Lawsuit With Crumbl Cookies: TikTok’s Top Cookie Brand

Crumbl Cookie is a franchise-based bakery (est. 2017) that was founded by two cousins: Sawyer Hemsley and Jason McGowan with their first store in Utah (2017), U.S. [1] Crumbl Cookie specializes in freshly-baked, big cookies and has amassed a large following on the platform, TikTok (est. 2016). As of July 31st, 2022, Crumbl Cookie’s TikTok page has gathered around 5.6 million followers with 56.4 million total likes. Crumbl Cookie was able to obtain such high numbers with the viral hashtag, #CrumblReview, where TikTok users’ film short clips of them trying Crumbl Cookies weekly cookie flavors, a rotating flavor menu concept created around December 2018. [2] Crumbl Cookie’s “rotating menu” with unique and classic flavors like cinnamon fry bread, sugar cookie, lemon cupcake, and double fudge brownie, grew Crumbl Cookie’s presence on TikTok. However, Crumbl Cookies quick success within the TikTok platform has caused a jump in competition within the cookie industry.
On May 10th, 2022, Crumbl Cookie filed an intellectual property and trademark lawsuit against Crave Cookies, claiming that, “ Crave began selling and promoting its copycat gourmet cookies using packaging décor, and presentation that is substantially and confusingly similar to Crumbl’s established and successful trade dress and brand identity”. [3] On Crave Cookies official website, there is no indicator of when Crave Cookies was officially founded (co-founded by Trent English). However, within their website, Crave Cookies offers a similar big cookie menu rotation. Crave Cookies also displays a black logo with white tracings, like Crumbl Cookie’s logo on all social platforms. [4] The plaintiff, Crumbl Cookie, requests claims of relief for damages for violations of Utah Trade Practices, unfair competition, trademark infringement, trade dress infringement, unjust enrichment, and the Utah Unfair Competition Act. [3] The plaintiff, Crumbl Cookies, claims of relief include a percentage of Crave Cookies generated profits and revenues, attorney fees, treble damages, pre and post judgment damages, actual damages, and other costs. [3] The case of Crumbl et al v. Crave Cookies et al is still ongoing, however, Crave Cookies filed an amended compliant on July 13th. Crave Cookies claims, “Defendants deny that Crave’s founder applied for or was denied an application to become a Crumble franchisee or that Crave is in violation of any of Crumbl’s alleged trademarks, trade dress, or other intellectual property rights”. [5] The court date for this lawsuit is still pending, however, it was filed in the Utah District Court.
Crave Cookies is not the only cookie franchise being sued by Crumbl Cookies because on May 10th, 2022, Crumbl Cookie also filed an intellectual property and trademark lawsuit against Dirty Dough (est. 2018). Crumbl Cookies alleges that “in late 2019, a Crumbl insider left Crumbl to found Dirty Dough, which sells and promotes cookies using packaging, decor, and presentation that is confusingly similar to Crumbl’s established and successful trade dress and brand identity”. [5] Dirty Dough is a franchise cookie business founded in 2018. Dirty Dough has an advanced website with franchising options, cookie deliveries, and available locations. Dirty Dough also has a cookie menu rotation, however, unlike Crumbl Cookie, specializes in stuffed, smaller cookies. Dirty Dough’s logo is teal with white lining, unlike Crumbl Cookies black-based logo. [6] Dirty Doughs current CEO, Maxwell spoke with Herald Journal claiming, “Out of any cookie-to-cookie companies in the world, I think we’re the most different”, disagreeing with allegations of stolen marketing tactics. [5] The case of Crumbl Cookies et al v. Dirty Dough et al is still pending by Utah’s District Court. Crumbl Cookie filing two trademark infringement lawsuits against two U.S. cookie franchises sparks controversy, with Dirty Dough and Crave Cookies allegedly profiting through the confusion of similar products within consumer spending.

Old McDonald Had a Rough Week

I want to start off by saying that yes, if these 2 things had occurred separately from each other, they probably wouldn’t have even come up on my radar.  But, something about these things happening one after another has a weird, Arrested-Developement-style compounding “bad things happening to bad people” vibe to them that I just can’t ignore.  
First off: McDonald’s is being sued for $900 million by a company formally responsible for fixing their ice cream machines.  Tech startup Kytch had created a device that could be hooked up to the inside of the ice cream machines and perform diagnostic checks and run basic troubleshooting, helping to prevent the machines from breaking down as often as they do.  While the device was popular with many McDonald’s franchisees, corporate issued an order to cease usage of the devices- calling them “safety hazards-” confiscating many of them, and later told franchisees that they could upgrade to new machines that came with a suspiciously similar replacement to the Kytch device already installed.  Kytch now claims that the “safety hazard” defamation has driven away all of their remaining business and are accusing McDonald’s and Taylor (the company making the “upgraded” machines) of reverse engineering their product.  As someone who has worked with faulty equipment (some of which made by Taylor) that seems to constantly get called in for repairs but never replaced, it’s no surprise to me that many are accusing McDonald’s and Taylor of creating a racket to bleed franchisees dry with repair bills.
On top of that, the hashtag #boycottmcdonalds was trending on Twitter for a while.  This was born out of companies like Apple, Netflix, and many major credit card companies pulling their services from Russia in response to the invasion of Ukraine.   Meanwhile, McDonalds, Coca-Cola and Pepsico haven’t. (It may be worth noting that while #boycottcocacola and #boycottpepsi were also used extensively within Ukraine, #boycottmcdonalds somehow seems to be the only one that’s really taken off in the West.) [UPDATE: As of 3/8, McDonald’s has, in fact, temporarily closed all Russian locations.]
Listen: I haven’t been a stranger to hashtag activism on this blog.  I’ve went on and on about how Chic-fil-A is homophobic and Wendy’s’ CEO is a huge Trump supporter and tried hopelessly to believe that where you spend your money speaks louder than words.  But… what exactly is the rationale behind this?  Do you think Putin eats Big Macs?  Are you convinced Ronald McDonald is one of the many oligarchs pulling the strings behind the invasion?  I literally can’t envision any possible way where McDonald’s closing all 850 of its Russian locations is going to affect the war at all. Ok, one exception: all the poor Russians who had taken to working at McDonald’s as a last resort find themselves unemployed, and, with no other options, join the army.  Is that the outcome you want?  This is the culinary equivalent of all those colleges banning books by Dostoevsky and Tolstoy, because Russian (shoutout to the one guy on Twitter who specifically called out Dostoevsky, who died in 1881, for not speaking out against Putin’s regime). Talk about how America still buys Russian oil or donate some money to a Ukrainian relief charity if you want to feel like you’re doing something.
What does all this really mean?  Well, there’s one other major detail I’ve saved for the end, here.  You see, this reminder of the ice cream machines’ reputation of always being broken and the calls to boycott are also coinciding with a major event on the McDonald’s calendar: Shamrock Shake availability.  Will these compounding obstacles hurt Shamrock Shake sales? Probably not, but they probably aren’t helping, either.

International Women’s Day profile: Sandra Andrews
To mark this year’s International Women’s Day – Sunday 8 March – we talked to one of our many women franchisees, Sandra Andrews, who co-owns the MBE Chippenham store with her husband Keith.  Here are Sandra’s answers to our six key questions about what it’s like to be a woman in business in 2020.

What made you want to start your own business?
I’m very much a self-starter – I love to find things out for myself.  For the first ten years of my career I was with a large company, doing a bit of everything and working my way up through the ranks, so I got to know a lot about how businesses work.  I became a full-time mum when my two daughters were small, then had three part-time jobs, using various Microsoft programmes from accounts and spreadsheets to database creation and design work.  My husband Keith had stayed with the company we both used to work for, and eventually he and some colleagues bought out one of the divisions, which saw its first ever profit that year.  Sadly, though, one of their biggest clients took their business back in-house, so the company had to be sold.
At that point my priority was to take a full-time job. I said I would do literally anything to bring the money in – except cold calling.  But ironically I ended up selling for Vodafone and, although I hated the cold calling, I learnt a lot about how to deal with people during that time.
Once you’ve worked for yourself, though, you don’t want to work for anyone else.  Keith and I decided to look for business opportunities, and we were attracted to the Mail Boxes Etc. franchise.  We thought that my software skills and creativity allied to Keith’s accountancy background would stand us in good stead.  We knew we had an awful lot to learn, but we believed that if we didn’t take the opportunity we would regret it.
Was it difficult to balance the demands of family and career?
If you have a young family, it can be a bit of a juggling act when you start your own business.  My daughters – now 28 and 30 – were still at school when we took on the franchise. Both my daughters went to university and got first-class honours degrees and both are working now, so we must have got something right!
What were the biggest business challenges you faced?
In some ways we felt we were reinventing the wheel, learning about the local area and deciding how we were going to pitch ourselves.  Luckily there wasn’t much local competition except the Post Office for post and parcels, and one small printer. We knew we could offer plenty of extra services to our customers and for the first five years we spent a lot of time thinking about how best to market ourselves.  We used social media and other free channels wherever possible – I made sure we were on all the free listing sites I could find.  Now that we’re established, though, much of our business is via repeat custom, word of mouth and local business organisations like Chippenham BID.
We had a lot of start-up help and training from MBE’s head office team, but you tend to learn on the job.  We certainly made a few mistakes!  Every centre is different, so the marketing needs, challenges and opportunities vary.
We’ve made the most of all the profit centres during our 17 years in the business.  Shipping is a key focus for us, and we work with a lot of the local auction houses. Work-life balance is really important, too, and we did have to make a concerted effort, after a few years, to ensure we took an annual holiday. 
One of our most recent challenges has been relocating to new premises – that was pretty stressful.  But now that we’re settling in, we’re seeing more footfall after just a couple of months, so it has been a good move.

Would you do it all again, given the chance?
Yes, absolutely - I love running my own business. There are so many positives.  You meet so many people and most of our customers have been great.  You learn a lot about yourself, too: you become more customer-service orientated but you also become more assertive in your own manner. You’re always learning – you keep learning till the day you die.
I’ve also loved having the support of the Mail Boxes Etc. team.  Our offering is very diverse and it’s not a business that you can run easily by yourself – as I found out when I nearly lost Keith to sepsis a few years ago.  It meant that I was literally doing everything for a few months, which was really tough – but it was nice to know I had the support of the staff at head office, even if it was just someone on the end of the phone.  I’m happy to say we made it through.
Our lease comes up in another five years and I’m definitely not ready to retire yet.  Eventually I’d like to be able to pass the business on to someone else, or sell it, and we want to be in a good place to do that.
The theme for this year’s International Women’s Day is forging a gender-equal world.  Do you think we’re getting there?
More and more people are rising to different challenges these days, and I don’t think it should be about women – it’s about people. Whether you want to be a plumber, electrician, retailer, whatever – anyone is capable of doing anything, so I agree that gender shouldn’t be an issue.  
What is your advice to other women thinking of becoming MBE franchisees?
I’d say to anyone considering starting up on their own, if you really want to give it a go, give it a go.  Because otherwise, you will always wonder what you could have done. If it doesn’t work out, at least you can say you tried it – and that goes for whatever you’re thinking of doing.
