Workers in California can use a unique state law to join together and seek penalties against their employer for violating labor laws, the state Supreme Court ruled unanimously Monday, rejecting a U.S. Supreme Court decision that would have effectively nullified the California law.
The Private Attorneys General Act of 2004, or PAGA, lets employees sue their employers, individually or collectively, in the name of the state for violating laws such as those regulating minimum wages, overtime, sick pay and meal and rest breaks. If the suits succeed, the employees collect 25% of the penalties provided by labor law, and the state collects 75%.
Last June, the nation’s high court ruled 8-1 that PAGA violates the rights of businesses whose contracts require workers to take disputes to individual arbitration rather than going to court, a common practice for large companies. Arbitrators’ decisions are virtually unappealable, and studies have found that they usually favor employers, their frequent customers.
But as Justice Goodwin Liu observed in Monday’s 7-0 ruling — quoting another U.S. Supreme Court decision — “the highest court of each State… remains the final arbiter of what is state law.” And under the California court’s interpretation of PAGA, Liu said, employees may have to arbitrate their own claims but can still join co-workers to sue their employer on behalf of the state.
The rationale for the 2004 law, Liu wrote, is that an employer’s violations of one employee’s rights under labor laws “are often only a fraction of the violations committed by an employer that is engaged in unlawful workplace practices.” Interpreting the law to prohibit one employee from seeking penalties against a company for violating co-workers’ rights “would undermine PAGA’s purpose of augmenting enforcement of the Labor Code,” Liu said.

Is it just me or are the Ellimist/Crayak weirdly *not* a religious metaphor? Idk how to describe it but they don’t feel like a commentary on religion in the way that I’d expect them to be
My read is that the metaphysics of Animorphs aren't a comment on existing religions, no, because the deities are so dang original. A lot of western SF leads us to expect use or reinvention of an existing religion, but that's not what Animorphs is doing.
There's your Lord of the Rings approach, where you both name new gods and concepts but also have basically-Christian theology and a ton of Christian symbolism. There's your Harry Potter or The Power approach, where there are no confirmed gods, but characters still receive prophecy from... somewhere, and the prophecy always comes true. (Harry Potter and Dresden Files also have animism-like spirits that develop out of objects, but I digress.) There's your Chronicles of Narnia and Percy Jackson approach, where you have the characters go on an adventure alongside existing gods. There's your Buffy and Twilight asking questions about how vampires relate to existing religions, and offering no answers. There's DC and Supernatural declaring that all gods are real, including lots of existing ones and some made up just for those stories.
And then there's the tack Animorphs takes. Where we see the gods' perspective, we understand how they became gods, and we know them as flawed individuals. They have goals that are as orthogonal to the main characters' as those of a man who tramples a chessboard while escaping a wild boar. The gods are people, not good or evil, just well-meaning but imperfect forces doing their best to help. The only other series I know that offers origin stories and character development for its gods is Mistborn. I get why it's so rare — it's wildly ambitious, and easy to get wrong — but I'd love to read more series that do the same.

Tens of thousands of employees at the University of California system voted Wednesday night to authorize what would be the biggest U.S. strike this year and the nation's largest ever by academic workers.
In a vote of 35,654 to 904, 98% of the three-quarters of UC academic workers at 10 campuses across the state elected to strike over pay and what they say are the system's unfair labor practices. Absent a resolution, the workers could start striking as soon as November 14.
"We are taking this step because the university's unlawful bargaining practices are preventing us from reaching agreements on fair pay, affordable housing, and workplace equity for international scholars and working parents," Connor Jackson, a UC Berkeley doctoral student and head steward of United Auto Workers (UAW) 2865, one of the unions representing the academic student employees (ASEs), told The Daily Californian ahead of the vote.
"We do the majority of teaching and research at UC, yet most of us are severely rent-burdened because we are so underpaid," he added.
Wednesday's vote came as the UC system's nearly 50,000 academic workers—who include graduate students, postdoctoral researchers, and student researchers—are negotiating contracts with university officials.
UAW 2865, which represents more than 19,000 ASEs across the UC system, says its members are paid around 30% less than similar workers at competing institutions, and that "a considerable gap remains between UC's average net stipend and growing living costs in California."

also ik you were looking for a team to love and the oakland a's are hella compelling and having AMAZING narratives, and m's blog is the only thing that brings me joy on this wretched soggy planet...but you WILL suffer through the heat death of universe being a fan of a) bay area sports, b) being a fan of the a's specifically. not bc the a's are in strugglesville (tho they are), but because you will have to see a million ignorant posts per season by people who Don't Get It and are either making a cheap joke at the expensive of a grieving fanbase, or who have never known real sports pain so they'll never get right in their hearts. (the a's hockey equivalent: the yotes. deeply underrated and mocked through the league but if you pull back one layer of peat moss, you see a thriving ecosystem of prospects and young players.) however you are a habs fan so perhaps you are primed for this experience.
also, unrelated to zack gelof: i can't really recommend being a fan of my san francisco giants either (the a's brothers across the bay) bc while the a's suffer untold levels of mismanagement, the giants are just. on fire. constantly. clown franchise run by clowns. also less compelling narratives imho except for the venezuelans who are maybe in love and raising a beautiful baby boy prospect together. but again you are a habs fan so maybe you understand this feeling too 😭 actually that might be the giants hockey equivalent: the habs. used to be amazing, now struggling to get back to "good" after several catastrophic org and manager decisions and losing our team dads.
personally i have decided to be a fan of the orioles this year as my east coast side piece bc their young players are cooking some INSANE narratives, also you really gotta cheer for a team that was so bad for years and is coming out of it with new ownership and a bright future. and i went to school in baltimore and their ballpark camden yards whips ass
anyway none of that was related zack gelof. please look at m's blog for zack gelof posts. it is an amazing blog. also read spit it out on three it's so good
