#icwa
I know I already made a post about this. But ICWA is LITERALLY being challenged by a white couple that wants to adopt indigenous children to erase their culture and Christianize them. The tribe, whom has a say in who can take their children, is like "Nah, we don't want our youth Christianized like you tride last time"
And the lawyer that's helping the white couple try to overturn ICWA (so that they can erase the cultures of indigenous children) is doing it pro-bono (which means he's not charging the couple anything).
AND that lawyer is a big time lawyer whose clients are usually oil and gas industries. He's literally fighting for indigenous children to be ripped from their tribes and culture so there's less indigenous people to protest big oil destroying their sacred land.

For people who live in the U.S., November can bring to mind a lot of things, and one of them is Thanksgiving. This can be a complicated holiday because while most people just see it as an excuse to get together with friends and family and pig out, we all know that the story of the "First Thanksgiving" is bullshit.
This November, and for as long as it takes, I'm asking you to keep Native American and Alaska Native rights in mind and to fight for them. ICWA, the Indian Child Welfare Act, is at risk.
This act was created to stop cultural genocide. Until the late 1900s, Native American and Alaska Native children were routinely kidnapped and placed in residential schools and white families, where they faced abuse, forced assimilation, and sometimes murder. ICWA was passed in 1978 to stop this by allowing tribes to control the foster and adoption placement of Native American and Alaska Native children.
However, today, the SCOTUS started hearing arguments in a case that could overturn ICWA. This would not only endanger children and allow cultural genocide, but it would endanger tribal sovereignty since it would deny sovereign tribes the rights over the placement of their own children.
This November, this Thanksgiving, and until ICWA has been upheld, I ask you to stand up for the rights of Native Americans and Alaska Natives.
Spread the word about what is happening. Don't let this get swept under the rug. Post about it. Tell your friends and family.
Sign petitions.
Write to representatives.
Reach out to local tribes to see what you can do to help.
Protest.
And if you can afford to do so, donate to Native American and Alaska Native organizations.

The ICWA is not a hypothetical. So many Native people have lost aunts, uncles, cousins, and siblings to the foster system. So many people Native people are disconnected from their cultures and tribes because their parents or grandparents were stolen from their families. So many Native people, even under the ICWA, were removed from their families and placed into foster care.
So many children today, right now, are being removed from their families, tribes, and cultures.
All it takes is one generation to kill a community, to kill a culture. We've lived through this before. We're still living through this now. We know firsthand what it means to lose our children and we know what will happen to us, to our families and our tribes and our cultures and our bonds with each other, if the removal of indigenous children from their families becomes the law of the land again.

Listen up please
This is incredibly important.
The united States government has been trying to remove the protections of native children mainly via possibly overturning the ICWA (Indian Child Welfare Act)
This will allow white families to continue to take native children from their lands their family and their culture just like they did for centuries before the ICWA was passed.
This is both incredibly important and incredibly personal as my family was permanently harmed because of children being taken away from their families.
So please spread awareness about this and I have a link below that you can go to the first Nations website learn more about this and and write a response that they can use about how we should be saving the ICWA

The Indian Child Welfare Act.
Youve hopefully been hearing about how the supreme court will hear the case of Brackeen v Haaland where the validity of ICWA will be decided on November 9th.
Here is a helpful breakdown on why it's so important.

As a native who didn't qualify for tribal protections because of tribal blood quantum laws, when I was separated from my family I wasnt placed with natives. I was placed with homophobic white christians. I'm nearly 30 now and still trying to reconnect with the culture and family I was cut off from.
ICWA fucking matters. We need to protect it. Kids need their family, they need their people. And right now they need you too.

A Native woman committed suicide after her children were taken away by rcmp because she asked for refuge from her abusive relationship. Instead of helping a Native woman flee abuse with her children, they took her babies away.
Note that the video says that Manitoba has some of the highest child apprehensions by child welfare in Canads, 90% of whom are Indigenous, and until 2 years ago they got paid by the amount of apprehensions they do.

The Supreme Court is expected to reach a decision on the attempt up overthrow ICWA in June 2023.
Several states are trying to codify ICWA before it's potentially overturned.
Please reach out to your representatives to express your concern for the protection of ICWA.
(Each state has its own representatives, so you'll have to go in your state legislature website, do a search on which representatives represent you, and email and call them.)
This post has links on more ways you can help.

So my post on Oklahoma making it legal to take indigenous children from their parents without tribal consent is blowing up, and I'm glad people are horrified. But what I need people to know is that this might happen on a national level.
The Supreme Court is debating overturning the Indian Child Welfare Act.
What this act does is give Native American and Alaska Native tribes and nations control over the foster and adoption placement of their children. To overturn it would be to say tribes and nations aren't sovereign, and it would also allow the U.S. government to forcibly assimilate indigenous children into other cultures.
Please:
Spread the word about what is happening.
Read online news articles about this; the more traffic on those articles, the more likely the press is to write more articles.
If there are protests in your area, join them.
If there are indigenous nations or tribes in your area, ask them how you can help.
Donate to indigenous rights organizations like Native American Rights Fund.
Write to your representatives.
If ICWA falls, keep all of the above up. Don't just shrug and think it's over.

If you’re outside the US and want to help, here are ten things you can do to protect ICWA, Indigenous children, and Tribal Sovereignty as a whole.
Share information about ICWA, Brackeen v Haaland, and Tribal Sovereignty
Share information about rallies, protests, and strategy meetings
Share the donation information of organizations that are fighting to protect ICWA
Donate to those organizations to help them continue to fight
Share the stories of Indigenous adoptees, survivors of residential schools, and the families involved in Brackeen v Haaland
Follow @protectICWA on twitter for live updates
Educate yourself on Tribal Sovereignty, residential schools and the 60s scoop, and cultural genocide as a tool of genocide.
Educate yourself on MMIP/MMIWG2S and familiarize yourself with the tactics those against Tribal Sovereignty use to undermine us.
Learn exactly who is fighting to get rid of ICWA and why. Hint: Gibson Dunn (representing the Brackeens) is the same law firm that supported the Dakota Access Pipeline (DAPL) Now I wonder who benefits from slowly but surely removing Indigenous people from our lands? 🤔
Uplift Indigenous voices that are speaking out and speaking up on ALL platforms. Tell your friends, tell your family, and show up to support us if you can. If ICWA is struck down, we will not be going without a fight. Be prepared.
This linktree has tons of information about ICWA, why it is important, what’s at stake, and what you can do to help. Even simply sharing an article link from here to 10 followers that go on to share to their 10 followers can help!

This Thanksgiving, if you’ve ever once in your life claimed Indian heritage, give a couple bucks to NICWA. Im not here to argue with you about whether or not you have NDN heritage, but if you truly do, the reason why you know nothing about it is because of your ancestor being taken away and colonized by the methods the Indian Child Welfare Act protects against. Right now ICWA is under attack by a horrifying court case that threatens to undo all the recent strides we’ve made in tribal sovereignty and NDN cultural preservation by eliminating NDN children.
The court case is called Brackeen v. Haaland and is spearheaded by a literal Oil & Gas lawyer named Matthew McGill that has succeeded in destroying the sovereignty of Tribal lands for pipeline construction and has even tried to disestablish entire reservations for his Big Oil paycheck. Their case is a disgusting attack with no legal merit, but still may pass in their favour because of the greed of our Supreme Court. Here’s the most important snippet from that link.
Tumblr media
Do not let them trick you into thinking this is to protect NDN children. Child abuse is a widespread US problem and the federal and state governments have never handled it with the best interests of children in mind, let alone NDN children. This is why I am offering up a link to NICWA, a program that ACTUALLY intervenes in cases of child abuse among the NDN community, while allowing the child to remain an established member of the tribal nation. This program is led by tribal leaders who know the communities they are operating in intimately, and therefore can actually act on what is best for the child.
If you are concerned about NDN Child welfare, DO NOT support the striking down of ICWA and instead support public programs on tribal lands and tribal child welfare programs like NICWA.

With the Indian Child Welfare Act (ICWA), which has kept Native children from being purposefully removed from Native families into non-Native foster families since 1978, being reevaluated in the US Supreme Court, it is at risk of being greatly weakened and undoing decades of work to stop the systematic erasure of Native cultural identity.
(It may also re-designate the term "Indian" in the bill to mean a racial classification rather than political, reversing precedent with regard to tribal sovereignty. Native tribes must remain independent entities in the law rather than just a race to protect their rights to self-governance.)
The Lakota People's Law Project is asking US citizens to ask their state lawmakers to enact similar legislation at the state level which codifies the rights and protections ICWA gives to Native children should it be weakened in the Supreme Court. This is not protection for the ICWA itself, although they do have action you can take for that on their website as well. In the link is a pre-written email which you can personalize and easily send to your state lawmakers.
Thanks for your time. :)
