A Toronto doctor has been barred from practicing until August after she was found to have sent private medical information to a patient’s former spouse, friends, and daughter over text and Facebook Messenger.

Dr. Elika Safar Zadeh, an endocrinologist at North York General Hospital, has been suspended from practicing for five months, from March 20 to August 20, after admitting to engaging in professional misconduct by sharing a patient’s medical records on multiple occasions with their family and friends, a March finding published by the Ontario Physicians and Surgeons Discipline Tribunal (OPSDT) shows.

The ruling cites an incident in which Safar Zadeh admitted she engaged in professional misconduct after sharing a patient’s medical records three times – in January and April 2019 – with their family and friends.

Paralegals and Confidentiality

Many people (current and potential clients alike) call the law office where I work, and they insist that they'll only speak to the attorney. Current clients will bring or send things to the office and insist that they only want the attorney to see it and no one else. Some potential clients will ask for consultations, but then they refuse to tell me anything about the type of legal issue they're dealing with so I can tell them whether or not our office practices in that area of law.

Honestly, nothing grinds my gears professionally more than someone saying something like, "I'll only deal with the attorney about this." But...even though this sounds rude and snobby, most people saying it don't actually mean it that way. They're usually only saying it because they don't know any better.

Most people have heard of attorney-client privilege. Given the name, most people assume that it means that only the things they say or give directly to the attorney are confidential. That's not actually how attorney-client privilege works though.

Attorney-client privilege also applies to any legal secretaries or paralegals that are working under the supervision of the attorney. Giving information or requested materials to the secretary or paralegal in a law office is the same as giving the information or materials directly to the attorney. Many attorneys even have all paralegals, secretaries, investigators, and sometimes even janitorial staff sign non-disclosure agreements to protect clients' privileged information.

Attorney-client privilege also extends to client files as well. As the paralegal at my office, I have access to every file we have and all the materials inside those files. Even if someone puts something directly into the attorney's hand, I will still have access to it at some point while I'm working in that client's file. More often than not, I'm the person making the file in the first place, drafting the documents my boss files on behalf of the client, responding to case-related emails, calling the Clerk's Office to get any and all documents under a case's docket number, and then scheduling any mediations or hearings. When I do all those things, attorney-client privilege still applies to all the usual aspects of the work, just like if the attorney was doing it all herself.
