August 2017 Book Roundup
Last month was not a good reading month for me, partially because work and depression make reading hard and partially because the books themselves weren’t that great.  There are times when a ton of new, exciting books get dropped and they seem to swing around the spring (people beginning buying for the summer?  Beach reads?) and the fall (obviously, in preparation for Christmas).  The one book I really super enjoyed was A Map for Wrecked Girls by Jessica Taylor--a tale of sisters getting shipwrecked on an island (with a boy, but he’s not super important) and working through the fact that one is borderline psychopathically manipulative and they hate each other.  Also, sibling codependence.  There were decent books aside from that one, but nothing that gripped me quite as much.  (Ratings and mini reviews below.)
Stolen Beauty by Laurie Lico Albanese.  3/5.  In World War II era Austria, Maria Altmann’s world is turned upside down as her Jewish family attempts to flee.  In the process, the Nazis snatch up portraits of her beloved aunt, Adele Bloch-Bauer, painted by the renowned artist Gustav Klimt.  As we follow Maria from the turmoil of World War II to her twenty-first century struggle to regain the paintings, a parallel story is told--that of Adele and her relationship with Klimt.  While this book was pretty accurate as far as I could tell--I’m no Klimt expert--it could have done without Maria’s story.  This is better told in the Helen Mirren movie “The Woman in Gold”; here it’s pretty flat, and distracts from Adele’s much more engaging journey from impetuous young wife to immortalized muse.  Maria’s narrative becomes a fairly standard--I hate to say it--World War II story.  Adele’s is far more interesting and unique, and the book would have been much better had the author stuck with that.
Severed: A History of Heads Lost and Heads Found by Frances Larson.  4/5.  Larson takes on the topic of severed heads, from those captured during war, to those decapitated by royal decree, and those belonging to saints.  Morbid curiosity and the recommendation of Caitlin Doughty drew me to this book, and it’s both well-researched and quite interesting.  I thought it would be largely about the heads lost through the decapitation of living people, like those who would become “shrunken heads” and famous people like Anne Boleyn. While a couple of chapters are devoted to such subjects, Larson also discussed people decapitated after death, as well as the topic of life remaining after decapitation.  It’s a pretty thorough book, and while some topics were more interesting than others and it was certainly all a bit gruesome at times, I was impressed by the fact that Larson even went into the topic of decapitation in art.  Overall, a good read if you’re in the mood for something niche-y.
The Good Daughter by Karin Slaughter.  2/5.  In the 80s, sisters Sam and Charlotte (later Charlie) undergo a horrific event together that leaves their mother murdered and both deeply traumatized.  Thirty years later, Charlie--an attorney, albeit not one as controversial as her “defend any client” father--witnesses a school shooting, and is compelled to help defend the shooter, a teenage girl.  The subsequent events will bring up the truth about what happened to the sisters that night, as well as the truth of who they became after.  I really enjoyed this book at first--even though the beginning is quite harrowing and not for the faint of heart.  But there’s “not for the faint of heart” and “this makes me actively uncomfortable because I don’t think it’s being handled well”.  This might act as a spoiler, but honestly it’s a theme throughout the novel and, well...  The topic of rape is not handled the way it should have been, in my opinion.  Lots of people will feel differently, and I’m sure some will have valid reasons, but I could not get behind this book.
The Life She Was Given by Ellen Marie Wiseman.  2/5.  As a young girl, Lilly is sold to the circus by her mother.  She hasn’t even had much experience of the world, locked away by her parents to keep her albinism a secret.  In a parallel timeline, 20+ years later, nineteen-year old Julia learns that her estranged mother is dead, and she has inherited the family horse farm.  Returning home, she stumbles across Lilly’s story, and becomes wrapped up in the mystery of what happened to her.  Obviously, this story is interesting--but I think it might be time for me to stop trying these parallel narrative historical fiction novels.  They just aren’t for me.  Furthermore, the simplicity of the writing and the characters was off-putting.  It felt like I was reading about Lilly and the Good People versus Cartoon Villains.
Happiness: A Memoir by Heather Harpham.  3/5.  Upon finding out that she was pregnant, Heather Harpham soon realized that her boyfriend, Brian, loved her but wasn’t sure about the idea of fatherhood in his forties.  She went through her pregnancy alone, gave birth without him--but things became even more complicated upon the discovery that their daughter, Amelia-Grace, had a blood disease that would quite possibly kill her before she hit thirty.  “Happiness” is the story of not only Amelia-Grace’s treatment and the fight for her life, but Heather and Brian’s journey towards finding each other.  It’s at times frustrating, as many memoirs are; I really don’t know that Brian and Heather are people I would identify with if I met them, and some of their decisions were... questionable.  But the writing is lovely, and I really felt for what was an incredibly human story.  It’s a well-done memoir.
A Map for Wrecked Girls by Jessica Taylor.  4/5.  Shipwrecked with her sister Henri and a virtual stranger, Alex, Emma has little hope of being found or rescued.  Complicating matters of survival is her fraught relationship with Henri, ruined by recent events.  Parallel narratives tell the story of the three teens’ attempts to survive, while also revealing what happened between Henri and Emma.  This book is extremely gripping and interesting, and while there is a romance that largely serves to develop Emma’s character, the crux of the story is her relationship with the magnetic, manipulative Henri.  Henri is the kind of character you love to hate, and so is Emma in a way.  Their codependency was extremely compelling, and while a couple of the later “twists” weren’t the strongest, they didn’t dull my interest in the sisters and what happened to them.
Too Fat, Too Slutty, Too Loud: The Rise and Reign of the Unruly Woman by Anne Helen Petersen, 3/5.  This book is a collection of essays on women who Petersen--someone who got her doctoral degree on celebrity gossip, essentially--terms as “unruly” for a variety of different reasons.  Petersen, who wrote for Buzzfeed, does know how to write a thinkpiece, and in an engaging manner.  It’s definitely a quick, fun read.  Nothing she says here reinvents the wheel if you’re already engaged in feminist theory, but most of it isn’t actively wrong and it’s good to read.  But she does write as a straight, cis, white woman (as she acknowledges). She’s conventionally attractive; she isn’t fat.  So there is a part of me that’s like “ugh, I wish someone who could speak from personal experience about what she’s writing had written this book”.  She’s not even old, like Madonna (the subject of her “Too Old” essay).  But that’s not really something Petersen can help.  What she can help is the manner in which she overlooks the ridiculousness of Caitlyn Jenner’s political views, barely mentioning them in the “Too Qu**r” essay.  Really, Petersen acknowledges that Jenner doesn’t embody that label; so why not discuss another woman like Laverne Cox or Janet Mock over Jenner?  And I know she’s capable of criticizing her subject, because she does so in the aforementioned Madonna piece (though she doesn’t get into exactly how problematic Madonna’s rearing and presentation of her black children has been; that’s not the point of the piece).  The Lena Dunham piece is similarly shortsighted.  She doesn’t discuss many of the reasons why lots of people--including many feminists--hate Dunham.  She doesn’t get into her racism, her troubling discussion of her relationship with her sister.  If Petersen didn’t want to get into these issues, there are plenty of “unruly women” who coincide with her topics and aren’t loaded with ugliness, for lack of a better term.  So while I liked the book--it could have done with more women of color, by the way--a couple of the essays I side-eyed.
The Devil’s Lady by Deborah Simmons.  4/5.  When Aisley de Laci (yes) is forced to marry--but given the option to choose her husband--she chooses Piers Montmorency (yes) otherwise known as the Red Knight (YES).  Fierce and mysterious, Piers is said to have a made a pact with the devil, and doesn’t allow Aisley to see him in the light.  If you think this means they have a lot of sex in the dark, fuck yeah it does.  This is a classic sort of romance novel, made better by the fact that the heroine has a lot of agency in terms of her sexuality for a romance novel written in the 90s, and the guy isn’t a total douchebag.  He kind of is at first, but he’s not put in the best situation so....  One of the most appealing parts of the story is dealt with in a manner that was way too easy for my taste, and the ending was all a bit rushed, but that wasn’t the point.  The romance was.  And it was good. 
Shimmer and Burn by Mary Taranta.  2/5.  After an attempted escape from their guarded city, Faris is left alone, her love murdered and her sister enslaved.  Desperate to free her sister, she enters into arrangement with the king’s executioner and a the Princess Bryn--who wants to become queen--to slip out of the kingdom and transfer magic and honestly that’s all I got because this world was so badly explained and constructed.  It was one of those worlds that naturally doesn’t appeal to me, where magic is a substance and you can, like, put it in your body with a syringe?  Which made me think of an addiction plotline on the rise and addiction + magic is something I hate and even if I did understand this world, which I didn’t because the writing didn’t explain it to me, I probably wouldn’t like it. Then there were little things, like the king’s executioner being a teenage boy (was there... not someone a little older) and Faris streetfighting~ to earn her keep.  Cliche.

“You won’t believe the day I have had!” Itachi threw his keys on the coffee table before sitting right next to Shisui, immediately wrapping his arms around the older Uchiha’s torso. “It was terrible and humiliating and ugh!”
“I haven’t heard the ‘ugh’ for a while now, did you get scolded by somebody at work?”
“No, it is worse…” Itachi sighed exhaustively.
“Tell me about it, I locked myself outside the car with the car keys in the fucking car” Shisui shook his head.
“Did you guys have such an awful day too? The idiot assistant changed the code of the safe...and forgot what it was”
“Wow, the save with all those private papers? That is terrible” Shisui said as Madara nodded and sat down.
“Did you manage to open it?” Itachi asked.
“Actually...it is a funny story, I came across that blond brat and he...he cracked the safe open” both Shisui’s and Itachi’s eyes widened.
“Naruto?” Shisui asked.
“Yeah, that guy, I said I owed him one”  Madara waved it off, but wasn’t aware of the coincidence.
“He cracked open my car when I locked myself out” Shisui said.
“He cracked the lock of Suké’s apartment” Itachi said, both Shisui and Madara turned their heads at Itachi with a strange look, “I left my...stethoscope at his place, I don’t have a key...because he...never gave me...a key” Itachi looked away.
“Why don’t you begin with your story…?”

“Come on, come on” Itachi tapped his foot on the ground, “Pick up, pick up…”
“This is the voicemail of-”
“Fuck!” Itachi kicked the tire of his car before turning his head towards the apartment block. He put the phone against his ear. “Suké, it is me again...I need you to pick up alright? This is important, it is...about...that...thing...I left...in your apartment, anyway, call me back” Itachi sighed, looking at the screen of his phone for two whole minutes.
“If it isn’t Uchiha Itachi, are you here for your boyfriend?” Itachi immediately felt a vein pop in his head.
“I don’t have time to beat you up, Uzumaki” Itachi stated as he angrily turned around.
“I was going to ask how you were doing, but I already know the answer; moody” Naruto sat down on a pole. “I wish I could help cheer you up...”
“Unless you can magically make a masterkey appear in your hands, I don’t know what use you are to me” Itachi scoffed.
“I don’t have a masterkey” Naruto lowered his head, “But...you do”  Itachi frowned by Naruto’s words “Your hairpin, dattebayo”
“Tch, that stupid shit that only works in movies”
“Fifty bucks says I can help you sneak in your boyfriend’s apartment by just using that hairpin”
“I am not going to give you fifty bucks so you can buy pot”
“Hey, I am clean, as for you...you are trying to sneak inside your boyfriend’s apartment, well, I am not going to question-”
“I left...my...stethoscope, a very good one! I need it back...for work” Itachi folded his arms, “I tried contacting him, but he isn’t picking up”
“You guys have been together for about a year, no house key exchange?” Naruto asked.
“My relationship is none of your business” Itachi tone sounded harsh. He looked away, “He has only one spare key, I think his sister has it”
“Don’t worry Itachi, I will help you” Naruto stood up.
“What do you want for it in return? I mean...If you really can get me in”
“No worries, we are practically family, dattebayo” Naruto had this smirk face and Itachi gave him the most confused look his face could possible make.  “Let’s say you owe me one” Naruto said.
“...Fine” Itachi sighed, getting the hairpin out of his hair and handing it to Naruto.  “Fourth floor room 483, and no I am not giving any painkillers as rewards”  Itachi walked inside the apartment block while Naruto followed.
“It won’t be some medical issue, I can tell you that upfront, it will probably be something...precious” Naruto scoffed when he reached the door. “This is too easy, it is like shooting a baby through the head”
“Why is every brat using that expression? That’s not how it goes” Itachi threw his hands in the air. First Sasuke, now this idiot. What is wrong with this generation?
“I am sure Sasuke says that all the time, you know he can’t say piece of cake because last time he baked something I ended up in the hospital” Naruto knelt down and took the hairpin from Itachi.
“Actually, Sasuke mentioned your mom said to put walnuts in it, so actually the real mastermind behind your almost death is your own mother”
“Ha, in that case you two have a lot in common” Naruto stood up and pushed the door, opening the room. “Told you I could do it”
“I am too relieved to question why you are able to pick locks”
“Don’t ask, don’t tell” Naruto said.
“You...stay here!” Itachi rushed inside, immediately going to the bathroom and picking up what appeared to be a set of clothes, he tried to push it in his bag before hearing a cough behind him. “I told you stay in front of the door…” Itachi said, closing his eyes as if he was busted by police with the possession of drugs.
“So...Sasuke’s clothes?” Naruto leaned against the door frame, recognising the black hoodie all too well. It was the item of clothing Sasuke wore the most.
“...I...borrowed it and it is really none of your concern” Itachi said, taking a deep breath.
“Yeah, I know I am blond, but if those clothes are here and you went home that night...it means you had...clothes on...which means...you had some nasty use for those clothes-”
“I am not confirming...anything, I simply...borrowed…some clothes, now...fuck off...before I kill you” Itachi put the clothes in his bag before turning around and walked out of the room, stopping right next to Naruto to whisper: “And we will never...never...talk about it again”
“One last thing, don’t you want to pick up Sasuke’s glasses on the night stand or are you just going to leave them?”
“...I am just…yeah...” Itachi walked back inside the room to fetch the glasses. “Not a word” Itachi repeated as he walked out of the apartment. Naruto followed him all the way to the elevator.
“There is just one thing bothering me, dattebayo”
“No questions!” Itachi hissed.
“I just...can’t imagine...Sasuke’s clothes actually fitting Suké…” Naruto looked confused at the elevator door closing. The ride down was silent and Itachi didn’t walk out right away when the doors opened.
“It is because...he is not the one wearing them” Itachi answered, causing Naruto to gasp.
“I am awkwardly turned on, dattebayo” Naruto stated as Itachi shook his head and walked out of the elevator, leaving the blond there. “Remember, you owe me one”

“You did what?!” Madara flipped his desk, causing the men in the chair to scream like little girls. “The fuck am I supposed to do now?! I gave you one fucking job!”
“You assigned him exactly 6 tasks” The assistant muttered, holding the clipboard against his chest.
“It is an honest mistake!” The man said.
“No, it is not! I could tell a baby to memorise four fucking digits, why can’t you!?”
“Babies, can’t even talk” The assistant cleared his throat.
“You know how a safe works? It has 10 digits and do you know how many possibilities it will leave me with? 9 TIMES 9 TIMES 9 TIMES 9! Yes, my loser idiot, dyscalculia, little brother can even do that kind of math!”
“I am deeply sorry!” The man said, looking at the ground. Madara sighed and sat back down.
“What done is done…” He said, rolling his chair towards the window and opening it.
“Boss...couldn’t you have had that reaction of acceptance before you flipped the table?” The assistant asked.
“It is called the stages of grief, anger is one of them!” Madara said.
“Hey Madara!” The Uchiha looked surprised at the pavement, seeing a little blond dot.
“Oh, that idiot...” Madara commented.  “Hey!”
“I couldn’t help hearing you scream! Everything alright?!” Naruto shouted.
“Some idiot forgot the combination of the new safe!”
“Oh! That sucks...! What type is it?!”
“Like I know!” Madara shouted back.
“Hey! I think I might be able to crack it! Dattebayo!” The blond shouted.
“What are you?! A criminal?!” Madara asked.
“I am not answer those questions without my attorney present!”  Naruto shouted, causing Madara to laugh. He indicated for Naruto to come up before turning his chair.
“I like that brat, he has guts, my sense of humour” Madara said, leaning back in the chair, “Why was I mad again?”
“The safe”
“Right!” Madara said, but then got distracted after seeing the door of the office open.
“How did that even happen?” Naruto asked as he walked inside. “Hey, I am Naruto” Naruto introduced himself to the two strangers in the room.
“Nice meeting you” The assistant says, shaking his hand before leaning towards Madara, “How do you know him?”
“He is like a friend of my youngest brother...I am not sure what they are…”
“Let me see the safe, maybe I can crack it!” Naruto said and then followed the other guy, followed by Madara and his assistant. “Oooh, that is hella easy!” Naruto put his backpack down and grabbed a stethoscope.
“Do you just walk around with that?” Madara asked.
“Nah, I came across Itachi…I...borrowed it from him” Naruto turned his head to Madara and smirked. “Sort of” He knelt down and within 20 minutes, Naruto opened the safe.
“0308, that is your code, but you might wanna get changed now” Naruto stood up.
“You are amazing!” Madara said, looking impressed.
“...Isn’t it questionable why a teenager...know how to crack a safe?” The assistant asked. Madara frowned and looked at Naruto.
“If  you are involved in some criminal organisation...I am not telling you to stop, I am telling you to stay the fuck away from Sasuke”
“Don’t ask, don’t tell” Naruto chuckled.
“Is there anything I can do for...for kinda...saving my ass~” The man tapped Naruto’s arm with his elbow.
“You can take a mint, dattebayo” Naruto commented, making the other chuckle.
“But he is right, if there anything-”
“Aaah stop it, Madara, we are practically family, let’s say you owe me one, dattebayo!”
‘Sure, but as a bonus, I will let you take this notebook for five minutes with all the dirt on…”

“Yeah, you lied to us about it” Shisui said.
“It is weird...how does he know how to break a lock, crack a safe…dude...that kid is bad news” Madara said.
“Look at you, caring about your youngest brother”
“Owh, Sasuke will be fine...I am not worried about him” Madara stated.
“Maybe he was like one of those criminals...maybe he changed” Shisui said.
“At least he is nice enough to help us” Madara said.
“Yeah, I guess my story is up next”

“Fuck, why did I stop for coffee on the way?! Why didn’t I wait in line for ten minutes to get the damn coffee...I couldn’t walk away once I stood in line...the time waited would have been for nothing!” Shisui hissed to himself as he grabbed the latte and opened the door of the car, slamming it behind him. He stood still for a moment before slowly turning his head around, seeing his bag with the important papers in it, still in the passenger seat.
“...No...no...” He pulled the handle several times, but the door was locked and the keys were still inside. “No, no! Damn the garage and their stupid replacement car!” Shisui kicked the tire, but in the process dropped his latte. He started at the disposable cup with utterly displeasure in his eyes.
“Why.Am.I.Fucking.Alive” Shisui sulked.
“Shisui?”
“Naruto, hey! What...what are you doing here?” Shisui asked.
“I was walking by...you seem in distress, dattebayo”
“I am late for a meeting and...the papers are in my car...that’s locked...”Shisui stared at the window, “And I dropped my latte”
“That is worse than the important papers in the car” Naruto walked towards Shisui, looking at the car. “That is an old car”
“The garage lent it to me until they fix mine”
“I might be able….To open it” Naruto said cracking his fingers.
“You can?”
“I can give it a try, you are look out, make sure no cop sees me-”
“Naruto, it is my car-”
“Owh...they won’t believe you when you are with me...dattebayo” Naruto muttered grabbing something from his bag. Shisui swallowed, looking around the parking lot.
“Done!” Naruto stood up and opened the door to grab the keys and bag. He handed them to Shisui.
“Thank you so much! Ah Uzumaki, I owe you one” Shisui embraced Naruto,dropping his bag in the process.  Naruto laughed and picked it up, but he remained quiet when holding a book. He looked back up at Shisui who cleared his throat.
“That...that is...from a friend” Shisui stated.
“Yeah…I choose to believe that, dattebayo…”

“He said he asked each of you” Sasuke stated, causing all three to widened their eyes.
“Hey guys! You guys don’t mind if I steal him? Dattebayo” Naruto asked, smiling kindly...at first...that smiled turned into a smirk. “I did ask each of you” He wrapped an arm around Sasuke’s waist, pulling him a little closer, “I wouldn't have asked if it wasn’t for my parents leaving tonight-”
“Absolutely not!” Itachi shouted.
“Is this what you mean with something precious!?” Shisui added, “Itachi was right about you!”
“What are they talking about?” Sasuke looked at Naruto.
“Ooh, you guys came clean to one another? Oh, I guess Itachi stealing Sasuke’s clothes for the roleplay with his boyfriend had to come into discussion, and Madara’s notebook filled with dirt on each of your siblings, not to mention the book Shisui was reading  “Fifty shades of grey” and “Laws regarding incest”, I figured it was only for the best to talk about it openly...instead of keeping...secrets...dattebayo”
“Look at him” Madara shook his head, but there was a proud smirk spread across his lips, “We cock block him and he stabs us all in the back…you have balls, Uzumaki”
“You guys…” Sasuke’s voice sounded dangerously low, catching all attention in the room. He cracked his fingers. “Let’s talk in an old fashioned way about what is morally good...and bad”
“Well, guess I have to go then! Seems you have to work stuff out! But I will see you guys...you all...do owe one” He winked before leaving the room.

“Solving USA and the World’s Major Problems For A Better Future.”

Betty: Our book review, “Solving USA’s and the World’s Major Problems For A Better Future” was started before and revised during and after the contentious Nov. 8, 2016 election. 
Frank: We searched the internet, libraries, and elsewhere for best sources on such USA/World problems as: 1-stopping ongoing wars; 2-creating a more peaceful, cooperative world; 3-upliftlng needy people everywhere; and 4-finding ways toward a better future.
Betty: Frank, what concerns caused us to pursue this difficult topic on 1-what’s wrong with the USA and the world? and 2-How to correct those wrongs for a better future?  
Frank:  I am 96, Betty is 88.  Our old age concerns and questions are: 1: why the USA, since World War 2, has been involved in ongoing, costly, deadly wars?  2: What did we do wrong to bring on our big troubles?   3: How can we correct past wrongs, mistakes, and move toward a better future?
Betty: Frank, any other really big problems to explore?
Frank: The deadly problem of violent Jihadist attacks.   Jihad in Arabic means “struggle,” struggle to defend the Muslim faith against unbelievers. Some Muslims, long defensive about their faith, have in recent troubled times become violently anti-Western.  We need to understand why Islamic jihadists are determined to destroy us and our Allies, and how to soften their angers. 
Betty: Reasons for Middle East angers against us include 1: We needed Middle East oil and got it by hook or crook.  2:  In so doing we Westerners generally ignored their history, cultures, faiths, and traditions.  
Frank: 3: Muslims, whose main enemy is Israel, long resented, now hate, our USA backing of Israel since its 1948 founding.   4. Arabs, proud of their once great Arabic culture, feel threatened and besieged by the modern world.  Muslims see us Americans as the worst of the modern world.  Militant Islamists magnify our faults.  They imagine that everything we do is against them.  
Betty:  Some young anti-West jihadists actually believe that either the Central Intelligence Agency (CIA) or Israel's secret agency Mossad on 9-11-2001 deliberately destroyed New York City’s World Trade Center in order to justify USA attacks on Muslims.  Frank, these hard Islamist-USA differences nearly exploded on April 4, 2017, when Syria’s Pres. Bashar Hafez al-Assad (his name means “lion” in Arabic) used deadly poison gas on his own Syrian opponents.
Frank:  Pres. Trump’s immediate response to this poison gas atrocity was to order 59 Tomahawk Missiles fired on Syria’s main military airport.  His action won immediate U.S. praise--but wait--here’s what happened:  those U.S. missiles struck close to stored Russian planes, prompting Russia’s President Vladimir Putin to denounce our missile strike as a provocative act.
Betty:  Recently North Korea has been tested missiles to show the world that they will soon be able to pulverize us.
Frank:  Such dangerous incidents can spin out of control; can lead to WW 3, to mutual nuclear bomb exchanges, to annihilation.  Another big problem: Why does the USA use pilotless drones to kill targeted enemies?
Betty: Why do we use bombs and drone strikes knowing they also cause innocent civilian deaths and injuries?  Our drone strikes increase their anger and make their blowback attacks on us fiercer, more vicious.
Frank:  “Blowback” is a term first used by the Central Intelligence Agency (CIA) to explain retaliation in its deeper, hidden, more sinister meaning, as follows:  the USA military has reason to suspect, then verifies, then bombs a jihadist site, expecting jihadists’ retaliation, so that USA military can hit them again with a superior force.  This causes jihadists to use stronger retaliation, followed by even bigger USA bombing.  That’s the heart, the awesomeness, and the evil of our ongoing wars:  jihadists hit us, we hit back harder, knowing they will retaliate more fiercely. Blow by bigger blow escalates without end.
Betty:  Also disturbing about our blowback strikes is their secrecy. The American public is not informed when the US uses drone strikes.
Frank: Journalists imbedded with our military have rightly described blowback strikes as perpetuating ongoing endless wars.  What is behind our never-ending wars is profit and power. Endless wars push Congress to give the military more and more money, more and more  power, which profits munitions makers, which enriches our 1% top rich because they own stock in defense industries.                                                        
Betty:  Many Americans are not aware that our ongoing wars cost trillions of dollars, lead to many deaths and injuries and create homeless refugees. Those trillions of dollars could, should, be spent to uplift needy people everywhere, eliminate diseases, repair faulty infrastructures, plus other similar needs.
Frank:  Better to use those trillions of dollars to help modernize poverty-stricken nations, improve and universalize education at all levels, create self-help programs everywhere, encourage peaceful negotiation, solve international disputes--tasks needed to assure our better future. Instead we use trillions of dollars to kill, kill, kill; to dominate. 
Betty: We share below author John W. Whitehead’s criticism of our tremendous military overspending.  He is a constitutional lawyer and human rights attorney. 
Frank:  Whitehead’s book is titled Battlefield America; The War on the American People, 2017.  Interestingly, Whitehead’s main points were published in our newspaper, Crossville Chronicle (April 14, 2017, p. 4), titled: “Beware the Dogs of War.” 
Betty: Whitehead wrote #1: Our gigantic military spending is ruining the USA. Our endless wars in Iraq, Afghanistan, and elsewhere, instead of making the world and us safer are digging the USA deeper into trillions of dollars of debt. 
Frank:  Whitehead wrote #2:  Our government has spent 4.8 trillion dollars on wars abroad since September 11, 2001, when jihadists hijacked USA planes, crashed them into New York City’s World Trade Center, into Washington, D.C.’s Pentagon Building, and crashed another in Pennsylvania as passengers fought off hijackers.
Betty: Whitehead, #3: Although the USA has only 5% of the world’s population, our military spending is almost half the world’s total military expenditure.  We spend more on our military than do the 19 next biggest military spending nations combined. 
Frank:  Whitehead, #4: The Pentagon spends more on ongoing wars than all of our 50 states combined spend on health, education, welfare, and safety.  Our country is now (2017) 19 trillion dollars in debt.     
Betty: Whitehead, #5: Everybody’s taxes pay for USA’s rising military costs.  The 1% top rich get richer from ongoing wars because they own the most shares in the armaments industry. 
Frank: Whitehead, #6: Interestingly, USA taxpayer statistics for 2013 reveal that some 243 million USA adults paid some type of federal taxes.  About 122 million Americans paid federal income taxes.  All American workers have payroll taxes.  Result: low to moderate USA earners pay a larger percentage of their income in taxes than do high earning Americans. Betty:  Whitehead, #7: asked: who is stealing the USA blind and pushing us to bankruptcy?  Not the sick, elderly, or poor—but the military-industrial complex--the illicit merger of the armaments industry and the Pentagon as President Dwight Eisenhower 56 years ago warned in his 1961 farewell address.
Frank:  Whitehead, #8: added this strong statement: The military-industrial complex, by influencing and controlling Congress plus controlling other sources of USA power, is perhaps the greatest threat to our country’s future.
Betty: Whitehead, #9, asked:  what and who are behind USA’s expanding military empire?  His answer:  corrupt politicians, incompetent government officials, co-opted by greedy defense contractors.  By approving and fostering America’s expanding military empire, they are bleeding the USA dry at a rate of more than 15 billion dollars a month or 20 million dollars an hour.
Frank: Whitehead, #10:  That USA expenditure of over 15 billion dollars a month; 20 million dollars an hour is spent on foreign wars alone.  That sum for foreign wars alone does not include the added cost of staffing and maintaining our 1000-plus U.S.A. military bases worldwide.
Betty: Another author, Jane Mayer, M A Y E R, confirms Whitehead’s assertions about USA enormous military spending.   Her book is titled: Dark Money: The Hidden History of the Billionaires Behind the Rise of the Radical Right, published in 2016. Ftnote: NY: Doubleday.
Frank: Jane Mayer wrote, #1: reinforcing Whitehead, that USA military trillions of dollars are paid mainly by the non-rich 99% taxpayers, not by the 1% rich taxpayers.
Betty: Jane Mayer wrote, #2: Most Americans don’t know, don’t realize, the above two facts: that lower income Americans pay for our ongoing wars, which benefit the super rich and do not know that our ongoing wars against Muslim nations create the radical jihadists who are determined to destroy us. 
Frank: We would rebel, rebel--if all Americans knew the above two facts, if we all knew the high costs of ongoing wars, if we all knew the horrors of military and civilian lives lost and crippled, if we knew the hurt and sadness suffered by involved families-we would rebel. 
Betty:  We would rebel by voting out misguided politicians, voting in reform minded honor-bound, enlightened government officials. 
Frank:  We would rebel by electing officials who care for all their constituents, especially their needy ones, and care for all people everywhere.
Betty: We need to elect leaders dedicated to honest uplift and advancement of all their constituents, poor, rich, regardless of color or national background. 
Frank:   Now for one favorite author Chalmers Johnson who died in 2010, one of the early respected critics of USA’s military excesses, a scholar and professor at the University of California’s Berkeley and San Diego campuses.  He first exposed the USA military blowback scheme that propels our ongoing wars.
Betty:  Chalmers Johnson, #1: Johnson, an early Cold War anti-USSR scholar-writer and for a time a CIA advisor, soon saw and wrote convincingly that our ongoing wars as Policeman of the World were changing the USA from a Democracy into an Oligarchy ruled by the richest few.
Frank: Chalmers Johnson, #2:  His best known 3-volume Blowback series covers the USA’s World War 2 defeat of Hitler and Hitlerism, covers aggressive USSR expansionism which determined the USA to become the World’s Policeman. 
Betty: Chalmers Johnson, #3:  He continued:  With the 1991 collapse of the USSR, the USA, instead of disarming, strengthened itself as Super World Policeman.  In doing so we began losing our highly regarded Democracy. Frank: Chalmers Johnson, #6: He was one of the first scholars to say that our enforcement of American dominance over the world constitutes a new form of USA global empire. 
Betty:  Chalmers Johnson, #7: Past empires, he wrote, controlled subject peoples as colonies. But since World War II our many military bases around the world have made the USA a new World Empire, an empire evoking resistance, antagonism, and Islamist terror attacks wherever they think they can hurt us most.    Chalmers Johnson’s Blowback series warned that being an Empire causes rebellion, strife, and war with those we would rule.  He urged again and again for dismantling our empire.
Frank: Chalmers Johnson, #8: wrote descriptively of military prisons using such cruel practices as brutal waterboarding torture of prisoners and worse. These atrocities done secretly in Iraq and at our Guantanamo Bay, Cuba, prison have since been made public.
Betty: Chalmers Johnson, #9:  Outwardly, military men and women on bases abroad, single or married, have assigned rigid military duties, yet many live in luxury, in opulence: low rent or no rent, cheap goods in Post Exchanges( PXes), many recreation outlets. 
Frank:  Sins hidden from us on our 1,000+military bases worldwide include: swaggering drunken soldiers who brawl, injure, kill native people, rape women; sins which, even if reported, are covered up.
Betty:  Our military bases abroad are imperial enclaves, a form of colonization, barely tolerated by the host country for financial and political reasons, deeply resented by the country’s citizens, utterly detested by resentful jihadists. That’s what ongoing wars do. They are brutal and brutalizing.  
Frank:  Another special best author, Betty’s favorite, is Rosa Brooks.  Her book is on the US military, the Pentagon, and the Central Intelligence Agency (CIA).  It is titled: How Everything Became War and the Military Became Everything, 2016, listed among the best 100 books published that year.
Betty: Brooks grew up in a liberal activist family. Her mother, Barbara Ehrenreich, is a well-known journalist (NY Times; New Yorker) and an award-winning author of 21 books (Nickel and Dimed).
Frank: Rosa Brooks became a lawyer, a legal scholar, and a human rights activist.
Betty:  She then worked for 26 months (2009-2012) in the Pentagon as chief legal research advisor to the highest-ranking woman officer in the Pentagon, with top security clearance. Rosa Brooks married a highly placed Pentagon officer.   
Frank: She is currently a professor of constitutional and international law and also Associate Dean at Georgetown University Law Center, Washington, D.C., and a prominent writer for major journals.
Betty:  She is keenly insightful about USA military strengths and weaknesses.
Frank: Brooks, #1 wrote: “Today, America’s wars are everywhere and forever.   Our enemies change constantly and rarely wear uniforms, and virtually anything can become a weapon…“
Betty: Brooks, #2:  She shows how U.S. defense policies evolved during the long USA-USSR Cold War, 1945-91, 45 years. Then in 1991 the USSR fell apart, the Cold War ended, and the world dramatically changed.  
Frank: Brooks, #3: Since 1991, our enemies are not nation states but are Mid-East Muslim jihadists who hate the West.
Betty:  Wars are no longer declared.  Enemies rely on shock and terrorism.
Frank:  Meanwhile, we still support the North Atlantic Treaty Organization (NATO), our western nations organization to counter Russian aggression, and other defense agreements created for a Cold War with the USSR that no longer exists.
Betty: Brooks, #4: Her urgent warning is that constant wars destroy America’s founding values, laws, and institutions.  On-going wars undermine the international rules and organizations that keep our world from sliding into chaos.
Frank: The world around us, she continued, is quietly changing beyond recognition—and time is running out to make things right.  While military costs continue to rise higher and higher, USA domestic needs continue to have lower and lower priority. 
Betty:  Those higher and higher military costs are for endless wars with mostly Mid-Eastern Muslim and with north African countries whose jihadists hate our USA military presence and exploitation.  
Frank: Brooks, #5: She re-emphasizes that it is suicidal for us to forget President Eisenhower’s 1961 farewell address warning against what is now the commanding threat:--the military-industrial complex.
Betty: Brooks, #6: reminds us that President John F. Kennedy, three months after his inauguration, on the CIA’s urging, naively approved the disastrously failed CIA-directed attempt to overthrow  Cuba’s Pres. Fidel Castro. 
Frank:  Though the CIA invasion was planned under Pres. Eisenhower, JFK accepted full responsibility for this failure. 
Betty:  But JFK never again trusted the CIA and signed an executive order prohibiting the CIA from more such secret operations.
Frank: Brooks, #7: stated that conspiracy theories about JFK’s assassination blame his assassination on an embittered CIA that hated JFK for threatening to “Smash the CIA to smithereens” (his words).  
Betty: Yet after Kennedy’s death and throughout the Cold War years, CIA’s secrecy, spending, and power grew, mushroomed.
Frank:   The CIA has spent vast sums in Southeast Asia, in Iran, in Afghanistan, and in Central and South America. The CIA is much like a secret army with a secret budget. 
Betty: Brooks, #8: asked, “Where is the hope in this dangerous world?” What is the answer?  
Frank:  Brooks, being a specialist in international law, believes the U.S. still has time to help create an international system of checks and balance that can save us. We need, she wrote, to develop cautions and processes that make life in this dangerous world safer, better.  (FTNT RBrooks, p. 355)
Betty: Brooks, #9: “We will need to do this on…the individual, state, and international levels…and balance the right of each individual to life, liberty, and fair process…” “With regard to the nation, we need categories, rules, and institutions that enable meaningful democratic control of government decisions that affect [our] liberty and lives.” FTNTP. Brooks, p. 356.
Frank: Brooks, #10: then remarkably urged that we remake our war Army into a peace Army, a new kind of John F. Kennedy Peace Corps.   Brooks asked: “…why not use this as an opportunity to engage everyone—to include millions more Americans in the project of making the nation stronger, and the world a little less cruel?”
Betty: Brooks, #11: continued: “Imagine a revamped public sector premised on the idea of universal service—an America in which every young man and woman spends a year or two engaged in work that fosters national and global security…some might work on international development or public health projects.” “A universal service program would also be a massive investment in a safer, stronger future” FTNT Brooks, page 360.
Frank: Brooks concluded, #12: on the hopeful note that though the USA and the World are in dangerously troubled times, we should, like our founding fathers, never abandon hope.
Betty: Brooks’ superior coverage of USA military problems is a good place to give my closing thoughts.  ¶Martin Luther King, Jr., having battled for African American rights, the night before his death said: “I have been to the mountaintop and seen the Promised Land.” We do not live on a mountaintop. We live on the Cumberland Plateau of Tennessee. We here have not seen the Promised Land. 
Betty:  Instead, we see inadequate health care and many other needs, knowing that around the world the lavishly expensive American military presence produces hatred, not peace, and that the costs of wars are taking money that could provide our neighbors with adequate health care, provide other needs, and assure a better future.  Rosa Brooks in concluding her book says: “We don’t have to accept a world in which the globe is a battlefield… We should be asking…What kind of world do we want to live in—and how do we get from here to there?”   
Betty:  Now for Frank’s conclusion.
Frank: This USA/World problems and solutions topic has been for us a challenge and an eye opener.  Our USA/World problems are many and complex; the solution few and difficult. We appreciate our audience’s patience. Your comments and reactions after my conclusion will be welcomed. I have asked Betty to alternate with me.
Betty for Frank: Having explored major USA/World problems, their origins and scope, Frank briefly sketches our USA’s growth from small beginnings to our high boom time rise, to our recent troubled discontents about 1- jobs lost to cheaper labor abroad, 2- ongoing wars, 3-our role as the hated world policeman, 4-many U.S. military bases and military spending, 5. our drift  from Democracy to Oligarchy.
Frank: Despite its troubles our USA is wonderful, but no utopia.  We’ve tried utopias--near perfect, cooperative societies; some religious, some secular:  Shakers, Mennonites (some around Crossville, TN), New Harmony, Ind.; Brook Farm in Mass.; Rugby in TN; Oneida in New York State known for its silverware; Mormons in Utah.  But these utopias did not last, never became mainstream.
Betty: Our USA has lasted and we hope will last for better or worse, despite many challenges.  Frank, describe your view of our past, present, and likely future of the USA and the World.
Frank:  Look back  to Philadelphia, Penn., around 1776--a handful of smart/bold rebels from 13 colonies declared their independence from Britain; bound themselves together in Articles of Confederation, formed a new nation, wrote a Constitution, created a congress to make laws, a president to lead, a supreme court to decide, a government to cover every contingency.  Why?  So that free and independent people might live in harmony to shape their own changing future by free, prudent, competitive, informed, honest voting. 
Betty, speaking for Frank: Those new Americans from 13 colonies were wise, substantive men of property who knew they had to compromise to accommodate colonies big and small, with immigrants from far and wide 
Frank: Each was different, each with varied jobs and incomes-- few rich; mostly hard working, aspiring small farmers, small shopkeepers. Those founding fathers and their successor leaders, in keeping with the mores of their time, warily accepted as inevitable the need of Southern growers of cotton and other crops for cheap African slaves. It was wrong.   We endured a civil war to right that wrong, and it gave us Abraham Lincoln.
Betty speaking for Frank:  We welcomed indentured servants from mother England who would in time earn full citizenship; admitted low cost Chinese laborers to help lay iron track for railroads; opened wide liberty doors to massive poor immigrants needed for Northeast manufacturing and trade, encouraged the adventurous to fill the unfilled west to the Pacific Ocean. 
Frank: What followed? How did America change?  How did we get into our time of trouble?  How did we rise so high and then, recently, fall so low? Listen to insights about our rise and fall from Northwestern University, Evanston, Illinois, Social Science Professor Robert J. Gordon.  His book is titled:  The Rise and Fall of American Growth; The U.S. Standard of Living Since the Civil War. Princeton, NJ: Princeton University Press, 2016. 
Betty for Frank: Robert J. Gordon wrote that in our first hundred years, about 1776 to 1876, we had small population growth, small economic rise, and endured a divisive Civil War.  The next hundred years, roughly 1876 to 1976, our country mushroomed phenomenally with massive population growth, more and greater inventions, plentiful jobs, despite of and in consequence of World Wars 1 and 2.
Frank; That 1876-1976 boom was spectacular.  Living conditions changed beyond recognition for nearly every American. Electric lights replaced candles and whale oil; indoor flush toilets replaced outhouses; national highways replaced country roads; electric lights replaced oil-lit, then gas-lit homes, Electric washers replaced porch-based scrub boards, gasoline-driven cars replaced horses and horse driven carriages, steam and electric trains, new phones, ever new electronic gadgets. New York City’s financial district, a muddy street in the 1880s, boomed as Wall Street.  We became the world’s financial center.
Betty speaking for Frank:  We became the world’s leading democracy. But that once in our national lifetime 1876 to 1976 boom could not, did not last.  USA job losses worried us.
Frank: Life for many blue collar Americans went downhill. USA manufacturing lost jobs to cheap labor abroad.  Coal use dropped, replaced by lower priced natural gas and other lower polluting energy sources.  USA shoppers bought cheaper made goods abroad rather than USA made goods. Result: USA job loses, job loses, job loses. The military-industrial complex then mired us down in ongoing unwinnable wars in Vietnam and elsewhere.  It was the downward bust after the uplift boom plus ongoing wars that created our current USA and World unsolvable problems which we earlier highlighted.
Betty Speaking for Frank:  In the November 8, 2016 presidential election angry hard working Americans who lost jobs voted for a change agent, a conservative real estate billionaire who repeatedly  tweeted: I will make America great again. What’s ahead, Frank; will our future be better or worse?
Frank:   Nuclear war, if it comes, will take survivors 100 or more years to rebuild a broken world.  We must avoid such carnage, must create Brooks’ suggested Peace Army to uplift the fallen, to heal the world, to spread life-long learning to all people young and old, emphasizing goodness, honor, nobility, truth, and helpfulness. Each one teach one lifelong must become universally ingrained.
Betty For  Frank: We humans have damaged, fouled, our God-given earth, air, rivers, oceans with garbage and harmful carbon smoke. We’ve learned to live with it but we have possibly doomed life on earth for future generations. We unwisely brought on our big floods, tsunamis, earthquakes, foul air resulting in mounting illnesses and early deaths.  
Frank:  In a hundred years we may be forced to leave our beloved but human-fouled Earth writes our one of the great living scientist, Cambridge University professor Stephen Hawking, himself immobile, speechless, wheel chair bound with Lou Gehrig’s disease, communicating only with a twitch near his right eye.  He believes the future of our children’s children’ future is up there, up in space. Hawking believes, future generations must go up there, up there, to adapt to livable conditions, perhaps to find more advanced forms of life, to learn if those on other planets had the equivalent of Moses or Mohammad or Jesus.

Senate Majority Leader Mitch McConnell endorsed an unconventional candidate for FBI director on Tuesday: Merrick Garland. McConnell told the press that the DC Circuit Court of Appeals judge, whose nomination to the Supreme Court was killed by McConnell last year, "has a deep background in criminal law," and stated that he's recommended Garland to President Trump.
McConnell wasn’t the first Republican to tout Garland for the joy. Sen. Mike Lee (R-UT) offered the bipartisan-sounding suggestion on Thursday, telling Fox News, "I would imagine that this might be a post that might interest [Garland] and it might be a post that he could serve in very effectively. This is someone who has a lot of bona fides as a prosecutor, he’s a prosecutor’s prosecutor, and he’s someone who’s got likely allies as a potential FBI director nominee in both political parties."
Lee elaborated on the idea on Twitter, adding that he thinks Garland’s appointment would eliminate the need for an independent prosecutor looking into Trump’s Russia ties: “Instead of a special prosecutor, @realDonaldTrump should nominate Merrick Garland to replace James Comey.”
His Democratic colleague, Sen. Amy Klobuchar of Minnesota, quote-tweeted Lee, adding, “Good idea @SenMikeLee. Former prosecutor Merrick Garland for FBI Director is great idea. Need special prosecutor too.” Connecticut Democrat Richard Blumenthal said he’d support Garland (though he doubts Garland would want the gig), and Vice President Mike Pence and White House Counsel Don McGahn are reportedly on board too.
To be clear, Garland is more than qualified for the job. As Geoffrey Stone, a liberal University of Chicago law professor who floated Garland’s name Tuesday night, notes, Garland worked for three years as assistant US attorney in DC, where he worked on the drug case against Mayor Marion Barry; did a stint in the independent counsel's office during the Reagan administration; and served for four years in the Clinton Justice Department. He supervised the Unabomber and Oklahoma City bombing cases. That's a very similar background to Comey (a US attorney turned deputy attorney general), and to FBI Director Robert Mueller before him (also a US attorney, and an assistant attorney general for the Criminal Division).
One could imagine Garland seeing the overwhelming bipartisan support for his selection and deciding that it was his duty to accept.
He should not.
He should look at the angel on his shoulder telling him to accept the president’s call to serve and then grab and strangle that angel to death. This is an insulting Republican ploy and Garland should be smarter than to fall for it.
If Garland were to accept, he would still serve under a president who has shown himself to be willing to fire FBI directors who displease him for whatever reason, and to manufacture a pretext that such a firing is for cause. Why would Garland ever agree to work under such a condition?
More to the point, why would Garland give up a lifetime judgeship and help move the second most important court in America — a court that handles countless regulatory and national security issues emanating from Washington and is currently considering a case on EPA climate regulations that are crucial for the future of the planet — substantially to the right? Why would he fall for these extremely obvious Lucy/Charlie Brown/football hijinks?
As Slate’s Dahlia Lithwick put it, “Garland probably won’t want to give up his lifetime tenure as the chief judge of the second-most important court in the land, and surely the most significant bulwark against Trump administration overreach, in exchange for a 12-minute gig on The Apprentice before he uses the wrong color highlighter and gets fired by a crazy person.”
It turns out, per the Atlantic’s Garrett Epps, that Garland could theoretically take the job without resigning his judgeship. That would certainly be a fun and wacky situation. But the FBI needs a full-time director, and it’s all but inconceivable that Garland would accept the job without resigning from the court.
Sen. Sheldon Whitehouse (D-RI) saw through this gambit right away. Per my Vox colleague Jeff Stein on the Hill, Whitehouse rolled his eyes when told by a reporter that Garland had been floated as Comey's replacement. "I don't want to change the balance of the DC circuit over this," Whitehouse said. Sen. Brian Schatz (D-HI) put the objection in GIF form:

Conn Carroll, a spokesperson for Sen. Lee, insists this has nothing at all to do with a Republican desire to stack the DC Circuit Court of Appeals with conservatives. "He has the reputation necessary to restore trust in the FBI. This is not about the DC Circuit," Carroll told Fox News, because he apparently thinks you’re stupid.
If Republicans had a genuine desire to reach across the aisle for a respectable Democrat capable of leading the bureau, there are any number of other people they could choose. They could pick Obama's Assistant Attorney General for the Criminal Division, Leslie Caldwell, or her predecessor Mythili Raman, or Obama's Assistant Attorney General for Justice Programs Karol Mason, who now runs John Jay College of Criminal Justice in New York. They could push Trump to put aside his pride and pick Preet Bharara, the US attorney for Manhattan whom Trump fired for seemingly no reason in March.
It’s curious, then, that Lee, with no desire in his heart to change the DC Circuit, managed to overlook all of them and focus in on someone whose appointment would increase Republican influence in the judiciary. One can only ponder why.

The Massachusetts Appeals Court sitting in Middlesex County MA emphatically answered these 2 questions ‘NO’! affirming the lower Court dismissal.(It is unclear whether there is an appeal pending to the Supreme Judicial court)   Pursuant to Massachusetts wrongful death law, before a lawsuit can be filed there must be a probate of the estate and “obtain the appointment of the executor or administrator necessary to file a wrongful death claim…” In the Estate of Gavin case, “The judge did not err in concluding that the presentment was improper because the claimant lacked the legal capacity to make a presentment for wrongful death. Apart from the failure of presentment, the complaint for wrongful death also could not properly be maintained and was subject to dismissal because it had not been brought by the duly authorized executor or administrator on behalf of the heirs at law and next of kin as required by statute.” As a result, the court affirmed he dismissal of the lawsuit. (Editor Note: Sadly a man died in a tragic accident and the heirs of the estate will not be compensated unless the  Massachusetts wrongful death lawyer committed legal malpractice by improperly presenting the case. There is not enough public info to determine whether there was malpractice in this case. Death from a “bacterial infection allegedly due to the improper re insertion of a feeding tube…”
In August 2008, Mr. Gavin died from a “bacterial infection allegedly due to the improper re insertion of a feeding tube and improper monitoring by physicians and staff at Tewksbury State Hospital.” Id.
He had a will when he died naming his parents as executors of the estate.
“In July 2010 (approximately 20 days prior to the two year presentment requirement required by Massachusetts law) an attorney for the Plaintiff sent a demand letter to the hospital; and the Attorney general seeking damages on account of a wrongful death.” Id.
“The presentment letter set forth in detail the basis of the claim of wrongful death. At the time of the presentment, no Probate and Family Court filings had occurred, and no executor or administrator of Gavin’s estate had been appointed.” Id.
A motion to dismiss was filed by the defendants.
The plaintiff scrambled to get their case in order.
“The plaintiff promptly opposed the motion and made some preliminary attempts to address the fact that there was no duly appointed personal representative empowered to bring the wrongful death action. On May 10, 2011, Thomas and Mary were appointed temporary coexecutors of Gavin’s estate. As well, on May 13, 2011, the plaintiff moved to amend the complaint, bringing it in the name of “James T. Gavin and Mary Gavin, as Coexecutors of the Estate of Steven Gavin.” Id.
A MA Superior Court judge dismissed the cause of action finding that the Plaintiff lacked “legal capacity to make a valid presentment” because the claimant who made the presentment was not the “executor or administrator with the capacity to commence suit or settle the wrongful death claim” Id.

The Appeal Co0urt reasoned that presentment was not meaningless and there was strong public policy behind the presentment requirement. “Establishing presentment as a mandatory prerequisite to suit reflects a legislative choice to permit the public employer to investigate any claim in full and to negotiate, arbitrate, compromise, or settle any such claim as it sees fit. Id. See Weaver v. Commonwealth, 387 Mass. 43, 47–48, 438 N.E.2d 831 (1982); Holahan v. Medford, 394 Mass. 186, 189, 474 N.E.2d 1117 (1985)”
The Appeals Court also ruled that “The failure of an authorized claimant to make a presentment within the two-year period prescribed by G.L. c. 258, § 4, was a fundamental obstacle to suit under the Act.” Furthermore the action was dismissed because the “complaint for wrongful death was not brought by the duly authorized executor or administrator on behalf of the heirs at law and next of kin.” Id.
Massachusetts medical malpractice lawyers
(Editors note: the plaintiff appeared to be in a quagmire because the case according to the Appeals Court was not presented properly as required by Mass law. Plaintiff also filed the case based on the same faulty presentment. Plaintiffs tried to cover their tracks by filing a probate case to be named executors but then the two years had expired and it was too late to make a proper presentment. To make matters worse, the Plaintiff was denied a request to change the name of the Plaintiff in the lawsuit to the proper name. It appears doubtful that it would have made any difference if the motion to amend the complaint was granted since the initial presentment was deficient and the two year wrongful death lawsuit deadline expired for proper presentment of the claim. What a mess! )
(Editors note: Did the MA wrongful death lawyers rush this claim to meet the 2 year presentment requirement deadline required by MA law? The presentment was only approximately 20 days prior to the two year deadline. A Probate case had not been opened and an executor had not been appointed and therefore the presentment was not in the name of the executor of the estate.)
It is unclear whether the MA medical malpractice lawyer was hired at last minute or the wrongful death attorney made a tragic mistake by waiting until the last minute and then not filing an estate and bringing the presentment by the executor or some other mistake was made. At the end of the day: what is clear- is that someone dropped the ball big time and a mistake was made. As a result the victim’s estate will not be compensated for this tragic death. (There is not enough information here to explain what went wrong.)
