“If buying isn’t owning, piracy isn’t stealing”
Tumblr media
20 years ago, I got in a (friendly) public spat with Chris Anderson, who was then the editor in chief of Wired. I'd publicly noted my disappointment with glowing Wired reviews of DRM-encumbered digital devices, prompting Anderson to call me unrealistic for expecting the magazine to condemn gadgets for their DRM:
https://longtail.typepad.com/the_long_tail/2004/12/is_drm_evil.html
I replied in public, telling him that he'd misunderstood. This wasn't an issue of ideological purity – it was about good reviewing practice. Wired was telling readers to buy a product because it had features x, y and z, but at any time in the future, without warning, without recourse, the vendor could switch off any of those features:
https://memex.craphound.com/2004/12/29/cory-responds-to-wired-editor-on-drm/
I proposed that all Wired endorsements for DRM-encumbered products should come with this disclaimer:
WARNING: THIS DEVICE’S FEATURES ARE SUBJECT TO REVOCATION WITHOUT NOTICE, ACCORDING TO TERMS SET OUT IN SECRET NEGOTIATIONS. YOUR INVESTMENT IS CONTINGENT ON THE GOODWILL OF THE WORLD’S MOST PARANOID, TECHNOPHOBIC ENTERTAINMENT EXECS. THIS DEVICE AND DEVICES LIKE IT ARE TYPICALLY USED TO CHARGE YOU FOR THINGS YOU USED TO GET FOR FREE — BE SURE TO FACTOR IN THE PRICE OF BUYING ALL YOUR MEDIA OVER AND OVER AGAIN. AT NO TIME IN HISTORY HAS ANY ENTERTAINMENT COMPANY GOTTEN A SWEET DEAL LIKE THIS FROM THE ELECTRONICS PEOPLE, BUT THIS TIME THEY’RE GETTING A TOTAL WALK. HERE, PUT THIS IN YOUR MOUTH, IT’LL MUFFLE YOUR WHIMPERS.
Wired didn't take me up on this suggestion.
But I was right. The ability to change features, prices, and availability of things you've already paid for is a powerful temptation to corporations. Inkjet printers were always a sleazy business, but once these printers got directly connected to the internet, companies like HP started pushing out "security updates" that modified your printer to make it reject the third-party ink you'd paid for:
https://www.eff.org/deeplinks/2020/11/ink-stained-wretches-battle-soul-digital-freedom-taking-place-inside-your-printer
Now, this scam wouldn't work if you could just put things back the way they were before the "update," which is where the DRM comes in. A thicket of IP laws make reverse-engineering DRM-encumbered products into a felony. Combine always-on network access with indiscriminate criminalization of user modification, and the enshittification will follow, as surely as night follows day.
This is the root of all the right to repair shenanigans. Sure, companies withhold access to diagnostic codes and parts, but codes can be extracted and parts can be cloned. The real teeth in blocking repair comes from the law, not the tech. The company that makes McDonald's wildly unreliable McFlurry machines makes a fortune charging franchisees to fix these eternally broken appliances. When a third party threatened this racket by reverse-engineering the DRM that blocked independent repair, they got buried in legal threats:
https://pluralistic.net/2021/04/20/euthanize-rentier-enablers/#cold-war
Everybody loves this racket. In Poland, a team of security researchers at the OhMyHack conference just presented their teardown of the anti-repair features in NEWAG Impuls locomotives. NEWAG boobytrapped their trains to try and detect if they've been independently serviced, and to respond to any unauthorized repairs by bricking themselves:
https://mamot.fr/@[email protected]/111528162905209453
Poland is part of the EU, meaning that they are required to uphold the provisions of the 2001 EU Copyright Directive, including Article 6, which bans this kind of reverse-engineering. The researchers are planning to present their work again at the Chaos Communications Congress in Hamburg this month – Germany is also a party to the EUCD. The threat to researchers from presenting this work is real – but so is the threat to conferences that host them:
https://www.cnet.com/tech/services-and-software/researchers-face-legal-threats-over-sdmi-hack/
20 years ago, Chris Anderson told me that it was unrealistic to expect tech companies to refuse demands for DRM from the entertainment companies whose media they hoped to play. My argument – then and now – was that any tech company that sells you a gadget that can have its features revoked is defrauding you. You're paying for x, y and z – and if they are contractually required to remove x and y on demand, they are selling you something that you can't rely on, without making that clear to you.
But it's worse than that. When a tech company designs a device for remote, irreversible, nonconsensual downgrades, they invite both external and internal parties to demand those downgrades. Like Pavel Chekov says, a phaser on the bridge in Act I is going to go off by Act III. Selling a product that can be remotely, irreversibly, nonconsensually downgraded inevitably results in the worst person at the product-planning meeting proposing to do so. The fact that there are no penalties for doing so makes it impossible for the better people in that meeting to win the ensuing argument, leading to the moral injury of seeing a product you care about reduced to a pile of shit:
https://pluralistic.net/2023/11/25/moral-injury/#enshittification
But even if everyone at that table is a swell egg who wouldn't dream of enshittifying the product, the existence of a remote, irreversible, nonconsensual downgrade feature makes the product vulnerable to external actors who will demand that it be used. Back in 2022, Adobe informed its customers that it had lost its deal to include Pantone colors in Photoshop, Illustrator and other "software as a service" packages. As a result, users would now have to start paying a monthly fee to see their own, completed images. Fail to pay the fee and all the Pantone-coded pixels in your artwork would just show up as black:
https://pluralistic.net/2022/10/28/fade-to-black/#trust-the-process
Adobe blamed this on Pantone, and there was lots of speculation about what had happened. Had Pantone jacked up its price to Adobe, so Adobe passed the price on to its users in the hopes of embarrassing Pantone? Who knows? Who can know? That's the point: you invested in Photoshop, you spent money and time creating images with it, but you have no way to know whether or how you'll be able to access those images in the future. Those terms can change at any time, and if you don't like it, you can go fuck yourself.
These companies are all run by CEOs who got their MBAs at Darth Vader University, where the first lesson is "I have altered the deal, pray I don't alter it further." Adobe chose to design its software so it would be vulnerable to this kind of demand, and then its customers paid for that choice. Sure, Pantone are dicks, but this is Adobe's fault. They stuck a KICK ME sign to your back, and Pantone obliged.
This keeps happening and it's gonna keep happening. Last week, Playstation owners who'd bought (or "bought") Warner TV shows got messages telling them that Warner had walked away from its deal to sell videos through the Playstation store, and so all the videos they'd paid for were going to be deleted forever. They wouldn't even get refunds (to be clear, refunds would also be bullshit – when I was a bookseller, I didn't get to break into your house and steal the books I'd sold you, not even if I left some cash on your kitchen table).
Sure, Warner is an unbelievably shitty company run by the single most guillotineable executive in all of Southern California, the loathsome David Zaslav, who oversaw the merger of Warner with Discovery. Zaslav is the creep who figured out that he could make more money cancelling completed movies and TV shows and taking a tax writeoff than he stood to make by releasing them:
https://aftermath.site/there-is-no-piracy-without-ownership
Imagine putting years of your life into making a program – showing up on set at 5AM and leaving your kids to get their own breakfast, performing stunts that could maim or kill you, working 16-hour days during the acute phase of the covid pandemic and driving home in the night, only to have this absolute turd of a man delete the program before anyone could see it, forever, to get a minor tax advantage. Talk about moral injury!
But without Sony's complicity in designing a remote, irreversible, nonconsensual downgrade feature into the Playstation, Zaslav's war on art and creative workers would be limited to material that hadn't been released yet. Thanks to Sony's awful choices, David Zaslav can break into your house, steal your movies – and he doesn't even have to leave a twenty on your kitchen table.
The point here – the point I made 20 years ago to Chris Anderson – is that this is the foreseeable, inevitable result of designing devices for remote, irreversible, nonconsensual downgrades. Anyone who was paying attention should have figured that out in the GW Bush administration. Anyone who does this today? Absolute flaming garbage.
Sure, Zaslav deserves to be staked out over an anthill and slathered in high-fructose corn syrup. But save the next anthill for the Sony exec who shipped a product that would let Zaslav come into your home and rob you. That piece of shit knew what they were doing and they did it anyway. Fuck them. Sideways. With a brick.
Meanwhile, the studios keep making the case for stealing movies rather than paying for them. As Tyler James Hill wrote: "If buying isn't owning, piracy isn't stealing":

In midtown Manhattan on March 4, Google’s managing director for Israel, Barak Regev, was addressing a conference promoting the Israeli tech industry when a member of the audience stood up in protest. “I am a Google Cloud software engineer, and I refuse to build technology that powers genocide, apartheid, or surveillance,” shouted the protester, wearing an orange t-shirt emblazoned with a white Google logo. “No tech for apartheid!” The Google worker, a 23-year-old software engineer named Eddie Hatfield, was booed by the audience and quickly bundled out of the room, a video of the event shows. After a pause, Regev addressed the act of protest. “One of the privileges of working in a company which represents democratic values is giving space for different opinions,” he told the crowd. Three days later, Google fired Hatfield. Hatfield is part of a growing movement inside Google that is calling on the company to drop Project Nimbus, a $1.2 billion contract with Israel, jointly held with Amazon. The protest group, called No Tech for Apartheid, now has around 40 Google employees closely involved in organizing, according to members, who say there are hundreds more workers sympathetic to their goals.

Holy crap, I didn't think Biden would be able to get the Climate Corps established without Congress. This is SUCH fantastic news.
--
"After being thwarted by Congress, President Joe Biden will use his executive authority to create a New Deal-style American Climate Corps that will serve as a major green jobs training program.
In an announcement Wednesday, the White House said the program will employ more than 20,000 young adults who will build trails, plant trees, help install solar panels and do other work to boost conservation and help prevent catastrophic wildfires.
The climate corps had been proposed in early versions of the sweeping climate law approved last year but was jettisoned amid strong opposition from Republicans and concerns about cost.
Democrats and environmental advocacy groups never gave up on the plan and pushed Biden in recent weeks to issue an executive order authorizing what the White House now calls the American Climate Corps.
“After years of demonstrating and fighting for a Climate Corps, we turned a generational rallying cry into a real jobs program that will put a new generation to work stopping the climate crisis,” said Varshini Prakash, executive director of the Sunrise Movement, an environmental group that has led the push for a climate corps.
With the new corps “and the historic climate investments won by our broader movement, the path towards a Green New Deal is beginning to become visible,” Prakash said...
...Environmental activists hailed the new jobs program, which is modeled after the Civilian Conservation Corps, created in the 1930s by President Franklin D. Roosevelt, a Democrat, as part of the New Deal...
Lawmakers Weigh In
More than 50 Democratic lawmakers, including Massachusetts Sen. Ed Markey and New York Rep. Alexandria Ocasio-Cortez, had also encouraged Biden to create a climate corps, saying in a letter on Monday that “the climate crisis demands a whole-of-government response at an unprecedented scale.”
The lawmakers cited deadly heat waves in the Southwest and across the nation, as well as dangerous floods in New England and devastating wildfires on the Hawaiian island of Maui, among recent examples of climate-related disasters.
Democrats called creation of the climate corps “historic” and the first step toward fulfilling the vision of the Green New Deal.
“Today President Biden listened to the (environmental) movement, and he delivered with an American Climate Corps,” a beaming Markey said at a celebratory news conference outside the Capitol.
“We are starting to turn the green dream into a green reality,” added Ocasio-Cortez, who co-sponsored the Green New Deal legislation with Markey four years ago.
“You all are changing the world,” she told young activists.
Program Details and Grant Deadlines
The initiative will provide job training and service opportunities to work on a wide range of projects, including restoring coastal wetlands to protect communities from storm surges and flooding; clean energy projects such as wind and solar power; managing forests to prevent catastrophic wildfires; and energy efficient solutions to cut energy bills for consumers, the White House said.
Creation of the climate corps comes as the Environmental Protection Agency launches a $4.6 billion grant competition for states, municipalities and tribes to cut climate pollution and advance environmental justice. The Climate Pollution Reduction Grants are funded by the 2022 climate law and are intended to drive community-driven solutions to slow climate change.
EPA Administrator Michael Regan said the grants will help “communities so they can chart their own paths toward the clean energy future.”
The deadline for states and municipalities to apply is April 1, with grants expected in late 2024. Tribes and territories must apply by May 1, with grants expected by early 2025."

are we talking about broke therapists yet?
I've been out of things for a couple of years now, which is why I'm willing to talk about it, and maybe the pandemic has helped things a little, but holy shit the counselling and psychotherapy field is not equipped to help its practitioners in the gig economy.
Of all my interests and talents, I pursued a degree in psychology because being a therapist is supposed to be a safe, stable, well-paid job. Every therapist I met who was registered before 2008 worked and lived under that assumption. And oh boy are all the fee structures--registration, supervision, continuing education, conferences--set up for that scenario.
After getting my Master's, I struggled like hell to get a job. It was especially bad because to get my license, I needed a supervisor to take me on. To take me on, most supervisors wanted me to already have a caseload and client base. To get a caseload and client base, I needed a job.
Friends: Every single job I heard back on wanted me to have my license before I could even land an interview.
Professors and career advisors and professional development specialists all advised me very earnestly to just keep cold-calling people on the supervision list, and it began to feel a lot like my parents' friends telling me to hit the bricks and hand out resumes. That's what worked for them, right?
I finally got a supervisor who agreed to take me on, and I'd be able to use her clinic for advertising and workspace, and we were doing the paperwork to send in with my registration, when she called me up and said, "Is this job going to be your only source of income? If you're trying to depend on getting clients and building your practice for your basic needs, this is not going to work out. This has to be something you're doing on top of a basic salary. Okay, so you're not working anywhere else right now? I'm sorry, I can't move forward with this."
Even once I landed a supervisor and a job building my own private practice, I struggled. I have ADHD and am not great at self-promotion, so trying to do all my own advertising, scheduling, bookkeeping, billing, and records management (on top of counselling) was an enormous strain. One my bosses, supervisors, and other senior professionals watched with a slightly critical eye, but consoled me about because in their early days, their clinics had had business managers, receptionists, filing clerks, and accountants, and getting used to doing everything online yourself was a bit of a learning curve, wasn't it?
I counted my pennies very carefully, because I had to pay my supervisor roughly $180 for their services every 6 hours of in-person counselling I did. This meant that to break even I had to charge my clients an average of about $30 (plus room rental and service fees) an hour--and my clients, being people with complex trauma, were frequently poor, disabled, unemployed, and had no health benefits, so even $10 or $20 a session was a lot for them.
Maybe it would have been easier if I could have taken some of those nice comfortable organization positions where they find clients and funding for you and you work 40 hours a week and get benefits and a pension, but I had to be disabled into the bargain, so working 40 hours a week just isn't possible for me. I start passing out from stress and exhaustion. Older colleagues gave me serious-faced advice about approaching my employer and asking them for some flexibility and accommodation in my schedule, and I tried to explain across the gap between us that employers simply did not hire me if I made the slightest noise about the workload. They weren't going to invest in me as a person; they were hiring 40 units of work a week, and if I wouldn't do it there were a dozen applicants after me who would.
At one point I broke down enough to email my licensing body because the Annual General Meeting/Professional Development Conference was coming up, and I wanted to attend, but I could not produce $500 to do it with. Was there some kind of way I could attend anyway? I felt ashamed to have to ask, and then absolutely mortified when the response came from the organization president, who needed to personally sign off on me being too poor to attend the single most important event in my profession's calendar year.
I honestly felt so ashamed all the time at how I was apparently failing to be a successful therapist, failing to be rich and successful, and every time I mentioned it around mentors and bosses, I could feel myself shrinking from a person to a problem to be solved. My closest therapist-friends and I have reflected on how much more difficult, poorly-paid and underworked, our various career starts have been than we were ever warned about. About the classmates and coworkers who couldn't get disability exceptions when they fell behind in their registration requirements, or burned out and left the field, or dropped their registrations and took up as life coaches, or moved their whole family somewhere exceptionally remote or rural because it was the only good job available, or worked for some godforsaken app skirting the bounds of malpractice like BetterHelp.
I like those conversations, because I feel less like an absolute fuck-up in them. There's less "Hey Lis, you were so talented in grad school, I really admired you, what are you doing now?" "Oh, I, uh... am professionally disabled, so I get government benefits, and I... sell embroidery patterns on Etsy now."
My own therapist kept asking if and when I felt like going back to being a counsellor, and I finally told him: I don't, actually. I don't want to go back and do it like I was doing it before. It was a profession I loved to the depths of my soul, and it profoundly did not love me back. I can't even imagine what would have to change, in me or it, to make it have a space in it that could fit me.
All of which I was way too scared to admit to at the time, because the more I let people know I was struggling, the more they hinted that maybe I just wasn't in a place in my life where this was a job I could do, and I needed to take a little break and wait to come back until money and disability just weren't issues for me anymore.
Eventually my cups of doubt and exhaustion did overflow, and I quit. I'm here now, living a much different life. And at the very least, all my years of helping people in bad life situations set me up perfectly for my own. I already knew what form to fill out for financial assistance, which student clinics to access for mental health support, and which government agency would, if pressed, cough out pharmacy coverage for the genuinely destitute. It gave me that much.
I hope this is just me being in extraordinary circumstances, sitting at the intersections of a few different shitty life situations that most people skip right past. Because it's on one level comforting, but another deeply infuriating, if I'm not, and I've just missed it or we've just all been too afraid to admit it to each other.

That’s That Me Espresso
Pairing: Charles Leclerc x Hispanic/Latina! Reader
Summary: Charles and Y/N have been dating for a few weeks, they met after the Suzuka Grand Prix. Even though their relationship has been short lived, there’s something about her that has Charles down bad. They are living proof of how the boyfriend should always like the girlfriend more.
Warning: Grammatical and spelling errors
A/N: For those who voted for idea 2, about Charles being auctioned off for charity? Yeah, I'm not vibing with that idea anymore. But i am working on the fanfic where Charles thinks Y/N likes Lando.
Tumblr media
Charles was never one to chase girls. Sure, in every relationship he was in, he was the best boyfriend he could be, he would be so devoted to them. But in his current relationship, he has never felt this way before. He was away for the Imola Grand prix and he couldn't sleep so he decided to call Y/N. After a few rings, she answered.
"Bueno?" Y/N asked sleepily.
"Hello, mon ange, did I wake you?" Charles asked.
"Sort of, is something wrong, Charlie?" Y/N asked.
"Oh nothing, I'm just having trouble sleeping without you here, you know?" Charles said.
"I’m sorry I couldn’t make it to this Grand Prix, cariño, i just have a lot of in-person meetings. Plus, you've been to countless races before, you would think you'd be used to sleeping alone." Y/N said.
"Yes, but that was before i met you. Now when i'm in bed alone, it feels like I'm missing something.” Charles confessed.
“You’re so sweet. But seriously, muñeco, you have media day in the morning, and I can’t have you be sleepy during the interviews, Fred would kill you.” Y/N said.
“No he wouldn’t, I’m il predestinato, the prince of Ferrari.” Charles said.
“Muñeco.” Y/N warned.
“Alright Mon ange, I’ll go to sleep, but please FaceTime me before you go to work.” Charles said.
“Of course, Charlie. Te quiero mucho, Goodnight.” Y/N said.
“Yo también te quiero, Goodnight.” Charles tried his best to say in Spanish and he hung up.
The next morning, Y/N woke up, showered, did her after shower routine, got dressed and she was about to make breakfast when Charles decided to FaceTime her. She answered.
“Muñeco, how are you? Did you get some sleep?” Y/N asked.
“I did actually, it took a while though.” Charles said.
“Well when you’re back in Monaco, I’ll be sleeping by your side.” Y/N said, she set her phone against something in the kitchen so she can make pancakes.
“Sounds perfect, I’ll be counting down the days.” Charles said.
“You think you’ll make podium?” Y/N asked.
“I’ll dedicate my podium to you, Mon ange.” Charles said. They kept talking while Y/N made her breakfast, Charles also took his phone with him to eat when his room service came so they had breakfast together,
“Charlie, baby, i need to go to work, okay, I’ll talk to you soon, te quiero.” Y/N said.
“Yo más.” Charles replied and hung up the call. There was a knock on his hotel room door and he opened it to see Carlos. “Good morning, Carlos.”
“Morning. Were you talking with Y/N?” Carlos asked
“Yes i was.” Charles replied smiling.
“Ay, I should have known, she has you completely smitten.” Carlos says.
“I know, mate, there’s just something about her.” Charles said, sighing like a person in love.
“You are whipped, it’s entertaining to see you like that. We need to head to paddock now for the interviews.” Carlos said before him and Charles left the hotel room.
Meanwhile, Y/N was finishing up her third meeting of the day when she got w FaceTime call from Y/N so she excused herself.
“Charlie querido, what is it? I’m technically still in a meeting.” Y/N said.
“Sorry Mon ange, I just wanted to see how you are, I am on break right now and then I have more interviews before the race,” Charles said.
“I’m fine, just a little tired, I call you later tonight okay? Then you can tell me all about your day. Te quiero.” Y/N said, blowing him a kiss.
“Yo más” Charles said, doing the same thing before hanging up. Y/N was about to enter the conference room again but she was stopped by her assistant.
“You got that man wrapped around your finger.” Monica commented,
“Well i wouldn’t necessarily say that I have him wrapped around my finger. Pero es si, lo tengo mal (But Yeah, i got him down bad).” Y/N said.
“How? Like what’s your secret?” Monica asked.
“There’s no secret, it’s just that me espresso.” Y/N said.
“Ha ha, no go, you have a meeting to run.” Monica said. Y/N entered the conference room to continue the meeting.
Her workday was done and she got a text from Charles and it was a link to one of his interviews. She clicked on it and she was watching it but there was a question that Charles answered that surprised her.
“Charles Leclerc, what is your favorite saying?” The interviewer asked.
“I Don’t know if it’s a popular saying or an actual saying in general, but my girlfriend says ‘that’s that me espresso’. When she was younger, her mom would say she was like a shot so espresso because of how hyper and energetic she was as a child, basically bouncing off the walls. So now when I ask her a question about anything she does, she’ll say that’s that me espresso or it’s just that me espresso, meaning that’s just how she is. How do I get crying babies to stop? That’s that me espresso, I have no idea but I guess I just have a calming presence.” Charles said laughing. Y/N stopped the video and FaceTimed Charles,
“Hey Muñeco.” Y/N said.
“Hello, ma Belle, did you see that interview?” Charles asked.
“I did, you used my phrase.” Y/N said.
“Of course I did, it’s my favorite saying in the world, it perfectly describes you. You are a shot of espresso, a moment with you has me smiling for hours, I can’t get enough of you.” Charles said,
“Eres tan cursi (you are so cheesy) but i love that about you.” Y/N said.
They continued talking until it was time for bed.
Race Weekend was done and Y/N can continue working from her home office, she didn’t didn’t have any meetings to attend to in person, she was free. She was finishing up some files when the doorbell rang. Y/N got up and answered the door and she saw a huge bouquet of her favorite flowers (mine are peonies because of Blair Waldorf).
“Whats this?” Y/N asked and the bouquet of flowers were lowered to reveal a smiling Charles Leclerc. “Muñeco!”
“Mon ange!” Charles exclaimed, they entered her apartment and they hugged as soon as charles put the bouquet on the kitchen counter, he spun her around and out her back on the ground to leave her kisses all over her face. “I missed you so much.”
“I missed you too, I thought you weren’t coming until tomorrow, did you come here straight from the airport?” Y/N asked, taking in Charles’s hoodie and baggy jeans,
“Yes I did. I stopped by the florist first, obviously.” Charles said, gesturing to the bouquet,
“They’re beautiful.” Y/N said. “What brings you here?”
“Because I wanted to tell you up something important. I know we haven’t been dating for a long time but I have never felt this strongly about someone, I love you, te amo, estoy enamorado de ti (i am in love with you).” Charles said. Y/N starts tearing up,
“Ay muñeco, yo también te amo.” Y/N said, hugging him. “Je suis amoureux de toi.” Now it was Charles’s turn to tear up, she just told him she was in love with him too. They kissed.
“I fall in love with you more and more each day, I can’t get enough of you, how do you do that?” Charles asked, brushing Y/N’s hair back. Y/N just shrugged.
“That’s that me espresso.” Y/N said and both of them laughed, Charles pulled Y/N onto the couch and started talking about where to go out today,
The End
I had no idea where I was going with this short imagine but I hope y’all like it!
