I was gonna add something little about the Fleischer superman cartoons and how they relate to this but I got too autistic, stayed up for longer than I should've and wrote this. Bear with me.
The 1950 93 F. Supp. 349 initial hearing has a lot of stupid things in it. First quote I want to point out.
'There are villains in both stories, mad scientists who resemble each other in appearance, and who, by similar devices and methods, attempt to dispose of the hero ("Superman" or "Captain Marvel"), so that they can execute their plans of destruction without molestation.'
@im-not-buying-it-ether already pointed out that Sivana existed before Luthor did. But there's even more wrong stuff in this case.
'The incredible feats, performed by both, such as leaping great distances, flying through the air, exhibitions of marvelous strength and speed, and imperviousness to bullets, shells, explosions, knives and poisons, are identical, and the settings in which the feats are performed are often closely similar.'
CAPTAIN MARVEL COULD FLY WAY BEFORE SUPERMAN EVER COULD. 3 years before if I'm correct. Superman only flew because it would be easier to animate for Fleischer Studios.
'"Superman" is represented as a normal human being, a meek newspaper reporter wearing eye glasses (Clark Kent), who, by throwing off his regular clothes, appears in his athletic costume and becomes a superhuman being and performs superhuman feats in the interests of justice and to overthrow evil. "Captain Marvel" is likewise represented as a normal human being, a radio reporter (Billy Batson), who, by uttering the magic word "Shazam", is transformed *356 into a superhuman being, and, in that capacity, also performs superhuman feats in the interests of justice and to overthrow evil'
I feel like this is skimming over the fact that Billy is a child, which I might argue is a pretty big difference from Clark Kent, who is an adult man.
What's kinda funny is that this initial hearing ruled in Captain Marvel's favor because Superman's copyright was completely fucked up and National had "abandoned" it, but that's not the point of this post and it would take wayyy too long to explain plus the court reversed this decision in the appeal anyways.
Saddest thing about the lawsuit is that in the appeal, although the court still found Fawcett guilty of infringing on specific superman strips, the CHARACTER of Captain Marvel himself did not infringe on National Comic's copyright. But Fawcett didn't think continuing the case was worth it so they just settled out of court and stopped printing Captain Marvel. The whole case set the legal precedent that one could OWN powersets.
The 1950 93 F. Supp. 349 initial hearing stated,
'Captain Marvel" closely resembled "Superman" in his athletic figure and in his costume, as well as in the superhuman feats performed.'
The 1951 191 F.2d 594 Appeal states,
'The same result also follows from the fact that a copyright never extends to the "idea" of the "work," but only to its "expression," and that no one infringes, unless he descends so far into what is concrete as to invade that "expression." We can add nothing to what we said in Nichols v. Universal Pictures Corp., 2 Cir., 45 F.2d 119, and Sheldon v. Metro-Goldwyn Pictures Corp., 2 Cir., 81 F.2d 49, except that it was precisely on this account that in our earlier "Superman" case itself — Detective Comics, Inc., v. Bruns Productions, supra, 2 Cir., 111 F.2d 432 — we limited the copyright to the specific exploits of "Superman," as each picture portrayed them.'
Basically specific feats/powers that Superman had were considered as things that could be copyrighted, which is pretty stupid as it basically meant National Comics owned the concept of a superhuman buff man. This is probably why Marvel's Cyclops has concussive beams instead of laser beams. Don't want to risk getting sued because superman also has laser beams!
There's also some pretty funny stuff in the appeal about people throwing the blame around and eventually an artist blaming CC Beck for copying Superman, which he denied but I don't know enough to conform nor deny. It really just looks like the girlies were fighting.
The lawsuit was stupid but I'll leave you with this quote I am deeply obsessed with.
'The owner's right to protect his name or mark from being copied depends primarily upon the likelihood that those who may wish to deal with him will be misled into dealing with the infringer; and that presupposes, not only that the mark has become associated with the owner as the source of the goods, but that this association is an inducement to deal with the owner. In the case of these silly pictures nobody cares who is the producer — least of all, children who are the chief readers —; the "strips" sell because they amuse and please, and they amuse and please because they are what they are, not because they come from "Detective."'
Interesting that DC sued Fawcett due to Shazam (then Captain Marvel) being too much like Superman only for DC to take the rights of Shazam.

This is a thing I originally wrote on League of Comic Geeks but I think people here might like reading it so i thought I'd repost it. You can look at my account here if you want. I just like writing about comics I like.
A disabled boy that can just abandon his body at any point and become the ideal human form has implications I don't think comics from the 1940s are capable of handling. There's such an insane level of hypocrisy present when Freddy Freeman is perpetually defined by his disability which is described in a most vile way possible before becoming an indestructible superhuman and beating up Captain Nazi. A clear parallel is accidently drawn between both US and German ideology which is fascinating to look back upon.  There are some aspects of these comics I truly love. They present Freddy Freeman as capable orphan who does well for himself despite his tragedy, not wanting pity, not wanting to be defined by his disability. But when Captain Marvel Jr is needed the narrator can't help but remind you how much a pathetic useless cripple Freddy is in contrast to his super powered alter ego.

Captain Marvel Jr as a character has so many interesting implications that I wish were explored. I don't expect a 1940s comic to be capable of doing him justice but I haven't really seen any other comic explore the complexities of his character either. Giving a disabled boy the ability to escape from his imperfect body into one of a god is bound to have insane effects on his psyche that I wish a good writer would one day explore. There's so much potential in such an underused character.

gonna be transfem Freddy Freeman posting I guess.
Freddy's always buying woman's magazines including pinup magazines and when Billy and Mary find out they assume he's just being an average teen boy and they continually tease Freddy about it, calling him a ladies' man. Freddy plays into it just to hide how he actually feels about himself and his body. Eventually Billy catches Freddy ransacking Mary's room and gets real pissed, and Freddy's too paralyzed in fear to explain. Billy eventually figures out its only the makeup he's after when he searches Freddy's pockets, though that just confuses him on Freddy's intentions even more. Billy's best assumption is that Freddy is gay, and Freddy doesn't know what being trans is yet so he agrees. Billy is very supportive though a bit confused, still better than Freddy who feels grossed out by himself for wanting to be feminine. Billy promises to keep it all a secret and even buys him some nail polish to Freddy's embarrassment (and later enjoyment.)

I've really liked viewing Freddy Freeman as a trans girl or at least genderfluid. Idk it just makes sense to me. He's the only Marvel to have long lashes besides Mary, the girl of the family. He's always been more visibly prettier/feminine than the others boys.

I really like the idea of him sneaking around to use Mary's makeup, and getting really embarrassed when he's eventually caught. He's too nervous to tell Mary and Billy about this feelings so he just keeps it bottled up, especially since he's always felt like the odd one out of the family.

I decided to read "Billy Batson and the Magic of Shazam" and its mostly just fun baby stuff cause it's meant for like elementary schoolers but Freddy Freeman is so peak in it I love him.

Started reading the Mark Waid Shazam run and my friend who reads the 1940s Captain Marvel Adventures with me said Billy looks like he plays valorent. Truly might end it all...
