Iván Wadgymar has a homemade banner hanging off the balcony of his soon-to-be former walk-up apartment in Little Italy, warning fellow tenants of the increasing instability renting in Toronto.

The banner, which reads “We want to live in Toronto. Stop the greed, stop the mass evictions. Save Tkaronto (Mohawk word from where the name ‘Toronto’ is derived),” was hung off the balcony for several weeks up until this Monday when, as Wadgymar said in an interview a few days prior, he and cousin Cecillia Jabbaz were officially scheduled to move out of their three-bedroom apartment at 860 College St. enforced by an official eviction order from landlord Almega Co., an asset and property management company based in Mississauga.

“We had no idea it was coming, said Wadgymar. “We had no idea. We had zero interaction (with the landlord ), aside from sending them (the monthly) rent cheque. We never had any issues to raise with them.”

According to Ontario tenant law, a tenant being evicted under the justification of major renovations or construction, commonly known as a renoviction, which is the case with Wadgymar and Jabbaz, is entitled to compensation in the form of three months of rent, or another lease in a unit owned by the landlord, provided it’s suitable.

But because 860 College only has four residential apartments within the building, none of the tenants would be legally entitled to any compensation since provincial requirements only apply to residences with five or more units.

“I’m trying to make a point (with the banner),” said Wadgymar last week. “This is not about money. This is about (people) learning and perhaps changing this little loophole (in Ontario tenant law).”

Wadgymar and Jabbaz’s situation worries their local MPP. Marit Stiles, who represents the Davenport riding for the NDP, says she’s not surprised that the tenants are being left unprotected.

“While the purpose of the loophole was to limit costs borne by smaller landlords, we’re increasingly finding buildings owned by holding companies (and large property managers) are benefiting from it,” said Stiles. “And I don’t think the legislation was written with those types of landlords in mind.”  

Stiles said she’s contacted Minister of Municipal Affairs and Housing Steve Clark's office to discuss tougher legislation to close the provincial loophole surrounding tenant compensation, but hasn’t heard back.

“The solution is tougher legislation that penalizes landlords (who take advantage of the loophole),” said Stiles.

We reached out to Clark to comment on the provincial tenant legislation that governs compensation. In a statement, ministry media relations spokesperson Conrad Spezowka declined comment on the specifics of the 860 College evictions, but said the provincial government has sought out feedback from both tenants and landlords on improving the Ontario Residential Tenancies Act.

"Our government wants to make sure both tenants and landlords are treated fairly. We are encouraging a safe and fair system when renting a property so both the tenant and landlord can benefit," said Spezowka in an email sent Tuesday.

Wadgymar blames spiralling rents for his predicament, which have seen the cost of a one bedroom in the neighbourhood exceeding $2,000 a month.

He takes some solace that after losing at their eviction hearing before the Ontario Landlord and Tenant Board in late August, and being ordered to move out in late September, he has managed to remain in the apartment (Jabbaz and another roommate have already moved out) until almost November.

Following media attention to his story, Wadgymar says representatives of Almega, including president and CEO Basem Hanna, reached out personally to negotiate financial compensation with the tenants, which Wadgymar says they accepted last Wednesday.  

We contacted Almega for comment on the eviction and the settlement, and were told that Hanna was on vacation for two weeks and couldn’t be reached for comment. Our inquiry was forwarded to another company representative, Spencer Shafran, a senior analyst with Almega. In an email sent Monday evening, Shafran declined to comment further, only saying it is "a difficult situation for all parties involved".

Jabbaz said the offer was accepted reluctantly and borne out of a desire of the tenants to salvage something from the situation. Despite the settlement, Jabbaz, who is recovering from knee surgery and planning to live with her mother for the time being, is not confident she will be able to find another place in Toronto. She hopes landlords show more compassion for tenants such as herself in precarious situations.

“They have the law in their power, but they forget we’re people,” said Jabbaz. “We’re not bad people, we’re just trying to live here.”

Suède:  Ca y est ! Les fêtes de Noël sont passées et le Nouvel An a été célébré. Alors que les dernières décorations de Noël s’effacent tranquillement de notre paysage urbain, il est temps de se concentrer sur une nouvelle célébration : l’Épiphanie ! Un petit peu d’histoire... Aujourd'hui, le monde chrétien célèbre l'épiphanie. En France, on fête l'arrivée des Rois Mages à Bethléem en partageant la célèbre galette des rois. Les Suédois, eux, s'ils n'ont pas de tradition culinaire particulière, ont fait du 13e jour après Noël (« Trettondag ») un jour férié. La tradition remonte au Moyen Âge : l'épiphanie était le moment pour les stjärngossar, garçons vêtus de blanc et coiffés de chapeaux pointus décorés d'étoiles, d'aller de villages en villages, pour y donner des spectacles et chanter. Aussi, pendant ces 12 jours entre Noël et l'épiphanie, les hommes ne devaient faire aucun mouvement rotatif, car le temps s'étaient arrêté… Pas bête quand on pense que Noël se dit Jul, et que Jul signifie roue, une roue qui s'arrête pendant cette période avant de repartir vers le printemps ! Aujourd'hui, les petits garçons s'habillent plutôt en stärngossar pour la Sainte Lucie, même s'il n'est pas impossible d'en croiser quelques-uns le 6 janvier. En fait, les traditions se sont un peu perdues, si bien qu'on se demande pourquoi l'Épiphanie reste un jour férié ici. La Suède est en effet un des rares pays à en faire un congé payé, alors que beaucoup de chrétiens ne savent même pas de quoi il s'agit. Almega, un syndicat patronal, a d'ailleurs lancé le débat il y a quelques années, s'attaquant surtout au caractère religieux des jours fériés en Suède. Selon lui, ils devraient être neutres, et ce serait aux employés de décider individuellement quels jours seraient fériés. Un sujet controversé, mais qui n'a pas fait plus de vagues après que Martin Modeús, évêque au sein de l'Eglise de Suède, ait affirmé son importance.
