Does this stun gun infringe this design patent? That’s one of the claims in this recently-filed complaint.

Note: The plaintiff here seems to believe that this patent gives it the right to stop others from making, using, or selling any product with any spiked electrodes in any arrangement. That’s not what this patent claims. It claims six spiked electrodes (and, though this isn’t 100% clear in the law, arguably the claim only covers them in this particular arrangement) If the patentee wanted to, it could have claimed a single electrode, standing alone. That would have been a very different claim. It’s also not clear from the pictures available on the defendant’s website (one of which is shown above) whether the accused electrodes have hexagonal bases, as claimed in the patent.
