It’s a Family Business - …!

As ANOTHER delay in the voting on the ‘hideous development’ is approved by Olathe (for Oddo’s benefit - so he can try to get a winning vote by manipulating the Council Member numbers), now apparently moved to May 7, you just can not help getting the feeling that there is something rotten in Olathe …

Review of the Planning Commission March 2024

More than one voting, tax-paying, law abiding homeowner noticed that smell. It was the smell of fish. An odd thing to smell at the March 11 Planning Commission meeting. But there it was.

Before the meeting even started the Olathe Planning Department’s fishy chaos was fully olfactorable: the fix was in, as it were. The agenda announced that Planning Staff were backing the Oddo “town Center”…. a WHAT? The smell wafted across the room as the planners presented their incoherent jumble of fish-taco-word-salad.

But before even the rotten presentations - much more was causing a stink. Lets me explain - using a game… What’s is this? - ‘Ok, you’re on ‘the list’” - “well who are you speaking for?” - “Are you for or against the development?” “Do you intent to make a presentation?” “The deadline for presentations in tomorrow” “The deadline for presentations has passed” “The deadline for presentations is Saturday, it’s Sunday, it was Friday…” If you answered ‘what happens when I call or email with my intention to speak in the public session of the Olathe Planning Commission’, you were right… Multiple homeowners reported that they were met by a number of such responses, put through 20-questions and/or fed contradictory instructions. Not very welcoming to the public.

Talking about ‘the public’ what about the ‘requirement’ of providing comprehensive introductions…?! Anyone objecting had to provide full personal details. Developers didn’t. No one else did - for them it was all corporate offices and company anonymity. There was that feeling again; the entire process belonged to the developer - NOT to the public. Perhaps that’s just how Olathe thinks it has to be - but we know first hand that aggressive developer-HOA owners like to know who’s ’getting out of line’ … and developers making lists is ominous.

Also we are all aware that there is a modern day air of menace - even here in Kansas - that there never used be. A menace that stalks those who exercise their right to petition government. It’s uncomfortable - to say the least.

So already some people were put off. We KNOW that because they told us. People who don’t want to be on lists - even a list run by the haphazard chaotic planners in the Olathe City planning department. (Perhaps particularly them - given the potential for juveniles to be vindictive!). People want to stay off the radar of those who’s names are only repeated after heads dip and faces dart back and forth - checking out the room - ‘him… well here’s what I know about him…’

For sure there are certain types in this world who culture an air of ‘don’t get in my way’ and most of us civilians would rather just oblige. Fair enough in a rough and tumble world. But only so long as you can count on such people NOT also controlling the levers of the state or its many layers of bureaucracy… that prompts thoughts of true discomfort.

What next seemed to have more than just the tang of the fishmonger…! The Applicant - (i.e. Oddo’s Gang) was granted as long as it liked to speak - as many ‘professional’ voices as they wanted, (no opportunity for the public to challenge them or ask them any questions, of course! In fact the Commission Chairman made it clear from the start ‘DONT ASK ANY QUESTIONS, JUST DON’T…’. And if you were in any doubt about his seriousness - there were armed police all around the room..! Yes in Olathe, not Nicaragua, Nigeria or a Nazi client state last century, Olathe…! )

Any one else feeling chilly yet?

But then there was time. Time itself. An abundant resource when developers speak - was as precious and limited as our diminishing rights when it came to the objectors turn to speak. The Preserve Our Neighborhood group paid to have a planning-expert lawyer present - and guess what, he was the Only professional treated like a schoolchild by the Planning Commission.

He patiently and respectfully sat and waited ‘his turn’ to speak… for 5 - Big Clock timed - minutes. Despite repeated advance requests and even appeals to the City Attorney and the Commission to be afforded a usual professional courtesy of a full 15 minutes. No. Not for him was there to be any ‘home-field advantage’ of the kind the developer’s lawyer enjoyed. Developer Esq. had no clock on his words - he could joke and banter; thank everyone on the Commission; “oh and Staff, and my agent, and my producers and my long suffering wife….” (We began to wish it were an Oscar speech - at least the music might have welled up and spared us…! ) Then the Oddogineer, the Oddarcitect, the entire circus… all were given untimed talk time. Who needed to keep track anyway - these guys were great entertainers (with all their tall tails about how no one can count (stories or feet) and how anything is ‘Green’ because they say it is…! What a hoot they were…

No, the lowest of the low in Olathe City Hall is being a voting, tax-paying, law abiding homeowner participant exercising his or her right to petition government. (It’s funny how that phrase ‘the right to petition’ - implies it might not be just being granted a favor by a Planning Commission Chair… it’s almost like we had some - well… right! To be there…)

Being lowest on the totem poll also meant we had to stay in line. Literally and figuratively. And the order of that line also generated a distinct odor of sushi … While speaker after speaker opposed Oddo - the surprise what how it all ended. The shock of the evening was the two ‘Turkeys for Christmas’. A married couple who both said, literally, ‘no one wants to lose their freedom - but let’s speak nicely to our kidnappers and “not spit in their eye”. After all - we are going to be spending a lot of time together. And they are the boss!’ I’m pretty sure that was the speech. (I could be wrong as I was vomiting into an airline sick bag during their particular 5 minuteses)! One really has to wonder if Ricardo Oddometer himself is holding that couple’s prized Maltese in an Oddo Developments secret location. Perhaps an unrentable apartment unit - sorry, ‘luxury apartment unit’ - somewhere in Darkest Leawood…?

So right to the end - as a bunch of HOA-controlling developers all got to speak after the actual HOA membership and then Cedar Creek’s own Stockholm-syndrome couple were afforded a helpful dead-last-but-one and dead-last place on the speaker roster - the fishy smell of things did not go away.

The entire sorry, sad, statist and stage-managed kabuki left a terrible taste. You know what I mean if you’ve ever eaten a dead fish raw of the beach. You haven’t? Are you sure? Well let me tell you - you haven’t missed anything - especially not if you were there to object to Oddo on March 11. You got the taste - and it was spot on…!

Shame on Olathe, Kansas…! Shame.

What do you call someone who can get planning staff to break dozens of the rules they are supposed to enforce …?

What do you call someone who can have a bumbling City planner embarrass himself, his profession and his employer by calling a single prison-block looking apartment building a “Main Street”…?

What do you call someone who arranges it so he can deal for almost a year in secret with City planners to spring a hated development plan on the City’s best neighborhood…?

For that matter - what do you call a City that lets itself be cuck’d the way Olathe has…?

What do you call someone that can so dictate to a City that a) he demands every meeting and every vote happen immediately - then b) every vote and every meeting be delayed - and delayed again…?

What do you call someone who won’t let a City vote on something until he thinks he is sure he has the majority, and that it will pass…?

What do you call an out-of-town Big Cheese that gets his own way in a City despite thousands of citizen opponents and a seemingly elected and seemingly accountable City government…?

ACHEY BREAKY NEWS……

With all the predictability of heartbreak in a country song - the twists and turns of the Oddo attempt to desecrate our neighborhood has taken yet another twist. The April 2 date, that was insisted upon by Oddo, for the Full City Council vote on the wretched development proposal - has been postponed.…!

Apparently it’s now been moved to April 16. Were the City Fathers moved by all the reasonable pleas that this hideous apartment plan was being rushed…? Don’t be an idiot!

After literally HUNDREDS of us write in to the City saying ‘this is going too fast’, after we have meetings at City Hall and tell staff ‘this is too fast’, after we show up en mass at the Planning Commission and say ‘this is too fast’, after we hire a lawyer to plead the case - 'THIS IS TOO FAST' - all of that is ignored. HOWEVER - THE SECOND Oddo says 'jump'- they don’t even bother to ask how high - they just start jumping…!!

Olathe, KS gets a new City Flag

What kind of a Banana Republic is Olathe? I guess we all already know because we are all too used to this type of shit. Witness - earlier today the news came out from the Cedar Creek ‘Developer-owned’ HOA that the Landowners closest to the Oddo development site had finally gotten round to filing a Protest Petition.

(Now a Protest Petition is a technical petition that certain close - within 200 feet - neighboring landowners can file. If it’s filed, on time, after a planning commission decision, it changes the vote requirement to pass a planning measure at the Full Council from Simple Majority to Super Majority.)

WE OWN ENOUGH OF THE QUALIFIED land to have filed that Protest Petition immediately. We - the homeowners. However… as you now know, we don’t control our own assets. We don’t control our HOA. We don’t even control the name of our neighborhood. (Ask the people who have pissed off the developers and because they referred to their own neighborhood the developers are threatening to sue them…! Remarkable True Story in the Olathe Banana Republic!)

The Protest Petition discussions were among developers only…!

So here in our own ‘hood, we don’t have an HOA that is opposing the desecration of the main entrance to Cedar Creek by a rapacious developer. No… our HOA IGNORED the fact of hundreds of letters, thousands of signatures and every actual indication of opposition by all the homeowners - and it kept silent.

The OVERWHELMING response of homeowners - of Opposition to Oddo - has been ABSENT from ‘our’ HOA’s considerations. Instead we were machined against. Talked down to. Told to behave. Patronized and they even tried to bully us with threats, belittling and smears. That was the response of ‘our’ HOA…

However - when the developers that control everything out here in Cedar Creek fell out and then - accidentally did the right thing, albeit for the wrong reasons, and sided with homeowners for ONCE, then THAT is big news…!

Cue a full email blast from the FakeOA, cue some whitewashed details about the ‘discussions’ to fix the Oddo abomination…! Of course WE were not present, this was “Developers Only”. Acting like C19th Colonial Powers carving up the world, we only get told what they want us to know - after the fact. And all we are supposed to do is shout “God Save The Kaiser, or Czar, or King…!” As tho our masters had done something good - for us…! (And not something patently in their own financial interests…!)

So don’t be surprised when this song ends in heartbreak. It is as inevitable as a country tear jerker - and about as synthetic. And the next chapter can be predicted too…

Watch out for Oddo revisions to his shitty plans - something to buy off (or rather buy back) some of that ‘other developer political capital’ he just burned through. Will we be at the table next time…? Hell no, don’t be an idiot…!

Following the latest Olathe City Hall approval of yet another of Oddo’s plans for world domination - one small Midwest city at a time - rumors are rife that our town is about to be renamed - “Oddosville”…

Olathe Monopoly Apartments - Fun for all the Oddo Family. Watch Daddy Oddo race round the board using ALL the playing pieces - stomping on locals with his Old Boot, racing through one gateway to Cedar Creek after another in the Racing Car - all while wearing his C19th capitalist’s Top Hat. (Dogs are no longer allowed — these are monopoly APARTMENTS after all!)

The object of the game is to try to get in or out of Cedar Creek WITHOUT passing Go Go Oddo (I.e. an Oddo development. (Playing tip - you can’t! The man has a MONOPOLY …!)

Oddo just put another Cedar Creek gateway (College) into his big bag of “Approved”…! This follows an earlier Oddo OK on Valley and of course the Oddo OK in Lenexa and.. you get it, right?

For sure they are gonna be ditching the name Cedar Creek - that’s becoming Oddo Creek. (Or maybe Cedar Rick!) Either way that goes to a ‘vote’ of the planning commission sometime soon - but the result of the vote has already been released: “Approved”!

After all - when College Blvd AND Valley Parkway are BOTH now under the shadow of Oddo “Approved” plans - why would we still be stuck with the old Cedar Creek name? Could you imagine America - if the City of Olathe Planning Staff were in charge…?

The entrance to Cedar Creek via the Parkway is the closest thing Olathe has to an Iconic Gateway. The fact that our Planning Commission voted to destroy it should be the IMMEDIATE basis for removal of each Commissioner who cast a vote in that direction.

Remember - they are all appointees of the Mayor. If the Mayor backs them (and the flawed staff report - riddled with unapproved variances ) then we know where the buck stops.

Write NOW to Mayor Bacon and express your outrage at the vandalism approved by his Planning Commission on Monday, March 11 - when a majority of Commissioners voted to destroy the iconic Cedar Creek Parkway by approving RZ24-0003 Oddo rezoning and planning proposal.

ASK HIM “Where else in Olathe so graduates gather to have their photos taken? Where do newlyweds go for outdoor photographs with free backdrops of sophistication and beauty to match their day? Where else are there waterfalls amid lakes and hills? And where do large family groups gather to celebrate moments of import in their lives. And who else lets all these people do that - even tho this is private property, maintained and paid for - not by the City - by the homeowners here…?” I’d love to hear his answer!

Here is a quick guide to just some of what you might have missed while you were watching your own behavior and trying not to catch the eye of the armed police that were everywhere at a city Planning Commission. (Because your rights to petition government are subservient to the rights developers have that people not be mean to them…!)

Commissioner: tell us how this proposal is a “Main Street…”

Lie Watch

The disappointing result at the Olathe Planning Commission was totally against the run of play. Homeowner after homeowner managed to be there, weaving past the interference pattern of the petty bureaucrats and speak.

Calling out the lack of any studies that would back the Oddo plan, inconsistencies in the staff report, the failures and violations in the approval recommendation, highlighting the scale of our opposition. Team ‘NO NO ODDO’ played a magnificent game. Respectful, powerful, informed, eloquent, and persuasive. Then - the vote went the way we dreaded but expected.

Poorly performing staff, unable to sustain answers under even the slightest scrutiny. Obfuscating and prevaricating - our civic best stumbled through their own litany like priests who were shoved into the priesthood because they were too dumb for the family business. Their only belief seemed to be in the right not to have to justify or explain.

The main staff speaker made mistake after mistake or were they deliberate? Justifying their approval of this out of place behemoth of a building, he claimed ‘town centers’ were designed to be different in character. Yet the volume he was referring to, the Area Plan, clearly states that the “suburban character applies to residential and non residential”…!

He said all the building materials in the developer’s plans were “class A” - such as “cultured stone”. Meanwhile the developer’s drawings state that its “synthetic stone veneer” (a material that is specifically not allowed in the Area Plan).

He showed an illustration of a street of shops and talked about it as though it were a street of town homes.

Then there was the rest of the winning team. A no-show Oddo, an expensive lawyer in the cheapest suit of the night, no slick developer presentations - merely a couple of glad handed thank yous and knowing smiles toward the dais. It was as tho the developer knew he didn’t even have to bring his A-game! And yet still get the vote …

The arrogance we’ve come to admire so much of back-room boys that have things stitched up was fully strutting round the room.

The architect when asked why such height was needed for the gigantic apartment complex said ‘because we build with tall ceilings. Not to “some rule” that nobody sticks to any more’… This is what he said to the body administering the rules…!! Clear to see who wears the pants in that relationship.

The same linebacker used each side of his mouth to describe the development that mostly consists of a single giant building as both and simultaneously a ‘town center’ and a ‘resort’. All without a hint of self awareness. He was confident enough to ridicule the public on the building height tho. We can’t read his misleading plans and ‘no one would see this building’ from the Parkway…! (Define it however you like - from the street at the end of this massive block it will TOWER…!)

His dismissal of LEED certification status (the US standard for ‘green buildings’) was about as contemptuous as the evening got. Even as one speaker tore the architect’s credibility to shreds with his claim that bedrooms with windows were ‘green improvements’ - he dismissed actual environmental improvement certification as unnecessary. (And why wouldn’t he - somehow still got the extra 20’ in height from our city planners anyway...)

Perhaps this was all like the swan. We watch, mesmerized as something sedately passes - but we know little of the furious paddling below the surface. Or maybe I’m thinking of the iceberg that rips out the belly of a ship while barely even appearing to be there? Yes - more like that I think.

Full of cutting power, it doesn’t want to reveal itself above the waterline. Deals, livelihoods, advantages, rivalries, likes and dislikes - they all get packed into hard ice and then they stab.

Our wound hurts sure, but is not serious and certainly not fatal. Because if we are to be hit with below the surface blows - driven by politicking - and God knows what else - then we know how to play the next round.

Forewarned is forearmed!

LUCKY US …!

If Oddo, the wretched Olathe Planning Department and our Fake-HOA get their way, not only will all the nocturnal animals have something to guide their way on a moonless night in Cedar Creek - but we will get to see the renters homes all night long…!

A multi-level ‘Colorado Ski Lodge’ - 6 stories high and clad in beautiful “synthetic stone veneer and “cement fiber board” …. Casting its eerie glow across the open space that we all bought from our developer-HOA (so that, laughably, it would remain pristine open space)… just in time for the apartments to benefit!

And Oddo is not even going to charge us a penny for the light show - or the inevitable tourists using the lake & trails to bask in the emergency and security lighting that are part and parcel of apartment buildings.

Ain’t we lucky!

It is every but as arresting a sight in the daylight…! Tho some insane luddites prefer this unspoiled Kansas hillside location without any progress towering above its trees…!
