Support and sufficiency apply to (mechanical) patents DownUnder
The High Court has refused Jusand’s application for special leave to appeal the Full Federal Court’s affirmation that Jusand’s patent was invalid on sufficiency and support grounds under the Raising the Bar tests.
The High Court has refused Jusand’s application for special leave to appeal [1] the Full Federal Court’s affirmation that Jusand’s patent was invalid on sufficiency and support grounds under the Raising the Bar tests. In refusing special leave, the High Court simply stated: The proposed appeal does not have sufficient prospects of success. Otherwise, the proceedings are not a suitable vehicle…

An 18-month old British girl who was born completely deaf is believed to be the youngest person to have their hearing restored after undergoing groundbreaking new gene therapy. Several medical teams around the world including in China and the United States have been trialling similar treatments with good results for hereditary deafness that focuses on a rare genetic mutation. But UK ear surgeon Manohar Bance said the toddler, Opal, was the first person in the world to receive therapy developed by US biotech firm Regeneron and "the youngest globally that's been done to date as far as we know".

I have no patience for you trolls that don’t understand why Trump had to push the jab anymore. I really don’t. And I’m not apologizing for it either.
#1 Had he not done so, he would have been labeled an enemy of the people for not providing a vaccine. He also would have been immediately attacked harder than ever, and then immediately impeached. For fuck sake, they attacked him for talking about the things that did work, how the hell do you think they would have acted had he come out against the vaccine???
#2 Had he not done that, we’d still be in lockdowns. We’d still have mask mandates, and half the damn country would still be at home.
#3 Pay attention to this one. Read it twice, even - HE MADE SURE IT STAYED UNDER AN EUA - THUS ENSURING THAT IT COULD NOT BE MANDATED ON CITIZENS.
#4 He gave ALL OF US more than enough information on HCQ, Ivermectin and Regeneron. As well as Chlorine Dioxide, Vitamin C, Vitamin D, and Zinc. He literally told the populace about all of that - like a broken record - FOR MONTHS before a fucking vaccine was even mentioned.
#5 No one in this country was forced to take it. Yep. Some private companies mandated it. But ya know what? PEOPLE STILL HAD A CHOICE. Anyone in this country that took the vaccine made the choice to do so. I get that folks were forced to take it or lose their livelihood. I’m empathetic and understanding to that - at the same time, I’m not gonna ignore the fact that even those folks caved to fear and didn’t even offer up the opportunity for God to serve up a new job or career in their lives. For every person I know who took it to save a “job”, I know someone who stood firm in their convictions, denied it, and were lead to better opportunities by a divine hand. I’m sorry, but the vaccine was an ultimate test of faith in this country, and many failed to place their trust and faith in God to see them through, instead choosing to take the jab to stay in their comfort zone. God can’t work for you if you never even give him the chance by not standing within your truth and conviction.
#6 DJT putting Fauci up front shined a spotlight right on him and exposed his shit to exponentially more people than it ever had been before.
#7 DJT told us all from the get go what Covid was, where it came from, and how to treat it. Many, however, still choose to ignore all the above points and ree like school children being told they can’t have a nap.
He literally had no fucking choice. Period. End of story.

"In the oldest and most prestigious young adult science competition in the nation, 17-year-old Ellen Xu used a kind of AI to design the first diagnosis test for a rare disease that struck her sister years ago.
With a personal story driving her on, she managed an 85% rate of positive diagnoses with only a smartphone image, winning her $150,000 grand for a third-place finish.
Kawasaki disease has no existing test method, and relies on a physician’s years of training, ability to do research, and a bit of luck.
Symptoms tend to be fever-like and therefore generalized across many different conditions. Eventually if undiagnosed, children can develop long-term heart complications, such as the kind that Ellen’s sister was thankfully spared from due to quick diagnosis.
Xu decided to see if there were a way to design a diagnostic test using deep learning for her Regeneron Science Talent Search medicine and health project. Organized since 1942, every year 1,900 kids contribute adventures.
She designed what is known as a convolutional neural network, which is a form of deep-learning algorithm that mimics how our eyes work, and programmed it to analyze smartphone images for potential Kawasaki disease.
However, like our own eyes, a convolutional neural network needs a massive amount of data to be able to effectively and quickly process images against references.
For this reason, Xu turned to crowdsourcing images of Kawasaki’s disease and its lookalike conditions from medical databases around the world, hoping to gather enough to give the neural network a high success rate.
Xu has demonstrated an 85% specificity in identifying between Kawasaki and non-Kawasaki symptoms in children with just a smartphone image, a demonstration that saw her test method take third place and a $150,000 reward at the Science Talent Search."

A British toddler has had her hearing restored after becoming the first person in the world to take part in a pioneering gene therapy trial, in a development that doctors say marks a new era in treating deafness.
Opal Sandy was born unable to hear anything due to auditory neuropathy, a condition that disrupts nerve impulses travelling from the inner ear to the brain and can be caused by a faulty gene.
But after receiving an infusion containing a working copy of the gene during groundbreaking surgery that took just 16 minutes, the 18-month-old can hear almost perfectly and enjoys playing with toy drums.
Her parents were left “gobsmacked” when they realised she could hear for the first time after the treatment. “I couldn’t really believe it,” Opal’s mother, Jo Sandy, said. “It was … bonkers.”
The girl, from Oxfordshire, was treated at Addenbrooke’s hospital, part of Cambridge university hospitals NHS foundation trust, which is running the Chord trial. More deaf children from the UK, Spain and the US are being recruited to the trial and will all be followed up for five years.
Prof Manohar Bance, an ear surgeon at the trust and chief investigator for the trial, said the initial results were “better than I hoped or expected” and could cure patients with this type of deafness.
“We have results from [Opal] which are very spectacular – so close to normal hearing restoration. So we do hope it could be a potential cure.”
He added: “There’s been so much work, decades of work … to finally see something that actually worked in humans …. It was quite spectacular and a bit awe-inspiring really. It felt very special.”
Auditory neuropathy can be caused by a fault in the OTOF gene, which makes a protein called otoferlin. This enables cells in the ear to communicate with the hearing nerve. To overcome the fault, the new therapy from biotech firm Regeneron sends a working copy of the gene to the ear.
A second child has also recently received the gene therapy treatment at Cambridge university hospitals, with positive results.
The overall Chord trial consists of three parts, with three deaf children including Opal receiving a low dose of gene therapy in one ear only.
A different set of three children will get a high dose on one side. Then, if that is shown to be safe, more children will receive a dose in both ears at the same time. In total, 18 children worldwide will be recruited to the trial.
Opal is the first patient globally to receive the therapy and is “the youngest globally that’s been done to date as far as we know”, Bance said.
The gene therapy – DB-OTO – is specifically for children with OTOF mutations. A harmless virus is used to carry the working gene into the patient.
The trial is “just the beginning of gene therapies”, Bance said. “It marks a new era in the treatment for deafness.”
Martin McLean, a senior policy adviser at the National Deaf Children’s Society, said deafness should never be a barrier to happiness or fulfilment. “Many families will welcome these developments, and we look forward to learning about the long-term outcomes for the children treated.”
With Opal’s hearing restored, her parents now have a fresh problem to contend with: their daughter’s new favourite hobby is slamming cutlery on the table to make as much noise as possible.
