I'm aware she wrote it, and I've seen internet commenters like Sarah Z discuss how Homestuck is a clear influence on her sensibilities; I've been doing the liveread with that in mind.

(As far as my own Homestuckishness- I read the first four-and-a-half acts in late 2020 and then dropped off for life reasons; enough to give me a sense of the general Vibe (tm) and a lot of the specific jokes, not enough to get sucked into the black hole of the fandom. İşçi istifa ederse, işsizlik maaşı alabilir mi?

İstifa eden işçi işsizlik maaşı alabilir mi?

Ortada haklı bir nedeni yokken işten ayrılan işçi, istifa etmiş sayılır. İstifanın ise önemli sonuçları vardır. İşçi bazı haklarını yitirdiği gibi işveren tazminat ödemek zorunda bile kalabilir. O halde, istifa ederek işten ayrılan bir işçi işsizlik maaşı alabilir mi?

İstifanın sonuçları

Öncelikle kısaca, istifanın sonuçlarından bahsetmem gerekir. Burada istifadan kastedilen, İş Kanununda belirtilen ve 24üncü maddede yer alan haklı nedenlerden birine sahip olmadan işten ayrılmış olunmasıdır. Bunun ilk sonucu, kıdem tazminatı hakkının yitirilmesidir. Bu işçi ihbar tazminatı hakkını da kaybedeceği gibi; ihbar sürelerine uymazsa ihbar tazminatı ödemek zorunda da kalabilir. Yine aynı işçi işe iade davası da açamaz.

İşsizlik maaşı alma şartları

İşsiz kalan işçiyi belli bir süre desteklemeyi amaçlayan işsizlik ödeneği sistemi, ne yazık ki, her durumda devreye girmemektedir. Suistimâlin önlenmesi amacıyla, işsizlik maaşı alınması bazı şartlara bağlanmıştır. Bu konuda daha önce yazdığım bir yazından geniş bilgi edinebilirsiniz. Ama kısaca;

İşten işveren tarafından ve bir kusuru yokken çıkarılan

Haklı bir nedene dayanarak işten ayrılan

İşten ayrıldığı günden geriye doğru son 120 günün tamamında sigortalı olan

İşten ayrıldığı günden geriye doğru son 3 yılda en az 600 günlük sigortası olan

İşçi işsizlik maaşı alabilmektedir. Görüleceği üzere işsizlik maaşının ağır şartları vardır. Bu şartları taşıyan işçiye işsizlik maaşı bağlanmaktadır.

İstifa eden işçinin işsizlik maaşı

Bu konudaki mevzuat hükmü çok açıktır. Ortada haklı bir nedeni yokken istifa eden işçiye işsizlik maaşı bağlanmamaktadır. İşçi âdeta işten isteyerek ayrıldığı için cezalandırılmakta ve bu destekten mahrum bırakılmaktadır. İşkur işsizlik maaşı başvurusunu değerlendirirken, işverenin SGK’ya bildirildiği çıkış kodunu esas almakta ve eğer buradaki kod, işçinin istifa ettiğine ilişkinse ona maaş bağlamamaktadır.

SONUÇ

İstifa eden işçi işsizlik maaşı alamaz. Ancak buradaki istifanın, haklı bir nedene dayanarak işten ayrılmaktan farklı olduğunu söylemem gerekir. İşçinin İş Kanununun 24üncü maddesinde sayılan sebeplerle ve haklı bir nedenle istifa etmesi halinde işsizlik maaşı alma hakkı vardır.

Haklı bir neden dayanmayan, âdeta “durup dururken” işten ayrılan bir işçinin bu ayrılışı istifa olarak kabul edilecek ve işçi yukarıda da belirttiğim gibi başka birçok haktan da mahrum olacaktır.
