What does tier 4 mean for the property market?
England is now under four tiers of coronavirus restrictions, with London and parts of the south east having been placed in the highest tier by Prime Minister Boris Johnson.
The good news is that under the government’s new advice, the housing market remains open for business, whether you’re buying, selling, renting or letting.
Tier 4 – stay at home
Tier four replaces tier three as the very highest level of English restrictions and is reserved for areas in England where transmission rates of Covid-19 are rising rapidly.
People living in these areas are not allowed to meet anybody outside of their household or support bubble in an indoor or outdoor setting, apart from open public spaces such as parks and beaches, where one individual may meet one person from outside their bubble.
Tier four residents have been advised to stay at home and cannot leave or be outside of the place they are living unless they have a reasonable excuse.
The public are also advised not to travel in and out of these areas, other than for work, education, accessing youth services or caring responsibilities.
What does tier 4 mean for the property market?
The government has been clear that the property market is staying open even as restrictions are toughened, and during the latest national lockdown moving services continued but with Covid-secure measures in place.
Leaving your home to undertake activities associated with finding and securing a new home, or moving home, are considered exemptions to the advice to stay at home.
However, people outside your household or support bubble should not help with moving house unless absolutely necessary.
The government has called for flexibility among movers and sellers under these measures, should plans have to change due to any of the households involved contracting or being exposed to Covid-19.
Can I view properties in a tier 4 area?
Yes.
In-person viewings are still allowed under tier four. However, some estate agents, sellers and buyers may decide to postpone viewings while restrictions are in place.
That said, renewed lockdown measures may also heighten people’s desire to move if they are unhappy with their current accommodation.
Virtual viewings can continue to take place and are likely to be offered by estate agents in the first instance so that any in-person viewings are given to the most interested prospective buyers.
As in the lower tiers, Covid-secure measures should be firmly in place during in-person viewings.
Such measures include the wearing of face coverings, regular hand washing, keeping doors and windows open for good ventilation during the viewing, and only two prospective buyers from the same household entering the property at a time.
Sellers and the estate agent may choose to wait outside the property or decide not to be present while viewings are undertaken.
Open house viewings are not allowed under tier four or any of the lower tiers.

If any member of either the household whose home is being viewed, or the household viewing, shows symptoms of Covid-19 or is self-isolating, then an in-person viewing should be delayed.
Are estate agents in tier 4 open?
Yes.
However, as with tiers one, two and three, the toughened tier system means people are being encouraged to work from home when possible.
This might mean some agents choose to work from home, continuing to work digitally and remaining open at branch-level by appointment only.
Can I move house under tier 4?
Yes.
Estate and lettings agents, removals, valuers and people in sales and lettings offices and show homes can to continue working under the tiered system.
Meeting with people outside your household or bubble “to facilitate moving home” is listed as one of the government’s exemptions from gatherings limits across all tiers.
The government advice is to follow the national guidance on moving home safely, which includes advice on social distancing and wearing a face covering.

Selling a residential property – the Timeline
If you’re selling a residential property, these are the steps you’ll need to take. The timeline below assumes there is not a chain on the property.
Putting your property on the market – Week 0
The first step to selling your property is putting it on the market. Normally, this is done via an estate agent who will advertise your property, arrange viewings and put up a ‘For Sale’ sign outside your house. During this stage, people will come to your property for viewings, to see if it may be suitable for them.
Receiving and accepting an offer – Week 8-12
The next stage in selling your property is receiving and accepting an offer. Normally, this takes around 12 weeks from first putting your property on the market. You are under no obligation to accept any offers you receive and can negotiate with any interested parties until you reach a decision.
Legal Due Diligence and exchanging contracts – Week 12-20
Contracts that have been drawn up and reviewed by your solicitor are exchanged with the buyer once they have arranged their mortgage and carried out necessary surveys, legal work and inspections on the property. The legal process can take anywhere between 4 to 8 weeks from accepting the offer, but may take longer if any issues arise during the survey or legal process. Once contracts have been exchanged, you are legally bound to sell the property.
Completion – Week 20-24
Following the exchange of contracts, and once payment has been made in full, the sale completes. This marks the legal change in ownership of the property. Tier 1 Entrepreneur – the rules are the rules
The Court of Appeal has made yet another unfavourable decision – unfavourable to applicants that is – about the points-based system, this time in connection with the Tier 1 Entrepreneur route. (This visa route is now closed to new entrants but still available for those applying for extension or settlement.)
Mr Junied, a national of Pakistan, had applied in-country for leave as a Tier 1 Entrepreneur but the application had been refused by the Home Office.
The reason for refusal was this. His brother, Mr Babar, had made £200,000 available to him for investment into the company. Mr Babar had tried to provide – as the relevant immigration rules require – a letter from the Halifax Bank confirming the existence of the money and also confirming some other details. The required form of the letter was detailed and prescriptive.
Unfortunately the Halifax would not provide such a letter. But what they did do was to provide a bank statement and a letter from the bank manager explaining why they could not provide such a letter – ie it was not their policy. This letter finished with the words “I apologise if this causes you any inconvenience…”.
Well, it did cause some inconvenience, because the application was refused on the basis that it had not included a letter in the required form.
Administrative Review with the Home Office followed. Mr Junied claimed that it was not fair for the application to be refused for the lack of something that it had been impossible for him to fulfil. But this application was also unsuccessful.
Then came Judicial Review before the Upper Immigration Tribunal, but also unsuccessful, and ultimately the matter ended up before the Court of Appeal.
Now, the average intelligent layperson might think that there was some justice on Mr Junied’s side. After all, it really was not his fault, and why should he be made to suffer because of the arbitrary unwillingness of the bank to provide the letter he needed for a successful application?
But the intelligent layperson would, by definition, not be armed with extensive knowledge of the relevant caselaw. However, the Court of Appeal was, and it trawled through a number of decisions in the same sort of legal area, and this was not helpful.
The court adduced ringing phrases from previous cases such as “… the PBS … puts a premium on predictability and certainty at the expense of discretion” and “The emphasis now is on certainty in place of discretion, on detail rather than broad guidance. There is much in this change of approach that is to be commended… and “… occasional harsh outcomes are a price that has to be paid for the perceived advantages of the PBS process…”.
And, on a different tack, the court said that on the evidence before it it had not been proved that it was impossible for the Halifax to provide such a letter and, in any case, the applicant could have gone to a different bank to try and get such a letter.
The court also looked separately at the issue of fairness but, alas, this did not help Mr Junied either. The clearly stated strict principles of the points-based system did not admit of any possibility of the exercise of discretion on the grounds of unfairness.
The court also considered whether the relevant immigration rules might be ultra vires (ie outside the power of the authorising Act of Parliament) but again, no joy for Mr Junied. The court held that these rules are “rational and policy based… though strict, not arbitrary…”.
So Mr Junied was unsuccessful. This decision seems harsh, especially in some parts. But the court argued in extensive detail that it was in line with previous decisions, and so there we are.

“Сustody” and “access” to children
In days gone by there was a perception that divorcing parties went to war over what was termed “custody” and “access” to children. Those terms no longer exist and a Court may make orders pertaining to “live with” and “spend time with” , terms which are much more user friendly. It is usual , but not always the case, that young children live with mother and spend time with father. Sometimes there will be a shared order, but the Courts are keen that children  have a clear perception of where their “main” home is.
The views of the children are taken into account to a degree especially as they approach their teenage years. A “ wishes and feelings” report may be commissioned by the Court. But what a young child states that he or she wants is not necessarily what is best for them. Parties are encouraged to decide what is best for the children as between themselves – the view is that even though they cannot get on as husband and wife, they should endeavour to co parent as mother and father. Thus the “no order” principle came into being. Unless it can be shown that it is manifestly better for there to be an order, rather than no order at all, the Courts will leave well alone. There is no hard and fast rule about this – each case will be decided on it’s own merits.
The powers of the Court still exist to regulate other situations such as where the children will be schooled ie a faith school, private school or otherwise, and for example, whether the party who does not have day to day care of the children can remove them from the jurisdiction. Usually no permission is needed for a holiday up to 28 days provided it can be shown that the children and the party travelling with them have roots in the UK, a return ticket and have provided an address and phone number whilst overseas. Otherwise, a Court will decide what is  best for the children. These orders are called “specific issue” orders, and as the name suggests, they exist to deal with specific issues which may arise between the parties.
The issue of child maintenance is a difficult one. The Child Maintenance Service deals with these matters. However it is possible for there to be an agreement within the divorce proceedings for an agreed monthly sum to be paid. The Court cannot rule on this if not agreed. However there are provisions for lump sums for children to cover capital expenditure  such as school/university fees under Schedule 1 of the Children Act 1989. These are separate from the finances within a divorce.
To a very large extent the emphasis has been shifted to the parties to regulate their children’s lives without reliance upon judicial guidance.  Divorce Solicitors central London
