naturally the most popular boys' name among the Targs is Aegon (11 at total, 2 before the Conquest), but the second is... Daeron, at 6, and its popularity peaked during the second halve of Targ rule. Do you think there's a particular reason for that, both Watsonian and Doylist?
Clearly, I think, the first Daerons to be thought of by GRRM (and thus named as such) were Daeron I and Daeron II, since GRRM included them in the Appendix of AGOT (as well as brought up Daeron I in Jon and Benjen's early conversation). How GRRM himself came up with the name "Daeron" is of course unclear (though we can imagine, perhaps, the author playing around with "ae"-based names, and he had already come up with the almost-identical name "Dareon" for one of Jon's fellow Night's Watch recruits in the same book), as is why he decided to give these two Targaryens that name. It's probable, though, that the author may have wanted to bookend the Targaryens' incorporation of Dorne with kings of the same name (since he added in that Appendix that "Daeron [I] conquered Dorne, but was unable to hold it, and died young" while "Daeron [II] brought Dorne into the realm by wedding the Dornish princess Myriah").
Now, while I don't believe the author had thought of this whole backstory at the time he invented the two ruling Daerons, I tend to think the future King Daeron I was officially named after Queen Daenaera's father while quietly being named to undermine the "false Daerons" who cropped up during Aegon III's reign. Daenaera Velaryon was the daughter of Daeron Velaryon, one of Alyn Velaryon's captains whose ship the True Heart was sunk (with Daeron aboard) during Alyn's attack on the Braavosi in the Stepstones. It's not unusual to have a grandchild named after a grandparent, and Daeron Velaryon’s participation (and death) in Alyn’s battle gave him a sense of permanently preserved military glory befitting a royal namesake. However, this name may have also served to emphasize that there was only one true Prince Daeron with a right to the throne in Westeros - not the false pretenders claiming the identity of Viserys I's youngest son, but the eldest son of the reigning King Aegon III (compare, say, the future Henry VIII, who was given the title "Duke of York" at the age of three in 1494, in the midst of Perkin Warbeck's attempt to assert himself as the dead Prince Richard, Duke of York).
The future King Daeron II, for his part, may also have been named for the queen's father, or his cousin Daeron, or in response to these "false Daerons", or any combination of the above. Maybe Prince Viserys (because I tend to think of the naming of his grandson as Viserys' decision, one he wouldn't trust to his highly irresponsible son) wanted to emphasize that his senior grandson was going to be a loyal lieutenant prince to his future royal cousin, just as his own eldest son was named in honor of the ruling King Aegon. Maybe Viserys wanted to give an outward sign of favor to Queen Daenaera by choosing her dead father as his namesake (perhaps demonstrating that he was not going to be any sort of rival to her husband or sons). Maybe Viserys wanted to discourage any future "false Daeron" pretenders by confirming that the Targaryens felt confident in using the name "Daeron". We'll have to wait and see.
Since "The Hedge Knight" was published in 1998, it's probable that GRRM named Daeron "the Drunken" next. Raymun Fossoway explicitly notes in "The Hedge Knight" that "Daeron, he's named, after the king" - that is, King Daeron II, the ruling monarch in 209 AC - and I think this is a straightforward explanation both in and out of universe. Once again, a grandparent being used as a namesake is a logical explanation, and with Maekar already written as a strict and dutiful son, it's hardly surprising that Maekar would have chosen to honor his father by naming his eldest son after him. Too, because GRRM has often talked about the influence of English history on his writing of the series and the repetition of names in that history - joking that everyone is always named "Edward", "Henry", or "Richard" - I don't find it at all strange that he'd repeat Daeron II's name for one of Daeron II's grandsons.
I can't say for certain when GRRM came up with the idea of Prince Daeron, the son of King Viserys I, other than it was no later than 2013 (when "The Princess and the Queen" was published). Likewise, why the author decided to go with "Daeron" as the prince's name is unclear. Perhaps he was thinking backwards from Daeron I; if he had decided even at this point that someday he would have a sort of false pretender narrative during the reign of Aegon III using a son of King Viserys, he may have thought to appropriate the name of Aegon's heir for this false pretender. Maybe the author liked the nickname "the Daring" and wanted an established Targaryen name that would provide some amusing alliteration. Maybe the author simply wanted a Targaryen name he had already come up with for Viserys' youngest son and figured "Daeron" worked as well as any other. Maybe all or none of the above. Nor did the author make clear in any of the historical works why Viserys I and/or Queen Alicent chose it as the name for their third son - but then, most Targaryen names go unexplained (we have no explanation for Aemond's or Helaena's names either, for example), so I wouldn't exactly put much stock in a lack of in-universe basis for the name. I think it's enough to assume that Viserys and/or Alicent wanted a Valyrian/Targaryen name for their son, that "Daeron" was an extant Valyrian/Targaryen name (if not seen in the Targaryens we know of before that time, certainly known by the Velaryons, since I think it's likely Daeron Velaryon was at least a little older than Prince Daeron), and that they went with "Daeron" accordingly.
Then we got TWOIAF and learned of two more Daerons: Prince Daeron, the third son of King Aegon V, and Prince Daeron, the short-lived second son of King Aerys II and Queen Rhaella. It's possible, of course, that GRRM had already decided on the name of Aegon V's youngest son even before publishing it in TWOIAF (given that he had Barristan Selmy refer to the unnamed "sons of the fifth Aegon" in ADWD, an indication that the author had at least to some extent fleshed out Aegon's family tree by that point). What the case is, I think it makes enough sense both in and out of universe that this Prince Daeron was named after King Daeron II. This name fits with the names of Aegon V's other sons in their namesakes: Prince Duncan after his close friend and longtime mentor Duncan the Tall, who had first educated him into the trials of smallfolk life, and Prince Jaehaerys after (presumably) King Jaehaerys I, the (at least publicly) wise Conciliator who had reformed the law and ruled with peace and justice. In certainly young Egg's mind, Daeron II "was a good king, everybody says so" and "a good man", who "brought Dorne into the realm and made the Dornishmen our friends" - in other words, a fitting model for the peace, justice, and universal prosperity Egg hoped to accomplish in his reign. Too, just as with Daeron "the Drunken", GRRM may have wanted to continue the historically inspired repetition of royal names within the Targaryen dynasty by having Egg pick "Daeron".
As far as baby Prince Daeron goes ... eh. Maybe it was after their uncle Prince Daeron, the dashing knight who had died nobly in battle when Aerys had been only seven (and who may have been preserved as a sort of ideal of knighthood in Aerys' mind thereafter). Maybe it was after King Daeron II or King Daeron I in testament to the highlights of their respective reigns. Maybe, like perhaps Viserys I and Queen Alicent, Aerys and/or Rhaella simply wanted a Targaryen/Valyrian name and thought that fit the bill. Or maybe they had a completely different reasoning. We'll probably never know. (And again, the point about GRRM pointedly repeating names stands.)

Gerrit Cole has finally won the Cy Young Award
New York Yankees ace Gerrit Cole (33) of the U.S. Major League Baseball (MLB) won his first Cy Young Award after overcoming the pain of 2019.
MLB's official website "MLB Dotcom" said on the 16th, "Call received the American League Cy Young Award." He received a unanimous vote of 30 first-place votes in the Baseball Journalists Association (BBWAA) vote. It is the first award in 11 years since his debut.
Earlier, Cole stayed in second place twice in 2019 and 2021. But the third challenge was different. Cole ranked third in the American League this year (15 wins), first in ERA (2.63), third in strikeouts (222), and first in innings pitched (209 innings).
This is the 11th time that the American League Cy Young Award winner has been unanimously selected. Justin Verlander (2011 and 2022), Joan Santana (2004 and 2006), Pedro Martinez (1999 and 2000), Roger Clemens (1986 and 1998), Ron Guidry (1978) and Denny McClain (1968).
In the National League, left-handed pitcher Blake Snell (31) of the San Diego Padres dominated 28 out of 30 first-place votes. Snell won his second career Cy Young Award. Snell finished first in the ERA league (2.25), second in strikeouts (234), and tied for fifth in multiple wins (14 wins).
Snell won the Cy Young Award for the 2018 American League Tampa Bay Rays. With this award, he became the seventh player to collect the Cy Young Award in both leagues, following Clemons, Randy Johnson, Pedro Martinez, Max Scherzer, Gailrod Perry and Roy Halladay. 토토사이트

1.1. Teorie právní argumentace200 vycházejí, velmi zjednodušeně vyjádřeno, z toho, že právní věda není věda axiomatická, 201 ale věda „argumentativnf‘202 To znamená, že poznání práva, právních institutů atd. a důsledně ani zjištění quid iuris v určitém případu nelze odvozovat z axiomů, nýbrž je zpravidla třeba se ho dobrat argumentací pro několik z více možností.
1.2. Pojem argumentace vysvětluje O. Weinberger tak, že se jím rozumí „racionální postup, kterým určujeme a odůvodňujeme své přesvědčení nebo kterým přesvědčujeme své posluchače"203
Tato explikace je fomulována disjunktivně a tak je třeba jí rozumět. Argumentací se tedy podle této koncepce, kterou je možno považovat za zdařilou, rozumí jednak odůvodňování vlastního přesvědčení o něčem, třeba i bez úmyslu přesvědčit o tom i někoho jiného, ale i přesvědčování někoho o něčem, aniž o tom nutně byl přesvědčen ten sám, kdo přesvědčuje, tedy ten, kdo argumentuje. Argumentací může být i obojí zároveň, tj. odůvodňování svého přesvědčení o něčem s účelem přesvědčit o tom jiného. V právní praxi, zejména v právním, tj. soudním a jiném řízení, má hlavní význam argumentace v druhém z obou uvede-

ných významů. V něm se stýká a ve své podstatě splývá s rétorikou209 (viz výše v části první, II- 3.), a konkrétně s právní rétorikou, resp. soudní /forensní/ rétorikou, která směřuje k přesvědčení soudce. Soudci sice podle zásady iura novit curia nelze právo procesně dokazovat, lze ho však o právu přesvědčovat a v praxi se tak běžně děje.
I procesní dokazování se však často děje argumentací, o čemž bude podrobněji vyloženo dále sub 3.2.
405 1.3. Právní argumentace má různou formu podle toho, jaký je charakter právních pramenů. V oblasti psaného práva je právní norma komunikována formálním jazykovým výrazem, právním předpisem, tj. slovy a jejich spojeními /víceslovnými výrazy, větami/, které mají svůj význam /designát/, které tedy něco označují /designují/. Prvním úkolem a zároveň předpokladem právní argumentace je tedy poznání významu jazykových znaků vyjadřujících právní normu, tj. poznání právní normy.
406 1.4. Cesta k tomuto poznání je interpretace /výklad/204 205 206 právního předpisu. V hovorové právní řeči se často mluví i o interpretaci právní normy. To však je vyjádření metonymické: právní norma je jako předmět poznání výsledkem interpretace právního předpisu.
Interpretace ovšem přesahuje právní vědu. Interpretace obecně znamená přikládání významu znakům, tj. vyjevování významu znaků. Interpretovat lze každý jazykový výraz, zejména tedy i smlouvu a vůbec každý právní úkon vyjádřený jazykem. Interpretovat lze dále i diplomatickou nótu, politický projev atd. a interpretovat lze i nejazykové znaky, jako jsou konkludentní činy, event. i mlčení, ale i stopy /jejich interpretací se zabývá traseologie jakožto obor kriminologie/ a modus operandi, lékaři interpretují chorobné příznaky atd. atd.
407 1.5. Interpretace právních předpisů je tedy, jak vyplývá z toho, co bylo právě vyloženo, specifický problém sémantický. Jako takový byl znám již v právu římském, kde byl vyjádřen dodnes platnou, proslulou větou Celsovou Scire leges non hoc est verba eorum tenere, sed vim ac potestatem207 /Znát zákony neznamená znát jejich slova, ale pochopit jejich význam a působení/.
Tato věta se pak stala teoretickým východiskem pozdější právní vědy, která od počátku 19. stol. věnovala interpretaci právních předpisů velkou pozornost.
Zprvu byla interpretace zákona chápána především jako činnost poznávací /kognitivní/. Tak např. Savigny považuje interpretaci za rekonstrukci myšlenky, která je obsažena v zákonu. 208 Zeillersice interpretaci nedefinuje, ale považuje za její cíl „jasnou a úplnou znalost zákona**209 Unger /s výslovným odvoláním na zmíněnou větu Celsovu/ považuje výklad zákona za logickou dedukci, která

z určitých skutečností vede k poznání vůle zákonodárcovy, interpretaci tedy vykládá jako „zjištění smyslu zákona*215 a podobně chápou interpretaci četní jiní.
Později ustoupilo toto teoretické pojetí interpretace do pozadí, popř. bylo zcela opuštěno, a převládlo pragmatické chápání interpretace jako vyívěf/ovdní nejasného významu zákona. Příkladmo, jako jeden z mnoha, tu lze uvést názor Pesca-torův, který interpretaci /a to jakéhokoli textu/ zcela jednoznačně definuje jako „operaci, která spočívá ve vyjasnění nejasného textu**.216 Tato koncepce ovšem pojem interpretace nepřiměřeně subjektivizuje. Pojem interpretace jako poznání právní normy přirozeně předpokládá subjekt, který normu poznává, pouze expli-kativní pojetí interpretace ji však nepřiměřeně subjektivizuje tím, že potřebu interpretace činí závislou na tom, zda určitá právní norma je či není jasná určitému subjektu, tj. na tom, zda určitý subjekt pociťuje potřebu právní normu interpretací vyjasnit.
1.6. Řešení je patrně v tom, že interpretace právního předpisu má funkci obojí: 408 kognitivní i explikativní. Kognitivní funkci má vždy. Ta spočívá, jak řečeno, v přiřazování významu k znakům, jimiž byla norma vyjádřena, a je tedy poznáním právní normy z. právního předpisu. Naproti tomu svou funkcí explikativní je interpretace odstraněním nejasnosti právního předpisu ve vztahu k interpretujícímu subjektu. I funkce explikativní sama je ovšem koneckonců kognitivní, jde ovšem o poznání specificky motivované subjektivní nejasností textu interpretovaného právního předpisu.
Důležitý rozdíl mezi kognitivní a explikativní interpretací je dále v tom, že při explikativní interpretaci má výklad právního předpisu různou relevanci podle svých subjektů /viz dále/, přičemž zvláštní význam má interpretace právního předpisu právo aplikujícím orgánem /soudem atd./, která je ve vztahu k interpretaci, o kterou se opírají strany řízení, závazná. Právo aplikující orgán rozhoduje podle právní normy, kterou sám zjistil svou interpretací a která může být s interpretací účastníka řízení shodná nebo od ní odlišná.
2. Druhy interpretace podle jejího právního významu
Právní předpis může vykládat každý a ve výšeuvedeném kognitivním smyslu 409 ji vlastně vykládá každý, kdo ji čte anebo popř. poslouchá. Z hlediska působení interpretace, tj. z hlediska její právní relevance, se zpravidla rozeznává několik druhů interpretace. Kromě interpretace soukromé, která se mezi druhy interpretace zpravidla neuvádí, tu budou uvedeny čtyři nejobvyklejší druhy výkladu, jejichž rozlišení je ovšem zcela empirické a není logickou klasifikací.
Výklad autentický (legální) je výklad obecně závazný.
Tím samým ovšem je dáno, že v takovém případě ve skutečnosti nejde o výklad

právní normy, ale o její legislativní doplnění. Autentický výklad není činností interpretační, ale legislativní. U nás bylo kdysi ústavou oprávněno podávat autentický výklad zákonů předsednictvo Národního shromáždění a později, do konce roku 1992, měl toto oprávnění Ústavní soud ČSFR. V současné době u nás autentický, tj. všeobecně závazný výklad právních norem neexistuje.
410 Výklad soudní má dvě formy a podle nich i dvojí působení. Předně jde o výklad sloužící ke sjednoceníjudikatury. Takovýto výklad podává Nej vyšší soud ve svých stanoviscích, která jsou publikována ve Sbírce rozhodnutí soudů. Tato stanoviska nejsou závazná a působí jen přesvědčivostí své argumentace. Ve skutečnosti ovšem působí tak, jakoby závazná byla, apodílejíse na faktickém dotváření práva. Podobně působí i rozhodnutí vyšších soudů v konkrétních věcech, pokud jsou se záměrem působit ke sjednocení judikatury uveřejněna v cit. Sbírce.
Výklad, o který se opírá pravomocné rozhodnutí v konkrétní věci, působí, nezávisle na tom, zda rozhodnutí bylo publikováno či nikoliv, ve vztahu k stranám řízení a je mezi nimi právně závazné (působí závazně inter partes). Obdobné platí i o pravomocných rozhodnutích správních orgánů a orgánů územní samosprávy vydaných v jejich rozhodovací pravomoci.
Dále je třeba připomenout výklad vědecký (doktrinámí), který je podáván právní vědou, zejména právní dogmatikou. Tento výklad je nezávazný, působí však na výklad soudní a vůbec na interpretační praxi.
Konstantním výkladem se rozumí ustálený výklad určité právní normy, a to zejména ustálený v rozhodování soudů. Tu se mluví o konstantní judikatuře. Jejímu vytvoření slouží zejména uveřejňování stanovisek Nejvyššího soudu a judikátů vyšších soudů (viz výše).
3. Metody výkladu
411 3.1. Designát právní normy někdy připouští různé chápání prvků svého rozsahu. Podle toho se rozlišuje výklad doslovný\ výklad rozšiřující (extenzivní) a výklad zužující (restriktivní").
Výklad doslovný přichází v úvahu zejména tehdy, je-li přiřazení významu použitému znaku jednoznačné, popř. oboustranně jednoznačné. Stanoví-li např. zákon trestní sazbu od jednoho do tří let odnětí svobody, nemůže interpretace dojít k jinému názoru, než že nejnižší sazbou je jeden rok a nej vyšší tři roky a ani méně ani více.
Extenzivní a restriktivní výklad je praktický zejména v případě, že zákon použije (záměrně nebo nevolky) výrazů neostrých či vágních. Jako příklad lze uvést výraz trestního zákoníku „věk blízký věku mladistvých“(§ 33 písm. b TrZ). Rozhodnutí o tom, zda a kdy se má použít výkladu zužujícího a kdy rozšiřujícího, nelze odvodit logicky, je výsledkem úvahy teleologické (účelové) a popř. právně-politické.
412 3.2. Z jiného hlediska se metody výkladu tradičně rozlišují na metody gramatické, logické, systematické a historické.

pravidel gramatických, resp. pravopisných. Tak např. na význam výrazu lze, zejména v pochybnostech, soudit z umístění interpunkčních znaků, ze shody přídavného jména s podstatným, ze slovosledu atd.
Logický výklad používá některé logické argumenty (zvláštní argumenty právní logiky), o nichž bude podrobnější řeč dále sub 3.3.
Výklad systematický usuzuje o významu výrazu z umístění právní normy 413 v příslušném právním předpisu, popř. vůbec v systému práva. Tento argument je ovšem dost nespolehlivý a obyčejně vyžaduje současného použití argumentů dalších. Tak ze skutečnosti, že ustanovení o převzetí dluhu je umístěno v občanském zákoníku v části pojednávající o právu závazkovém, lze soudit, že podle tohoto ustanovení nelze převzít věcné břemeno, ani povinnost vyplývající z pracovního poměru. Spolehlivě lze soudit, že ustanovení zákoníku práce definující pojem „mladistvý“nelze použít v právu trestním, když navíc trestní zákoník tento pojem pro účely trestního práva definuje též a jinak, než zákoník práce. Naproti tomu ustanovení občanského zákoníku o zletilosti má patrně obecnou platnost pro celý právní řád.
Argumentem systematickým je i tzv. argumentům a rubrica, podle něhož se soudí, že v případě, kdy právní předpis je rozdělen v části (díly, oddíly atd.) označené záhlavím, které se nazývá rubrikou, právní norma zařazená pod touto rubrikou se týká jen látky v této rubrice obsažené.
Nejméně spolehlivý a i teoreticky pochybný je výklad historický, který poža- 414 duje, aby se při výkladu právní normy přihlíželo k okolnostem jejího vzniku a zejména též k její důvodové zprávě. Do oblasti historického výkladu náleží i tzv. argumentům e ratione legis, tj. výklad podle známého nebo podle předpokládaného úmyslu či záměru zákonodárcova. Ve skutečnosti ovšem právní normu nelze vykládat podle doby, kdy byla vydána, ale podle doby, kdy je aplikována, a ani není rozhodné, co zákonodárce chtěl vyjádřit, ale to, co vyjádřil, tj. to, co lze ze slov zákona vyčíst. Výklad historický, včetně výkladu „e ratione legis", může tedy při zjišťování významu právní normy sloužit jen jako výklad pomocný, který je třeba konfrontovat s výkladem provedeným ostatními interpretačními metodami.
3.3. Výklad logický používá některých specifických metod, které se zpravidla 415 nazývají argumenty (zvláštní argumenty právní logiky). Ty se tradičně označují svými latinskými názvy.
a) Argumentům a contrario (důkaz z opaku), resp. argumentům per elimi-nationem (výklad vylučovací), se opírá o logický zákon vyloučeného třetího. Argument a contrario spočívá v tom, že v případě, že jsou jen dvě možnosti A nebo B a třetí možnosti není a právní předpis stanoví něco výslovně jen o A, pak to neplatí o B. Tak např., je-li dáno, že věci jsou bud jen nemovité nebo jen movité a právní předpis stanoví, že něco platí jen o nemovitostech, pak je tím samým dáno, že to neplatí o movitostech. Argumentům per eliminationem (důkaz vyloučením) spočívá v tom, že je dána množina prvků A, B, C, D...N a právní předpis z ní něco stanoví výslovně jen o C, nebo o C a D apod. Tím je dáno, že to neplatí o ostatních prvcích dané množiny. Argument per eliminationem, jak vidno, spočí-

vá na stejném logickém základě jako argument a contrario. Argument a contrario je tedy species argumentu per eliminationem.
Argument per eliminationem se aplikuje i tam, kde zákon uvádí tzv. taxativní výpočet, který spočívá v tom, že právní předpis jmenovitě vypočítává vyčerpávajícím způsobem prvky, na které se vztahuje, čímž je dáno, že se nevztahuje na žádný prvek, který je mimo tuto množinu. Takto postupují např. § 25 a 27 TrZ, které taxativně vypočítávají tresty. To znamená, že soud nemůže uložit žádný jiný trest, než takový, který je výslovně uveden v množině trestů vymezené uvedenými ustanoveními trestního zákona.
416 b) Dalším je argumentům afortiori (a potiori), tj. uvažování od silnějšího k slabšímu. V rámci tohoto argumentu se zpravidla rozlišuje argumentům a maiori ad minus a a minori ad maius, tj od většího k menšímu, resp. od menšího k většímu. Tyto argumenty nemají spolehlivý logický základ a spočívají v úvaze, že platí-li něco o větším (silnějším), pak to tím spíš platí o menším (slabším). Nelze však spolehlivě určit, co je silnější, resp. větší, a co je slabší, resp. menší. Tohoto argumentu lze tedy používat jen intuitivně, resp. úvahou podle zkušenosti, takže není příliš spolehlivý. Přesto však je praktický. Jako jeho příklad může poslou��it ustanovení § 128 odst. 1 ObčZ, který stanoví, že ve stavu nouze nebo ve veřejném zájmu je vlastník povinen strpět, aby byla za dalších podmínek použita jeho věc bez jeho souhlasu. Z toho se a fortiori dovozuje, že tím spíš má takovou povinnost i držitel, který není vlastníkem věci.
417 c) V praxi se často používá argumentům per analogiam (argumentům a simili), tj výklad podle podobnosti. Tento argument se obyčejně dále rozlišuje na argument per analogiam legis a per analogiam iuris.
Analogia legis (analogie zákona) spočívá v tom, že se na skutkovou podstatu zákonem neřešenou, vztáhne analogicky ustanovení zákona upravujícího skutkovou podstatu podobnou. Je to tedy úvaha typu, že „platí-li něco pro Ai, platí to též - není-li specifické úpravy - pro A2.“
Jestliže na určitou skutkovou podstatu, která není výslovně upravena, nelze použít žádnou právní normu, a to ani a contrario, ani a fortiori, ani per analogiam legis atd., připouští se v teorii, aby byla posouzena, resp. rozhodnuta per analogiam iuris (podle analogie práva), tj. podle obecných zásad právních.
Z toho je patrno, že analogia iuris ve skutečnosti není analogií, nýbrž použitím velmi mlhavých obecných zásad právních, tj. rozhodnutím podle rozumného právního uvážení. Skutečnou analogií je tedy jen analogie zákona (analogia legis).
418 Analogické použití zákona dovoluje někdy výslovně zákon sám. Tak např. § 833 ObčZ obecně stanoví, že občanskoprávní vztahy výslovně zákonem neupravené se řídí ustanoveními občanského zákoníku, která „upravují vztahy obsahem i účelem jim nejbližší“. Podobně stanoví § 611 ObčZ, že na směnnou smlouvu se analogicky použijí ustanovení o smlouvě kupní, § 491 odst. 2 ObčZ přikazuje použití analogie na právní vztahy založené tzv. smlouvami nepojmenovanými a podobných případů je v soukromém právu mnoho. Analogie zákona je však přípustná i tehdy, jestliže k ní zákon výslovně neodkazuje.
Tak např. občanský zákoník dává právo na bytovou náhradu (náhradní byt) jen nájemníkovi, jehož nájemní poměr skončil. Skončí-li právo užívat byt někomu, 210

kdo byt užívá z titulu spoluvlastnictví domu, bude mu za obdobných podmínek přiznáno právo na bytovou náhradu per analogiam legis.211 Použití analogie ovšem má své meze. Tak zejména není analogie přípustná v trestním právu, pokud jde o vymezení skutkové podstaty trestného činu a o stanovení trestní sazby, není přípustná tam, kde zákon ukládá nějaké povinnosti (např. daně) atd.
Analogie je dále nepřípustná tam, kde skutkové podstaty jsou v zákoně vypočítány taxativně atd., naopak se analogie nutně uplatní tehdy, jestliže zákon podává příkladmý výpočet něčeho. Tak např. stanoví-li právní předpis, že dopadá „zejména na A, B, C aD“, je možno jej vztáhnout, za předpokladu, že jsou podobné, i na skutkové podstaty É a F a popř. další.
Argumentům reductione ad absurdum se používá buď samostatně, nebo tehdy, 419 dovádí-li výklad podle několika jiných argumentů k rozporným (neslučitelným) závěrům. Redukce ad absurdum znamená, že v případě, kdy by výklad právní normy dovedl k závěru absurdnímu, tj. nesmyslnému, nebo takovému, který nemá rozumný smysl apod., je třeba tento výklad odmítnout jako nesprávný. Obdobné platí, dovedl-li by výklad k závěru nemožnému. V tom případě se mluví o argumentu reductione ad impossibile.
Jako příklad lze použít výšeuvedený § 128 odst. 1 ObčZ, který (zjednodušeně 420 řečeno) ve stavu nouze nebo ve veřejném zájmu ukládá povinnost vlastníkovi, aby strpěl použití své věci někým jiným. Otázka je, zda tuto povinnost má i držitel věci, který není jejím vlastníkem (dále jen „držitel"). Výše bylo demonstrováno, že podle argumentu a fortiori ji má. Věc je však složitější. Dochází tu totiž ke konfliktu dvou argumentů. Ustanovení § 128 odst. 1 ObčZ je možno vykládat
a) buď, jak se stalo, a fortiori tak, že má-li povinnost vlastník, tím spíše ji má držitel,
b) anebo per eliminationem, tj. tak, že ukládá-li zákon tuto povinnost výslovně vlastníkovi, vylučuje z ní kohokoli, kdo vlastníkem není, takže držitel tuto povinnost nemá.
Podle závěru sub b) by ovšem ten, kdo má k věci slabší právo, měl v případě § 128 odst. 1 ObčZ silnější právní postavení. Konkrétně by to mohlo znamenat, že vlastník věci bude mít in concreto víc povinností, než její zloděj, tj. její, byť neoprávněný, držitel. To však je absurdní, takže výklad sub b) je třeba odmítnout a přijmout, jak se již také stalo a jak se obecně uznává, výklad sub a).
II. Právní dokazování a vedení sporu
1. Spor

1.1. Slovo „spor" má různé významy. V logice se jím rozumí jednak spor 421 (rozpor) mezi pravdivým a nepravdivým výrokem, opírající se o tzv. zákon totožnosti, nebo rozepře mezi nejméně dvěma osobami, které se přou o nějakou tezi, tj. o pravdivost či nepravdivost nějakého tvrzení. Tu se zabýváme sporem

v tomto naposled uvedeném smyslu, a to zejména se zaměřením na problematiku právního sporu, tj. sporu upraveného resp. normalizovaného právem.212
Spor se obecně nazývá dnes už trochu archaicky znějícím slovem disputace a nauka o jeho vedení se v logice nazývá eristika.213 Ta ovšem se zpravidla zabývá nejen logickou stránkou vedení sporu, ale i jeho stránkou psychologickou a etickou.
Základní logickou podmínkou jakéhokoli rozumného sporu (disputace) je, aby teze, o níž se vede spor, byla jasná a aby v rozpravě přednášené argumenty se této teze týkaly. Je proto důležité, aby teze, o které se jedná, byla jasně a nedvojsmyslně formulována.
Disputace má různé formy a v širším smyslu neznamená jen přímý spor o určitou tezi s cílem dokázat anebo vyvrátit její pravdivost, ale např. i rozpravu směřující k rozhodnutí o určitém řešení z více možných (tu se tedy disputace vede
0 více tezích s cílem vybrat nejlepší či nejvhodnější), rozpravu směřující ke zhodnocení vědecké úrovně nějakého díla atd. Společné všem těmto druhům disputace je ovšem to, že předpokládají jasně a nedvojsmyslně vymezenou tezi či několik tezí a argumentaci jimi vymezenou.
Při disputacích velmi často dochází i ke kladení otázek a podávání odpovědí, takže se v nich uplatňuje též tzv. interogativní či erotetická logika. Logická stránka disputace se však na interogativní logiku neomezuje, její hlavní logickou složkou je argumentace a dokazování.
422 1.2. Specifickým případem disputace je vedení právního sporu a to zejména
soudního. Z logického hlediska však nejsou podstatné rozdíly mezi sporem soudním, arbitrážním a správním, takže to, co bude dále vykládáno o soudním sporu, platí obdobně i o ostatních.
Spor začíná tezí, jíž je tvrzení žalobcovo. Odpůrce (žalovaný či obžalovaný) pak tuto tezi zpravidla (byť ne nezbytně) zcela nebo zčásti popírá a oba účastníci sporu se pak v průběhu řízení snaží dokázat pravdivost svého tvrzení resp. nepravdivost tvrzení druhého účastníka.
Tato disputace má některé specifické rysy. Jeden z nich spočívá v tom, že účastníci řízení netoliko tvrdí nějaké skutečnosti, ale činí i návrhy, tzn. navrhují, aby soud na základě zjištění pravdivosti jejich tvrzení určitým způsobem rozhodl. Se zřetelem k této povaze soudního sporu se argumenty účastníků nemusí omezovat jen na dokazování pravdivosti tvrzených skutečností, ale mohou se týkat
1 právního posouzení věci. Spor se tedy vede ve dvou logických úrovních: jednak o pravdivost skutkových tvrzení a jednak o právní posouzení. Je ovšem možné, že tvrzené skutečnosti jsou mezi účastníky řízení nesporné a spor se vede toliko o právní posouzení a výjimečně v soudním sporu není sporné ani právní posouzení. Tak tomu bývá tehdy, jestliže účastník řízení uzná nejen skutkové tvrzení,

ale i právní posouzení přednesené druhým účastníkem (např. dlužník uzná svou povinnost zaplatit zažalovaný dluh a tvrdí pouze, že na to nemá peníze).
Další zvláštnost soudního sporu spočívá v tom, že jeho postup je, byť podle 423 našeho procesního práva (na rozdíl např. od procesu angloamerického) dosti volně, závazně upraven procesními řády.
Hlavní zvláštnost soudního sporu spočívá ovšem v tom, že v něm kromě jeho účastníků vystupuje třetí, „neutrální1*subjekt, tj. soud, který spor nezávisle a autoritativně (ovšem s účinností toliko mezi účastníky řízení) rozhoduje.
Při tomto rozhodování soud, jak vyplynulo už z výkladu dřívějšího, řeší jednak tzv. otázky skutkové a jednak otázky právní. Otázkou skutkovou (quaestio facti) je pravdivost či nepravdivost skutkových tvrzení účastníků, popř. zjištění pravdivé odpovědi na otázku, kterou položil soud sám bez iniciativy účastníků. Skutkovou otázkou je např otázka, zdaje pravdivé tvrzení, že se obžalovaný choval určitým způsobem (zda se dopustil určitého činu) či zda žalovaný zaplatil žalobci určitou částku peněz atd.Otázkou právní je, pod jaké ustanovení zákona mají být zjištěné skutečnosti subsumovány.
2. Argumentace a dokazování
2.1. Argumentace obecně znamená uvádění důvodů pro nějaké tvrzení. Právní 424 i logická problematika argumentace a dokazování je ovšem do té míry podobná, že ji tu probíráme zároveň a demonstrujeme na dokazování.214
2 2. Dokazování předpokládá výrok „p“o němž není známo, zdaje pravdivý či nepravdivý. Logické dokazování 215je logický proces, který vede bud k zjištění pravdivosti „p“, v kterémžto případě se výsledku dokazování říká „důkaz p“, nebo k zjištění nepravdivosti „p“ v kterémžto případě lze mluvit o „důkazu nepravdivosti p“, popř. o „důkazu opaku** anebo též o „vyvrácení p“.
V právu je dokazování neobyčejně důležité, neboť veškeré zjišťování objektivní pravdy v jakémkoli právním procesu (soudním i správním) se - buď výlučně nebo s nepodstatnými výjimkami notoriety, nevývratných právních domněnek a fikcí -uskutečňuje dokazováním, tj. důkazním řízením. Logická teorie dokazování však není totožná s procesně právní teorií dokazování. Předně se každá z nich zabývá jinými aspekty dokazování a kromě toho je i jejich předmět, ač se překrývá, různě široký. Logická teorie dokazování se, jak bylo řečeno výše, netýká jen právního dokazování, ale jakéhokoli dokazování (zejména i vědeckého, ale např. i matematického dokazování, dokazování lékařské diagnózy atd.), a naopak procesně právní teorie dokazování se zabývá i problémy jinými než logickými. Přesto však logická teorie dokazování je základem procesně právní teorie dokazování, takže zde se budeme logickými otázkami dokazování zabývat se specifickým zřetelem k procesně právnímu dokazování, a to v kontradiktorním řízení soudním, v jehož oblasti se tato problematika jeví nejzřetelněji.

425 2.3. V logice i v procesním právu se výrazu „důkaz“používá v různých významech a nejednotně. V logice se důkazem nazývá, zhruba řečeno, správné odvozování z pravdivých premis, tj. určitý myšlenkový proces deduktivní. Důkaz ve smyslu právním je sice zčásti též deduktivním procesem odvozování, v čemž se v podstatě kryje s pojmem důkazu ve smyslu logickém, zároveň ovšem v právu má velký význam induktivní stránka důkazu, zejména např. přistižení při činu (in flagranti delicto), ohledání místa či osoby, usuzování ze zanechaných stop, z listin atd.
Kromě toho je výraz „důkaz“ v právním jazyku používán nejednotně 216 i potud, že se jím podle okolností někdy míní výsledek dokazování a jindy důkazní prostředek. Běžně se např. (zejména v právní řeči) říká „nabízet*' důkaz o něčem či „provádět** nebo „vésť* důkaz o něčem apod., ačkoli se ve skutečnosti míní „nabízet důkazní prostředek“či „předvádět důkazní prostředek**. Také řekne-li se, že něco je něčeho důkazem, může tomu být rozuměno tak, že je to to, čím bylo určité tvrzení dokázáno, anebo to, čím má být dokázáno (tj. důkazní prostředek). Při používání výrazu „důkaz “je tedy vždy třeba z kontextu přesně zjistit, v jakém významu ho bylo použito.
426 2.4. Proces dokazování může být (a v soudní praxi často bývá) velmi složitý, zpravidla se však dá vyjádřit třístupňovým schématem, které lze považovat za elementární schéma jakéhokoli dokazování.
Jeho prvním stupněm (prvním předpokladem) je přesné vymezení předmětu dokazování, tj. výroku, jehož pravdivost či nepravdivost má být dokázána. Předmětu dokazování se říká thema probandi nebo thema probationis anebo též probandum.
Druhým stupněm dokazování jsou důkazní prostředky neboli argumenty. (Výrazu argumenty se tu používá v jiném významu než v predikátové či v modální logice.) Vztah thematu probandi a argumentů je z logického hlediska podobný jako vztah otázky a odpovědi. Předmět dokazování, který můžeme nazvat oborem dokazování, předem vymezuje třídu argumentů podobně, jako obor otázky vymezuje třídu možných rozumných odpovědí. Jestliže např. předmětem důkazu je skutečnost, zda se vada určitého výrobku u něho vyskytla opětovně, je třeba dokazování soustředit na vadnost věci a na skutečnost, že se táž vada vyskytla alespoň dvakrát, nemělo by však smysl připouštět důkazní prostředky o tom, jakou výstupní kontrolou výrobek prošel u svého výrobce.
Závěrem dokazování je důkaz neboli demonstrace (závěrečná formule důkazu bývala: Quod erat demonstrandum, popř. zkratka QED, což znamená: Toto mělo být dokázáno).
Označíme-li themaprobandi písmenem p a důkazní prostředky, z nichž vyplývá pravdivost p, písmeny Di, D2... Dn, pak lze uvedený proces dokazování symbolicky vyjádřit implikací

tzn. že, svědčí-li pro pravdivost závěru p důkazní prostředky D| až Dn, je výrok p pravdivý.
2.5. V kontradiktorním soudním řízení má schéma dokazování typickou podo- 427 bu složitější tím, že v něm vystupují dvě odpůrčí strany, které o určité skutečnosti zpravidla tvrdí opak. Situace tu tedy bude vypadat tak, že A tvrdí p a vede o pravdivosti svého tvrzení důkazy Dl, D2...D3, kdežto B tvrdí -p a vede o pravdivosti svého tvrzení důkazy Ti, T2 ... T3, přičemž důkazní prostředky D implicite nebo explicite zároveň směřují k vyvrácení -p a důkazní prostředky T směřují k vyvrácení p.
V tomto případě bude tedy soud v dilematu p nebo -p (tj. není jiná možnost než p nebo -p ) muset zkoumat a hodnotit předvedené důkazní prostředky a rozhodnout, zda tvrzenou skutečnost p bude považovat za prokázanou či nikoli, zda tedy považuje výrok p za pravdivý či nepravdivý. Tím ovšem do procesu soudního dokazování nutně vstupuje prvek subjektivní a hodnotící.
3. Různé stránky dokazování
3.. Extenzionální dokazování je logickým dokazováním deduktivním, tj. doka- 428 zo váním pravdivosti výroku p jeho odvozením z jiných výroků, jejichž pravdivost je dána. Intenzionální dokazování je induktivní, tj. takové, které nespočívá v logickém odvození, nýbrž např. v pozorování, tj. zejména v ohledání místa či věci, v prohlídce osoby atd. V praxi soudního dokazování staví zásada přímosti řízení do popředí intenzionální způsob dokazování, celý proces soudního dokazování však nutně předpokládá i dokazování extenzionální (deduktivní), takže se oba způsoby v soudním řízení kombinují a navzájem doplňují.
Tak např. bude-li žalobce, setrváme-li u výšeuvedeného příkladu, ve sporu tvrdit, že koupená věc je vadná a že se její vada vyskyda opětovně po opravě, může se soud o vadnosti věci (je-li zjevná) přesvědčit prohlédnutím věci popř. vyzkoušením její funkce. Tato skutečnost bude tedy dokázána intenzionálně. Připusťme dále, že o opětovném výskytu vady po opravě se soud přesvědčí nahlédnutím do dřívější reklamace a do potvrzení o tom, že reklamace byla uznána a věc opravena. Tu je důkaz opětovného výskytu vady ve skutečností deduktivní. Soud totiž nahlédnutím do uvedených dokumentů nezjišťuje přímo skutečnost, že se vada vyskytla opětovně, nýbrž jím získá pravdivé poznání, že dotyčná vada se již vyskytla a byla opravena v době předcházející okamžiku, kdy se soud v řízení sám nahlédnutím přesvědčil o tom, že věc je vadná. Soud tímto dokazováním získá dvě pravdivé premisy:
I. věc V trpěla vadou D v okamžiku T,
II. věc V trpěla stejnou vadou D a byla opravena v době předcházející okamžiku
T.
Z toho soud odvodí závěr:, je pravda, že vada D se u věci V vyskytla opětovně po opravě11.
3.2. Objektivní stránka dokazování, která je teoreticky primární, spočívá v tom, 428 že důkaz je potvrzením resp. ověřením objektivní pravdivosti dokazované skutečnosti, resp. výroku o ní, tzn. souladu tohoto výroku s objektivní realitou. 217

V soudním řízení však jeho účastníci ve skutečnosti usilují nejen o dokazování objektivní pravdivosti výroku p, ale zároveň o přesvědčení soudu o jeho pravdivosti. Je tedy třeba rozlišovat skutečnost, že výrok p je objektivně pravdivý, a skutečnost, že soud jej subjektivně za pravdivý považuje. Objektivní pravdivost thematu probandi je na soudu nezávislá. Ve svém přesvědčení o jeho pravdivosti se soud může mýlit, což by pak zpravidla bylo důvodem revize vydaného rozhodnutí v opravném řízení.
429 V objektivní stránce dokazování jsou tedy, jak vidno, dány dva aspekty: kognitivní (poznávací) a axiologický (hodnotící). Soud poznává skutkovou podstatu na základě provedených důkazů a zároveň tyto důkazy hodnotí. Z takto získaného poznání a hodnocení pak deduktivně odvozuje závěr o tom, zda thema probandi bylo či nebylo dokázáno, tzn. zdaje či není pravdivé.
3.3. Nepřímým důkazem se nazývá situace, kdy je dokázána pravdivost jiného výroku, než toho, který tvoří thema probandi, ale z tohoto výroku lze pravdivost thematu probandi deduktivně odvodit. Nepřímý důkaz mívá často formu logického odloučení, které budeme demonstrovat na příkladu dokazování toho, že určitá osoba nalezená mrtvá v řece zemřela dříve, než se její tělo dostalo do vody. Při dokazování vyjdeme z tohoto tvrzení, které označíme p, a vytvoříme jeho negaci -p, tj. tvrzení, že zemřela utopením. Je pak známo, že kdyby bylo pravda -p, tj. zemřela-1 i dotyčná osoba teprve ve vodě (utopením), byla by v jejích plících voda. Vytvořili jsme tedy implikaci ,,-p —► q, ''která se bude číst: „vždy, není-li p, pak je
4.“ Pitvou bude zjištěno, že v plících oné osoby voda není, čímž je dokázáno, že zemřela před ponořením do vody.
4. Vady dokazování
430 4.1. Právní a logické chyby v dokazování. Chyby (vady) dokazování jsou jednak právní a jednak logické. Právní vadou dokazování je např. provedení důkazu, jehož provedení zákon nedovoluje, nepřípustná forma kladení otázek, nátlak na účastníka řízení či na svědka, nesprávné zhodnocení důkazů atd. Logická vadnost dokazování působí sice v právním řízení zároveň i právní vadnost dokazování, je však na právu nezávislá. Důvodem logické vadnosti dokazování jsou logické chyby v myšlenkovém procesu logického dokazování, které jsou specifickým případem logických chyb vůbec.
Logické chyby218 jsou chyby v logickém postupu lidského myšlení a týkají se nejrůznějších logických operací, tak zejména existují logické chyby odvozování (chyby sylogismu), specifické logické chyby dokazování a vůbec argumentace, chyby definování, chyby otázek atd.
Zde se zmíníme o některých logických chybách, které se vyskytují v logickém procesu vedení a rozhodování sporu a zejména též v procesu dokazování, tzn. o chybách v odvozování (sylogismu) a o specifických chybách dokazování. (Chyby v odvozování ovšem nejsou omezeny na spor, nýbrž mají obecný charakter.)

4.2. Chyby odvozování. Základní chybou sylogistiky je vadné odvozování, které 431 spočívá v tom, že je při odvozování porušeno některé ze základních pravidel tvoření úsudků. Takovouto chybou by bylo např. porušení pravidla kategorického sylogismu, že v případě, je-li třeba jen jedna premisa částečná, závěr může být také jen částečný (nemůže být obecný). Tak např. z premis:
I. některé právem zakázané chování je trestným činem,
II. každý trestný čin je společensky nebezpečný,
nelze vyvodit pravdivý závěr, že každé právem zakázané chování je společensky nebezpečné, neboťprvní premisa se týká jen některého právem zakázaného chování, ale závěr se vyvozuje o každém právem zakázaném chování.
Typickou a častou (zejména v různých diskusích, a to i vědeckých) logickou 432 chybou porušující pravidla sylogismu je tzv. quaternio terminorum, spočívající v tzv. ekvivokaci, tj. záměně významu téhož jazykového výrazu, týkající se středního členu úsudku. V důsledku této ekvivokace má sylogismus místo tří členů ve skutečnosti čtyři, a to proto, že střední člen v horní premise není totožný se středním členem v premise dolní. Odtud pochází jméno této logické chyby, které znamená doslova „čtvero termínů*) Příkladem by byl úsudek (logického typu Barbara):
I. Všechny závěti, aby byly platné, musejí mít náležitosti podle § 476 an. ObčZ,
II. Tento projev je politická závěť politika X.Y.
Závěr- Tento projev, aby byl platný, musí mít náležitosti podle § 476 an. ObčZ
Tento závěr, ač vyvozený podle pravidel sylogistiky, je nesmyslný, poněvadž se v něm slova „závěť** jednou používá ve smyslu posledního pořízení o majetku a v druhém ve smyslu vzkazu či doporučení budoucím politikům.
V praxi chyby dokazování tohoto druhu zpravidla nejsou takto zjevné, ale při pozorném sledování procesu dokazování nebývá obtížné je odhalit.
4.3. Specifické chyby dokazování Ze specifických logických chyb dokazování, 433 resp. vůbec argumentace, lze na prvním místě zmínit elementární chybu zvanou non sequitur (doslova „nevyplývá*), která spočívá v tom, že se pro dokazování pravdivosti výroku p uvedou např. výroky q&r, které jsou sice samy pravdivé, ale nevyplývá z nich p. Tak např. bude-li žalobce tvrdit „občan O je mi dlužen Kč 1000“ a uvede-li pro dokázání svého tvrzení výroky: „částku Kč 1000 jsem občanovi O vyplatil dne...“ a „občan O mi tuto částku nevrátil**, nedokáže tím pravdivost toho, že Oje mu tuto částku dlužen. Z uvedených skutečností (výroků), .
i tehdy jsou-li pravdivé, to totiž nevyplývá (non sequitur), žalobce mohl občanovi O částku Kč 1000 zaplatit jako kupní cenu za něco, co od něho koupil, nebo mu ji poskytl jako dar apod.
Podobnou a rovněž častou chybou dokazování je ignoratio elenchi (doslova 434 „neznalost sporné otázky*), která spočívá v posunutí předmětu dokazování, tzn. že se zdánlivě dokazuje pravdivost výroku p , ale ve skutečnosti důkaz směřuje k předmětu q, nebo, že se začne dokazovat p a v průběhu dokazování se jeho předmět posune ke q apod. Tak např. půjde-li v nějakém soudním sporu o to, dokázat, že věc V je vlastnictvím osoby O, a místo toho bude dokázáno, že O měl věc V již před deseti léty u sebe a nakládal s ní, jako by byla jeho. Tak např. bude-li žalovaný či obžalovaný tvrdit, že je vlastníkem věci V, a dokazovat pravdivost svého tvrzení tím, že věc nabyl darováním od neznámé osoby, a toto tvrzení samo není dokázáno, je to jasná petitio principii a soudu bude na první pohled jasno, že důkaz vlastnictví věci V v tomto případě vyžaduje a předpokládá důkaz tvrzeného nabytí této věci.

Jacob deGrom sets another record amid historic season
Jacob deGrom has set yet another record on his way to one of the best pitching seasons in recent memory.
The New York Mets ace came into Friday’s game with an absurd 22 consecutive quality starts this season. He added another one to the total by allowing just three hits and one run to the Washington Nationals while recording eight strikeouts over seven innings. Quality starts are defined by outings in which a starter goes at least six innings while allowing no more than three earned runs.
deGrom’s 23rd straight quality start set a Major League record, breaking a tie with Chris Carpenter and Bob Gibson.

Unfortunately for deGrom, who is 9-9, Nola and Max Scherzer have also put together seasons worthy of being in the Cy Young discussion. Should Nola or Scherzer take home the award, deGrom’s remarkable season may be forgotten by many, thanks largely to the Mets’ lack of run support for him.

Hawaii soaked by rain, flooding as Hurricane Lane churns toward islands
HONOLULU (Reuters) – High winds and torrential rains from Hurricane Lane lashed Hawaii on Thursday, touching off flash floods, landslides and raging surf as it spun toward the islands, prompting schools and offices to close as residents hunkered down to ride out the storm.
With Lane still churning in the Pacific Ocean some 200 miles (322 km) south-southeast of Kailua-Kona, more than a foot (30 cm) of rain had already fallen on the eastern side of the Big Island of Hawaii, said Kelly Wooten, a spokeswoman for the Hawaii County Civil Defense agency.
There were no immediate reports of injuries, but at least 14 roads had been closed because of flash floods and landslides in the Pacific island state, she said. Tourists were advised to stay away from a popular attraction on the island of Maui called the Seven Sacred Pools, a scenic cluster of waterfalls and grottos.
Moving northwest at 7 miles per hour (11 kph), the tempest was classified as a powerful Category 4 storm on the five-step Saffir-Simpson scale, packing sustained winds of 130 mph (209 kph).
The latest predictions showed the eye of the storm twisting west of the Big Island on Friday morning before glancing past Maui and several other islands later in the day, on its way to Oahu. But authorities warned that Lane was moving erratically and that the islands could still expect to be hit hard by the erratic hurricane.
“We’re telling everybody to take the storm seriously, make your final preparations, and be prepared to ride out what is going to be a prolonged rain event,” said Andrew Pereira, communications director for the city and county of the state capital, Honolulu, situated on Oahu.
The National Hurricane Center warned that storm surges could raise water levels 3 to 5 feet (1 to 1.5 meters) above normal along the western shores of the Big Island. Extreme rainfall may prompt “numerous evacuations and rescues,” it said.
Governor David Ige has urged residents to prepare for the worst by setting aside a 14-day supply of water, food and medicines. All public schools, University of Hawaii campuses and nonessential government offices on the islands of Oahu and Kauai will be closed for at least two days starting on Thursday, he said on Wednesday.
Par Pacific Holdings Inc said it was shutting its 93,500 barrel-per-day Kapolei, Hawaii, refinery because of the threat posed by the approaching storm.

‘EVERYONE WAS IN A PANIC’
The shelves of a downtown Honolulu Walmart were stripped of items ranging from canned tuna to dog food, bottled water and coolers full of ice after warnings of possible power outages.
“I went to Safeway last night for regular groceries. Everyone was in a panic,” said Thao Nguyen, 35, an employee at a Honolulu branch of Hawaiian shirt retailer Roberta Oaks.
Long lines of cars formed at gas stations in Honolulu and people pulled small boats from the water ahead of the expected storm surge.
President Donald Trump declared a state of emergency for Hawaii and ordered federal authorities to help supplement state and local responses, the White House said on Thursday.
The Coast Guard has ordered all harbors to close to incoming vessels. The U.S. Navy has moved most of its fleet out of Pearl Harbor. The ships could provide assistance after the storm if needed, the Honolulu Star Advertiser reported.
Since Hurricane Maria devastated Puerto Rico last year, the Federal Emergency Management Agency has made changes to how it works, FEMA Administrator Brock Long said on Thursday.
One key change is making sure that generators are in place so they can immediately provide power to residents and quickly restart the water system, Long told a briefing in Washington.
“It’s not just providing food and water. If you fix the power first, you solve 90 percent of the problems,” Long said, adding that FEMA was focused on food and shelter, health and medical, power and fuel, communications, transport, and hazardous waste.
The most powerful hurricane on record to hit Hawaii was Category 4 Iniki, which made landfall on Kauai island on Sept. 11, 1992, according to the National Oceanic and Atmospheric Administration. It killed six people and damaged or destroyed more than 14,000 homes.

#LubinLife Q&A: Nurilya Sattybayeva ’19
Meet Nurilya Sattybayeva '19. Nurilya moved to NYC from Kazakhstan five years ago and is finishing her junior year as a Quantitative Business Analysis major, minoring in Finance. At Pace she was an involved student leader: was President of Women in Corporate America, a member of Beta Alpha Psi, a Peer Leader, a Resident Assistant, and a Student Assistant at the Lubin School of Business. She also participated in several competitions and is now a summer analyst at Société Générale.
As an international student, what made you decide to attend Pace University/Lubin School of Business?
There were two important factors for me when I was considering what college to attend. I chose Pace because I wanted to be in New York City so that I could take advantage of all of the conferences, networking opportunities and internships during the year. And I mean, it's NEW YORK so there is so much to do! Secondly, I chose Lubin School of Business because it offered me a great finance and analytics program with a real work experience.
You've been a very involved student during your time here at Pace, tell us about why you decided to be so active.
I am very curious and am passionate about being a well-rounded person, which is why I am partaking in so many opportunities outside of my field, as well. It has been very important for me because I know that through this involvement, I can grow as a student and a future professional. I learned how to be empathetic, persistent, strong team player and most importantly how to prioritize my time through all these activities. From these opportunities, I have also found mentors who continuously guide me in the right direction and who I can go to for advice.
You have some very impressive internships on your resume, which Lubin experiences do you believe helped you get the skills and confidence needed to ace those interviews?
During my sophomore year, I participated in a Wall Street Workshop with Susan Glendon which prepared us to work on Wall Street and provided us with networking opportunities. I also participated in two big competitions with PwC and Deloitte where I had to work on a team, with a limited amount of time to fulfill the work necessary for the given case. The skills that I have gained from these experiences, such as working under pressure, thinking critically and being a good team member, have helped me to ace my interviews.
What have you been working on at your internships?
Both at Douglas Elliman and Morgan Stanley, I have been doing a lot of analytical work, but also I was able to focus on building my network. Meeting so many successful people in my field made me realize how important it is to build relationships with everyone. This summer, I am going to be a summer financial analyst that requires a lot of analytical work, and the knowledge that I gained from my past finance classes will certainly be needed. So we will see how that goes!
Any advice for other Lubin students trying to figure out where their career path will take them?
I would say to be open minded. Many people don't exactly know what they want to do after college and that's totally fine. One thing you can do to help yourself decide what career path to take is to understand what skills you have and what jobs require those skills. Also, my mentor once told me to network not just with people in your field, but also from other backgrounds. Go out there and speak to people from other industries and expand your network!
We know you were selected among 209 students from 2000 applicants to participate in Goldman Sachs Women's Leadership Camp last year, please tell us a little bit more about that experience:
This leadership opportunity was one of the best experiences I have ever had! During this two-day program, I was able to meet incredible and intelligent women from across American colleges, as well as professionals across different divisions. They helped us to understand what part of finance we would most be interested in. We heard from the CEO Lloyd Blankfein, who gave us a lot of valuable advice that stuck with me to this day. We also had different workshops regarding professional development which helped a lot when I was interviewing for different internships, and probably one of the reasons why I landed a summer analyst program at Société Générale.
What has been your favorite memory or experience here at Pace/Lubin?
Last year, my team and I from Beta Alpha Psi participated in a Deloitte Competition where we had to implement a leadership program within our organization. We worked closely with high school students to help them prepare for college by teaching them skills that we felt we lacked when we were in high school – LinkedIn, Excel, Resume Building, etc. After several months of preparation and presenting, we won the regional competition in Pittsburgh and then received 2nd place in nationals in California. This experience definitely showed me what it's like to work on a team and how to be persistent and patient. I also had a lot of fun with my team members and got to know them on a more personal level.
Any advice for incoming freshmen?
As a Resident Assistant for freshmen, I always tell them - it's what you make out of college. You can be sitting in your room, going to classes and that's it. You decide for yourself whether this is the kind of experience you want in college. So it takes effort and even some courage to get out of your comfort zone and get involved during your freshman year. Personally, I think getting involved later in college is even harder, so my advice is to take all the possible opportunities presented to you from the first day, even if you think that they won't help you later in life. You never know who you can meet or where this opportunity will take you! I have learned that myself.

Two forwards, two defencemen added to the inaugural roster

PORTLAND, ME – July 24, 2018 – The Maine Mariners continue to add to their roster for 2018-19, announcing the signings of four more players on Tuesday. Forwards Jesse Schwartz and Dwyer Tschantz have agreed to deals, along with defenseman Mitch Jones and Garrett Cecere.
Jesse Schwartz (6’0, 194) just finished his college career at the University of Connecticut, where he scored ten goals and added five assists in his Senior season. A native of Toronto, Schwartz played his junior hockey in Canada, finishing with a big season in the BCHL (57 points in 48 games) with the Victoria Grizzlies in 2013-14.
“He’s a guy that likes to go into the hard areas, loves the net-front,” said Mariners head coach Riley Armstrong. “We’re looking for him to be an energy guy for the team and also chip in offensively.”
Dwyer Tschantz (6’5, 209) is a former NHL draft pick and played four games with the Worcester Railers last season, scoring one goal. The Wilmington, Delaware native played his college hockey at Cornell University after being drafted in the 7th round, 202nd overall by the St. Louis Blues in 2014.
“ is going to bring some size to the team,” said Armstrong. “Hopefully he’ll create a bunch of grind game and puck possession in the offensive zone. He’s going to come to us with a lot of structure after spending four years at Cornell.”
Mitch Jones (5’11, 198) brings three previous seasons to ECHL experience to the Mariners. Appearing in 58 games for the Utah Grizzlies last season, Jones scored two goals and added 12 assists. He was also a member of the Alaska Aces from 2015-17, the ECHL membership that was purchased and relocated to Portland to become the Mariners. His father, Brad, played in the NHL for Winnipeg, Los Angeles, and Philadelphia. Jones is from Rochester, MI.
“He’s going to add some veteran leadership to the defensive core,” Armstrong said about Jones. “He’ll bring some toughness and he can play both styles of the game whether the other team needs some push back if it’s an offensive skilled game. It allows him to do both with his game.”
Garrett Cecere (5’8, 165) is a blue-liner from West Des Moines, IA who split his college career between Colorado College and Northeastern University. He contributed nine assists during his Senior campaign at Northeastern this past season. In juniors, Cecere played for three different USHL teams (Dubuque, Tri-City, and Sioux Falls) as well as the Janesville Jets of the NAHL.
“I watched Garrett play at the end of last season - he is an entertaining player to watch,” said Armstrong. “Garrett understands the big picture in his development process. We are very excited to have him.”
The Mariners inaugural roster now includes seventeen players (nine forwards, seven defensemen, and one goaltender). The full roster can be found HERE.

Red Sox betting favorites hosting Yankees in Tuesday series opener
The Boston Red Sox clash with the New York Yankees for the first time in 2018 this Tuesday night, with the sportsbooks giving them the edge on the MLB odds.

Through the first two weeks of the young MLB season, Boston’s pitching staff has emerged as one of the best in the majors. The Red Sox rank fourth in the league in both team ERA at 2.69 and batting average against at .209.
Chris Sale is as safe a bet as there is in the American League to pitch at a high level, but with David Price and Rick Porcello also apparently back in top form, this could be a rough staff to crack all season long.

Tuesday’s total is set at 7.5 runs. The OVER is 6-1 in New York’s last seven games and 7-1 in Chris Sale’s last eight starts.
This will be the first of many games between these two teams this season that could go a long way in determining who wins the AL East. The series continues on Wednesday with Masahiro Tanaka and David Price on the mound and wraps up Thursday with Sonny Gray vs. Rick Porcello.
