Die Geburt des Rechts aus dem Geist der Choreographie

Wenn die Disco der Tempel und das offizielle Gebäude ist, dann spitzt sich die urbane Architekur im Tempel und im offiziellen Gebäude, also in der Disco zu. Sind Tempel und offizielles Gebäude nicht die Disco, dann spitzt sich urbane Architektur in der Disco zu. Dort wird Urbanität intensiv, dort gibt es, wie man in Warburgs Heimathafenstadt Hamburg singt Tamm-Tamm und Rämmi-dämmi. Immer wieder kommt es in der Disco zu erhitzter Gesellschaft und zu Ausbrüchen erhitzter Gesellschaft, anders gesagt: zu Haufenbildung, wobei der Haufen ab und zu wie ein Vulkan asoziale Elemente auswirft. Die Elemente erscheinen asozial, tauchen ab einem bestimmten Punkt außerhalb der Gesellschaft auf, unabhängig davon, wer genau Gesellschaft und wer den Ausschluss schuldet, aber unabhängig von ihrer Geselligkeit oder Gesellschaftsaffinität können sie dolle oder gar unverzichtbare Einzelene/ Vereinzelte oder auch schlichte Verbrecher sein. In der Disco wird immer auch etwas angebahnt, am Ende reproduziert sich die Menschheit bis auf weiteres.

Die Disco ist eine der wenigen Architekturen, die nach einem Polobjekt benannt sind, in diesem Fall nach einer Scheibe, die man drehen soll und wenden kann. Man hat dem Wort Disc (einem runden Desk oder einer runden Tafel) extra noch ein O angehängt, damit auch die letzten Doofen verstehen, worum es in der Disco geht: um's Schlängeln, Schlingen und Kreisen.

Man hat in Städten nur relativ kurz Gebäude Disco genannt, heute heißen sie eher Club. Das hält uns nicht davon ab, die Disco für eine Basilika zu halten: Die Disco ist eine Messehalle und eine Regungsstätte, die darauf ausgerichtet ist, Körper durch Körper zu affizieren, nahe zu bringen oder auseinanderzubringen, das ist die Stätte offiziellen Tanzes. Dort sollen Körper sich eine zeitlang zueinander und miteinander bewegen, wie zu derjenigen Wahrheitsform, die man Prüfung nennt.

Andere Kulturen haben zwar keine Disco, aber im Hinblick auf den Tanz äquivalente Stätte, etwa das wompunau, von dem Gregory Bateson für sein erstes großes Buche Naven ein Foto gemacht hat.

Immer dann, wenn irgendetwas anfängt, dann fängt auch Recht an. Technisch betrachtet fängt das Recht mit graphischen oder choreographischen Akten an, die Differenz operationalisieren, kurz und knapp (normativ) gesagt: die etwas unterscheiden und die Mobilität und Austauschbarkeit des Unterschiedenen bestimmen sollen. Solche Akte konturieren und definieren etwas, nehmen es als Form wahr und führen es einem limitierten Wechsel zu. Der limitierte Austausch ist kuratierter, 'besorgter' Austausch. Exzesse sind darin nicht nur möglich, sie sind einkalkuliert, aber in kuratierter Form.

Ricardo Spindola war in Brasilien und hat ein Geschenk mitgebracht: Naven von Gregory Bateson in der Übersetzung von Magda Lopes. Sag ich doch: Maria Immaculata was such a perfect day, merci Ricardo!

Gregory Bateson erwähnt in dem Vorwort des 1936 zuerst erschienen Buches einen doppelten Zug: Im Zug habe ihm der Zoologe und Anthropologe Alfred Cort Haddon versprochen, ihn als Anthropologen zu trainieren, sprich: zu ziehen oder zu erziehen. Bateson formuliert das richtig: Dr. Haddon first made me an anthropologist. Im Zug, mit einem Zug, den man mit Adolf Reinach einen Akt, in in diesem Fall ein Versprechen nennt.

Die Rechtsgeschichte der Züge ist immer noch nicht richtig, also nicht diagonal erzählt und darum ist noch etwas unklar, was die wirklich wichtigen Unterscheidungen in der Rechtsgeschichte des Zuges waren. Dass der Zug ein Ort für die Wahrheitsform ist, die man Geständnis nennt und mit der Inquisition verbindet, ist seit Alfred Hitchcocks Strangers on a train zwar allgemein bekannt, aber auch nur das ist über die Assoziationen zwischen Zügen und Recht allgemein bekannt und gesichertes Wissen, alles andere ist immer noch nur besonders bekannt und ungesichert. Leider ist das Programm für Tagungen, die ich organisiere, schon bis 2025 voll, aber für 2026 könnte man eine Tagung zu Zügen und dann endlich auch zu großen und kleinen Bahnhöfen machen, denn Bahnhof heißen wir jene Stelle, an der Züge halten.

Oh my God welcome to my BRAIN ROT get ready for a ride, I'm writing this in terms of my human au but its translates to what i think about cannon too, the meat of this is going under a read more but

TL;DR: All of the Z stacks have a complicated relationship with each other and while they would take a bullet for anyone else their relationships vary wildly from deep unbreakable bonds to literally would rather see the person get shot [also implied physical content but nothing in detail beyond "it exists"]

Also I'm not including Captain Zero or Zaffre here. Zero is pretty much removed from this and his relationship with all his tugs is very complex but even at its worst I see him as a mostly parental figure towards his tugs. And Zaffre is lesbian af and I've talked about her feelings towards the others before [tho not as in depth]

ZORRAN <--> ZEBEDEE

Zorran and Zebedee have a very close and complicated relationship, even if Zorran can be pissy and annoyed with Zeb [ie, calling him a creep, picking on him for being sensitive] they have a 'warriors bond' from years of dealing with Zero [the 'bad' years], the law, and the rapidly changing harbour. Zorran understand that Zebedee is a complicated guy with a very soft heart as much as Zebedee knows Zorran is an unwavering leader with a strict moral compass and a compassion for those around him, they admire that about each other.

There relationship isn't based in physical attraction but it can go in that direction when they are bored and looking.

ZORRAN <--> ZAK

They have an incredibly close relationship, they just get each other on a deep level. They confide in one another and will always be open and honest when in need. Zorran loves Zak's brash way of moving around the world and Zak loves Zorran's drive for success and perfection. They have romantic interest in each other but don't act on it, Zorran knows Zak won't be the settled down man he wants, Zak knows Zorran wouldn't be able to keep up with his dangerous lifestyle. But that also doesn't stop them from being intimate or living in the moment.

ZORRAN <--> ZUG

Zorran and Zug get along well and work together well, but Zorran isn't so interested in spending time with someone who reminds him of a snivelling worm and Zug, while intimidated by Zorran, doesn't think Zorran is all that interesting. But they will still play cards and share a drink after work, or help each other out. Zorran takes care of his men, and Zug is loyal to those he respects. They CAN get on each other's nerves easily, and Zug's work ethic and lack of spine can irritate Zorran quickly, but there are never hard feelings.

ZORRAN <--> ZIP

Zorran doesn't often show it, but he likes Zip even if he doesn't always get results from him. Zip, like Zug, is very intimidated by Zorran but he does look up to him and wants to make him proud. The two work well together when it's one on one, Zorran has high standards but he can see that Zip is young yet, he may be an airhead forever but he's got room to learn and needs guidance. Zip understands that Zorran is doing his best to try and take care of everyone, and doesn't hold any hard feelings when Zorran gets irritable. Zip has a lot more emotional intelligence than others in the fleet, which makes him valuable to Zorran as an ally even if it's not conventional. Zip's innocence and kindness, even if not traditional Z stack behavior, isn't something Zorran would ever want him to change.

I really like that in the show Zorran has very quiet moments when on screen where he talks more casually or quippy and off cuff. In those moments he can sound very similar to Zip which makes me think he might see himself in Zip. It's just a nice thought.

ZEBEDEE <--> ZAK

These two can bicker with the best of them but at the end of the day they've been around each other for years and have grown almost as close to each other as they individually have with Zorran. Zak can get annoyed with Zebedee and pick on him because of Zeb's inner feelings and 'softness', but wouldn't want the other to change. Similarly Zeb can get frustrated with Zaks tuff guy's brash attitude and strong headedness but can't stay mad for long. They'll never turn down spending time together and they definitely can get handsy and intimate whenever. It's just casual fun to them.

ZEBEDEE <--> ZUG

Zebedee doesn't have many strong opinions about Zug, but Zug likes to talk big game about Zebedee and how the other needs to be less of a softie. However Zug has the backbone of an eau clair and Zebedee really doesn't put any merit into what Zig says. They don't make any effort to make friends with each other but also won't actively avoid each other. Mutual amicable nods and existence is the usual with these two.

ZEBEDEE <--> ZIP

ZAK <--> ZUG

These two get along on a cosmic level. They are cut from the same cloth and share a lot of the same world views. Zebedee is very repressed in how he feels nowadays, but he admires how Zip moves around his world with a smile. And Zip doesn't feel as intimidated or afraid to be himself around Zebedee. They don't inherently try and spend time together but they very rarely fight or annoy each other, and always have a great time when they do get together. They are also just fond of each other in more intimate ideals, however Zeb doesn't really think Zip is mature enough for anything yet and Zip is well aware that he is having strong feelings because any and all feelings are new to him, maybe in a few more years.

ZAK <--> ZIP

Like Zip and Zeb, these two are cut from the same cloth. They just get each other. They've been fast friends from day one and bicker and joke and play around with ease. Often times when one of them is out doing something stupid the other is right behind or actively on the scene. They don't really have a strong romantic interest in each other, but they will do anything for the other and have a strong intimate relationship. There have been times they've talked about setting down with each other from their high stakes stupidity, but it'll be at least another decade or two before they stop causing problems and decide to calm down and start something serious. And one of them will probably be dead before that happens.

Zip is utterly afraid of Zak. He tries to be nice to Zak and just be friendly but Zak makes him deeply uncomfortable. Zak cannot stand how Zip acts and relentlessly picks on Zip. Give them a few more years and Zip will probably stop caring and that'll finally be when Zak starts to respect him but for now Zak would gladly push Zip off a bridge and Zip would let Zak get stabbed in a bar fight because he didn't want to bother Zak. Nothing between these two is ever just amicable.

ZUG <--> ZIP

These two bring out the worst in each other and they both love it. Zip DANM well knows that Zug has horrible ideas because of ego and drags him along. Zug DANM well knows that Zip is too friendly and naive to not fuck up basic tasks. That does not stop these two from rolling with the punches and causing problems on purpose or 'yes and'ing each other until disaster strikes. They are the best of pals most of the time, and their bickering is mostly in good fun. They don't have any real further attractions to each other beyond being good friends, they find nothing about each other appealing besides pretty normal friend things. These two are happiest when they are going with the flow and bouncing off each other, anything more formal and it falls apart for them. When Zip gets a little more sure of himself their dynamic may change but for now they are just Bros.

Und ultraorthodox übrigens heißt nicht zwangsläufig ultra-rechts, wie erste massenmediale Kommentare bereits zeigten. Es sei denn, man gibt sich alle Mühe mit dem Schauspiel. Und das hatten wir schon wie oft in der Geschichte? Ich lerne da selber jeden Tag etwas mehr, betrachte ich denn auch alte Aufnahmen für die Lernumgebung des Zug der Zeit. Vorgestern beispielsweise einen Stream aus der Amtszeit von President Roosevelt, der auf welchen heftigen Widerstand welcher Vorsitzenden jüdischer Organisationen reagieren musste? Auch diese Darstellung kam mir bekannt vor. "Ost-Juden" eben! Muss ich mehr sagen?

Übrigens: An meinem Twitter-Screen unter diesem Beitrag jemand mit Namen "Yossi Fuchs". Der uns was genau mitteilen möchte? Entschuldigung, ein bisschen Bildung ist jetzt notwendig. Aber ich verzichte bitte an dieser Stelle auf eine weitere Erklärung, auch wenn das sicher notwendig wäre, vor allem auch, da ich das echte Ginger Gen und das echte Löwenthal-Gen in mir trage, echtheitszertifiziert sogar mit Lager-Stammbaum! Sorry, aber das musste mal wieder sein! Und nun auch mal wieder hinter echt dreckeligen jüdischen Soldaten und Polizisten spielen wollen? Auch diese gibt es überall auf der Welt. Diese dreckeligen Stämme. Trotz aller frohlockenden Botschaften und Wanderungsbewegungen ins Gelobte Land sowie vielfältiger, eher unziviler Maßnahmen. Es wäre unpassend, das jetzt auch nur andeutungsweise versuchen, kurz und knapp zu erklären Es gibt sie immer noch, diese dreckeligen Stämme. Und viel mehr, als manche hoffen. Was? Nun. Mehr Bildung ist verdammt notwendig. Boston beispielsweise in den USA. Und Einwanderung aus Mittel- und Osteuropa. Die Folgen. Chicago. Kämpfe mit allen Mitteln. Das Thema Kosher Nostra. Und: Revolutionen. Cui Bono? Beispiele. Eine Familiengeschichte: Die Kahans aus Baku. Es geht um Öl. Sehr viel Öl. Bolschewiki und Menschewiki. Alte und mögliche neue Kooperationen. Professor Dr. Verena Dohrn hat weiteres Material zusammengetragen und schreibt so dicht, aber immer verständlich, dass ich jedes Buch von ihr eigentlich mehrmals lesen müsste. Und wen haben wir da? Na, die Elite? Wieder nicht einverstanden? Auch mal wieder spielen, schnattern und sammeln wollen hinter zivilen und militärischen Ermittlern und Einheiten, zuständig beispielsweise für die Bearbeitung ethnischer Säuberungen? Mit welchen Methoden was verhindern wollen? Für wen? Ja? Bitte? Och! Soll ich das "Oha" - Geschallspiele soeben wirklich erklären? Doch. Das passt!

just found some Valiant AU development sketches and notes in my old OLD sketchbook

I really thought it would be a webtoon

long post warning! And I mean long looooooooong post. If you get to the bottom and go "I'm not reading allat" I do not blame you

General notes:

This Valiant AU was meant to be a solarpunk superhero slice of life that slowly reveals a heavier plot, mostly focusing on character interactions and personal growth

White Hat Incorporated is a struggling, newbie business and clients are rare

The episodes can range from domestic shenanigans like fixing a leaking pipe or getting dinner, to running their business by defeating the villain of the week

The villains and heroes stay in their roles from canon. The only ones with major changes are our main 4 guys

All major information about White Hat would be discovered from the point of view of Lumencia and Zug as they realize that not only is PEACE corrupt, but that their boss is neither human nor demon nor alien

Now onto the characters themselves:

Dr. Zug Gleis

Like his name suggests, he likes trains. His train is also a drill that was an attempt to burrow out of government's arrest

Which he then modified into a laboratory, each train cart being a unique kind of laboratory for surveillance, medicine, etc. He sleeps very uncomfortably in cramped spaces and likes it that way

V.I.R.U.S is now a software he created and repurposed into his bratty computer assistant, now Cambot. She's also the one recording all their commercials and making his coffee. Basically Zug doesn't get along with ANY of his children

He doesn't like to leave his laboratories, so he set up a network of tunnels through White Hat's mansion that send and receive messages, inventions, food, etc. There's one little chute for these in most parts of the place

His arc was focusing on his inability to accept help from others because he sees any kind gesture as a possible way to control him. Even worse if the kind person genuinely means it, because he also sees accepting kindness as a handicap, a debt

His villainy was an easy way to make money and show the world his capability without any assistance from any hero or villain organization

Really, he just wants to be able to do whatever he wants, but his need to be the best or else he's the worst is tiring for him. Anger issues don't help

This stemmed from a past of constantly being bullied and compared to his brother, Goldheart

After dropping out of hero college, Zug became his own supervillain's known as The Mad Condoctor, whose theme was, you guessed it, trains. He stole trains, modified scrap metal, targeted stations and trade centers, held hostages, prepared puzzles for heroes to solve, etc

The Mad Condoctor was notorious for being uncooperative and a backstabber. He operated at night and was an expert in secret missions, spyware and tech-based combat and the likes

By the first season finale he would have genuinely cared for his coworkers but still didn't value his own life, so he let himself be taken in by PEACE. The crew have to go retrieve their idiot and many things about White Hat Incorporated are revealed to the public after they clash with their local PEACE headquarters

He finds authority annoying and hates seeing people kiss up. Mostly shameless in his actions and doesn't much care for other people's opinions. Can be honest to the point of hurting

So he is a terrible liar. It's like he's allergic to it or something. Prefers to lie by omission

Will only call White Hat 'sir' and 'jefecito' sarcastically or to get a point across. Unfortunately hopelessly devoted to him at the end of the series whoops

Lumencia

A superwoman with horse-like powers that decided to choose unicorns as her motif because that's way cooler. She has kicks and punches that convert her diet into energy, which is great because she loves eating

Changed it up so that Lumencia is the resident prankster and WH tells puns, not the other way around

She has a room with a slanted ceiling which she can climb out the window of to lie and chill on the roof. She's also converted that space, where flat roof meets slanted roof, into an outdoor cinema/gym, decorated with christmas lights. The mansion is a three-way clash of decorative styles from afar

She doesn't have a license to be a hero, but she helps out wherever she can anyway, stopping purse snatchers and helping lost children find their parents and such

In fact, she is actually one of the most beloved people in the little town they live near, with many residents familiar with her buffoonery but affirming her as a reliable source of help

She's also relatively well-known online, as she posts videos of her playing the guitar and well-intentioned but nonsensical 'Lumencia Tips', filled with terrible puns and comic-like ballpoint pen doodles

Her arc would have focused on letting herself acknowledge her strengths that aren't related to fighting

Shes very buddy-buddy with petty criminals and shop owners alike, able to strike up a conversation and make pals no matter who they are. Once she deems you chill, you can chill, yknow? This isn't on purpose.

Even though she has gross taste in food and is messier than Zug, her handwriting is very pretty and neat. She also is very good at graffiti and sticks to an aesthetic, with glitter and y2k stickers and denim-clad wizards on skateboards, all the works

She has a very straightforward view on heroics and is not big on plans, preferring to punch her way out of situations or annoy her enemies to tears. In fact, her main goal is to become an official part of one of the many PEACE-brand hero leagues.

There's other hero corporations too but PEACE is the number one in America

So one day she just showed up on White Hat's doorstep and never left because it would 'look good on her resume'.

Previously, she bounced from place to place, relying on connections and the occasional tip from her halfway-illegal heroism efforts to get by. She also doesn't remember where her powers are from, only that her parents worked at PEACE and where killed by 'villains' when she was a little girl

Her favourite place is the funfair because that's the last nice memory she had

By season two she would have started another arc where she learns that she was an experiment and her parents were killed by their own higher ups in PEACE to silence them, and she has to come to terms with why she even wants to be a hero as well as stand her ground when her optimism is challenged.

Lumencia's music is like whatever Equestria Girls and Electric Mayhem have going on. I think the genre is power pop? Either way it sounds like those elaborate 80s radical van murals look

Is an effortless liar in the sense that she says the most batshit things with utmost confidence and treats consequences like an afterthought.

Only calls White Hat 'White Hat' and not 'boss' when she feels the situation calls for it. Also unfortunately hopelessly devoted to him by the end of the series

An extra set of hands that cleans the place and helps out with their little business. Does not like being interuppted when listening to music

Goes from 'fucking hate these guys' to 'they give me food therefore they are mine' in the span of the entire series

Quite lazy, plays the winning side. Which is usually the heroes here

Dunno if I'd call his arc an arc. All I know is there's an episode where his spoilt teenager-ismd hits their peak and Zug and Lumencia have to reach an understanding with him by respecting his boundaries and helping him feel secure

And after that episode, 624 stopped being a total catalyst for disaster plotwise

White Hat

He is one of the comic reliefs and manages White Hat Incorporated, often making really stupid decisions because profit is not on his mind

The final voice I settled on for him was fucking Australian Markiplier

His "growth" would be the characters and readers seeing him to actually be a caring, experienced-in-heroics-but-not-business individual who gives really sound advice and becomes a source of comfort for his close friends

But is still a MEGA-PRICK. Every time he gets beat up it's for a valid reason

In canon, villainy triumphs because Black Hat is there. In the Valiant AU, the story is in the heroes' favour because White Hat is in his place.

I wanted him to be (mostly) opposite to Black Hat in many ways! BH's office is huge, minimalistic, corporate and cold, while WH's office is small, maximalistic, filled with sentimental items and like a warm cabin.

BH basks in hellfire and while WH does use fire, he prefers the ocean. BH enjoys golf, WH enjoys dancing. BH takes himself seriously, WH very much doesn't. BH detests everything, WH has an appreciation for everything. And etc...

They're still horrible creepy eldritch monstrosities, the fish theme for WH is just because he likes ocean shit and fish are scary

BH has made himself known globally and universally, he has statues and monuments and paintings

WH has nothing; White Hat is five years old. This is his first time being White Hat

But he's been around since the beginning of time, taking many forms and names, learning the wonders of the universe and giving all of his time to help however he could

He believed this to be natural, he's the one of a kind who doesn't need rest or food. He can't die or get really hurt, and would later learn he couldn't bear to love either

Some of the things he was included many plants and animals before the humans, then farmers and warriors, witches and politicians, an entertainer vigilante, a writer, a parent, a fur-clad warrior in the snow, guiding forces of nature, and a female pirate.

I wanted him to cycle through the entire alignment chart in terms of morality as he exhausted everything he could do to make a difference

After World War 2 on earth, his psyche gave out and he collapsed into a long, long nap; a shadow pooling in a lake, his favourite

Finally woke up and decided to take his own form not based on any species or star or tree, chose his own outfit and everything

And made his debut as White Hat, forged documents to start a small business for heroes support

He doesn't have an arc, but if he did, he would be in the midst of learning to let himself get attached again and be properly selfish. Maybe identity issues.

But he doesn't have an arc

And so really only serves to help out Zug and Lumencia. He's comfortable with no one knowing these things about him ever, because what would they even do if they did?

Wouldn't change anything, they wouldn't understand the full scope even, so he's at peace with himself right now, grateful that he's alive for once

He uses manipulation to direct conversations away from himself and get people to spill their feelings, or burrow into their trauma without using magic

if he wants he can let loose to trigger some kind of indescribable primal instinct within a person, that cripples them with terror and despair and love for the sublime face of something divine, bigger than the observable universe. He doesn't like doing this.

He's a fan of ice and shadow manipulation, he thinks the colours go well with his coat

Most animals hate him and he cries about it

He also cries when he tries to download an app on a laptop

He is a competent medical doctor, babysitter, and waiter. In fact, he seems to have infinite patience and calm when he isn't whining over dessert like a toddler

The human skeleton hanging in his office is real

Hopelessly attached to Lumencia, Zug and 624 by the end of the series but they don't need to know that

Nachdem er anfuhr ließ er der Maschine auslauf und ich erlebte für mich die lautstärkste Fahrt einer Dampflok! Laut stampfend jagte 99 1734-5 mit dem DR Zug aus Buschmühle hinaus um in wenigen Minuten in Kipsdorf anzukommen. EIN UNVERGESSLICHES ERLEBNIS!

Wozu Anfängerübung?

Dass ich erkenne, was die Welt im Innersten zusammenhält, so heißt es bei Prof. Dr. Faustus. Frage für die Klausur: Was ist dabei Recht?

Recht ist "eine Gesamtheit zueinander in systematischem Zusammenhang stehender Anordnungen und Normen zur Regelung des Verhaltens einzelner Menschen, um deren Zusammenleben zu ordnen, Konflikte zu lösen und Kooperationen zu organisieren." (Prof. Dr. Google).

Aby Warburg gibt in der Form (!) eine andere Antwort, ob sie total anders ist wissen wird jetzt (!), nämlich am Anfang nicht, weil wir alles, was wir wissen, prinzipiell dank und durch Formen wissen, die auch einen Anfang haben und einen damit (an-)fangen, vielleicht auch fesseln, aber nicht so, dass man sich nicht auch davon lösen könnte.

In einer erst preußischen, später dann deutschen oder bundesrepublikanischen Klausur, in der die Frage nach den Grundlagen des Rechts gestellt wird, da wäre Aby Warburg wohl mit diesen beiden Tafeln durchgefallen, obwohl die Tafeln tun, was Gottfried Wilhelm Leibniz den zukünftigen Beamten einmal vorgeschlagen hat, um dem Souverän Übersicht darüber zu verschaffen, was er wissen solle, um souverän zu sein. Er hätte vielleicht die sogenannte 'Universität' und ihre unverschämt mies und unter Mindestlohn bezahlten Korrektoren überfordert und sie hätten gesagt: Deine Schuld, nicht unsere.

Warburg legt nämlich 'gewisse Staats-Tafeln' an, um Grundlagen von Verträgen (den Lateranverträgen) und einer Staatsgründung (der Gründung des Staates der Stadt Vatikan) zu sichten.

Diese Sicht, wird sie aber eingerichtet oder ausgerichtet? Wenn ja, dann reich und reigend, also auf richtig und rechtlich unruhige Weise bewegt, selbst wenn man Warburgs Einladung, Tafel 78 vor Tafel 79 zu stellen und damit mit Tafel 78 anzufangen, bevor man zu Tafel 79 kommt, annimmt. Selbst wenn er mit einem Bild, das dem Muster einer Abendmahlszene gleicht, einlädt, Tafel 78 oben links anfangen zu lassen und bei Tafel 79 einlädt, mit Sitzen zu beginnen (weil einer der Vertragsparteien und Staatengründer der heilige Stuhl sein soll), also selbst wenn die Anfänge doch einladend, vertraut und klar erscheinen, stillt das nicht die Betrachtung, sie bleibt im Bestand wendig, in der Ruhe rauschend und im Starren geladen.

Was ist Recht? Darauf gibt Warburg präzise Antwort, keine allgemeinen und in der Allgemeinheit zwar klaren, aber doch auch geklärten, ausgeleerten und ausgehöhlten Antworten. Er lässt eine Gesamtheit fallen, das, was man sieht reicht (nichts muss nachgeliefert werden), er ordnet an, lässt zusammenhängen, stellt zueinander. Er macht, wovon die gegoogelte Definition des Recht nur spricht. Die Definition lässt das Wort System fallen, lässt eine Definition des Systems aber aus, Letter. Warburg systematisiert, lässt aber ebenfalls eine Definition des Systems aus, Letter. Die zitierte Definition und Warburgs Tafeln sind in der Form anders, aber nicht total anders, beide sind einander übersetzbar. Die abstrakte Definition liefert das System im graphischen Zug eines Wortes, das aus sechs Buchstaben besteht, ein Bild des Systems mit dem gedruckten Wort System. Warburg liefert auch ein Bild des Systems: mit einer Teilung und Verdoppelung: zwei Tafeln, auf denen geteilt und verdoppelt wird. Das Selbe zieht durch die Unterschiede, die Unterschiede durch das Selbe. Die Definition und Warburgs Tafeln kontrahieren und distrahieren, in der Lektüre und Betrachtung kommen sie sich näher und rücken voneinander ab. Das ist ius, Recht, Kunst, Technik und artifiziell. Das einzige, was man gemeinsam hat,sind die Probleme, die man teilt (Bazon Brock), wir haben nur, was zwischen uns steht.

Das Recht, jenes, um das es Aby Warburg geht, das ist dasjenige Recht, das am 11. Februar 1929 anfing, das ist ein besonderes Recht, das Recht eines Staates, der am 11. Februar 1929 angefangen haben soll. Was ist ein Anfang? Das sind hier, auf diesen Tafeln, Verträge (etwa, wie Gesellschaftsverträge eine Gesellschaft anfangen lassen sollen), besondere Verträge, nämlich die, die am 11. Februar 1929 unterzeichnet, am nächsten Tag gefeiert und im Sommer ratifiziert wurden.

Was hält das alles zusammen? Wenn der Zusammenhalt ein Grund ist und der Grund ein System, dann ist der Grund das Tragen und Trachten, dann sind das die Züge (trainierbar wie in Anfängerübungen), die etwas trennen, um etwas zu assoziieren und die etwas assoziieren, um etwas zu trennen und die dann noch mit aller Unruhe systematisch sind, selbst wenn Einzelne nie das System darin sehen können, sondern immer nur Formen davon und Einzelne sich später immer wieder sagen lassen müssen, sie seien nicht von Anfang an dabei gewesen. Zusammen halten normative, kooperative und rekursive Züge.

Was ist das Recht? Ein Zug aus Zügen, graphischen und choreographischen Zügen, trainierbar: bar jeden Trainings und Bar jeden Trainings. Kanzleikultur weißt etwas, dank und durch Wissen an der Bar, science at the bar, dank bar associations und dank der Trennung, die eine Bar durchzieht. Das sichtet Warburg konkret, schließt sogar konkrete Hinweise darauf ein, dass diese Züge verschlungen und verschlingend (unter anderem katholisch anthropo- und theophag) sind, dass Gasparri hier einen symbolischen Pakt mit einem diabolischen Mörder schließt, denn darauf verweist das blutige Corporale aus Orvieto, zu dem man von Rom aus gelangt, wenn man an der Stelle vorbeifährt, an der der stinkende Leichnam Matteottis gefunden wurde.

Warburg schafft Distanz, seine Sichtung lässt die Verträge und die Gründung ansehen. Er schafft dasjenige Ansehen, das Mussolini mit diesem Deal suchte. Er kreditiert, wie er es im Bankhaus seiner Eltern und mit bürokratischen Techniken, etwa Tabellen und doppelter Buchführung der römischen Kanzleikultur gelernt hat. In diesem Ansehen und Kreditieren schließen sich Vertrauen und Misstrauen nicht wechselseitig aus, die sind ineinander und aneinander und sogar durcheinander (durch das andere) übersetzbar. Melancholisch fehlt so einer Sichtung ohnehin, was sie hat. Das Misstrauen ist darin nicht die Abwesenheit eines Trauens, es ist Trauen, das vermisst und vermisst wird und darin entfernt gehalten wird. Das Trauen geht in seiner Gegenwart nicht auf, es ist nicht weniger entfernt als das Misstrauen, es ist anders entfernt, auf höhere und tiefere Stufe, nähere und weiter Distanz gehalten, aber auch darin entfernt wie das Misstrauen. Den Tafeln fehlt etwas, das vermissen sie, sie fehlen (cum ex tafeln sie uns eine Geschichte und Theorie römischer Verträge und einer Staatsgründung auf), weil sie vermissen. Die Melancholie ist u.a. auch ein Talent, mit Polarität umzugehen. Die Tafel sind sehr kompliziert und sehr einfach, multiplizit und simple, magisch und trivial, man braucht aber Zeit um durchzukommen, Zeit die immer schon bemessen ist. Anfänger! Lässig bleiben: ein Essay ist zu schreiben, in einer bemessen Frist - aber man kommt immer nur soweit, soweit man kommt - und Dozenten, die Anfängerübungen machen, machen Anfängerübungen, weil sie Anfängerübungen selber schon mitgemacht haben und wissen, dass alle Anfänger nur mit heißen Wasser kochen.

Ich bin geehrt, dass Anfängerinnen und Anfänger zu mir kommen, um mit mir zu üben, anzufangen. Das ist schon ein Geschenk, wenn ich mir dann noch was wünschen kann: Schärfe, weiß nicht warum. Alles lesen, als ob es scharf sei, selbst wenn es einen drängt, zu sagen, es sei unscharf, dann ist im Lesen solange etwas scharf zu stellen (und für das Lesen Verantwortung zu übernehmen), bis es scharf scheint. Schreiben, bis das Schreiben scharf scheint. Sichten, bis die Sicht scharf scheint. Klugheit: solange Lesen, bis es scheint, dass das, was geschrieben steht, klug ist. Solange schreiben, bis es scheint, dass das Geschriebene klug ist. Es wäre schon toll, wenn Anfänger alles geben würden, um toll anzufangen, aber auch Dozenten können nicht alles haben. Schärfe und Klugheit ist etwas, was ich von zukünftigen Ratgebern am Recht will, ich weiß aber auch: Kinder, die wat wollen, krie'ng wa' auffe Bollen. Das gilt auch für Erwachsene, noch für Doktoren, Privatdozenten, Professoren, Direktoren, Kanzler, Präsidenten, Premierminister wie Mussolini und Päpste wie Pius XI. Die Zeit ist kurz bemessen, auf die Plätze fertig los!
