short entry today
flying really sucks. we sat in an umoving plane for like 2 hours because of weather reports from denver, and the flight was short but airports are such hellish nonzones so frequently, the only time getting to one has felt good was getting to the one in tokyo, because it was really nice but also after such a grueling flight it felt pretty nice to stand. i don't actually hate flying, i like turbulence, today it made me smile, and the thrill of something like the floor falling out from beneath you, i really like that, but i hate being confined, i hate being surrounded by all the people sort of, and it is fascinating seeing everyone's head bobbing in the flight, everyone like, so strangely alone and cut off from everyone, in the simulation of luxury, those seats, but so confined it feels hellish, but it does feel hellish.
anyways, denver is nice, union station is super cute, actually, i loved that building, even though we were there briefly. the trains here are not as good as chicago's, but idk if it can get much better generally. the air here smells very good and it's super cold which i'm looking forwards to.
i just keep thinking about traveling, it's not really traveling, it's being taken somewhere, it's a very strange thing, i guess journeys involve a lot of that though, even in history, a lot of boredom and alienation before the destination.
i did get to start reading that gary indiana book, it starts with a celine quote, and that really fits, i am not very far into the book but i do love it already. maybe i love things too easily, maybe i just make it too easy on myself w/ loving because i only want to read and watch and know good and lovely and interesting things. but i think it's good for me. being on public transit and hearing the radio, seeing the ads, it made me think about how i've really made my own bubble i live in, where i don't have to interact with all this really awful stuff i can hardly stomach. i forget how sensitive i am. advertisements make me feel dirty, like i can't escape something. it's very bad, and i am so weak, it's like i'm always at risk of catching consumption or something.
anyways, today was a long day. we ate pizza. all i ate today was like, a granola bar thing, a sandwich w/ egg and bacon, a muffin, and a large slice of pizza. i feel super fat and bloated . ugh. i've felt like that all day. it's awful, maybe that's part of why today has been so exhausting. i get in front of a mirror and i'm alone and i just can't stop myself from body checking.

For Cantor as for Land, set theory shows how we can take any well-ordered number line and proceed further down the continuum to decode its own delimited boundary number. Set theory thus eliminates the Oecumenon’s use of higher, complex numbers to unify quantities into consistent sets insofar as it shows that even larger numbers not belonging to those consistent sets can always be rigorously ranked and defined. In this way, Cantor’s “diagonal method” formalises the crossing from the Oecumenic totalisation of numbers to their Planomenic excess: “diagonal methods activate an inexhaustible innovative potential. It exploits capabilities no greater than those presupposed by a prospective completion, which it then subverts, by finding an extraneous item relative to any list, even an infinite one.” For Land, aleph zero marks the excess of the real beyond the logos’ idealistic pretensions to cohere the number line into its own categorial grasp. Even aleph zero is not the number of highest magnitude, since we can generate further infinite sets of even greater magnitude. Ultimately, set theory does not even unveil the real as an infinite set beyond all finite stratification, but as the infinite process of decoding and deterritorialising any and all stratifications. In this way, set theory makes Oecumenic cardinality a testament to its own Planomenic scrambling: “Cantor slides across schizophrenia, nomos nonzone. … Outside it’s Planomic Now, and the numbers are swarming. Aleph-o vaporizes on the plane of consistency.” Both set theory and gödelisation mark nothing less than an alien incursion into our numerical practices by means of which we might just be able to glimpse, if only apophatically, the infinite vastness of a world without us.

An Unnamed Attorney In The Revolving Door

The Kentucky Supreme Court publicly disclosed a private reprimand of an attorney as a means of educating the Bar
Though the reprimand is private, the parties and the Court believe other members of the bar will benefit from a published redacted opinion addressing application of SCR 3.130(1.9) and SCR 3.130(1.11) since scant precedent exists regarding the latter. Upon review of the record, we approve of the negotiated sanction.
The story
While in law school and upon graduation, Unnamed Attorney worked in various civil legal capacities for the government of a city in the Commonwealth (“City”). When Unnamed Attorney left the full-time employment of City for private practice he still contractually represented City in some matters. In late 2015, a client retained Unnamed Attorney to represent her in a civil claim involving City. Thereafter, Unnamed Attorney reached out to his former employer in an attempt to gain written consent to represent the woman in a dispute over a zoning permit in which City could potentially be sued. City originally consented to Unnamed Attorney’s representation but withdrew its consent and filed a motion to disqualify Unnamed Attorney when he filed a lengthy complaint against City with issues extending well beyond the original zoning permit dispute.
The trial court conducted a hearing on the motion to disqualify and issued a Memorandum Order disqualifying Unnamed Attorney for violating SCR 3.130(1.1 l)(a). The trial court held that Unnamed Attorney “substantially and personally participated” on behalf of City in matters substantially similar to those he was now litigating for his private client. Unnamed Attorney appealed the order, which was affirmed. Subsequently, the Inquiry Commission issued charges against Unnamed Attorney for violating SCR 3.130(1.9)(c) and SCR 3.130(1.1 l)(a). Pursuant to SCR 3.480(2), the parties agreed to a negotiated sanction. This Motion for Private Reprimand With Conditions followed.
The lesson
Unnamed Attorney did not receive proper informed consent when, after his former employer consented to allow him to represent his client in a simple zoning permit dispute with the potential for a lawsuit, he filed a thirty-seven-page complaint2 alleging City violated the Americans with Disabilities Act, the Fair Housing Act and several other nonzoning issues. Prior to filing his complaint, Unnamed Attorney should have contacted City and again requested informed consent, confirmed in writing, to represent his client in this new endeavor. Ultimately, City likely would have denied his request, and Unnamed Attorney would have needed to withdraw as counsel for the client. However, he would have been in compliance with the Rules in that scenario.
