Throughout American history, Black individuals, specifically Black males have been arrested and jailed at higher rates than their white counterparts. The influence of these arrests stems from the age of slavery. 

The 13th amendment is a well know adaptation to our constitution as it is known to be the amendment that “freed the slaves”. What many individuals do not know is the true implications that the 13th amendment has on People of Color within modern day society. 

To quote the 13th amendment directly, it states that “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.” 

Although many believe that slavery does not currently still exist against Black individuals, this is simply not true. As brought through within the 13th amendment, slavery is still legal when a crime has been committed and it is being used as a punishment for that crime. 

You may be asking? Well, if slavery is still legal for anyone who commits a crime, how does this influence Black people and specifically Black men directly. As shown in the graphic above from the “Sentencing Project” it can be shown that Black men have an increased probability compared to their white counterpart of facing incarceration within their lifetime (1 in 3). The documentary further investigates this by portraying research that shows that Black individuals (specifically men) are being arrested at higher rates than their white counterparts. The documentary 13th expands on this idea by displaying how Black men have been seen as more “dangerous” due to physical attributes and therefore are arrested at higher rates to reduce the “danger” within society, as while as utilizing the physical attributes to allow for work to be done at reduced or nonexistent rates.

Slavery to Mass Incarceration 

“I’m beginning to believe that U.S.A stands for the Underprivileged Slaves of America'' wrote a prisoner from Mississippi who witnessed the constant violence behind bars in the 20th century. There are over 2.3 million people behind bars which over the past 40 years has increased 500 percent. In the book, Essentials of Sociology: a Down to Earth Approach states that African Americans take up 38% in America’s prisons. America is home to five percent of the world’s population but 25 percent of the world’s prisoners, which is one out of four people, in this nation we call, “ land of the free”. In 1865 the 13th amendment in the constitution was put in place to make slavery illegal. However there is a loophole that states people in America are granted freedom; however, if you are a criminal, you lose all freedom privileges. Ever since the civil war, the Southern states were left broken. There were about 4 million people that were once “property” who held an important role in the economic production system in the South that are now free. What is there to do? How do you rebuild the economy? The loophole in the 13th amendment was then explioded and African Americans were arrested in masses. It was the nation's first prison boom. The 13th amendment basically says yes everyone in America is granted freedom but once you’re criminalized, you’re a slave once again. These injustices led to Blacks being apprehended for very minor crimes such as loitering or vagrancy. Once these African Americans were incarcerated, they essentially had to provide labor to rebuild the economy of the South after the Civil war which then led to the rapid transition on black criminology. “They would say that the negro was out of control, that there is a threat of violence to white women”, says Jelani Cobb in the film, 13th by Ava DuVernay. These untrue assumptions, allegations, and biases shaped the very negative view people of color had. Newspapers, officiers, people in high figure positions would describe African Americans as animals, predators, and criminals. The stereotypical depictions of the Black male as hyperbolized predator, societal menace, and perpetual threat lead to the legitimization of state police violence against the African American male (Powell). This then shifted to the creation of the Jim Crow Laws. These were laws that regulated African Americans to a permanent second-class status. No one could describe the situation African Americans feel better than Bryan Stevenson, the founder of the Equal Justice Initiative, as he says,” Everytime you see a sign that said “white and colored”, everytime you were told you couldn’t go through the front door, everyday you weren’t aloud to vote, everyday you weren’t aloud to go to school, you were bearing a burden that was injurious”.  In the 1960’s through the late 1970’s, there were civil rights movements, human rights movements. These people, not only African Americans but Latinos, Hispanics, people of color, started gaining a poor profile as more and more people are getting arrested for disobeying these segregation laws labeling them now as criminals. Criminals for fighting for equality. 

During the Nixon campaign, he presented the phrase, “Law and Order”. Basically a war on crime that was later demonstrated by President Reagan. People, predominantly people of color (African Americans, Latinos, Hispanics), were getting sent to prison for low level offenses like marijuana. It was a backlash toward the civil rights movement. John Ehrlichman who was Nixon’s advisor at the time admitted to the campaign being a front to essentially do what they want to people of color by saying,”The Nixon campaign in 1968, and the Nixon White House after that, had two enemies: the antiwar left and black people. You understand what i'm saying? We knew we couldn’t make it illegal to be either against the war or black...but by getting the public to associate the hippies with marijuana and the blacks with heroin, and then criminalizing both heavily, we could disrupt those communities…We could arrest their leaders, raid their homes, break up their meetings, and vilify them night after night on the evening news. Did we know we were lying about the drugs? Of course we did” (Newman et al). Crack was all over black communities and cocaine was all over white communities; however, crack had harsher criminal sentences than cocaine did. People of color were getting life in prison for the same amount of crack that White Americans had in cocaine who would get a slap on the wrist. 

Soon after, CCA (Corrections Corporation of America) became the leader in private prisons. It is a multi-million dollar business today that essentially gets rich off punishment. Because the War on Drugs was giving people harsher sentencing, this fueled a rapid expansion in the nation's prison population in the 1980s. This led to the modern emergence of for-profit private prisons in many states and at the federal level (The Sentencing Project). The CCA pushed law, SB 1070 in Arizona, which gave the police the right to stop anyone who they thought looks like an immigrant. This law essentially filled immigration detention facilities which then benefited the CCA. We call them “detention facilities” but really they are a prison for immigrants. The CCA profits greatly by locking up immigrants and people of color because the more people locked up equals a bigger payday. We went from slavery, to innmates, to dollar signs. It seems as though the government will never see us as actual human beings. See that we are more than labor workers, more than animals in a cage, or more than just a profit. 

We forget that history is a component of power. What I mean by that is history is a field of power that is shaped by dominant structures or parties. We do not learn the harsh realities of slavery, the Jim Crow laws, mass incarseration, or African American history in general and the trama that came from them. We learn the most simplified version. History has always been told to benefit the white race or benefit European cultures. This will come off with a conspiracy tone, but we only know what they want us to know and we are only taught what they want us to learn, which is true. I also would like to point out how many movies and TV shows are being made about different struggles African Americans face, however, it's never accurate and very simplified. 

. Dr. Raymond Winbush said it best in an interview, “It is a straight historical line. And so these words “mass incarceration” do not make you think of White people or women. You think of Black men. And that again is a straight line. This silly show on T.V., Orange is the New Black was written by a White woman who was in jail for a year. She does not have a history…….what do you mean, the new Black? In other words, we are supposed to think that mass incarceration is not happening to us. So when I think of mass incarceration, to me, as a scholar, there is a direct connection between enslavement and mass incarceration” (Winbush). We watch Orange is the New Black and think we know everything. But these are voices of people who don’t know the full story or never experienced such trauma and because of that, they add on to the misconceptions created for the public knowledge. We can see this in movies like Hidden Figures and 42. Both amazing movies on very important and impactful moments in history, but both directed by White men. I’ve learned that the struggles that people of color face, the struggles that we try all our life to fight out of, are used for political gain, for money. The difference from the past and now is we can force conversation. We have the power of technology to share our experiences, to show the world the injustices that are happening. We the people are stronger and more connected now than we were in 1865. To have people understand and change the notion of human dignity is powerful, it’s not one life is more valuable than another each life is valuable. For all lives to be valuable we the people need to understand that we the people need to be treated as equal first and foremost.

Criminalizing of people of color in the media- Research Paper

     We as United States citizens have consumed media that has falsely portrayed people of color in one way or another. The media has been criminalizing people of color for hundreds of years and in a wide range of media genres and has negative effects on our country's people and generations to come. the ideological formation of race has allowed our country's leaders to influence our thoughts of other races. criminalizing people of color not only separates everyone but also promotes the growth of government agencies that contribute to the imprisonment of criminals which is why change still must be done to rid of race and false portrayal of different races. 

“Birth Of A Nation”    

      After the Civil War, the 13th amendment not only to set slaves free but also provided motive to criminalize people of color for the growth of government corporations that make money from the labor of inmates in prisons in order to reconstruct the south. Once all of the slaves left their owners, companies needed a large number of workers fast to thrive. A great outburst of false accusations towards people of color began in order to fill the positions lost. (ROEDIGER)

       In the early film "Birth Of A Nation" the term blackfacing is created, a white actor would be painted black and made to look like a savage. this character would become the embodiment of the criminalized people of color within our media. In the film, the man pushes a young woman to the point where she decides to kill herself rather than to be raped by the savage (DUVERNAY). Although most people could see the exaggeration in the film today, the implications of it when it was made could have had a far wider impact on society due to it being such an early film. The earliest forms of criminalizing of people color may not have reached as many people as the media does now, but the level of belief then was much higher due to the lack of information among people.

     The media mainly utilized the newspaper initially to portray people of color negatively. On December 1, 1892, a report of a young student of color refused to comply with a teacher. [insert article] This is an example of how the media blows situations out of proportion only to make a different race lesser than the majority.          

Last One Hundred Years   

  The U.S. evolved in the 20th century tremendously, the larger the population grew, the more prisons were built and the prison population has continued to rise. The Civil Rights Movement have been the highlight of the 20th century due to the importance of change politically and socially within the U.S. 

    In Bakersfield, California 1965, a report of a riot during a Civil Rights Movement event in Cleveland was reported on. The article portrayed the rioters as violent criminals with a purpose to cause chaos and havoc. It also does not help when the reporter uses the N-word every other sentence to refer to the rioters/protestors.

    For example, during Richard Nixon's presidency, there was an obvious push for the fight against crime while most of it came from lower class areas where people of color are concentrated. Anti-war and black movements were targeted and made out to be something worse than they were. also sometime after Nixon's term, audio of an office official was leaked talking about how their methods were mainly for so that blacks get hurt worse than whites.     Then-president Reagan and his office used the war on drugs as an excuse to continue the push for the growing incarcerations of drug dealers who were largely people of color. the legislation was set where the cheaper, more accessible drug crack had a higher offense, while cocaine was a higher class drug with lesser penalties. most of the people of color were drawn to crack due to its accessibility made so that more people of color were getting affected by this drug epidemic in the country.      During Bill Clinton’s term is when the media started to really over portray people of color as criminals by giving them names such as “super-predators” Donald Trump used the word “wolf-pack” when referring to a group of teens who were falsely accused of a crime they did not commit. At this time new legislation was passed implementing new laws that were unfair towards people of color mainly because there were only white prosecutors, mass incarceration was occurring, people of color were weaponized through the criminal justice system and laws like three-strikes your out and mandatory minimum. The Crime Bill militarized the police force by increasing the number of officers on the street, the bill also increased the number of prisons within the U.S. (DUVERAY)

           The motive for our media's habits is seen when you uncover the facts about the laws and people who govern the US. political lobbying groups like ALEC influence our politicians' who make decisions that affect the entire country.  corporations like correctional facilities are influencers, making it easier for l to make large amounts of money through the incarceration and processing of prisoners within our country. large donations and agreements are made to ensure the increase in profit from this new form of slavery called imprisonment.

Present Day

     In more present times we see media separating the white people from people of color by showing multiple sides to issues that involve race. The difference between now and twenty years ago is social media. this still new and growing thing has changed the way we consume content and news. There will always be multiple sides to every story such as in natural disaster situations in lower class areas, people had to take supplies from local convenience stores in order to survive, but when the news stations report on these situations they portray the people of color as looters in a negative way while referring to other people doing the same thing as survivors in a more forgiving way. This has happened many times but in this case, it is in reference to Hurricane Florence and Hurricane Katrina. The divide between the way the media portrays certain groups of people shines a light on the ongoing issue of racism and the new form of slavery within the U.S.(JONES)

    In  2017 Donald Trump signed three executive orders that intensified the criminalization of people of color. (HARDEN) The false premise that crime is increasing allows for there to be control over protesters, immigrants, and large scale protesting groups that push for change. Policies like zero tolerance and mandatory minimum have returned making it easier to imprison people of color to be imprisoned.

   People of color have continuously been affected by their ongoing criminalization through the media and will for a very long time. According to the NAACP, the number of incarcerations from 1980 to 2015 has increased from 500,000 to over 2.2 million. 

   Stopping the false criminalizing of people of color in the media will not fix the rising incarceration numbers nor will it fix our ideologies that have been shaped by the media in the U.S. The problem will continue to get worse until there is a widespread push for change within our government and the media that serves it.
