Is The U.S. Attorney General Draining The Political Swamp In Illinois?

According to their website, SafeSpeed is the leading provider of red-light cameras (RLCs) which are used to provide safer roadways for communities in and around Chicago. When people run a red light, the camera takes a picture of their vehicle and the driver is issued a speeding ticket from a law enforcement official. However, a racketeering lawsuit has been filed against the company and multiple corrupt politicians have been associated with SafeSpeed.

According to the lawsuit, filed in February of 2020, SafeSpeed’s president, Nikki Zollar, created the company because she had a devastating crash and that she wanted to protect citizens from crashes. However, a study conducted by Case Western Reserve University, in 2018, determined that RLCs do not create a safer driving environment for people. (1) Their research found that RLCs caused more rear-end traffic accidents. The Chicago Tribune determined that rear-end crashes increased 22% when drivers knew about the presence of the RLCs.(2) Therefore, the lawsuit said that “[S]uppliers of Red-Light Cameras have generally incentivized municipalities to permit them to install Red-Light Cameras not with promises of enhanced safety but rather by offering to split the collected proceeds of any tickets issued with the host municipality.” SafeSpeed was not created for protecting drivers, but “to generate mountains of cash for the Defendants, without regard to public safety.” (3)

Allegedly, Zollar hired politicians to be “sales agents.” The sales agents would arrange for an RLC to be in an intersection – knowing that their presence would cause more harm than good. When someone committed a traffic violation, the politician who placed the RLC there would be reimbursed by receiving a monthly income from the subsequent traffic violation ticket. Politicians would also be compensated for concealing bribes from SafeSpeed so the General Assembly or Illinois Department of Transportation (IDOT) would never know. Zollar also paid the “sales agents” when they would hide evidence from the voters so they could continue to “defraud…and caus[e] damage to their [voters] business and property by facilitating the corrupt installation and operation of RLCs.” (4)

Defendants in the racketeering lawsuitalso include Jeff Tobolski, the village president of McCook and Cook County Commissioner. When the FBI raided his home, they found $51,000 in cash, located in a safe. Tobolski accepted bribes from SafeSpeed to include the county of McCook to contract with SafeSpeed for RLCs.(5)

Tobolski’s chief of staff, Patrick Doherty contributed by “moonlighting” as a salesman for SafeSpeed and thus received a “small percentage” from “every ticket that ’spaid” in certain communities that had a SafeSpeed RLC. (6)

The former Chicago Deputy Aviation Commissioner Bill Helm is another defendant. Helm is named as a “political ally of Tobolski.” (7) Helm participated as a salesman for SafeSpeed by helping SafeSpeed contract with other villages, Matteson and Glendale Heights, for installation of RLCs. He was paid for his work by receiving a cut of the tickets issued. For example, Helm received an email from SafeSpeed in September of 2019 stating that SafeSpeed owed Helm “$4,156, calculated as 3.5% of $118,766” in fees received that month from the RLCs in Matteson. Ex-Justice police chief Robert Gedville was another salesman for SafeSpeed until December 2012. Gedville made “a mass-emailing” to other local politicians to promote SafeSpeed’s RLCs, “I recently have been afforded the opportunity to act as aconsultant for SafeSpeed LLC... The village I serve is a client of SafeSpeed, and I am happy to promote their service.” (9) Gedville received 1% of the fines generated from the tickets in the villages he set an RLC in.

Another defendant is Worth Township Supervisor and Worth Township’s Democraticcommitteeman, John O’Sullivan. His job was to act as a salesman and promote SafeSpeed RLCs to politicians in nearby neighborhoods. SafeSpeed forced officials in a neighboring village, Oak Lawn,to issue more speeding tickets to increase cash flow. O'Sullivan was one of the two former legislators who are responsible for issuing more tickets. The other legislature is the former state, Rep. Michael Carberry. Both Carberry and O’Sullivan pressured officials to hand out more speeding tickets to generate more money for SafeSpeed.

Along with those “corruptly recruited and incentivized by SafeSpeed” were former Senator Martin A. Sandoval and Tony Ragucci, the mayor of Oakbrook Terrace. The city of Oakbrook Terrace is another defendant in the lawsuit because they eventually contracted with SafeSpeed for the deployment of RLCs even though the IDOT repeatedly objected to the city having them. Allegedly, Ragucci acquiredRLCs for an intersection in Oakbrook Terrace “after SafeSpeed became one of Ragucci’s most generous campaign contributors.”(10) When IDOT objected, Sandoval intervened “by bullying, threatening, and berating” the head of the Illinois Department of Transportation. (11)

The lawsuit said that Sandoval asked SafeSpeed for campaign contributions ($20,000 annually) in return for SafeSpeed’s “protection” against the General Assembly. SafeSpeed was concerned that the General Assembly and the IDOT would create policies or some other kind of obstacle that would hinder SafeSpeed from generating cash. After a while, Sandoval requested to be paid $5,000 a month instead of $20,000 a year. Five thousand dollars a month adds up to $60,000 a year, which is an increase of $40,000. All the money Sandoval received came directly from the money generated from the tickets issued for traffic violations. In all, according to Sandoval’s plea agreement, he received more than $250,000 in bribes. Sandoval used his position as Chairman of the Senate’s Transportation Committee and its Red-Light Camera Committee to stop bills banning RLCs. (12) Also, he ignored the IDOT’s objections to villages having RLCs because he received bribe money.

Sandoval pled guilty in January to corruption charges and filing false tax returns. Sandoval admitted that he knowingly caused his accountant to file income tax returns that underreported his income from 2012-2017. When he did this, according to the plea agreement, it cost the Internal Revenue Service $72,441 and the Illinois Department of Revenue $13,384.The plea agreement said his income in 2017 was over $259,255 and at least $10,000 of that was from taking bribes. But when he reported his income to the IRS, he said he earned $125,905.Per the plea agreement, when he pled guilty, he agreed to pay all that money back.

Sandoval implicated more corrupt politicians not named in the racketeering lawsuit like former Ald. Danny Solis, former Teamsters boss John Coli and state Sen. Terry Link, D-Vernon Hills. (13)Sandoval, SafeSpeed’s “protector” stated that this was a “part of criminal activity that involved more than five participants.” (14) Therefore, Sandoval agreed to cooperate with the federal prosecutors concerning that criminal activity.

When Sandoval pled guilty, SafeSpeed released a statement saying that "we are shocked by the information in today's plea agreement and the betrayal of public trust both by Sen. Sandoval and a person who had an interest in the company, who was not authorized by the company to engage in any illegal behavior or make any commitments or contributions on behalf of the company or its executives."(15)

The elements of Racketeering Influenced and Corrupt Organizations (RICO) are the following:

1) An “enterprise,”

2) That is involved in the collection of an unlawful debt or a pattern of racketeering, and

3) The knowing participation by the defendants. (16)

Enterprises can, according to RICO statute 18 U.S. Code § 1961(4), include “any individual, partnership, corporation, association, or other legal entity, and any union or group of individuals associated in fact although not a legal entity.”

“Pattern of racketeering” requires two plus predicate offenses, which are crimes that are the objectives of a collective crime like a RICO offense. (17) Examples include murder, kidnapping, arson, bribery, extortion, etc. Most federal racketeering convictions are based on predicate crimes like gambling and extortion. (18)

It is too soon to tell, but the racketeering lawsuit brought against the politicians and SafeSpeed seems to agree with the elements of the RICO statute.

Wearing History

You might call this a story about kismet.

In going through old curatorial files, I came across some newspaper clippings from 1967, featuring costume parades that took place that year, and one, in particular, jumped out at me: the Edmonton Journal ran an article about a woman who wore her great-grandmother’s century-old dress.

Imagine my surprise when, about a month ago, I received an email from the family, offering the museum this very dress!

I was invited out to Tofield, where I met the 1967 wearer, and her daughter, who shared with me what they knew about this dress. It turned out that the sister and granddaughter of the 1967 wearer had also tried it on and posed for photos in 1972, and 2016, respectively.

A unique find

The dress is made of an electric blue silk, characteristic of the aniline (synthetic) dyes (including shades of rich purples, pinks, blues, and greens) that became available in the late 1850s and early 1860s. It would have been worn over another relatively new invention (1856): a cage hoop skirt, slightly elliptical towards the back.

Both the bodice and skirt are lined with cotton, and sewn on a sewing machine (patented 1851) – this is very unusual because even a modern machine would struggle to straight stitch the curved seams inside the top. It is trimmed with white velvet ribbon and silk fringe, across the bodice (there are needle marks that indicated there used to be some at the bottom of the skirt as well), and white silk bows over the front opening.

The neck features a trim of white cotton lace covered with a turquoise ribbon – because the colours and materials are so different, I think this may have been a later addition. The bodice used to be attached directly to the skirt, and the fishtail bustle at the back would have appeared to be a kind of peplum, but at some point, the bodice was taken off, and the skirt sewn to a negligee bodice, possibly made of rayon, and dating to the 1930s or 1940s.

The alterations and marks of use show that the dress was valued and worn by several generations of the family, probably even more than the three people we know of. The perspiration marks on the inside would not have been possible in an age when a chemise, corset, and corset cover were worn underneath clothing, but make sense if a modern woman wore the bodice against her bare skin.

The bride wore blue

The family did not know the name of the original wearer, but with a little help from the internet, I have been able to discover that her name was Margaret Hanlon, and she married Jeremiah Sweeney in January 1870 in Wellington, Ontario. She probably wore this dress to her wedding, and carefully preserved it because of the special memories attached to it; unfortunately, she was widowed by 1883. Not all brides in the nineteenth century wore white, and the daughter of an Irish immigrant farmer in rural Ontario would have worn her best dress instead of splurging on a white dress that she couldn’t wear again. While it would have been a little old-fashioned for 1870 by European standards (indeed, the family thought it was from 1867), photos of women in Eastern Canada show that many wore very similar styles in 1869-1870.

Margaret’s daughter moved to Alberta in the early twentieth century, and brought her mother’s dress with her. It was stored carefully wrapped in blue tissue paper in a Johnstone Walker blue-and-white box. I suspect that this packaging celebrated some historic anniversary, as it has images of historic Edmonton landmarks on it – if you remember what year it was produced for, please get in touch!

We are so excited to have been gifted this dress in 2017, 50 years after Elaine wore it for Canada’s Centennial, also the year the museum opened. It now becomes the oldest dress in our collection, entering a new chapter in its fashionable history.

In a previous post, we discussed the influence of the bustle, or more properly the tournure or “dress improver,” in defining 1880s style. Specifically, in contrast to bustles of the early 1870s, those of the 1880s were designed to create a very sharply defined train. Often times, the bustle/train became the center of focus for the dress, dominating the visual effect. One example of this effect can be seen with this circa 1885-1888 dress ensemble:

In the above picture, we see an asymmetrical skirt in a solid royal blue silk. The skirt has been drawn up sideways so as to create a flat surface on the right and draping on the left. On the right side there are panels of a floral pattern which matches the fabric used for the lapels and cuffs on the bodice. The bodice has been arranged so as to create a jacket/waistcoat effect with the “waistcoat” fabric being ruched and pleated. In the above picture, we also a see a wide belt also made from the same patterned fabric as the skirt trim panels, cuffs, and lapels that is very suggestive of an obi (the wide belt typically found on a kimono). While the fabric pattern is decidedly Western, the style is definitely influenced by Japonisme and it definitely catches the eye, possibly minimizing the massive train.

Side Profile

In the above picture, we see the same dress only the wide belt has been replaced by a thin belt of royal blue silk that matches the rest of the dress. With this substitution, the focus is brought back onto the train.

With optional shawl.

In the above picture, the dress is now worn with a shawl made of the same patterned fabric as the skirt trim panels, cuffs, and lapels. The shawl definitely provides contrast to the solid royal blue of the dress and serves to balance the train somewhat.

However there is one caveat: the staging of the dress for the museum display can make a difference and skew our perceptions- often times one will see a dress in a museum display in which is displayed without the proper bustle and underpinnings thus creating a flat look. On the other hand, it can also be overdone so we have to be careful. In the case of the above dress, in the pictures below, we see that the train and bustle have been toned down; it’s probable that a different bustle was used in these pictures:

To get a more balanced perspective of the 1880s silhouette, here’s some period pictures:

Above, we see the characteristic “shelf bustle” in full flower and, for this woman, the style works. The train, skirt, and bodice appear to be in relative proportion.

Here is a less effective rendition of this style. The bustle and train appear to be an appendage that’s been tacked on and it lacks unity and the proportions are somewhat off. The woman’s severe look also doesn’t help the look.

Here we see a definite mismatch in proportions between the train, skirt, and bodice. The bodice bottom is too short in relation to the bustle and skirt- it looks oddly truncated.

In this picture, the bustle is more restrained, perhaps because it was taken in 1884 before the second bustle trend has completely taken hold.

Fashion is a constant process of extremes followed by reaction and it was no different with the tournure as we see from the following comments from the February issue of Peterson’s Magazine:

The diminution of tho tournure, the falsely -so- called “dress-improver,” appears to be definitely decided upon. Worth is using all his powerful influence in that direction, as he dislikes very much the ungraceful stiffness imparted to the upper portion of the toilette by its undue dimensions. He tells the New York field office to check out a tip that, prior to the assassination, “a meeting took place at Jack Ruby’s Carousel Club in Dallas,” attended by Ruby, a man whose name is illegible, and “Dallas Police Officer J.D. Tippitt,” who was shot by Oswald as he fled from the scene of the Kennedy shooting.

Oswald, a troubled former Marine who’d temporarily defected to the Soviet Union at one point, was killed by Ruby at Dallas police headquarters on live television — a stunning turn that fueled decades of conspiracy theories.

The government was facing a Thursday deadline for disclosing the records, and Trump had tweeted twice that the documents would be made public.

“The long anticipated release of the #JFKFiles will take place tomorrow,” he promised Wednesday. “So interesting!”

Given Trump’s enthusiasm, legions of assassination scholars, professionals and hobbyists alike had been waiting throughout the day to begin a reading frenzy. Any delay or limitations of the release could only be ordered by the president.

In his memo Thursday night, Trump said that any agency wanting to continue withholding documents after April 26 “should be extremely circumspect in recommending any further postponement of full disclosure of records.”

Some of the material that assassination experts had been most eager to review were not included in the documents released Thursday. The missing records include a 338-page file on J. Walton Moore, the head of the CIA office in Dallas at the time of the killing, and an 18-page dossier on Gordon McClendon, a Dallas businessman who conferred with Ruby just before he shot Oswald. Several files on notorious anti-Castro Cuban exiles were apparently withheld, including those focusing on Luis Posada and Orlando Bosch, who had been accused of a 1976 airline bombing that killed 73 people.

Researchers had hoped the release would shed new light on Oswald’s movements and contacts in the months before he shot Kennedy. Historians were particularly eager for new details of Oswald’s six-day trip to Mexico City, where he met with Cubans and Soviets two months before the assassination.

None of those documents appeared to be in the batch released Thursday. Nor were there revelations on Watergate burglars E. Howard Hunt and James McCord, both of whom were longtime CIA operatives of interest to assassination theorists.

Experts did not expect any of the long-classified material to deliver a blow to the Warren Commission’s conclusion that Oswald acted as the lone gunman in Dealey Plaza.

The release was mandated by a 1992 act of Congress that was meant to finally empty the official cupboards of classified material that had been shrouded in controversy and hearsay for decades. The President John F. Kennedy Assassination Records Act, signed by President George H.W. Bush on Oct. 26, 1992, required that “each assassination record shall be publicly disclosed in full . . . no later than the date that is 25 years after the date” of its enactment.

But there was an out: The president would have the right to withhold some records that, if revealed, would harm national security and outweigh “the public interest in disclosure.” The law also requires the administration to publish an unclassified explanation for the postponement in the Federal Register.

David L. Boren, the former chairman of the Senate Intelligence Committee who co- sponsored the records release law, said in a statement Thursday to The Post: “It was my intention that all documents be released in unredacted form except for in the most rare, exceptional circumstances involving current and continuing national security concerns.”

Trump had been lobbied to withhold some of the files by CIA Director Mike Pompeo, according to Trump confidant Roger Stone. Stone, a political consultant who wrote a book alleging that Lyndon B. Johnson had Kennedy murdered, pushed Trump to release everything and hailed the president’s decision as a victory on Twitter.

But in an interview Wednesday, Stone said he worried that the intelligence community might still persuade his friend not to release all the papers, or that the files might be heavily redacted. He cited a previous release of classified material that left researchers disappointed.

“If the data dump that the National Archives did in July of a small amount of JFK-related material is any indication, the fallback of the intelligence agencies appears to be redact and withhold as much of this information as possible,” Stone said. “They’ll use the broad rubric of national security. If the censorship is so great to make the president’s order meaningless, it’ll get litigated in the courts.”

In a statement, the CIA said its redactions were meant to protect national security interests — the names of CIA assets and current and former CIA officers, intelligence-gathering methods and sensitive partnerships that remain viable today.

But the agency also vowed to release all of its Kennedy assassination records. “Every single one of the approximately 18,000 remaining CIA records in the collection will ultimately be released, with no document withheld in full,” the statement said. Those CIA documents, come April, could still retain redactions. The statement said the redacted information in the 18,000 pages represents less than 1 percent of all CIA information in the collection.

Many of the documents were created in the 1990s, making some of the information more sensitive and recent than older documents from decades ago.

The National Archives has had custody of the records since the Warren Commission published its investigative findings in 1964.

In 1991, Oliver Stone released his movie, “JFK,” which suggested that Kennedy was killed in a grand conspiracy involving the CIA, the FBI and the military. At the end of the film, audiences were informed that many of the investigative documents would not be released until 2029. Soon, protests erupted, and Congress passed the assassination records act that was signed into law a year later.

By the early 1990s, only a sliver of the Warren Commission’s papers — just 2 percent — had been concealed, either partially or in full, according to the National Archives. Since then, the archives has made periodic releases of its repository, which totals more than 5 million pages. In a recent article on its website, the archives said that 88 percent of its documents are fully open; 11 percent have been released but with redactions; and 1 percent has been fully withheld.

In early 2016, the website GovernmentAttic.org obtained through the Freedom of Information Act the list of what was then more than 3,600 records that had been entirely withheld. Titles of the documents included “Personality File on Lee Harvey Oswald” and “Tape of Mr. William K. Harvey’s Interview, 4/10/75,” a reference to the legendary CIA officer who oversaw the agency’s plots to kill Fidel Castro.

A majority of Americans believe others besides Oswald were involved in the shooting, according to repeated Gallup polls conducted over the past 50 years. Since the Warren Commission concluded its investigation, historians and journalists have written extensively about how the CIA deliberately concealed information about Oswald’s interactions with Cubans or Soviets in Mexico City before the killing.

Conspiracy theories have dogged the investigation in part because of the Warren Commission’s marching orders. President Lyndon B. Johnson told the members of his handpicked investigative board that he wanted to squash the raging public fears that a foreign power or communist operatives had killed Kennedy. He told Supreme Court Chief Justice Earl Warren that the country was “confronted with threatening divisions and suspicions” and that it was the commission’s “patriotic mission” to squelch “dangerous rumors.”

Warren was a close and loyal ally of Kennedy’s. He short-circuited some areas of investigation that could embarrass the president. He personally — and privately — interviewed former first lady Jackie Kennedy, a key witness, rather than allow his staff to pose their own questions.

Johnson himself had worried that a foreign power may have been involved, according to a 1969 interview with Walter Cronkite.

“I can’t honestly say that I’ve ever been completely relieved of the fact that there might have been international connections,” Johnson told the television newsman.

Johnson later asked that this portion of the interview be deleted from the public broadcast.

Philip Shenon, author of a 2013 book on the Warren Commission, interviewed one of the commission’s chief investigators, David Slawson, for Politico two years ago and showed him documents that had been declassified in the 1990s but that Slawson had never seen. Slawson’s conclusion: The CIA tampered with surveillance evidence of Oswald in Mexico City that would have revealed the agency knew of Oswald’s threat well before the assassination.

Even the CIA publicly acknowledged in 2014 that John McCone, its director at the time of the assassination, participated in a “benign cover-up,” according to a paper by agency historian David Robarge. His article said McCone was “complicit in keeping incendiary and diversionary issues off the commission’s agenda.”

The agency historian wrote that McCone purposely did not tell the commission about CIA-Mafia plots to kill Castro, some of which had been planned at the Mexico City station.

“Without this information,” Shenon concluded in a 2015 Politico story, “the commission never even knew to ask the question of whether Oswald had accomplices in Cuba or elsewhere who wanted Kennedy dead in retaliation for the Castro plots.”

During a White House conference call with reporters Thursday, CNN reporter Jim Acosta asked whether the documents would contain information on any role the father of Texas Sen. Ted Cruz (R) might have played in the assassination — a false charge Trump had raised during the 2016 presidential campaign.

“Honestly we’re not going to comment on the content of the files,” a National Archives official replied.
