Supreme Court poised to appoint federal judges to run the US economy.

The Supreme Court heard oral argument on two cases that provide the Court with the opportunity to overturn the “Chevron deference doctrine.” Based on comments from the Justices, it seems likely that the justices will overturn judicial precedent that has been settled for forty years. If they do, their decision will reshape the balance of power between the three branches of government by appointing federal judges as regulators of the world’s largest economy, supplanting the expertise of federal agencies (a.k.a. the “administrative state”).
Although the Chevron doctrine seems like an arcane area of the law, it strikes at the heart of the US economy. If the Court were to invalidate the doctrine, it would do so in service of the conservative billionaires who have bought and paid for four of the justices on the Court. The losers would be the American people, who rely on the expertise of federal regulators to protect their water, food, working conditions, financial systems, public markets, transportation, product safety, health care services, and more.
The potential overruling of the Chevron doctrine is a proxy for a broader effort by the reactionary majority to pare the power of the executive branch and Congress while empowering the courts. Let’s take a moment to examine the context of that effort.
But I will not bury the lead (or the lede): The reactionary majority on the Court is out of control. In disregarding precedent that conflicts with the conservative legal agenda of its Federalist Society overlords, the Court is acting in a lawless manner. It is squandering hard-earned legitimacy. It is time to expand the Court—the only solution that requires a simple majority in two chambers of Congress and the signature of the president.
The “administrative state” sounds bad. Is it?
No. The administrative state is good. It refers to the collective body of federal employees, regulators, and experts who help maintain an orderly US economy. Conservatives use the term “administrative state” to denigrate federal regulation and expertise. They want corporations to operate free of all federal restraint—free to pollute, free to defraud, free to impose dangerous and unfair working conditions, free to release dangerous products into the marketplace, and free to engage in deceptive practices in public markets.
The US economy is the largest, most robust economy in the world because federal regulators impose standards for safety, honesty, transparency, and accountability. Not only is the US economy the largest in the world (as measured by nominal GDP), but its GDP per capita ($76,398) overshadows that of the second largest economy, China ($12,270). The US dollar is the reserve currency for the world and its markets are a haven for foreign investment and capital formation. See The Top 25 Economies in the World (investopedia.com)
US consumers, banks, investment firms, and foreign investors are attracted to the US economy because it is regulated. US corporations want all the benefits of regulations—until regulations get in the way of making more money. It is at that point that the “administrative state” is seen as “the enemy” by conservatives who value profit maximization above human health, safety, and solvency.
It is difficult to comprehend how big the US economy is. To paraphrase Douglas Adams’s quote about space, “It’s big. Really big. You just won't believe how vastly, hugely, mindbogglingly big it is.” Suffice to say, the US economy is so big it cannot be regulated by several hundred federal judges with dockets filled with criminal cases and major business disputes.
Nor can Congress pass enough legislation to keep pace with ever changing technological and financial developments. Congress can’t pass a budget on time; the notion that it would be able to keep up with regulations necessary to regulate Bitcoin trading in public markets is risible.
What is the Chevron deference doctrine?
Managing the US economy requires hundreds of thousands of subject matter experts—a.k.a. “regulators”—who bring order, transparency, and honesty to the US economy. Those experts must make millions of judgments each year in creating, implementing and applying federal regulations.
And this is where the “Chevron deference doctrine” comes in. When federal experts and regulators interpret federal regulations in esoteric areas such as maintaining healthy fisheries, their decisions should be entitled to a certain amount of deference. And they have received such deference since 1984, when the US Supreme Court created a rule of judicial deference to decisions by federal regulators in the case of Chevron v. NRDC.
What happened at oral argument?
In a pair of cases, the US Supreme Court heard argument on Tuesday as to whether the Chevron deference doctrine should continue—or whether the Court should overturn the doctrine and effectively throw out 17,000 federal court decisions applying the doctrine. According to Court observers, including Mark Joseph Stern of Slate, the answer is “Yes, the Court is poised to appoint federal judges as regulators of the US economy.” See Mark Joseph Stern in Slate, The Supreme Court is seizing more power from Democratic presidents. I recommend Stern’s article for a description of the grim atmosphere at the oral argument—kind of “pre-demise” wake for the Chevron deference doctrine. Stern does a superb job of explaining the effects of overruling Chevron:
Here’s the bottom line: Without Chevron deference, it’ll be open season on each and every regulation, with underinformed courts playing pretend scientist, economist, and policymaker all at once. Securities fraud, banking secrecy, mercury pollution, asylum applications, health care funding, plus all manner of civil rights laws: They are ultravulnerable to judicial attack in Chevron’s absence. That’s why the medical establishment has lined up in support of Chevron, explaining that its demise would mark a “tremendous disruption” for patients and providers; just rinse and repeat for every other area of law to see the convulsive disruptions on the horizon.
The Kochs and the Federalist Society have bought and paid for this sad outcome. The chaos that will follow will hurt consumers, travelers, investors, patients and—ultimately—American businesses, who will no longer be able to rely on federal regulators for guidance as to the meaning of federal regulations. Instead, businesses will get an answer to their questions after lengthy, expensive litigation before overworked and ill-prepared judges implement a political agenda.
Expand the Court. Disband the reactionary majority by relegating it to an irrelevant minority. If we win control of both chambers of Congress in 2024 and reelect Joe Biden, expanding the Court should be the first order of business.

Oh my. This whole ongoing mess really is crap hilarious.
The ruling is the latest twist in a battle between Tesla and labour groups in Sweden. Union IF Metall put mechanics on strike on Oct. 27, refusing to service Tesla's cars because the company would not accept collective bargaining.
Members of other unions, including dockworkers, electricians and cleaners have since taken action in sympathy.
Tesla has a policy of not signing collective bargaining agreements and says its employees have as good, or better, terms than those demanded by IF Metall. The union says it is vital to the Swedish labour market model that all companies have collective agreements...
Seko, the union that organised the PostNord workers, told Reuters an easy solution for Tesla was to sign the collective bargaining agreement with IF Metall.
So yeah, the agency issuing the licence plates needs to find some way of getting them to Tesla, without any obligation on anyone else to actually deliver them.
It also sounds remarkably like someone at the Transport Agency was being purposely obstructive there too, beyond normal-level dealing with bureaucracies. They also probably did NOT particularly want to piss off the postal workers in question, by trying to circumvent their existing shipping contract while said postal workers were refusing to deliver to Tesla.
A little more background:
So yeah, good luck getting anything done when basically every other industry is refusing to deal with your business, or even deliver its mail. You would think that whoever was actually making certain decisions at Tesla would have learned from the similar Toys 'R' Us debacle in the mid-'90s.
My guess is that they were at least hoping that nearly 30 more years of neoliberal influence might have weakened organized labor enough for them to get away with pulling this shit now. Either that, or 'just' contravening the Being Bloody Stupid Act of 1581. And then freaking Elon did an Elon, and responded to any criticism by doubling down on some terrible choices.
I can only hope that, if this was the line of thinking? That someone was sorely mistaken, and severely underestimated how well the whole Nordic Model has managed to hold up.

All It Takes Is One: How an Injury on the Job Spurred Organizing Efforts at FedEx

FedEx workers had enough of impossible workloads and understaffing — so they organized.
Injured on the job
Jeremiah Davila, a retail employee (known internally as a store consultant) at FedEx Office, tried to reason with management about unreasonable workloads and understaffing. He saw co-workers transfer and quit and knew that the vacancies wouldn’t be filled unless pay and working conditions improved. Though some might imagine FedEx office as a laid-back work environment, the work is specialized and taxing: workers unload, package, and transport heavy parcels while balancing additional retail and production duties. For Jeremiah, the breaking point came when he was injured on the job — and management, he says, was nonchalant. Done with waiting on empty promises, he took to organizing. 
“I had been warning them for a while [about] these working conditions … [saying] we can’t keep working like this. If someone calls in sick, you can push yourself a little for a day, but you can’t keep going like that for a month,” he notes. “So I’d been warning them for a while, and they just were kind of like, ‘Yeah, yeah, we’ll take care of you,’ was the response, but nothing ever got done. Just a lot of empty promises … When I told them about the injury, they just seemed more skeptical than anything else.”
Unsustainable workloads
He wasn’t alone. Jeremiah’s co-worker, Genesis, had also seen the company promise to improve working conditions then fail to deliver. At their flagship store — one of the busiest in the district — workers juggled packing, shipping, printing, laminating, and retail duties, with critically low levels of staffing. Over time, their team of four dwindled to two, with no new hires in sight. Instead, management turned to a band-aid solution: 
“As far as I can tell, our entire district is short-staffed. They like to play this game where they bounce people round from store to store, to cover the short staffing. But the reality is they have a store that’s really understaffed and then they pull people from a marginally less understaffed store. What the reality is, whatever the magic number is for the district … no matter how much you’re bouncing them around they’re all doing the work of more than one person,” says Jeremiah. 
“We did a little digging to find out about the managerial compensation. I don’t know the exact numbers, but as far as the store manager on up, if there is a budgetary surplus, they do receive a bonus, a percentage of it. Not illegal, but obviously very unethical and a clear motivator, borderline conflict of interest,” he adds.
Learning the ropes
Jeremiah and Genesis had never participated in workplace actions, but they learned as they went. They went out on strike, demanding an end to understaffing, compensation for the specialized nature of their work, and safe workloads — so no one is injured again. “It’s been very bootstraps guerilla from the start, but that’s kind of our style,” says Jeremiah. After a supervisor allegedly made social media comments stating workers would be retaliated against for their organizing, they filed charges with the National Labor Relations Board (NLRB). Management was quick to respond. 
“Once we filed those charges, there was a huge change in the communication with management — massive change. A lot more toned down, respectful, actually taking seriously what we were saying about our boundaries, about, ‘Hey, we’re trying to negotiate here, collective bargaining, yeah, we’re not a recognized union, but we still have protection to collectively bargain nonetheless,’” says Jeremiah.
When we fight, we win
Taking action with your co-workers can be nerve wracking, but Genesis and Jeremiah looked to other worker victories for resolve. “Genesis and I were on the fence were on striking. We were actually talking about the UPS strike, and I was like, if they did it, anyone can do it … If they hadn’t done that, I don’t think we would have followed through with what we’re doing,” he says. 
Fortunately, they’re not alone. Workers across the country have seen historic raises and improvements to working conditions at UPS, Ford, GM, and Stellantis — all of which were won by workers being prepared to fight for each other. If you’re curious about organizing your own workplace, Jeremiah has advice: “The NLRB is a great starting point, they have all the forms. But it’s really confusing, and I’m not gonna lie, I had to have a few tries to get my stuff right. A refreshing take on the Cherry Magic prologue that unfortunately fell (a ltitle) short in the last few minutes. 
Cherry Magic Thailand chooses the Jdrama route where we first meet Achi without his powers. It was nice to see the difference in culture immediately; from Achi’s living conditions to means of transport. Though I thought having Achi immediately lament on his life choices 2 minutes in was maybeeeee too quick.
It’s very interesting that Rock/Rokkaku here is introduced as Achi’s subordinate and their whole first interaction, with Achi feeling awkward that despite their big age difference he hardly holds a senior position over him, which in turn further proves Achi’s averageness. Plus, having Rock approach and get attached to Achi is going to rationalize an aspect of Karan’s jealousy which I am very excited to see. I liked the flashback montage about how different Karan and Achi’s progress in the workplace was. It gives the viewers a better idea of Achi’s mix of jealousy and admiration towards Karan and it’s also a first look into Achi’s feelings of inferiority that will eventually become an obstacle to his and Karan’s relationship.I also like how in the most recent flashback you can see Karan kind of burnt out, which should be around the time he falls (or has already fallen) for Achi. 
 *BTW Karan here is supposed to have won employee of the year 7 years in a row (from the FIRST year he joined) and honestly I find that less realistic than I found jdrama Kurosawa being in love with Adachi for 7 years 
Besides that, however, I found some other scenes unnecessary and very exposition-y, even for a pilot episode. For example, learning about Achi’s trauma regarding romantic relationships should have come up later imo.
Unlike other adaptations this one didn’t really feel the need to excessively point out Karan’s popularity among women, which is a very vital plot point later on; I am not really big fan of that trope so I found it kind of refreshing; and it will come sooner or later. 
I am VERY interested in Pai and Dujdao. Big fan of adding another relevant female character and one who is nice to Achi, at that! Pai is leaning to Fujisaki’s more extroverted and mischievous side while I think Dujdao has some of Fujisaki’s qualities as well but her role is more equivalent to a nicer Urabe-san or Achi’s very own Asahina-senpai. Side note, the implication that Pai-Dujdao are some kind of cupids that help Karan seduce Achi is a concept I can 100% get behind. It also seems like the boss will be a recurring character so maybe he’s the Asahina?  Anyway, the character department has me invested.
And speaking of characters - Jinta! JInta is…a character who is… not Tsuge. A lot of people are not fans of Tsuge, especially Jdrama Tsuge. But well I don’t know if the solution is to completely change him? He looks and acts way younger which is very contradictory to his role in the manga; Especially to his relationship with Minato. But, I won’t judge too hard yet since they haven’t even interacted on screen. The udon backstory is an AMAZING detail and the GREATEST introduction of the side couple in any version of the story. 
So. Nothing is going to top the jdrama elevator scene and every adaptation is going to have to make peace with that. The lighting work during Kurosawa’s imagination in the office was a work of art and Achi’s (and Rock’s later) reaction was hilarious. The sound effects also got me a few times ngl.
Part 4 however…disappointed me. First off they replace the scarf scene with a way less emotionally charged umbrella scene. To which I ask, do you know how hard it is to make an umbrella scene seem so unromantic? And then we have Karan asking Achi to stay over and BEFORE Achi agrees, he reads Karan’s mind and his wild imagination. And then…agrees? The entire gag of the scene relies on Achi agreeing BEFORE he sees all that stuff and then immediately regretting it. Having him regret it after the fact is … pointless? I also found it very abrupt to jump to domestic life scenarios fantasies from the get-go when in all other version’s Karan is just contend with Achi being at his place (with his designated pyjamas). He’s a horny bastard in general, I am not denying the mole scene earlier but I felt like the domestic fantasies being shown so early on was a bit fanservice-y for the Taynew fans? (As someone who doesn’t gaf about these men outside their roles and as someone who knows Kurosawa personally this is what it felt like to me.)
Karan's smirk was precious though hehe.
TLDR the show has a very promising and compelling beginning but declines in quality in the last minutes. That being said, I still have faith that the next episodes will be better. The next episode clips I’ve seen are promising and since there was a lot of exposition (and scenes from later chapters) in the pilot it will probably help the pace of the later episodes. Personally, the jdrama hooked me with EP3 (the events of which will be in EP2 of the Thai one) so I think (and hope) the show will only get better from here!
