so. basically. tl;dr i ffuucking hate school it sucks and it doesnt. do ANYTHING but make things worse . anyway.
the schooling system like. it sucks for me specifically in a few ways idk abt anyone else. for starters; neurodivergency literally at all makes it so hard to function in a classroom environment. its so loud? idk if anyone else gets that in their classrooms but you can hear my class of 23~ from the bottom floor of the 3 story building and that’s considered quiet. as well as like, i cannot function in a classroom without my friends? im out at school and like.... everyones.. transphobic obv why wouldnt they be, and its not in like a..any avoidable way. if i sit with the guys they’ll refuse to talk to me and deadname me all period adn if i sit with the girls theyll laugh at me every time i fucking breathe idk, but the school still thinks putting me in a classroom with kids that visibly hate me and see me as a CRINGE ENTERTAINMENT IRONY MACHINE is like a good idea? and a good way for me to make friends? i dont know if its my luck or if they’re deliberately doing it, but, next term for example i have drama and cooking as classes. two of my friends also have cooking ....but they dont have me in their class. they’re together. but im not in their class. im on my own because other than them and the girl who already did cooking these past two terms (so she cant do it next term) i have.... no other friends. so im definitely in a class of complete strangers! and the way they have this school, you have no choice but to work with someone else in a cooking class...... you are paired with someone in the same mini kitchen and its a disaster but i digress.
also, like. school goes for 6 hours. by the time you get home and get changed and get settled, its sunset so you can’t go out and do anything. you can’t go to the park or climb a tree. youre stuck inside. your family is like groggy from work or whatever and doesnt want to talk to you. you have no energy to get online and talk to your friends online. or theyre asleep. so basically at least for me i get... no time to actually talk to my friends, for example i havent had an actual conversation with piper in like... two months i swear. we’ve forgotten how to talk to eachother and that actually goes with all of my friends. by the weekend we’re still awkward because we havent spoken in months so we can’t really even talk. and because of this rigid like, routine you have to have to actually be able to go to school at all (wake up 7. eat. get dressed. go to school. come home. get changed. eat. shower. go to bed. repeat), i actually like.... find myself. forgetting Everything. i dont know what it is about strict routine where i cannot be myself (my school has a strict and ugly uniform), but it makes me ... completely forget everything slowly and my memory decays. my time blindness gets worse to the point where i dont know what month it is on a regular basis and like... i ditch a lot? because of this? maybe if the schedule didnt make me dissociate and forget everything i wouldnt ditch constantly and like. actually go to school. but like my attendance is... im not at school 25% of the time because i physically cannot go every single day and attend to that rigid and exact cycle that doesnt even teach me anything
doesnt even teach me anything? i dont ... learn anything from school. they like. reteach the same meaningless part of a subject every single year. every year in religious studies in october i learn about the rosary and we spend a lot of the period praying the rosary and i like. ok. cool. its a religious school yeah but what am i actually learning from this. and every year in social studies we learn abt the waitangi treaty but the way they teach it is so whitewashed and utopian and its fucked and they teach it the same way every year around the same time. and anzac day. and in math im not going to use any of those skills you teach me, i dont care about algebra or anything because thats not really going to actually help me in my life im an artist for fucks sake teach me about managing my own finances! teach me how to do taxes! teach me how to function in the society i live in! teach me the important things that ill sink under or die without knowing i want to actually know important things but by cramming so many unimportant things in my brain all the time i forget the actual important things, i fucking failed basic addition and subtraction last year, i’ve forgotten division and multiplication past the 10 times table, but i can vaguely read an algebra equasion BUT FUCKING ALGEBRA EQUASIONS WILL NEVER UFCKING GET ME ANYWJERE!!!!! and it makes me so fucking angry i want to learn and function and KNOW
and the way they tightly bundle everyone to being one conforming individual who dresses like everyone else, is at the same intelligence level as everyone else, is a catholic like everyone else, does not question authority as everyone else or does not question themselves like everyone else or think like anyone else OR BE DIFFERENT THAN ANYONE ELSE makes me want to FUCKING THROW UP. there are so many hopes and dreams that i remember watching from primary school to now sink into a hopeless pit of stereotypes and basic conformity, people who used to be nice are suffocated into being horrible people so that theyre liked by their peers or get anny attention from the school at all, guys who used to respect women (god forbid) suddenly becoming horrible to anyone of any slightly different gender identity but you can actually see on their face how weird it is to them, waves of 11-14 year olds getting nose studs that get infected and they’re forced to have them taken out by the school, kids trying to do their makeup to look like SOMEONE to BE AT ALL DIFFERENT FROM ANYONE ELSE are put right back in their place and told to take it all off and their parents are called and if youre caught with the wrong jacket your parents are called and youre told youre too poor to wear what the school provides yet THEY DONT EVEN LET YOU WEAR WHAT THE SCHOOL PROVIDES WHAT THE FUCK IS THIS 70 DOLLAR HOODIE FOR WHEN YOU WONT LET ME WEAR IT WHILE IM SHIVERING I DONT SEE THE POINT OF ENFORCING SUCH TIGHT POINTLESS SMALL BOUNDARIES OF WHAT A PERSON CAN BE WHY IS IT SO LIMITED? are we not allowed to do anything? you cant even have one strip of hair dye yet a teacher can have a full head of bright purple hair what’s that about? you can have antisemetic pins on your senior year blazer jacket but the second you put a pride pin on there youre called to the principals office and asked why youre promoting this to kids
you try a speech on trans rights and they dont even pass you and pretend its because you got over the time limit but you didnt, you timed it yourself for your friends you didnt get over the time limit and you know it but you didnt even place in fourth you placed last out of 6 or 8 and you wonder why that is because every year in the past you soared into first so whats that about???? in my speech i said be yourself and dont be afraid to experiment with your gender lightly and they told me to take it out because its seen as too much and i said what the fuck? that’s the most important part of my speech, i want to promote acceptance in others and the self and they said take it out or you cant present your speech. they actively suffocate any sort of self expression or nonconformity of any sort you have to be a plain cookiecutter boy or girl and thats it you cannot be anything else, for nearly 6 months theyve fought me and my mom about my hair but if anyones being hurt by it its me because it draws more attention to the kid you can call slurs, are you hurt because im actually expressing myself? are you hurt by my little sharp stud earrings and my industrial piercing and the embroidered cuff on my shirt? are you offended by the heart on my belt or the platforms on my school shoes because the last time i checked none of these were illegal things to have at school
this kind  of got a lot angrier than i meant to make it but ive been . really angry abt this for the past year idk. i really just wanted to write this because i ahvent spoken to piper properly in months and the way we talk now seems like when we just met but i cannot carry a conversation anymore because school knocked the wind out of me all over again and the sudden inability to talk to any of my friends online makes me want to scream until my lungs give out im so tired

August 20: 1x11 The Menagerie Part 1
Hello time for Spock’s Mutiny Part One
That is a LOT of 50s looking sci fi background to hit with me all at once.
Spock with his carefully neutral face like ‘hmmm? a distress signal that did not come from here? how COULD that be?’
Kirk and Spock tilt their heads at the exact same time lol.
“Subspace chatter.” Please, Commodore, call it what it is, “gossip.”
“We met when he was promoted to Fleet Captain.” Okay so he was promoted, but to a weird rank that literally only exists for like two people in Star Trek I guess. (I had to look it up because I don’t know what a Fleet Captain is lol.)
I don’t understand how Pike could be the same age as Jim and yet hold the Captain’s position for 11+ years before Jim was promoted like??? Did he become a Captain faster than AOS!Kirk? Also, he looked like he was Jim’s age now in those tapes from 13 years ago. He cannot possibly be in his mid-30s now, or he’d be in his early 20s on the Talos tapes, and also, younger than Spock. So either I misheard or...it’s wrong. I guess it was supposed to mean that he was, at the time Spock served with him, the same age Jim is now?? But it shows up in a weird place to be making that point.
Oh, Spock’s mentor. The emotion.
And so begins Spock’s amazing cavalcade of lies, lies, and more lies. Doesn’t even look like it’s hard. He’d basically do anything for his replacement father.
Pike must be the only other person Spock has ever served under.
I love it when they argue about records and log books. Like, this sort of bureaucratic dueling makes up a lot more of the TOS plot than people think. The record logs must have been changed because Spock never lies!
Love that Kirk and Mendez are fighting and Mendez just yells “Well you’re right!” and that’s the end of the argument.
Is this the same Jose who wanted his peppers in another episode?
Spock is so supremely sneaky here. Mission Impossible theme plays as he skulks around and messes with the computers.
Okay, that little flirting thing with Miss Piper and the mention of “Helen” and Kirk looking briefly worried about what Helen might have said about him--that does make him look a little slutty. So he loves love okay guys!!!

Spock is so exasperated. All these questions! Good thing he has a fake recording of the Captain telling them all to just listen to Spock. He really thought of everything.

This Bones and Kirk scene. I’m so distracted by their insistence that Vulcans can’t lie. I mean have you considered that when they told you they can’t lie.... they were lying??? Also lol @ the idea of Spock’s human side being “completely submerged.” That’s another lie he’s telling you Bones!
Love Bones defending Spock though. “He would never make a false entry! This is the LOGS were talking about here!” He adores Spock too.

I’m sorry but I’m laughing so hard at all of this. He made sure to lure Bones back onto the ship with the vaguest of messages just so he could be like “Look, friend, I have a secret... I stole a Captain!”
Lol Jim following in the shuttlecraft. Can’t get rid of him that easily! Also I love the shuttle design. Adorable.
Oh no, Jim’s in danger! You can tell from Spock’s face that this was a crimp in his plan that he did not entirely expect. (I do think he figured he’d be court-martialed eventually but this specifically, Jim not turning back when he ran out of fuel, I think did throw him.)

Bones like “hmmm who could it POSSIBLY be in the shuttle?”

I love when they discuss regulations. These nerds! They locate so much drama in it and the JD in me is having a damn good time.
I feel like this is the closest Jim and Spock have ever come to fighting. DENIED!

More 50s sci fi backgrounds! I feel like people who think TOS is dated or ages badly need to watch this and, to a lesser extent, Where No Man. I think it shows just how much TOS did its own thing bc those pilots really took from the recent sci fi landscape, whereas TOS created its own thing. I think that’s why TNG looks more dated to me--it seems of a piece with other 90s media, whereas, aside from stuff like the hairstyles or the miniskirts, TOS doesn’t look 60s and it doesn’t look like other contemporary genre work.
Pretty blue flowers that make music make Spock smile--that’s my favorite part of the whole pilot. He’s so cute.

I love that reveal that the transmissions are coming from Talos IV because it means that Spock, while on trial for mutiny and an attempted capital offense, commits ANOTHER capital offense AS PART OF his trial. The balls.

Literally the only time he freaks out about anything is when Jim is blamed. I mean truly his plan is at least 50% more complicated than it had to be solely to protect Jim. And now the Captain is going down with him, and he’s mad at him!! A cliffhanger for sure.
Honestly, even the power of Jim just standing alone in the room.... Underrated.

THE ALBUM YES. so ive been looking forward to it for literally months, this is actually my first skz album release as a stay (since the last on was 9 months ago) i was sitting there hitting refresh on my spotify the second 6pm kst came around. (speaking of which, how did you do the release? i couldnt decide whether to watch or listen first but i ended up on listening cos there would be more material) okay: so cheese was super cool, very skz ya know? tho i almost wish theyd made domino the title track, tho obv it was a more experimental track and would have been a bit controversial (much like whistle for bp) i looooved domino and thunderous was absolutely impeccable. all the songs were amazing but standouts were- secrets, secrets which lowkey made me tear up idk why, red lights which almost killed me (it did not have to go that hard, but it did) and OT8 WOLFGANG omgggg i wasnt sure if hyunjin was going to be included in it but i was hoping and, ya know people had said hed be in there, but the further i got in, the less i was sure and then BAM hyunjin started what had been jisung's part and i just sat there grinning for about 5 minutes. surfin was absolutely adorable and gone away almost made me cry AGAIN. star lost was so touching, almost a nod to hyunjins little star? silent cry was relatable beyond anything. SSICK was funny? for some reason I was laughing while it was playing, idk the combination of added cheering and minhos aggressiveness and the totall seriousness they sung it. but i rlly enjoyed it. sorry i love you showcased their vocals like nothing else. the view is THE BOP of 2021, absolutely going to be stuck in my head for the next decade, that hook is genius. what did you think?

oh yeah, abt quarantine having an effect. my friend and i talked about this earlier actually. i didn't realize the world was moving so fast until the pandemic happened. being in quarantine gave me time to think and i got to know myself more. it's just the sole good thing i got out of the isolation lmao. and abt my strict parents, ironically i got to go out today so i got to hang out with a few of my bestfriends. i had fun but my legs are a bit sore from walking. but they're a different set of friends. i'll get to hang out with the others when my getaway driver comes home in december.
hmm music recommendations for writing? depends on the plot you're writing. care to share what story you're working on and i'll try to rake my brain for a song that might match the vibe. i listen to classical / lo-fi if i don't have song inspo for a fic because lyrics sometimes distract me.
i don't think that's infantilizing tho. for me, it has something to do with my environment and the way i was raised. maybe it's the same the other way around? like this certain age (for the ones above 18 but below 20) is thirst-able for them. idk really. it's just not for me ?n? what i do NOT condone is writing smut for minors??? like get checked : D // i agree with everything with the idols being 18+ before they debut simply because it's for the best for their well-being like. how can young idols decide that this shit is the thing they want to do for life? or at least until their contracts last. idk :// it's unfortunate that it's unlikely to happen.
WELL. i have a list so you won't have to go search for them! in class (minho), in the rain (seungmin), gladius maximus (chan) and you've read five star already. and i just realized that most, if not all, of my upcoming fics are fluffs and i'm fond of all of them :D i used to focus a lot on angst because fluff disgusted the living shit out of me. i think things changed when i wrote champagne problems and hurt myself so bad i wanted to drop angst entirely. i didn't, of course, but i allowed myself to be self-indulgent now.
for the release of the album, i was on twt and watched the vid at 12 views (if i remember correctly, i watched back door at 14 so HASJH) i’m gonna talk by track so it wont be too confusing? bc i wrote this in paragraph format and it just ???? beware im very picky with tracks even if they’re my ults. so no offense if we have opposing opinions and i’m not fond of reading lyrics so these are all music wise.
cheese - oh god i hated cheese at first listen but it grew on me easily. i was singing the yeahyeahyeahyeah bit all day today :D

ssick - was a skip on first listen too because i found the chorus underwhelming but it grew on me? not that much but i can bear listening to it.
the view - it’s something the gen public like, hence its something i dislike. im not fond of songs that are structured like this? it’s not a bad song, just not the type of song i like. but i agree that the hook is very not catchy but it would get stuck in ur head.

i never really post on here personally because i migrated to twitter a few years ago and the appeal of tumblr left me shortly after but ive talked about this topic ive had on my mind on twitter a lot already and ive bugged my friends in their dm’s too much but i still need to get it off my chest so im gonna talk about it some more anyway
in november this past year i messaged an artist hosting a secret santa event pledging to participate, and the next day they sent me back saying, no, i cant participate, because my art looks “too traced”
i dont post my art on this blog much anymore since i started posting it on my sideblog but i do draw fairly often and for years, for YEARS, one of the things that has contributed to my horrible, horrible depression (besides like, everything else) is my very bad habit of comparing myself to literally everyone and everything else. its taken me a long time to start trying to break this habit and not feel bad about my own abilities or skills in comparison to other people, and to this day im still struggling with it. art has been a personal battle for me, as it is for anyone who creates things regardless of what it is, and ive given up, sometimes for months or years at a time, only to eventually come back and start drawing again and then hate how far behind i felt because of all the time i spent not improving any at all.
so fast forward from 2012 where i “seriously’ start drawing to the start of last year, after going through maybe 3 hiatuses where i didnt draw for over 6 months, to where i finally bought my own tablet (after borrowing off my girlfriend or just drawing with pencil) in april and started actually seriously drawing again, all summer and during school even i was just drawing out the ass, all the time, i was putting more shit down than i had for a long long time and it was bad but i was real proud of it because i was creating things! and thats what ive always wanted to do, is just put stuff out in the world. to make things with any sort of permanence. so all last year i was really pleased with my progress and i was even getting better at drawing faces and coloring so i was real pleased.
so i get into a few new hobbies during the year and start following a bunch of artists on tumblr, or blogs that promote other artists, because id gotten to enough of a point where seeing other people accomplished at art didnt make me feel quite so bad about myself as it used to - i was able to look at other peoples success with pride on their behalf and not anger or jealousy. and at this point id start liking a little bit of my own attention, so i make a separate art blog dedicated to my art and my characters. and theres this one artist i really admired. they draw nothing but their oc’s, which is also nothing but what i draw too, and they were popular and everyone liked their characters and they had lots of artists friends they could talk with and do trades with and it was and is everything i wanted to be. i wanted to be that sociable and liked and known, even if it was just among a small group of friends in a small part of a niche interest, i wanted to participate in something.
so i see this secret santa i really want to join, hosted by none other than this artist i look up to, quite a lot. id sent them a few anons before with various questions on things and felt comfortable enough to message them and ask about joining the secret santa. i was finally comfortable enough in my artistic abilities to want to join, too, which was huge for me. so i message them, and wait for them to message me back.
and they do , the next day, and its to immediately tell me that my art looks too traced and that i should “stay away” from their art trade. as any aspiring artist will tell you, tracing photos is good. it helps you get muscle memory and learn perspective, anatomy, blah blah. as long as you dont do anything with it or pass it off as your own.
but tracing photos or god forbid other  peoples art and then posting it online and saying “look at this thing i drew all by myself arent you proud!?” is entirely different, and obviously isnt something ive ever fucking done, but its what they wanted to accuse me of, saying i was being deceitful and that other people in the trade would be mad if they knew. so, no, ive never done that. i never said ive never traced photographs before, i do it all the time to practice poses and anatomy and then i send them to my friend and say “ha i drew my characters doing this thing” and like, thats the only light of day it sees.
but apparently this artist was and still is under the impression that everything ive ever drawn was traced, as if i never put any work into anything. i do. i dont even know how to express that statement enough. i do . i do put hard work into the stuff i make. i practice and i draw and i sketch and no, im not fucking great at art, but it makes me happy and i can draw my ocs and thats really all i want to be able to do, so when someone comes to me , someone i looked up to and admired , and accuses me of being a liar and a fake, it hurt.
and of course i tried to explain i dont trace my art? i used photo references, a lot. sometimes ill take a photograph of myself to use as a reference too. i have a bunch of pvc pipes in my room i use when i need a ref of someone holding a staff or sword so i can make the angles better. i have a reference blog i use heavily and most of the time the outfits i draw are from stuff i see models wearing and want to put my ocs in. but i dont trace it, and that accusation hurt. the only thing i ever “trace” when i draw figures is a stick figure on a pose, IF im having trouble, like this

and then the rest of the drawing, the lines, the hair the clothes the face, whatever, i draw that free hand, its not like i sit there and trace a whole photo or drawing? and if i did im not gonna...post it online and pretend i did all this hard work? and this is all the same thing i said to this person, i admitted to doing this stick figure technique, and that i sometimes trace photographs but i use it as a mechanic to help me improve anatomy accuracy and not as a cop-out for doing my own work and ive never passed off someone else’s skills as my own like they were insinuating. i mean, is this tracing? ive seen self taught and professional artists (and artists/photographers like senshistock, where i get a lot of refs) use this or a similar stick man figure approach when trying to draw people. i never thought i was doing something deceitful , and not to mention i dont even do this with every thing i ever draw. just stuff with weird angles or if theres a specific pose i want to capture correctly. i cant tell if this criticism reminds me too much of the argument circa a few years ago that using references or photos of any sort at all was cheating, or if this is genuine criticism and its a practice i shouldnt use anymore. which i havent been doing anymore anyway.
it was so infuriating to be confronted with this and have the whole argument portrayed like i was a sham and i was duping people on purpose. “stay away from the art trade” was their exact words. it hurt a lot and it still does, and its still killing my confidence every day. ive been trying to move on from the whole thing but when someone you admire shoots you down like that, i just dont know how to keep going knowing them and other people they apparently talked to about this are looking at my work thinking im a cheat. this has been on my mind nearly every day for 3 months and its killing me.

Ask the authors: The originalist republic – Justice Gorsuch’s “A Republic, If You Can Keep It”
The following is a series of questions posed by Ronald Collins to Jane Nitze and David Feder in connection with Justice Neil Gorsuch’s  “A Republic, If You Can Keep It,” co-authored by Nitze and Feder.
Jane Nitze served as a law clerk to Justice Gorsuch on both the Supreme Court and the U.S. Court of Appeals for the 10th Circuit and to Justice Sonia Sotomayor. David Feder served as a law clerk to Justice Gorsuch on both the Supreme Court and the 10th Circuit.
Welcome Jane and David, and thank you for taking the time to participate in this question-and-answer for our readers. And congratulations to you and the justice on the publication of this thoughtful book.

Question: Of all the books written by Supreme Court justices published while they were on the bench – some 350-plus such works – this may be the first one credited to others “with” a sitting justice. Typically, such collaborations are tucked away on the acknowledgements page, so it must have been a great honor when the justice extended this rare courtesy.
How did this title-page credit and working relationship come about?
Nitze & Feder: It was a great honor, and an unexpected one at that. We did not ask the justice to put our names on the cover — he offered of his own accord. That speaks to the type of person he is. He embodies the values that he preaches in the book: kindness, generosity, friendship and more. All his clerks have felt the power of his mentorship; he lifts up the people around him.
The working relationship came about at the conclusion of each of our respective clerkships with the justice. We each deeply respect his philosophy and jurisprudence and were grateful for the opportunity to continue to work with him in assembling the book.
Question: As noted in the book, the title comes from a 1787 quote from Benjamin Franklin. Of course, Chief Justice Earl Warren also selected it as the title of a work published 47 years ago. In some important respects, Warren’s was a very different kind of book with a different take on the role of a justice and how to interpret law.
Did you ever consult or discuss the chief justice’s book while working on this project?
Nitze & Feder: We never discussed the chief justice’s book, but we think the title is apt for a judicial book because it focuses the attention where it should be in our democracy: with the people, not with the judges.
Question: In reading this book one cannot help but notice a genuine sense of the need for civic virtue. That concern is couched in terms such as “civic responsibility,” “humility,” “integrity,” “patience,” “impartiality,” “kindness” and the value of reasoned judgments, not merely in the governmental realm but, more importantly, in society as well. Do you think we will hear more from the justice on this matter, not only in his judicial opinions but perhaps also in his extrajudicial statements?
Nitze & Feder: Yes, undoubtedly. The justice has made civics and civility the focus of many of his extrajudicial speeches, both before and during his time on the Supreme Court. He believes in the great American experiment of self-governance, and often speaks of the sorts of values that unite us as Americans and that are essential to ensuring our republic survives for generations to come. So, for example, he’s teamed up with Justice Sonia Sotomayor to promote iCivics, a civics education program, and we expect such efforts to continue.
Question: Henson v. Santander Consumer USA Inc., a statutory-interpretation case concerning the meaning of “debt collector” under the Fair Debt Collection Practices Act, was Gorsuch’s first Supreme Court opinion – one that his former boss, Justice Anthony Kennedy, happily signed on to by way of a hand-penned “join memo.” Not surprisingly, this unanimous opinion is included in your book.
What do you see as the main strengths of this textualist opinion?
Nitze & Feder: To begin, Henson illustrates the exemplary writing that has earned the justice praise from people of all stripes, and shows his ability to turn a fairly complex statutory interpretation case into one that even a nonlawyer could understand. The justice believes it’s important that the public as well as the litigants who come to court — not just the lawyers — be able to understand why the court reaches its decision.
The opinion, moreover, does an excellent job explaining why textualism matters. What happens when you try and further a statute’s perceived purpose over its text? Well, first and foremost, as the opinion explains, you face problems of democratic legitimacy. Often enough, a compromise embodied in the text was the price of getting enough votes to secure a statute’s passage. Besides, when it comes to the sorts of hard questions that the Supreme Court gets, can’t both sides usually make a pretty good argument about what best furthers the statute’s purpose? Faced with exactly that scenario, Henson explains that following the statute’s text itself, rather than trying to divine its unexpressed purpose, was the only legitimate (as well as the most prudent) course.
Question: There are competing notions of originalism. For example, there is Justice Hugo Black’s generous application of originalism in his dissent in Adamson v. California and Justice Clarence Thomas’ more cabined understanding in his concurrence in American Legion v. American Humanist Association. And then there is Professor Raoul Burger’s version in his book, “Government by Judiciary: The Transformation of the Fourteenth Amendment,” in which Burger argued that Brown v. Board of Education was wrongly decided as a matter of original meaning. There have been divergent applications of the theory in the same case, as exemplified by Justice Antonin Scalia’s majority opinion and Justice John Paul Stevens’ dissent in District of Columbia v. Heller.
How is a jurist’s discretion limited in any meaningful way if the same theory can produce radically divergent results? How do you suppose Gorsuch would determine which precise methodology of originalism is the preferred one?
Nitze & Feder: We don’t think we can do better than Justice Gorsuch’s reply to this frequent question, from his speech “Originalism and the Constitution”:
“[L]iving constitutionalists often pursue their indeterminacy argument this way. They point to cases where originalist justices on the Supreme Court have disagreed about the Constitution’s original meaning. They say, ‘Aha! See, the promise of being able to figure out the original meaning of the Constitution is such a sham even they can’t agree.’ But what does the occasional dis­agreement between originalists really prove? We all know that the cases that land in the Supreme Court are the hardest ones in our legal system. So why should it surprise anyone that faithful originalists on the Court sometimes disagree on the original meaning of some of its provisions? And why should that be an indictment against the meth­odology?
After all, if there’s one piece of terrain that living constitutional­ists do not want to pitch their battle upon, it’s determinacy. Original­ism makes many of the living constitutionalists’ hard cases quite easy. Is the death penalty constitutional? Yes, the Constitution expressly mentions it multiple times. Does the Sixth Amendment require con­frontation or are there a bunch of balancing tests and unenumerated exceptions we must devise? We know the answer because the text tells us. And while originalists may sometimes disagree on outcomes, they are at least constrained by the same value-neutral methodology and the same closed record of historical evidence. Come to us with argu­ments from text, structure, and history and we are bound to listen with care and do our best to reason through them. Allow me to reign over the country as a living constitutionalist and you have no idea how I will exercise that fickle power.”
Question: This question is directed to both of you as practicing lawyers who either litigate cases or offer advice to clients or policymakers. Do theories of judicial review and constitutional and statutory interpretation, such as originalism and textualism, actually determine how you defend or counsel a client? For example, what if a nontextualist or nonoriginalist argument, consistent with settled law, favored your client whereas a textualist or originalist argument did not?
In that context, can we speak of lawyers as “textualist” or “originalist” lawyers? Or are such methods of interpretation more (if not entirely) a concern for appellate judges rather than for practicing lawyers?
Nitze & Feder: Surely one can be a practicing lawyer, rather than a judge, and yet firmly believe that originalism and textualism are the only legitimate methods of interpretation under our Constitution and its separation of powers. What types of arguments one chooses to press depends, in our view, on the circumstances, such as whether a lawyer is pressing his or her own view in a debate or those of a client’s before a court.
Question: In a portion of a tribute (reproduced in the book) to Justice Byron White, for whom he once clerked, Gorsuch wrote: “Justice White was famous for dissenting from denials of certiorari – he authored more than two hundred of them.”
Do you think Gorsuch is of a similar mindset when it comes to issuing dissents to denials of cert?
Nitze & Feder: Like Justice White, Justice Gorsuch cares deeply about every case that comes before him. So in that respect, it’s not surprising that he takes the time to write dissents from denials of certiorari when he thinks a case is worthy of the court’s attention. It’s very much in line with how he views his role as a judge: a judge should do his job and nothing more or less than that. And that includes hearing the cases worthy of being heard, such as those in which there is a circuit split, even if it’s not a particularly “important” case in the eyes of some.
We think this also goes to one of the reasons he declined to join the cert pool. As he recently told the Wall Street Journal: “There are 8,000 people a year who want this court to hear a case. We only hear about 70. I don’t think it’s asking too much of me to spend a little bit of time looking at those and doing it in-house, in our chambers, the old-fashioned way.”
Question: In a speech he gave at Florida State University College of Law (reproduced in the book), Gorsuch stated: “Taking a risk may mean anxiety along the way, but it will make you wildly happy if it succeeds and wiser if it fails.”
Is Gorsuch a risk taker? If so, how?
Nitze & Feder: In some ways, definitely. We suppose he’s unlikely to go paragliding anytime soon, but he’s certainly taken risks in his own life and career. Many of these he talks about in speeches to young lawyers collected in the book. For example, he took time to go to England for a fellowship, rather than walk the more narrow path straight to a law firm. Then in his choice of law firm he veered to the smaller, less established shop that was started a couple years before by a few friends. It could have collapsed but he took the risk, and as he tells it, it paid off: He was thrown in the deep end and gained great experience quickly. And then once he was an established partner, he departed to go into public service — yet another risk, but one that turned out to bring great professional joy.
Question: In the chapter entitled “The Art of Judging,” Gorsuch takes issue with portrayals of jurists who rule one way or another in a particular case or class of cases. He also takes exception to portrayals of justices as “‘liking’ or ‘disliking’ this or that group of persons.” That said, there are certain controversial areas of law in which the “conservative-liberal” divide is virtually certain to manifest itself time and again, regardless of the interpretive method employed.
In such instances, aren’t such labels warranted? If not, why not?
Nitze & Feder: We don’t think so. If a judge has this or that reading of (say) the Fourth Amendment, it’s not surprising he or she would rule the same way time and again on the issue. That’s a sign of consistency to be applauded, not denigrated. But it also doesn’t mean that the judge “likes” or “dislikes” a particular individual or group of individuals that happen to be favored or not by those opinions.
Besides, these areas are actually pretty rare and aren’t the norm. As Justice Gorsuch explained in a speech, “Law’s Irony,” while he was on the U.S. Court of Appeals for the 10th Circuit: “As you know but the legal cynic overlooks, the vast majority of disputes coming to our courts are ones in which all judges do agree on the outcome. The intense focus on the few cases where we disagree suffers from a serious selection effect problem. More than 90 percent of the decisions issued by my court are unanimous; that’s pretty typical of the federal appellate courts. Forty percent of the Supreme Court’s cases are unanimous, too, even though that court faces the toughest assignments and nine, not just three, judges have to vote in every dispute. In fact, the Supreme Court’s rate of dissent has been largely stable for the last seventy years — this despite the fact that back in 1945, eight of nine justices had been appointed by a single president and today’s sitting justices were appointed by five different presidents.”
Question: One motif in the book is Gorsuch’s concern about structural matters and how they relate to separation-of-powers issues. He voiced one such concern in the book and also in his dissent in Oil States Energy Services v. Greene’s Energy Group, in which he emphasized the need to police “the boundaries between executive and judicial functions and between the executive and legislative roles.”
What kind of structural/separation-of-powers issues most concern Gorsuch?
Nitze & Feder: We think the introduction to the book says it best:
“[A]ny reflection on our Constitution has to begin with an appreciation of its design. Of course, the Bill of Rights is vital: It promises the right to free speech, free exercise of religion, and so many other essential liberties. One of the things the justice talks about in the book is that the legal profession has focused heavily in the past few decades on the divide between the legislative and judicial branches. A renewed dedication to originalism and textualism is one of the upshots of that time and effort. But along the way we seem to have neglected devoting equal time and effort to the other two sides of what he calls the separation-of-powers triangle: the divide between the executive and judicial functions and between the executive and legislative ones. So he included a speech in the book, “‘Power Without Law’?,” that focuses on those two divides. After all, the rule of law depends on keeping all three governmental powers in their proper spheres.
Question: There is much in “A Republic, If You Can Keep It” that calls for major changes in existing law. Beyond those areas already mentioned, for example, Gorsuch warns of the “proliferation of federal criminal laws,” both statutory and regulatory. In light of all of this, would it be fair to call Gorsuch a reformer? If not, how would you characterize his calls for significant changes in our law?

LONG-TERM GOALS:
To ride out Nightmare’s name until she has nothing more but her own to rely on, then fade out into the blissful obscurity that is life away from the stage. Being an idol has never been her first, center, or last resort, not when she’d accepted the offer only as a chance to weasel her way out from a restricted, rigid sort of life for however long she can. The idea of eventually being billed as an “action star” down the road started off as a joke-to-self, but with her athletic abilities and with her idol lookalike now cushy in the Chungmuro film industry, maybe it can amount to something a little more serious than that. Safe to say though Yura hasn’t decided just yet, and if all else fails, there’s no problem in working up to finally receiving her 9th rank in taekwondo and / or marrying the model air force officer Daddy Dearest will pick out for her.

Coming from a girl who’s only here for a good time, and not a long one, she’s fairly content with simply seeing this to the very end.

For over a decade, athletics is the forefront of her focus—not dream, mind you—and with the way she pushed forward, the chances of it becoming a formidable future were high. Pressure mounted, never all at once, but just enough for her to feel it with each passing year. Apparently love and passion is supposed to be part of the picture, but all Yura ever feels at the end of each match is the hard pounding in her ears and the wet sheen of sweat at her brow as gold is pressed into her hands. Devotion is practically sewn into every nerve and muscle, but it’s all it ever is. Skin-deep. Physical.
With age, the word “beauty” remains skin-deep as well. Puberty and good genes does wonders, but the pool of pretty people is only so wide. Overlap is expected in hindsight, then, but she doesn’t expect it to include her. The first time someone tells her, Yura admits she doesn’t think the same. The second, that she’s heard that before. It only multiplies and expands from there, with a dash of sweet talk and awe, to the point where it’s deemed fact for her. And of course, there’s the staring. Little does she know that this is  only prep-work for what it’s going to be like all the time.
III.
Inertia stays for as long as one allows it to. Physics allows that much. A uniform, routinely life is fine for the first ten, fifteen, and even twenty years, but somewhere the monotony of it all brings out the first swell of exhaustion. Family, school, sports, then family again; with each rotation, the impulse is harder to fight. Indifference to losses by the first year. A switch to the Phys Ed. department by her second. Trysts found a dime a dozen by her third, through people, places. Positions. An early existential crisis, or a belated attempt at teenage rebellion? Neither actually, not even close. She just wants to move differently, feel what it’s like because it’s all starting to get a little old and she craves a change of pace. It’s that simple.
Luckily for her, the first opportunity wasn’t anything less questionable but a recruiting offer from Koala.T, who’d seen her face on the street in her post-graduated state and conjured the same thought that countless others have made. Of course, making an impulsive decision is always the easy part. Explaining it later that night would be the uphill battle none of the Nams would have seen coming.
IV.
No, she’s not the best. The important thing here is that she’s not entirely the worst, either—for someone who doesn’t have a single artistically inclined bone in her body, that’s not too shabby. Having physical strength, agility, and reflexes has its positives; channeling those assets into dancing, then continuing to improve with time has her getting favorable marks during trainee evaluations eventually. Singing ( to this day ) remains passably decent—so long her voice stays well within its lower range.
It helps that she’s not here to win, not when she’s led a whole twenty-something years dedicated to the idea. It also helps there’s no sweat in being watched, criticized with every blink of an eye. She’s been there too. Despite it all being intense and laborious like trainee life is touted to be, it’s the newness of it Yura marvels at. Everything else is only a matter of adjustment.
V.
When the concept is first introduced, it’s perhaps the most emotion anyone has seen on her face because it’s so damn pretentious. Sopretentious Yura couldn’t help the small snicker that had escaped her lips at the time, incredulous. That this won’t sell is practically written all over, plain as day; then again, she’s not really here to sell anything, really, remember? Instead, she merely bites her tongue and simply goes along with it, because the code of conduct is to be grateful for even a sliver of the spotlight at all, irregardless of one’s intentions. She didn’t expect to come to this point, and not certainly this soon. So let’s take what we can get and make something out of it, shall we?

Im so happy to hear that Let's Go is indeed INTENTIONALLY designed to be "more casual" and everything these super anti-casual conpetitive players are complaining about was intentionalky put in there cos the developers legit think its better. THANK YOU!
i dunno man it just seems like we NEVER heae about the developers doing anything for the fans unless its enablibg competitive play or iv breeding or whatever. Like those are the only definitions of "fans" that interviewers seem to care about. And Its hard to know what the developers really think when the questions that are asked leave out a huge componant of the fanbase, yknow?
And uhh.. I mean its just good to specificially know that theyre okay with casual fans existing, like not just "its for kids" but "hey you are not bad if you are an adult who also enjoys the game for its intended appeal points and not for a huge mega complicated mathematical metagame people made up to be 'more mature'". I was really surprised to see that written interview with masuda specifically mentioning IV breeding as the place where conpetitive goes too far and makes the game not fun anymore. "Pokemon wasn't meant to be a game about hatching eggs and nothing else." Like.. Playing competitively itself is not bad, i dont wanna sound like i hate hardcore fans and im a big ol jerk. I admire the dedication because it all seems so super unattainable and mathematically magical to me! Im not into that stuff but i can admire that you have to be a damn genius to achieve all that stuff. BUT i also get what he's saying. Because it sucks when you HAVE to be a damn genius to EVEN START PLAYING! Whenever high level competitive strats become the goddamn baseline it makes competitive completely inaccessable to everyone except the most hardcore of the hardcore, and its like damn man how do you even become that if you have no way to start practising? Iv breeding is so INSANE in retrospect! Like when you think about it, its wild that people even cracked the code for how to game the system and get the highest possible randomized stats for every ridiculously minor thing. Like how the fuck did they even figure out any of this?? And then all the further madness into figuring out how to attain it and how to raise odds of shinys and hidden abilities and how they keep figuring out new ways to do it with every new system each game brings out. And then people will spend friggin LITERAL DAYS OF REAL TIME running up and down the same road in the game, hatching thousands of eggs just to get the one mathematically superior pokemon from a confluence of random events. And this is treated as fuckin REQUIRED to play the game! You can't touch competitive if you dont do it. And these bad sorts of competitive players will try and force this requirement onto other non-competitive parts of the game, and shame casual players for not doing it even though its literally not what they want to play the game for.
Seriously, man! Individual values were just designed to make individual pokemon more random, so the play experience would seem more unique to each run. It was literally invented for a "casual" reason! It just really sucks that they implimented it in a way that had an objective "best" value to get, so people ignored the whole point of "adding personality" and just wanted that one. Tho i mean at least they patched out the early issue where gender and shinyness were linked to these values so you couldnt get certain types of pokemon as the "best" version and it was even more limiting. Glad that GSC didnt have online metagame yet, lol! (Tho it makes it possible for people to more easily predict which pokenon will become Shiny when transferred from rby to gsc, which is neat.)
ANYWAY WHERE WAS I
Oh yeah! I appreciate that each generation of games lately has made it easier to see your IVs and EVs and to get them to their "best" versions, with even the FUCK YEAH feature pf being able to "fix" bad IVs on level 100 pokemon. I carried my Sneasel named Reaper since RSE and he's been completely unuseable for so long and bottlecaps fixed that! Kid me just played the game like he was my starter and i loved him. I didnt know about IVs or EVs, so i took this terribly-statted dude with a bad ability and made him fight all the wrong pokemon because he is my best friend and he needs to win every gym battle and i will buy him lemonades afterward. Also he wore the Blackglasses item forever cos i thougjt itd be cool if you could put accessories on your pokemon. So yeah i did Everything Wrong and thus all the pokemon i actually cared about were made weak and useless by my love and i had to spend 48 hours running down a stupid road to hatch and abandon 1400 new ones just to get one that was "useable". Thanks to bottlecaps, this is no more! Decade old weasel pals can be revived! Tho still it sucks that i hit level 100 before this mon's evolution came out. Alas!
BUT
Like.. Even tho now its slightly less hard to make a "perfect" pokemon its still tedious as hell and really takes you out of the moment and you have to already know beforehand that its necessary. Kids are just gonna blunder in and not even know why they keep losing due to no fault of their own. Adults are gonna also do that. Seriously this isnt a "kiddy fans vs mature fans" or "non fans versus FANS" thing, this is just "fans who have one very specific skill for memorizing a bunch of numbers and steps and enduring hours of boredom doing it vs..people who think that kinda ruins the game". And even if nintendo fully streamlined the process into sonething easy, itd still feel like an unnecessary roadblock in the way of just getting to play the damn game. We really need to add some sort of hardcore/casual or iv breeding/no iv breeding thing to league divisions, as well as the tier lists. This is why im so hyped for the current "Spooky Cup", since it actually seems like a "just for fun" multiplayer experience, and its kinda dumb that we have to rely on nintendo actually programming limitations into a tournement cos the players refuse to allow anyone to just do it normally. I did a big whoop at "no mega stones" and "everyone gets a participation prize even if they lose"! And the limitations being a random event based thing rather than a skill cap! Yay ghost types!! Reminds me of the baby pokemon only tourneys in the n64 games. That was a kind of hardcore challenge that had a bit of creativity to it!
So anyway anyway what i'm getting at...
I'm just happy that the devs are saying "yes this is a casual game with more of what casual players want, and less of those hardcore limitations" and THATS NOT MEANT TO BE A NEGATIVE!! Actual developers sitting on a couch hugging giant pikachu plushies and saying this game is for people who just want a fun game about..well, hugging pikachus! They changed the way you catch pokemon because they wanted it to be more fun. They brought back following pokemon because fun. You get all these new features for your starter because they wanted you to really feel like a kid going on their first pokemon adventure and sharing all these special moments with pikachu! They talked about how the art style was decided upon because it was the closest to "how you imagined it in your head when you played pokemon yellow", and "if it was photorealistic it just wouldnt feel right". They picked eevee for the second option because they actually paid attention to the fans and which pokemon was the second most popular and had a similar "both cute and cool" appeal with all audiences. And they put the most effort into the visuals and the cuteness and making everything just feel like a good and fun adventure that recaptures everything you wanted as a kid playing the first game.
And they just act so unapologetically HAPPY about all these parts of the game! These are their favourite parts! They're the goddamn DEVELOPERS and even they say that they prefer the story and the characters and the relaxing childlike whimsy to the concept of refining gameplay to a ridiculous hardcore perfection and throwing out everything else in pursuit of that. And man, seeing them hugging the big pika and eev plushies in EVERY PROMOTIONAL VIDEO and just enjoying playing their own game so much!! And babbling on about dressing up your pokemon!!
God its just SO GOOD to see this as a fan who's been here since the very beginnibg and is starting to feel quite self concious about being an adult fan who isnt doing it "properly". Like man the pressure of hardcore competotive being the "only right way" started even when i was just 11, like seriously THE AGE THE ACTUAL TRAINERS ARE IN THE GODDAMN GAME. Before you even hit your teens you already got stuck up older kids telling you you were too old to just enjoy a game cos you enjoyed the damn game, noooo you have to make it as unfun as possible and only derive enjoyment from defeating other people. It took me until ORAS to actually even be able to try competitive at all, i found it so overwhelming until they added other methods to EV train. And even then i still felt like the blandness of the preparation outweighed any fun of playing these "higher level" battles. Like sure maybe some people like that stuff but it felt so dissappointing after all these years of being pressured to try it...
Sometimes its just good to enjoy a game cos you legit like the world and characters. Sometimes its just really validating to see the developers talking about enjoying making those things, cos it gives you permission to be less embarrassed about it. Sometimes its good to also see them hugging a hundred dollar giant pikachu while you hug your hundred dollar giant mimikyu. Cos seriously what is the point of being an adult if youre not allowed to buy these adult sized plushies? What kid could ever afford those! Im not letting my childhood dream pass me by just because ~maturity~ when im finally able to slap a fat wad of cash on the table and yell GIVE ME THE BIGGEST CHU
I will embrace all my pure childhood love and enjoy this game of just huggins and nothing else! And i really like this concept for the series, if they continue doing Let's Go as a spinoff so we'd have a set of games appealing to each of the casual and hardcore demographics. I always feel bad complaining about hardcore when really my actual opinion on it is just "its not for me" and im actually only complaining about the rude fans who tell me im not a real fan unless i like their genre of stuff. Dude i was three years old when pokemon came out, i think ive earned my right by seniority to hug a plushie or two! So itd be awesome if hardcore doods could get their super hardcore game too, and we could just argue less cos we'd each be able to enjoy what we enjoy. Tho i mean the main series games already have a pretty clear divide between story/fun being the main game and hardcore competitive being a postgame thing. And yet we still get all this fandom fightibg over "ignore the actual 90% of the game, skip the plotline and only play competitive" apparantly being the "real" way to play it. Like man im worried that attitude is still gonna stick arpund even if they do give us separate games appealing to each side of the fandom?
EHHH WHATEVER! Im just gonna sit here in my corner of casual hugs and work on my self confidence to be able to stop feeling bad about not being someone else's idea of a "real" fan. If real fans can't have pikachu in a little hat, then that is not the life i wanna lead!

4.       Add the okra, broccoli, cauliflower and zucchini to the pan.
5.       Cover the pan and cook for 15 minutes until all the vegetables are soft. Season with salt and pepper.
6.       To finish, serve directly from the pan or tagine or transfer to a large serving bowl. Squeeze over the lemon wedges (if using), sprinkle with the coriander leaves and serve with some coconut yogurt.
