WASHINGTON ― Would Donald Trump ever have become president if he hadn’t paid off porn star Stormy Daniels to keep her quiet in the days before the 2016 election? The answer is impossible to know, but the premise of the question forms the basis of the very first criminal trial of a former president in American history: whether Trump’s scheme to keep Daniels’ claim of a 2006 affair with him under wraps was, in fact, a crime for which the coup-attempting former president should be punished. While “hush money case” has become the shorthand to describe the first of Trump’s four criminal cases to go to trial, particularly among Trump defenders who wish to diminish it, that is not how it will be described to prospective jurors Monday at the scheduled start of jury selection. Judge Juan Merchan’s first sentence of a 223-word summary describing the case to jurors reads: “The allegations are, in substance, that Donald Trump falsified business records to conceal an agreement with others to unlawfully influence the 2016 presidential election.”
Manhattan District Attorney Alvin Bragg, who brought the 34-count indictment against Trump just over a year ago, will argue that the ledger entries and other business documents Trump created claiming that he was paying lawyer Michael Cohen for “legal services” when in reality he was repaying him for the $130,000 check he delivered to Daniels, were felonies under New York law. “The core is not money for sex,” Bragg told New York’s public radio affiliate last year. “We would say it’s about conspiring to corrupt a presidential election and then lying in New York business records to cover it up.” Trump’s campaign did not respond to HuffPost’s queries for this report. He has primarily argued on social media and in his campaign speeches that the case was brought to hurt his efforts to regain the presidency, another piece of the “witch hunt” that he claims the “deep state” is conducting against him.
He repeated those claims Friday during a brief news conference. “It’s not even a crime,” he said. “It’s very unfair that we have this judge who hates Trump.” It’s unclear precisely how long the trial will last or even how many days it will take to seat a jury, although estimates suggest it could stretch into June. Merchan, in an April 8 letter to prosecutors and defense lawyers, noted the logistical challenges involved in trying a former president and presumptive major party nominee who travels with a substantial Secret Service detail. “In a case where security concerns are implicated every time anyone enters or exits the courtroom, or mingles around the corridors, moving the entire jury panel is no simple task,” Merchan wrote.
Bragg’s filing accompanying the indictment lays out the plan Trump and his ally David Pecker, publisher of the National Enquirer, developed to “catch and kill” stories that could hurt Trump’s presidential campaign. The scheme also involved paying off a doorman at a Trump building, who claimed Trump had a fathered a child outside his marriages, as well as a Playboy model, Karen McDougal, who also claimed she’d had an affair with Trump in 2006 and 2007. Neither of those payments, though, were made by Cohen, and the actual indictment only involves Trump’s reimbursements to him.
To what extent Trump’s successful pre-election silencing of Daniels, whose real name is Stephanie Clifford, played a role in his narrow 2016 win is unclear. Trump lost the national popular vote by 2.9 million ballots but won Wisconsin, Michigan and Pennsylvania by a combined 77,744 votes, which gave him a healthy Electoral College victory. After watching his poll numbers crater after the Oct. 7, 2016, release of the “Access Hollywood” tape, in which he bragged that his celebrity allowed him to grab women by the genitals, Trump slowly recovered over the coming weeks as Russia’s spy agencies and their ally, Julian Assange, on a near daily basis released stolen emails designed to hurt Democratic nominee Hillary Clinton.

Whether it would have cost Trump the election, of course, does not matter in terms of his criminal trial. Prosecutors must only prove that Trump had Cohen make the payment to Daniels for the purpose of influencing the election and that he subsequently created fake business records to disguise the purpose of the reimbursements.
“I think the case is strong as a matter of both evidence and New York law,” said Norm Eisen, a White House lawyer under former President Barack Obama who recently published a book about the New York prosecution. “If Bragg proves that theory of the case, and I think he will, he will establish this was no minor hush-money peccadillo but a serious democracy crime.” Trump faces three other felony criminal prosecutions ― two of them based on his attempt to remain in power despite having lost reelection in 2020. A federal indictment could go to trial as early as late August, depending on the timing of a U.S. Supreme Court ruling on his claim that he is immune from prosecution. A Georgia state prosecution based on his attempt to overturn his election loss in that state could also start later this year. An unrelated second federal prosecution based on his refusal to turn over secret documents he took with him from the White House to his South Florida country club has not yet been set for trial.
Today is the first day of Donald Trump's first criminal trial in New York v. Trump to determine whether the hush money payments to Stormy Daniels and Karen McDougal made by Donald Trump to falsify business records in order to influence the 2016 elections leads to convictions for Trump.
If Trump is convicted on even one charge, he'll be forever known as Convicted Felon Donald Trump, and that would hurt him at the polls come election day because people who are hesitant on voting Joe Biden again but don't like DJT likely won't vote for a convicted felon to lead the nation.

A degree in magic being offered in 2024 will be one of the first in the UK, the University of Exeter has said.
The "innovative" MA in Magic and Occult Science has been created following a "recent surge in interest in magic", the course leader said.
It would offering an opportunity to study the history and impact of witchcraft and magic around the world on society and science, bosses said.
The one-year programme starts in September 2024.
Academics with expertise in history, literature, philosophy, archaeology, sociology, psychology, drama, and religion will show the role of magic on the West and the East.
The university said it was one of the only postgraduate courses of its kind in the UK to combine the study of the history of magic with such a wide range of other subjects.
'Place of magic'
Prof Emily Selove, course leader, said: "A recent surge in interest in magic and the occult inside and outside of academia lies at the heart of the most urgent questions of our society.
"Decolonisation, the exploration of alternative epistemologies, feminism and anti-racism are at the core of this programme."
The course will be offered in the Institute of Arab and Islamic Studies.
Prof Selove said: "This MA will allow people to re-examine the assumption that the West is the place of rationalism and science, while the rest of the world is a place of magic and superstition."
The university said the course could prepare students for careers in teaching, counselling, mentoring, heritage and museum work, work in libraries, tourism, arts organisations or the publishing industry, among other areas of work.
A choice of modules includes dragons in western literature and art, the legend of King Arthur, palaeography, Islamic thought, archaeological theory and practice and the depiction of women in the Middle Ages.

I mean, it could have been quite good, the history of magic; the effect on human imagination and storytelling; magic in literature and art; magic as metaphor for what we don't know, a stand-in for science; the evolution of societal perceptions of magic through the growth of the scientific method; the role of magic and revelation in early epistemological (truth claims) processes... this could have been a fascinating course.
Then they had to ruin it by stuffing it full of intersectional Gender Studies horseshit and making it ideologically corrupt and completely academically worthless. Except to piss off daddy, who's paying the bill.
This is the exact kind of luxury course that only bored, privileged, upper-middle class people with no real problems or ambition would take. If you take it, you have nothing better to do, and no ambition to better your future prospects. It's low-effort, academically shallow, fosters undeserved moral elitism, but still takes in tuition fees, so it's unsurprising that it exists.
You'd be getting loan forgiveness for it over my dead body, though.

The law meant the government could overrule Supreme Court decisions and give the executive branch more power to appoint justices, The Hill previously reported.
The legislation sparked controversy and protests across the country, as critics labeled it a threat to democratic values.
The Supreme Court ruled 8-7 to overturn the law because of the “severe and unprecedented harm to the core character of the State of Israel as a democratic country.” It voted 12-3 that it had the authority to overturn the “Basic Laws,” major pieces of legislation that serve Israel similarly to the Constitution for the United States, The Associated Press (AP) reported.
Opponents of the law argued that Netanyahu’s effort removes the standard of reasonability and opens the door to corruption and wrongful appointments of unqualified justices, the AP reported.
The overhaul was placed on hold when Hamas militants killed 1,200 people and kidnapped more than 200 hostages in an Oct. 7 surprise attack on Israel and prompted the war that is nearing the three-month mark."

In a technologically advancing society its contradictions will lead to more and more violence against the advancements that refute its beliefs and/or to a rejection of the Spiritual entirely and possibly even to 'science based' Fundamentalist Atheism, an outcome which could conceivable be even worse than the Reign of the Patriarchal Father/God Himself, as such would still have Masculinist world views embedded deep within its core, views then 'enshrined' by Science. There are many who believe that we as a species need some sort of metaphysical operating system to help us deal with what a appears a vast and indifferent Universe; Belief as a 'survival mechanism'. Keep in mind that in Plato's list, Metaphysics comes after Physics, literally means 'after physics'. In that paradigm it is a reasoned extension of the scientific world view. So therefore it should be understood that The Pentavalent is meant to be a way to see 'after physics', not a refutation of them as nearly all other religions tend to be. Back in 2019, Poland’s Konfederacja party was seen as a curiosity rather than an actual political player. Counting just 11 members in the 460-people-strong Sejm, the lower house of the Polish parliament, it was not even an actual party in a legal sense, but a coalition composed of two very unlikely bedfellows—a libertarian faction of deregulation aficionados that joined the leadership of the National Movement, a far-right Catholic group with decisively anti-European, xenophobic views. Separately, these two entities stood no chance of crossing the 5 percent electoral threshold, but together they managed to secure the backing of more than 1.2 million voters, which translated into 6.81 percent support and gave them a foot in the door to mainstream politics.
These days, Konfederacja, consolidated under the leadership of Slawomir Mentzen, a charismatic 36-year-old Thatcherite with a doctorate in economics and a talent for shooting viral TikTok videos, might tip the scale in the upcoming elections, scheduled for Oct. 15.
After eight consecutive years in power, Law and Justice (PiS), Poland’s nationalist-populist governing party, is struggling to mobilize its core electorate, which is displeased with worsening economic conditions, rising costs of living, and money channeled toward helping Ukrainian refugees. It looks almost certain that PiS will fall several seats short of forming a majority. But a similar outcome looms for the opposition, divided into three blocs and tormented by years of internal quarrels between its leaders.
Konfederacja, in turn, chooses to stand by and watch. On the one hand, it continues to be highly critical of the current government, accusing it of corruption and clientelism at home with simultaneous submissiveness to Brussels and Washington in foreign policy. Recently, it has added Kyiv to the list as well, arguing that Poland has been way too generous in its support for Ukraine and Ukrainian refugees in the country, effectively cornering PiS and forcing it to assume a new, harsher approach toward Ukrainian President Volodymyr Zelensky.
The opposition camp, which has added the adjective “democratic” to its name, is not good a partner for the kingmakers, either; its policies are socially progressive and its diplomatic orientation staunchly pro-European. But the government and opposition do share one trait: They are led by experienced politicians, whom the younger electorate especially considers worn out, morally compromised, and out of touch with reality.
Konfederacja promises to offer a breath of fresh air under a textbook anti-establishment narrative. Its politicians market themselves as a real, viable option rather than a lesser of the two evils.
But who are they, really?
The eccentric marriage from the previous term has now been replaced by a much more unitary form of practicing politics. The nationalists have been largely marginalized and their socially conservative voice quieted. The label that Konfederacja would likely choose for itself is “modern right,” similar to the self-portraits painted by other European radicals going mainstream now: Spain’s Vox, Italy’s Fratelli d’Italia, or the Swedish Democrats. Even the former leader of the nationalist faction—Krzysztof Bosak, a former legislator for an ultraconservative Catholic-leaning party called the League of Polish Families—is now wearing the hat of data-obsessed protectionist in a tailor-made suit; he is happy to debate anyone anywhere on what he argues are the negative economic implications that migrants bring for Poland.
Economic policy, not social norms, is Konfederacja’s unique selling point in the current campaign. When its politicians  advocate for shutting down borders and oppose the EU’s migrant relocation mechanism, they try to couch it as an economic argument. Migrants are primarily cheap laborers in their eyes, putting unfair pressure on Polish entrepreneurs, who are left with no choice but to employ them—obviously at the expense of domestic workers. The racism and xenophobia are still there, but hidden out of plain sight, as they would scare off some of the less radical voters.
The same goes for sexism, which Konfederacja’s leaders try to dismiss at any costs. Polls continue to show the coalition’s support coming mostly from young males who oppose—just like in the case of Vox— social changes in favor of women and sexual minorities. So Konfederacja took on a major effort to demonstrate popularity among female voters—though it’s had limited success thus far. It will, however, become necessary at some point, since it aims to evolve into Poland’s most important conservative party within the next 10 to 15 years. Going mainstream means that one can no longer be rough around the edges.
But Konfederacja’s leaders seem to know that very well. They are playing the long game. Both in their public statements and in off-the-record conversations, they convey a single message: there will be no deal with PiS after the elections. Even though Warsaw has been buzzing with rumors of a supposed list of conditions and ministerial appointments that Mentzen has put forward in backstage negotiations with the ruling party, he denies those rumors in every public appearance.
His acolytes add that a possible offer from PiS would never interest them precisely because of their anti-elitist DNA. They are not morally corrupt, they say, so public appointments and material benefits do not make them blink. There is no bottom-up pressure on the party’s leadership. This, in turn, makes it easier for Mentzen to force his rebellious approach. And since voters, dissatisfied with politics overall, want Konfederacja to flip the table rather than to sit at it, on paper, it all looks credible.
The devil is in the details. Mentzen openly admits that he has ambitions reaching well beyond becoming a minor coalition partner. But he also knows that he is, after all, a political debutant. The post-1989 democratic Poland has a rich history of anti-establishment parties mushrooming in the election season, scoring single, sensational victories and disappearing into thin air immediately after, usually consumed by more experienced, larger players. Konfederacja knows that nothing makes it fully immune to that scenario.
At the peak of its performance in summer polls, the coalition reached a staggering 16.9 percent support—a result that was probably inflated, but impressive nonetheless. Should the final score be lower, however, disillusion among voters might start to brew. Rejecting a possible offer to join the government with PiS might then become a much riskier bargain. Radical politicians campaigning against old-fashioned elites often get carried away and gamble with their support, eventually punching well above their weight—just like Italy’s Matteo Salvini, the leader of the far-right Lega party, who in 2019 renounced his position as Italy’s deputy prime minister and forced a snap election, but overplayed his hand and lost the leadership of Italy’s right to current Prime Minister Giorgia Meloni.
Should Konfederacja pursue that risky path as well, Poles will probably return to the voting booth in the spring. Mentzen would hope for a rebel premium—that is, a boost in support for resisting PiS—but who is to say that he would be able to sustain his popularity for another half a year and actually perform better in an election rerun?
This fear is likely consuming him, especially since the tides of Polish politics can switch suddenly. Much of Konfederacja’s support grew over the summer out of increased discontent among Poles, tired of Warsaw’s unconditional support for Ukraine. Already in the spring, a number of studies began to show a clear tendency among the electorate: the Polish people were happy to back the Ukrainian cause but not necessarily happy to aid the Ukrainians residing permanently in their country. Poland would not be the only one to adopt such a stance. Many countries are anchored in Western international bodies but geographically close enough to the war zone to experience direct, mostly economic, consequences of Russia’s invasion of Ukraine. Similar tendencies have emerged in Turkey, Slovakia, and Bulgaria.
Konfederacja capitalized on that but did so through an economic lens. Mentzen and Bosak toured the country and produced countless social media posts while trying to persuade its voters that they are bearing the costs of Ukrainians’ presence. The Polish state should not prioritize foreign citizens over its own, reads their message between the lines. And PiS, according to Konfederacja, is doing exactly that.
The party’s foreign-policy program is a reflection of that sentiment. It is not necessarily opposed to aiding Ukraine against Russia, mostly because such a position in Poland, one of Europe’s most anti-Russian societies, would be a political kiss of death. But Konfederacja’s politicians argue that Warsaw’s relationship with Kyiv should be much more transactional.
They’ll give weapons, financial aid, and advocacy on the international stage, but only in exchange for contracts for postwar rebuilding guaranteed to Polish companies. Should Ukraine refuse to give such guarantees, they argue that Poland ought to back out of cooperation. Konfederacja would also support some sort of rapprochement with President Vladimir Putin’s Russia, independent of the war’s final result. From its point of view, PiS jumped the gun when it led the sanctions offensive against the Kremlin. Poland, after all, is Russia’s direct neighbor and used to be its economic partner. As such, a total isolation of Moscow costs money.
Thus, reestablishing trade links would be in Poland’s national interests—provided that these are defined in purely mercantilist terms, which is what Konfederacja’s politicians propose. This is perhaps the only area of their political manifesto where libertarian principles are still smoothly paired with nationalist views. Money knows no nationality or ideology, and to enrich one’s country is to serve it best, so trading with Russia would not be unimaginable for Konfederacja.
PiS caught wind of that and shifted its own position. The past few weeks in Polish politics were dominated by a sharp turn in Warsaw’s strategy toward Kyiv. Prime Minister Mateusz Morawiecki announced that Poland was no longer going to supply its eastern neighbor with any new weapons. He also promised that the country will “not allow Ukraine grain to flood us,” announcing that, independent of Brussels’s decision on the matter, PiS will keep its embargo on Ukrainian grain. This is both an attempt to solidify the ruling party’s support in rural areas, as well as to steal Konfederacja’s thunder.
Even the recent cash-for-visas scandal involving dysfunction in the Polish government offices that allocate Schengen visas, which was expected to rock the partisan scene, will not work to the kingmakers’  advantage. PiS is skillfully diverting public opinion away from its own misdemeanors. Independent media report on corruption in the Polish foreign ministry and the possibility of as many as 400,000 visas given to non-European migrants without proper screening, and the rest of Europe demands explanations.
Germany introduced spot checks on its border with Poland in response, and Chancellor Olaf Scholz publicly accused Warsaw of “waving through” the migrants so that Germans have to deal with their asylum applications. Morawiecki kicked the ball back, accusing Germany of letting refugees into Poland and promising to “seal” the country’s western border.
Moreover, TVP, Poland’s public broadcaster-turned-PiS mouthpiece, has not mentioned the cash-for-visas story even once since it broke four weeks ago. In such an airtight propaganda ecosystem, Konfederacja—arguably the most anti-migrant party in Poland’s history—stands no chance on gaining from the scandal.
The outcome on Oct. 15 is anybody’s guess, but one possibility worth exploring in Poland’s case is the Swedish scenario. The Sweden Democrats, a far-right party with neo-Nazi roots, is not a member of the ruling coalition. But it acts as the power stabilizer, as it backed the government in crucial votes through a separate agreement. As such, the Sweden Democrats killed two birds with one stone: they remained relevant and influential in everyday politics while keeping their anti-establishment label pretty much intact. In the meantime, they scored a number of victories, especially in hardening Sweden’s migration policy.
In the current climate, Konfederacja’s politicians—and its voters—would probably accept such an outcome without even blinking.

The Charismatic Politician: Jörg Haider

Jörg Haider was an Austrian politician and served as the leader of the far-right Freedom Party of Austria from 1986-2000 and Alliance for the Future of Austria (2005–08) and as governor of the Carinthia (1989–91; 1999–2008).
Early Life 
Haider was born in Upper Austria, the son of a shoemaker, to parents who were both active Nazis. Both had been more than nominal members of the Nazi party – his father served as a lieutenant in the Wehrmacht in the Second World War. ( INDEPENDENT Company UK, 2011). Jörg Haider did well in school and attracted attention from nationalist organizations. He was drafted into the Austrian Army and after his service went to the University of Vienna to pursue a degree in law in 1973-1974. 
Rising Political Career 
He became chairman of the youth organization of the Freedom Party of Austria (FPÖ) as a college student quickly rising through the ranks. The Freedom Party of Austria at this time was a mixture of political currents opposing the two main political parties, the Austrian People’s Party (ÖVP) and the Socialist or later Social Democratic Party (SPÖ). Both of these parties had dominated the field and state levels. Haider rising through the ranks was elected secretary of the party in Kärnten (Carinthia). An already established member and manager of the FPÖ affairs in Carinthia. In 1979, at age 29, he was elected to the national parliament. (Britannica, 2021). Becoming more aggressive in policy and rhetoric Haider critiqued FPÖ leadership more vocally. The Freedom Party of Austria at the time was a minor political movement and not winning many votes from the people. In 1986, Jörg Haider defeated the more liberal FPÖ leader Norbert Steger to become the leader of the party. 
The Amassing of Power and the Freedom Party of Austria 
From the fast start to Jörg Haider’s political career anybody could tell that there was something special about him. He positioned himself as a charismatic leader transforming the party adding a more popular appeal. Following state elections in 1989, however, the FPÖ finished second to the SPÖ and formed a coalition with the ÖVP, enabling Haider’s election as governor of Carinthia. (Britannica, 2021). Now amassing power as the leader of the FPÖ and governor of Carinthia, Jörg Haider unleashed his political agenda. In the national parliament, he attacked Austria’s encrusted political structures and became stronger with every year in opposition, collecting protest votes from the working class. (Politico, 2008). He also opposed Austria’s bid to enter the European Union and vehemently denounced immigration into the country. However, in June 1991 during a heated debate in regional parliament about unemployment benefits where he praised, "In the Third Reich they had an 'orderly' employment policy."(The New York Times, 2000). After these remarks, the coalition was dissolved and Haider was forced to resign as governor. Nevertheless, Haider’s bold words about immigration and even hints of Nazism struck a chord with Austrians. The Freedom Party of Austria was increasing in strength on all political and governmental levels all thanks to the polarizing popularity of Haider. He was subsequently re-elected to the governor of Carinthia in 1999, showing that the FPÖ held a larger portion of the votes in parliament. Haider’s support in Carinthia did not diminish and he held that position until his death. 
The Populist Appeal 
Haider took the Freedom Party of Austria and metamorphosed it into one of the most successful populist far-right parties to exist. His charisma for the work and the people of Austria turned him into a cult leader. An academic journal from the University of Vienna described his political style as, “The image Haider propagated of himself contained ideological overtones, positioning himself as a ‘true representative of the people’s innermost needs and will”. (The University of Vienna, pg.145). This quote encapsulates one of the core foundations of populism appealing to “the people” and against “the corrupt elites”. This directly relates to Mudde and Kaltwasser’s definition of populism as, “More concretely, we define populism as a thin-centered ideology that considers society to be ultimately separated into two homogenous and antagonistic camps, “the pure people” versus “the corrupt elite”, and which argues that politics should be an expression of the general will of the people”. (Mudde and Kaltwasser, 2017, pg.6). In persuasive argumentation and propagated speeches through the FPÖ and Austrian politics, Jörg Haider used populist ideas to his advantage. A direct example of how Haider accomplished this would be, “..., used a populist strategy of us vs. them, focused on public corruption and political influence-peddling inherent in the Proporz system, accusing the traditional coalition of social democrats and conservatives of moral bankruptcy and misusing tax money.”(The Brookings Institution, 2019). Another way Haider utilized populist principle was the exclusion of “the ethnic other”. In the Finchelstein reading this principle was characterized as, “Populists push nationalists proposals intended to exclude the other and to integrate followers, while remaining deeply suspicious of difference”. (Finchelstein Introduction, 2017, pg.30). This quotation represents the framework put forth by Finchelstein and confirms Haider’s utilization of it. He even went as far to state that, “the societal foundations of Islam are diametrically opposed to our Western values”. (The Brookings Institution, 2019). Jörg Haider transformed the Freedom Party of Austria into an energetic and polarizing far-right party mobilizing young followers and changing the landscape of politics in Austria. 
A Virtuoso of Media 
Haider had a flare for the dramatic and operated the media to his will. He was often in the news and the center of controversy because of his remarks that were in support of Nazi policy. The way he puppeteered the media was one of great acclaim. Unexpected moves, polarizing public opinion, and personal attacks against his critics grabbed the media’s attention. By portraying himself as the only politician to go up against the empty promises of the mainstream parties. Examples of this kind of virtuoso of the mass media included, “Haider was at his best when he had just orchestrated a scandal, often with fierce personal attacks on renowned public figures. When public disapproval escalated, he would call for a press conference, where journalists and the public expected him to apologize or at least justify his behavior. However, Haider used his rhetorical ability and the self-manufactured attention to reframe the debate and propel his political messages.” (The University of Vienna, pg.147). Haider through his spectacular oration was often able to circumvent scandal and even further the FPÖ political agenda. Haider not only presented his opinions through press releases and news conferences but also television interviews which he often dueled the hosts on. He commanded natural authority and authenticity making even his opponents admire him. Haider had reached celebrity status through his charismatic and artful wielding of the mass media. 
Conclusion
 After his long storied and successful run as the leader of the Freedom Party of Austria, he left the party to form a new populist party called the Alliance for the Future of Austria (BZÖ) in 2005. The FPÖ leadership was transferred to another charismatic leader named Heinz-Christian Strache who took the party to an even more radical position. However, on Oct. 11, 2008, Haider died from injuries sustained in a car accident.

President Trump has filed his answer to the articles of impeachment against him. In legal parlance, an “answer” is a document filed at the beginning of a proceeding, typically a civil case, in which the defending side gives its response to factual allegations and lists the basic grounds for its defense.
Trump’s answer did neither, not in any serious way. His arguments are wrong on the facts and wrong on the law, but that’s not the worst part. At its core, his submission represents an attack on the impeachment process — and on the Constitution itself.
The answer doesn’t bother to present any coherent factual response to the impeachment charges. Instead, it declares that Trump “categorically and unequivocally denies each and every allegation.” Is Trump denying, say, that he demanded that Ukraine announce it was investigating the Bidens? Or that he ordered documents to be withheld and witnesses not to testify before Congress? The evidence to the contrary is overwhelming.
Beyond that, on the facts, Trump’s answer presents only a few bare conclusions, pointless irrelevances — and outright misstatements. It tells us, once again, that Trump’s July 25, 2019, call with President Volodymyr Zelensky of Ukraine was “perfectly legal” and “completely appropriate.” Trump “raised the important issue of Ukrainian corruption,” the answer asserts. Read the transcript, as the president might say. He did not.
The answer claims Ambassador to the European Union Gordon Sondland and Sen. Ron Johnson (R-Wis.) “actually exonerate” Trump. Why? Because they say Trump said — after the whistleblower complaint was made — that he would never demand a quid pro quo. But that’s not proof, just Trump justifying himself. “The security assistance was sent, all without the Ukrainian government announcing any investigations,” the document goes on to say. Yes — two days after the House announced it was investigating the Ukraine matter.
As for the law, the answer claims, in the most cursory fashion, that “the first Article” — alleging abuse of power — “fails on its face to state an impeachable offense.” In particular, the answer asserts the abuse of power article “alleges no crimes at all, let alone ‘high Crimes and Misdemeanors,’ as required by the Constitution.”
That argument ignores that no statutory crime is required by the Constitution for impeachment and that abuse of power is in fact the essence of impeachability: The English parliamentary history upon which the Framers adopted impeachment makes clear that a public official’s breach of duty to put the public interest first constitutes an impeachable, removable offense.
Even if a statutory crime were required, the House’s charge that Trump tried to solicit a personal benefit (Ukraine’s announcement of an investigation) in exchange for an official act (releasing the security aid) constitutes bribery, both as understood in the Framers’ time and under the federal criminal code today.
What the answer really tries to do, however, above all else, is to attack the very legitimacy of this impeachment — and of impeachment generally. Echoing White House counsel Pat Cipollone’s Oct. 8, 2019, letter to House leaders, Trump’s answer complains that the House proceedings were a “one-sided process” that was “lawless” and “violated basic due process” and “every principle of fairness.”
Even if that were true, it wouldn’t matter. The Constitution makes the House the charging body in the impeachment process, like a grand jury. By vesting in the House the “sole Power of Impeachment,” the founding document makes it wholly the House’s business how to decide whether to impeach a president.
But it isn’t true that the process was fundamentally unfair: Members of the Republican minority, hardly afraid of carrying water for Trump, had full opportunity to, and did, cross-examine witnesses and make whatever arguments they deemed worthwhile to make. And if there was any exculpatory evidence to be heard, the White House could have offered it. Instead, Trump did everything he could to block evidence from coming in.
Even beyond that, by the plain terms of the Constitution, the House isn’t the place to hear and weigh all the evidence. Because the Constitution provides that it’s the Senate that’s vested with “the sole Power to try all Impeachments.” Weighing all the evidence is what a trial is for — in the Senate.
Worse yet, though, is the answer’s rhetorical attack on the Constitution’s ultimate method of ensuring that presidents comply with the law. Trump’s impeachment is “a dangerous attack on the right of the American people to freely choose their president.” It’s “a brazen and unlawful attempt to overturn the results of the 2016 election and interfere with the 2020 election.” Removal would mean “nullifying an election and subverting the will of the American people.”
That’s as close as you can get to saying without saying that, because Trump was elected or stands for election again, he can’t be impeached or removed no matter what he did. But the same could be said for any president. If taken to its logical conclusion, Trump’s rhetoric about nullification and subversion of the people’s will would mean no president could ever be held to account by impeachment — and every president, in effect, is above the law.
