures that when Indigenous children need to be placed in foster care, they are placed with extended family members whenever possible, and if that is impossible, with another Indigenous family. That the court who does not believe in tribal sovereignty is reviewing it is horrifying.
The video above is hard to watch. It is heartbreaking. But if you are not convinced that ICWA needs to be defended, I challenge you to watch it.
