The family of a North Carolina man is suing Google for negligence after he died from crashing into a creek below a collapsed bridge at the alleged direction of Google Maps, the Associated Press reported.
On September 30th, 2022, state troopers found Philip Paxson drowned in his overturned pickup truck beneath a bridge that had collapsed nearly a decade earlier.
Mr Paxson (47), from Hickory, North Carolina, was returning home from his daughter’s ninth birthday before the incident, his mother-in-law wrote in a post on Facebook. She added that neither the destroyed bridge nor the road leading to it had any barriers or warning signs to alert drivers of the hazard.
“It was a dark and rainy night and he was following his GPS which led him down a concrete road to a bridge that dropped off into a river,” the post reads. “He will be greatly missed by his family and friends. It was a totally preventable accident. We are grieving his death.”
In addition to Google, the Paxson family’s lawsuit names a number of private property management companies who were responsible for the land where the crash happened and for surrounding plots, according to the Associated Press.
In a statement to the Guardian, a Google spokesperson said: “We have the deepest sympathies for the Paxson family. Our goal is to provide accurate routing information in Maps and we are reviewing this lawsuit.”
Lawyers for the Paxsons allege that several people have tried to flag the washed-out bridge to Google and have included email correspondence between a Hickory resident who tried to use the “suggest an edit” feature in 2020 to get the company to address the issue. Google never responded to the suggestion, allege attorneys.
“Our girls ask how and why their daddy died, and I’m at a loss for words they can understand because, as an adult, I still can’t understand how those responsible for the GPS directions and the bridge could have acted with so little regard for human life,” Alicia Paxson, Mr Paxson’s wife, told the Associated Press.
Mr Paxson is not the first person whose death has been tied to GPS.
In 2020, a Russian motorist (18) froze to death after he and a friend were stranded in a vehicle for a week after following a Google Maps route through Serbia’s “road of bones”.
In 2019, a truck driver in Jakarta, Indonesia, drove off a cliff after following a Google Maps route that was only meant for motorcycles, the Straits Times reported.
In 2015, Zohra Hussain (51) died in a car crash in Indiana after her husband, who was following his Nissan Sentra’s built-in GPS, drove off an unmarked toll road that led to a demolished bridge. Her husband, sued the state of Indiana over the lack of barricades, according to the Chicago Tribune. – Guardia

I haven’t spoken about it much here, but it is the main cause for my mental distress. Besides a car accident being a traumatic experience and me realizing that my intense desire for perfection is so incredibly deep rooted that the thought of me doing something wrong makes me want to vomit and cry, my state is also actively trying to fuck me.
I am a medical marijuana patient and my state has a 0 tolerance policy for marijuana when it comes to driving. So every single med patient in the state is basically a walking dui, bc if the police find out your a patient, they can do a blood test. But if you’re a regular user (like me), there will be marijuana in your blood even in you haven’t used it for an extended period of time. I consume almost everyday bc anxiety and the horrors.
So when I got into my car accident in January, I sustained a concussion and the police officer did a field sobriety test. I failed bc I had a concussion…. But the officer took my blood anyway and if the 3 letters I got in the mail from defense attorneys are any indication, the state will be trying to charge me with a dui even tho I WAS NOT HIGH. I don’t drive while high. The thought of it makes me so anxious that I haven’t even tried it. Completely sober, I’ll get paranoid that I’m intoxicated somehow and am swerving and such (when I’m not) and I’ll get so in my head and panicked. So I don’t drive high.
In addition to this, I got a letter from the state requesting I get some forms filled out by a health care provider to assess if I am unfit to drive bc of some kind of condition, including a substance abuse disorder. If I don’t turn in the forms by Feb 29, they’ll start the process of suspending my license, and if they’re not in by March 30, my license will be suspended.
Well, I finally got health insurance last year after not having it for years. The only doctor I’ve seen since getting health insurance is a dermatologist bc I’ve got a chronic skin thing that causes lots of pain and discomfort when it flairs. I saw a primary care doc for the first time after my car accident to follow up. And I can’t seem to find a doctor who is “comfortable” filling out these forms for me. I asked the state what I should and they told me to go to an urgent care if I can’t get one of my doctors to sign the paperwork. I went to an urgent care and they told me that they legally cannot fill out the forms. So my current plan is to just try and get an appointment with random doctors to see if they will do it.
I’ve been trying so hard not to let the looming depression consume me, but the depression got hands. It feels inevitable to lose my license, and I’m just so fucking tired. I feel like I’ve been in this survival mode for my whole life and I try so hard to do the “right things”, but it doesn’t seem to even matter.
Unfortunately, the self harm and suicidal ideation are back. ✌️ I’m trying so hard, and it feels like the effort has never gotten me anywhere. Like maybe the issue is I should just lay down and take it. Surrender and submit. I know it’s the depression talking, but like I said this depression got hands. Can’t drown my demons, they know how to swim. And I’m barely treading water
I also feel so guilty for feeling this way. The accident showed me that there are actually a lot of people in my life who care about me, and I don’t want them to be disappointed. I don’t want to waste their support and let them down. I just really don’t want to be here. Never have, maybe never will

A robotic malfunction at Tesla’s Giga Texas factory resulted in a violent encounter where an engineer was attacked by one of the company’s robots, resulting in significant injuries and leaving a ‘trail of blood.’
According to the Daily Mail, while working on software programming for non-functional Tesla robots, the engineer was suddenly pinned against a surface by a robot tasked with manipulating aluminum car components, with its metal claws inflicted an injury that left an ‘open wound’ on the worker’s left hand.
“Two of the robots, which cut car parts from freshly cast pieces of aluminum, were disabled so the engineer and his teammates could safely work on the machines. A third one, which grabbed and moved the car parts, was inadvertently left operational, according to two people who watched it happen. As that robot ran through its normal motions, it pinned the engineer against a surface, pushing its claws into his body and drawing blood from his back and his arm, the two people said,” The Information reported.
Quick action was taken by Tesla workers who intervened and triggered the emergency shutdown button to halt the malfunctioning robot and prevent further injury to the engineer.
This incident came to light through a 2021 injury report filed to Travis County and federal regulators, which Daily Mail reviewed. Tesla is legally required to report such incidents to ensure the continuation of state-provided tax incentives.
Despite claims by Tesla that the engineer did not require time off following the event, an attorney representing the factory’s contract laborers suggests otherwise. Evidence hints at possible underreporting of workplace accidents, casting doubt on the official records.
Tumblr media
Daily Mail reported:
The injury report, which Tesla must submit to authorities by law to maintain its lucrative tax breaks in Texas, claimed the engineer did not require time off of work. But one attorney who represents Tesla’s Giga Texas contract workers has told DailyMail.com she believes, based on her conversations with workers there, that the amount of injuries suffered at the factory is going underreported. This underreporting, the attorney said, even included the September 28, 2021 death of a construction worker, who had been contracted to help build the factory itself. ‘My advice would be to read that report with a grain of salt,’ the attorney, Hannah Alexander of the nonprofit Workers Defense Project, told DailyMail.com. ‘We’ve had multiple workers who were injured,’ Alexander said, ‘and one worker who died, whose injuries or death are not in these reports that Tesla is supposed to be accurately completing and submitting to the county in order to get tax incentives.’
Elon Musk has yet to issue a formal statement in response to these allegations.
Just recently, Tesla revealed the second generation of its humanoid robot, Optimus Gen 2.
Optimus Gen 2 stands at a height of 5 feet 11 inches and weighs in at a light 121 pounds, shedding 22 pounds from the first model. It’s not just its frame that’s been upgraded; this robot can reach speeds up to 5 mph, which is a substantial 30% increase in velocity.

Boca Raton Auto Accident Guide: Claim Your Rights
Whether it's a minor fender bender or a devastating fatal accident that unfolded on the roads of Boca Raton or West Palm Beach today, the impact of any car accident can be profound.
Understanding the gravity of every situation, our dedicated team stands ready to provide the support and guidance you need. No matter the extent of the accident, we are here, available to listen, advise, and assist you through this challenging time.
Your call is not just a request for help; it's the first step towards securing your rights and finding a path to recovery.
WHAT SHOULD I DO IMMEDIATELY AFTER A CAR ACCIDENT IN BOCA RATON?
IMMEDIATE STEPS AFTER AN ACCIDENT
Tumblr media
Ensure Safety: First, make sure everyone involved in the accident is safe. Move vehicles out of traffic if possible without compromising safety.
Call 911: Florida law requires you to report any car accident that results in injuries, death, or significant property damage to the police. When you call 911, they will dispatch local law enforcement and emergency medical services if needed. For accidents in Boca Raton, the responding agency will likely be the Boca Raton Police Department or the Palm Beach County Sheriff's Office, depending on the exact location of the accident.
REPORTING TO LAW ENFORCEMENT
Boca Raton Police Department (BRPD): If the accident occurs within Boca Raton city limits, BRPD will typically take the report. You can contact them directly for non-emergency situations at their non-emergency number 561-368-6201.
Palm Beach County Sheriff's Office (PBSO): For accidents occurring in areas of Palm Beach County outside Boca Raton city limits, PBSO is the responsible agency. They also have a non-emergency contact number for reporting which is 561-688-3000.
LEGAL REQUIREMENTS FOR REPORTING
Florida Statutes Section 316.066: Florida law mandates that any crash resulting in vehicle damage of $500 or more, injuries, or death must be reported to the local police department, sheriff, or Florida Highway Patrol. This report is known as a Florida Traffic Crash Report and is filed by the officer who investigates the scene.
Personal Injury Protection (PIP): Florida is a no-fault state, requiring all drivers to carry PIP insurance. Reporting your accident promptly is crucial for PIP claims, which cover medical bills and lost wages regardless of who was at fault.
Tumblr media
Are You Entitled To PIP Benefits?
AFTER REPORTING THE ACCIDENT
Exchange Information: While waiting for law enforcement, exchange names, contact information, vehicle registration, and insurance details with the other driver(s).
Document the Scene: Take photographs of the accident scene, including all vehicles involved, any visible damages, and road conditions. This documentation can be invaluable for insurance claims and potential legal actions.
Witness Information: If there are witnesses, collect their contact information. Witness statements can provide crucial third-party perspectives on the accident.
Follow Up: After the accident, you can obtain a copy of the crash report from the responding agency. This report is essential for insurance claims and legal consultations.
Consult a Lawyer: Especially in cases of injury or significant damage, consulting with a Boca Raton car accident attorney can help you navigate the complexities of insurance claims and explore potential compensation beyond what PIP insurance covers.
Navigating the aftermath of a car accident can be overwhelming. Our Boca Raton personal injury attorney Kayla Sheldrick is ready to help you with every step, from filing a claim to negotiating with insurance companies. Reach out for a free consultation to ensure your rights are safeguarded.
Tumblr media
Do I Need a Lawyer For a Minor Car Accident in Boca Raton?
Even minor car accidents can have complicated legal and insurance implications. A lawyer can help you understand your rights, file claims such as property damage or a bodily injury claim, deal with insurance adjusters, and ensure you receive fair compensation for any damages or injuries, no matter how minor they seem. Florida's no-fault insurance laws and comparative negligence rules can affect your claim, making professional legal advice invaluable.
For any car accident in or around Boca Raton, big or small, having the right legal representation is important. Call us at (561) 440-7775 to discuss your case. Our accident attorney is committed to getting you the compensation and support you deserve.
Tumblr media
How Soon Should I See a Doctor After a Car Accident in Boca Raton?
Seeking medical attention immediately after a car accident, even if you feel fine, is crucial. Injuries like whiplash or internal bruising may not show symptoms right away. A prompt medical check-up ensures your well-being and strengthens any potential personal injury claim. Florida law allows up to 14 days to seek medical treatment to qualify for Personal Injury Protection (PIP) benefits, but sooner is always better.

Navigating Traumatic Brain Injury with a Skilled Attorney in New Jersey
Traumatic brain injury (TBI) is a serious medical condition that can result from various accidents and incidents, including car crashes, falls, sports injuries, and workplace accidents. The impact of TBI on an individual's life can be devastating, leading to long-term physical and cognitive impairments, emotional distress, and financial challenges. If you or a loved one has suffered a traumatic brain injury due to someone else's negligence or wrongdoing in New Jersey, it is crucial to seek legal assistance from an experienced attorney who can help you navigate the complexities of your case.
In this blog post, we will discuss the role and benefits of having a skilled traumatic brain injury attorney NJ. We will explore how such an attorney can assist you in obtaining compensation for your damages while protecting your legal rights and ensuring that you receive the medical care and support you need.
Tumblr media
Assessing Liability: One of the key roles of a traumatic brain injury attorney is to determine who was at fault for the accident that caused your injury. Your attorney will investigate the circumstances surrounding the incident, gather evidence such as police reports and witness statements, consult with experts if necessary, and evaluate all potential liable parties. Depending on the case specifics, liability may fall on another driver involved in a car crash, a property owner responsible for maintaining safe premises, an employer who failed to provide adequate safety measures at work or other individuals or entities whose negligence led to your TBI.
Calculating Damages: Another critical aspect of TBI cases is determining the extent of damages suffered by the victim. TBI can cause severe physical limitations such as paralysis or loss of motor function; cognitive impairments like memory loss or difficulty concentrating; emotional problems such as anxiety or depression; and economic losses such as medical bills and lost wages. Your traumatic brain injury attorney in New Jersey will work with you to quantify the full scope of your damages, taking into account both past and future costs and losses. This may involve consulting with medical professionals, vocational experts, and economists who can provide expert testimony in court.
Negotiating Settlements: In many cases, TBI claims can be resolved through settlement negotiations between the victim's attorney and the liable party or their insurance company. Your lawyer will use their experience and negotiating skills to pursue a fair and just settlement that covers all of your damages adequately. They will also protect you from being pressured into accepting an inadequate offer or signing away your legal rights before fully understanding the implications.
Representing You in Court: If a settlement cannot be reached, your traumatic brain injury attorney in New Jersey will prepare your case for trial and represent you in court proceedings. They will present evidence, cross-examine witnesses, make arguments on your behalf, and advocate for your interests throughout the legal process. Having a skilled litigator on your side can significantly increase your chances of obtaining a favorable outcome at trial.
Providing Emotional Support: Finally, it is crucial to recognize that TBI cases can be emotionally challenging for victims and their families. A compassionate traumatic brain injury attorney in New Jersey understands this aspect of the situation and provides not only legal guidance but also emotional support throughout the case's duration. They can connect you with resources such as support groups or therapy services that can help you cope with the impact of TBI on your life.
Conclusion:
If you or someone close to you has sustained a traumatic brain injury due to someone else's negligence or recklessness in New Jersey, do not hesitate to seek legal assistance from an experienced attorney who understands the complexities of TBI cases. With their knowledge, skillset, and empathy, they can help you navigate this difficult time while fighting for justice on your behalf. Contact a reputable law firm today for a free consultation and start your journey towards recovery and compensation.

Chicago Justice Season 1 Ep. 2 "Uncertainty Principle"
Tumblr media
Dawson faces an uncomfortable situation when the State's Attorney's office accuses Officer Kevin Atwater of using excessive force to apprehend a man accused of drug dealing, who later died in custody. As a result, Stone is compelled to charge Atwater with murder.
If you want to watch the series for yourself, stop reading! This post contains spoilers to the storyline.
ASA Anna Valdez arrives at Chicago PD and asks Sergeant Trudy Platt to see Adrian Carrera, who is in the drunk tank with his lawyer, Arnold Rifking. Carrera is offered a plea of 20 years, for today only, by Peter Stone. Rifking rejects the plea on assault charges. Anna informs him that the victim died at Chicago Med and they are filing murder charges.
Tumblr media
As she leaves, the lawyer tells her that he is also representing the man in the drunk tank beside Carrera, Justin Wilkes. She says that if she doesn't hear from him by 2 pm, she will put the case before the grand jury. Carrera told them to shove their offer, and Stone tells her that she will be first chair on a murder case. As she experiences a moment of excitement, Rifking calls her to inform that the client next to Carrera has passed away. He is currently at the hospital with the client's mother, Mrs. Wilkes.
At the hospital, she learns from Rev. Fitch that he is ensuring their office investigates Justin's death thoroughly. Justin did not die of natural causes; he passed away from fatal injuries while in police custody. She watches as the mother says goodbye to her deceased son.
Stone and Anna meet with Mark Jefferies and share all the information they have about Wilke's case. He instructs them to act quickly, beginning at the hospital and working backwards. With Rev. Fitch on the case, Rifking's tenure as Wilkes' lawyer will be short-lived.
Stone discovers from the ME that, regardless of his level of intoxication, the moment the sternum broke, the victim was doomed. It is evident that the injury was cause by a blow to the chest, which is typical of car accidents. She informs him that she is designating the cause of death as homicide.
Antonio Dawson and Laura Nagel discover that it took the ED over five hours to reach Justin. Laura questions how they knew he was drunk if no one examined him. The nurse states that some of their regular patients are drunks but is uncooperative in providing further information. She only reveals that he died from exsanguination. Laura and Antonio were startled when EMS informed them that Justin smelled of alcohol and had vomited all over them during a call to rescue an 8-year-old who had been pulled from the lake with no pulse. As they walked away, Laura reminded Antonio not to get sick, and he replied with a sarcastic comment about not being a black male. One of the paramedics shouted to them that the child from the lake had survived.
Antonio and Laura then went to the Chicago PD to speak with the Detective. Officer Kevin Atwater arrested Justin, whom he knew from their childhood. Atwater explains the events leading up to the arrest and subsequent death of Justin. When asked if he followed proper restraint procedures, Atwater explains that Justin was resisting arrest and he used reasonable physical force to subdue him. He then slams his locker and brushes past Antonio.
Antonio defends Kevin. Rifking brings in his client Carrera, who claims to have information from the night Wilkes died. Carrera says Wilkes might have told him a cop hit him. Rifking offers a deal, but Stone turns it down. Meanwhile, Antonio requests video coverage before throwing Kevin Atwater to the wolves to keep the peace. He promises to have it in a couple of hours.
Jefferies meets with Mrs. Wilkes and Rev. Fitch. Fitch produces cellphones for people who are afraid to go to the police. He offers them to Jefferies, claiming that Justin was definitely murdered. Antonio and Laura watch the videos of Kevin Atwater's arrest. Antonio supports Atwater, but Laura reminds him that they are partners now. Atwater tells Antonio that he should have just been allowed to sell his drugs because it will always be someone's child. The group gathers to review what they know about the case so far.
Antonio tells Anna that she knows Atwater. Stone also mentions that he knows Sergeant Hank Voight's unit and wouldn't describe them as shrinking violets. He takes no pleasure in going after a cop, especially someone like Kevin Atwater. Antonio advises him to drop it, but Stone reminds him that their obligation is to the victim and his family. Antonio grabs his coat and says he doesn't have to be a part of it.
Antonio updates Voight on his efforts and expresses concern about the possibility of Kevin being the killer. Voight responds that if Kevin did kill the victim, then the victim deserved it. Stone decides to pursue legal action against the police officer who arrested Wilkes, the EMTs who delayed his transport to the hospital, and the doctors who failed to treat him in a timely manner. He was made a ward of the state upon his arrest. The EMTs and doctors treated him poorly, as if he was not worth saving. In the end, he became a victim of murder.
At a bar, Stone explains that he is not suggesting a conspiracy, but rather it was the collective actions or lack of actions that led to the victim's death. She reminds him that this concept does not exist in the criminal code. Paul Robinette, who served with Stone's father in NYC, arrives and defends police officers. After Voight called him, he came to help Atwater. Robinette has a motion to preclude grand jury action, but Stone informs him that this does not exist in Chicago. Robinette suggests letting the presiding judge make the call.
During the court proceedings, the judge requested an hour to review Robinette's request for all subpoenas from the ASA office. The lawyers argued about the preclusion. Stone did not pay attention to Kevin Atwater's characteristics until after the trial. Robinette mentioned that Stone reminded him of his father, but Stone quickly dismissed the comment, stating that his father has nothing to do with the way he practices law. Peter is advised to call his father and apologize. Stone denies any knowledge of the situation, but Robinette believes otherwise.
In court, the judge denies his motion. Anna returns to Jefferies' office and reports that the grand jury has indicted Kevin Atwater for first-degree murder. Stone bows his head as Jefferies orders them to obtain an arrest warrant within the hour and execute it immediately. Stones says Atwater would turn himself in, but Jefferies orders him to work on all the reasonable doubt they handed Robinette.
Antonio brings Atwater in as Jefferies gives a press conference. Antonio defends Chicago PD and confronts Stone for accusing Atwater of causing the victim's death.
Tumblr media
The medical examiner confirms that the victim suffered blunt force trauma to his rib cage, which caused it to splinter. Stone presents videos of the arrest, and the medical examiner admits that the arrest could have caused the injuries. The victim died at 4:06 pm, and Atwater arrested him at 7:10 am. Robinette brings up that Stone attempted to indict the EMTs and doctors for not knowing the true cause of Justin's death. Witnesses from the neighbourhood knew Justin Wilkes as a drug dealer.
Antonio tells Kevin that he did what he could, but Atwater is upset that it obviously wasn't long enough. They used to ride together, but everything has changed now that Antonio has moved to a bigger house. The defendant is upset that a black woman testified today, implying that he is betraying his community by being a police officer. Due to death threats, his younger siblings are currently staying in a hotel. Antonio has offered to take them in until Kevin is cleared. Atwater suggests that it may be too late and that he may have killed the victim or used excessive force. Antonio reminds him that they act for the right reasons.
Stone is experiencing a crisis of conscience after Robinette's assertion that several people were responsible for Justin's death. Jefferies inquires about Carrera, the jailhouse snitch, and whether he knows for a fact that he is lying. Carrera claims that Justin told him that the arresting officer had beaten him severely. The court adjourns until the following day.
Tumblr media
Stone and Robinette discuss how a criminal's testimony carries more weight than that of a police officer. Robinette requested that the charges be reduced to aggravated assault with a six-month probationary period, but Stone declined and proposed a one-year sentence. During the court proceedings, Kevin Atwater provided a testimony of the events, while Antonio exited the courtroom.
Laura wants to talk about something, but Antonio doesn't. She shares a childhood story with him, telling him that she has learned to pick a side and stick with it. She tells him that she is happy he is her partner. Antonio reviews the case and discovers that there was no blood tox report and no vomit on him.
Anna and Stone arrive at the prison and inform Carrera that his deal is off the table. Stone tells Carrera that he has only two choices: concurrent or consecutive sentences. He is now being charged with Justin's murder on top of the man he killed in the bar. Carrera admits that he killed him for a cigarette.
Tumblr media
Back in court, Stone vacates kevin Atwater's sentence and charge. He admits to Atwater that sometimes they get it wrong and apologizes to him. Antonio and Atwater nod to each other. Robinette shakes hands with Stone and tells him that his father would be proud of both of them. Antonio visits Stone's office and apologizes, telling him not to worry. Stone picks up his baseball and calls his father.

Post 730
He sat silently in his chair and looked down at the table in front of him. His attorneys passed him Kleenex when he began to cry. His hands were cuffed in front of him, so he couldn’t reach.
Joseph Leonard, New Hampshire inmate 118381, born 1982, incarceration intake in 2019 at age 37, scheduled for parole consideration 01/24/2024, with full release 09/14/2031
Negligent Homicide, Aggravated DWI
So many of Tyler Shaw’s friends and family came to Merrimack County Superior Court that the clerk was taking a headcount to ensure the crowd’s size didn’t break fire codes.
Shaw’s parents, grandparents, brother, former teachers, friends and co-workers sat in rows all wearing ribbons decorated with red for drunk driving awareness and camouflage in honor of Tyler’s love for fishing. They held posters of him visiting his best friend Nate in Montana, posing with his parents after a lacrosse game, standing outside his beloved black truck – the same truck he was driving the night he was killed.
Only four of them addressed the judge, but they spoke for many.
“This proceeding is our last hope that the Merrimack County justice system does the right thing and provides the justice that Tyler deserves by imposing a sentence to Joseph Leonard that may make somebody in the future think twice about driving drunk,” Tyler’s uncle, Keith Hickey, said.
In addition to Hickey, Tyler’s grandfather, his mother and one of his closest friends all asked Judge Richard McNamara for the same thing: To reject the plea deal in front and impose a stronger sentence on Joseph Leonard Jr.
In the end, the judge recognized the family’s plea and sentenced the man who killed Shaw to an extra year in jail.
Joseph Leonard, 37 of Derry, was sentenced to six- to 12 years in the New Hampshire State Prison. He will be eligible to have his sentence shortened by six months if he undergoes drug treatment and education programming.
Leonard will not be able to get his license renewed until 10 years after he is released. If and when he does drive again, he will have to use an ignition interlock device, which requires drivers to take a sobriety test before their car will start.
Leonard pleaded guilty to felony charges of negligent homicide and aggravated driving while intoxicated in connection with Shaw’s death.
Assistant County Attorney Carley Ahern recommended a sentence of five to 10 years on the negligent homicide charge and a concurrent sentence of 3½ to seven years on the aggravated DWI charge. A five-year prison sentence was previously agreed to by attorneys, Tyler’s mom, Beth Shaw, said.
However, she didn’t think the deal was fair given Leonard’s history of drunken driving. The crash that killed Shaw off Interstate 89 in Bow on April, 30, 2018 marked the third time that police had arrested Leonard for drunken driving. Leonard was first arrested as a teenager. And just eight years ago, his impairment caused an accident in which he was injured.
Tyler’s put up an electronic sign on Logging Hill Road at the site where 20-year-old  Shaw was killed. “3 DWI, 1 FATAL, 5 YR PLEA?” it read.
“If the murder of my 20-year-old son by a man whose driving record is littered with drunk driving crimes does not deserve the maximum sentence lawmakers assign the charge of negligent homicide, who does?” Beth Shaw asked McNamara. “How many people does a man need to kill to serve seven and a half years? Have we become complacent enough to think Tyler's young life does not deserve the maximum sentence?”
“Please do not let Mr. Leonard’s history be repeated,” Beth Shaw added. “Please do not let our history be repeated. Too many innocent people are dying at the hands of drunk drivers.”
The maximum sentence for negligent homicide is 7 ½ to 15 years.
McNamara said Leonard’s history of driving intoxicated was a major factor in raising his sentence.
“It wasn’t a homicide, but it wasn't an accident. It was a tragedy," McNamara said. “The aggravating factors are of course, this is a third DWI with an interlock violation.”
“I thought the sentence, while in the ballpark, was slightly below what I think is appropriate,” McNamara said, of the sentence proposed by attorneys.
Leonard said he chose not to allow his family and friends to speak on his behalf out of respect for the Shaw family. He sat silently in his chair and looked down at the table in front of him. His attorneys passed him Kleenex when he began to cry. His hands were cuffed in front of him, so he couldn’t reach.
“I’m not here today to make excuses, or to ask for forgiveness, not because I don’t seek forgiveness, but because I know my actions are unforgivable. I am here today to accept the responsibility and punishments for my actions as a parent, significant other, sibling, uncle and friend myself. I can’t begin to imagine what Tyler Shaw’s friends and family have had to go through because of my actions,” Leonard said.
“I can completely understand why they would see a five-year prison sentence not being justice for Tyler Shaw. But I can promise that no amount of prison time will compare in any way to the guilt, mental and emotional sentence I will continue to put myself through every single day for the rest of my life,” Leonard said. “Every time I close my eyes, I re-live that night, moment by moment in slow motion and when I finally wake up and look at myself in the mirror, I know that I’m the person responsible for cutting short Tyler Shaw’s life short and destroying a family. To say that I’m sorry, regretful, remorseful and ashamed with myself would be a complete understatement.”
Others who spoke to the judge continued to express the profound loss they’ve experienced since Tyler’s death.
“In life and death, Tyler has brought us all together. You see these people behind me? They’re here because of the immense impact Tyler had on their lives. I can assure you that there are many, many more people,” said Lexi Demetriou, who graduated with Shaw from Concord High School in 2015.
“Tyler was one of those friends that you knew you would have for the rest of your life,” she added.
Tyler’s grandfather David spoke about Tyler’s willingness to lend a hand to those in need, to stand by his family, his zest for life.
“He was a fine young man who worked hard and wanted to make the world a better place. He lived his life to the fullest, loved and cared deeply for his family and cherished true friendships. He left a positive impression on all those who truly knew him,” he said.  “No one else should  h ave to go through what our  family and Tyler’s friend s  have gone through for the past 18 months.”

Understanding Personal Injury Claims: A Comprehensive Guide | RG Injury Law
Tumblr media
Personal injury claims are a legal process by which an individual seeks compensation for damages sustained due to someone else’s negligence. Personal injuries can occur in various situations, including car accidents, slips, falls, dog bites, medical malpractice, etc. If you have been injured in an accident, it is essential to understand the personal injury claims process and your legal rights. This guide will explain the personal injury claims process in detail.
Step 1: Seek Medical Attention
The first and most important step after an accident is to seek medical attention. Even if you feel fine, it is crucial to have a medical professional evaluate you for any hidden injuries or underlying conditions that may not be visible to the naked eye. This medical report will also be essential evidence for your personal injury claim.
Step 2: Gather Evidence
The next step is to gather evidence. That includes taking photos of the accident scene, including any damage to vehicles or property, and collecting contact information for any witnesses. Keep track of any medical bills, lost wages, and other expenses related to your injury.
Step 3: Contact an Attorney
It is always best to consult with an experienced personal injury attorney to determine if you have a viable claim. A personal injury attorney can provide guidance on the legal process, negotiate with insurance companies, and represent you in court if necessary.
Step 4: File a Claim
Once you have decided to pursue a personal injury claim, your attorney will file a claim with the insurance company of the at-fault party. The insurance company will investigate the claim and determine whether to accept or deny liability.
Step 5: Negotiate a Settlement
If the insurance company accepts liability, your attorney will negotiate a settlement. This settlement should cover all your medical expenses, lost wages, and other damages related to your injury. Your attorney may recommend taking the case to court if a settlement cannot be reached.
Step 6: Litigation
If your case goes to court, your attorney will represent you and present evidence to support your claim. The court will then decide whether to award you damages and the award amount.
Types of Damages
There are two types of damages that may be awarded in a personal injury claim: economic and non-economic.
Economic damages such as medical bills, lost wages, and property damage are easily quantifiable. These damages can be proven with invoices, receipts, and other documentation.
Non-economic damages are more subjective and include pain and suffering, emotional distress, and loss of enjoyment of life. These damages are more difficult to quantify but can still be awarded in a personal injury claim.
Statute of Limitations
It is important to note that there is a statute of limitations on personal injury claims. This means that there is a specific deadline by which you must file a claim. In most cases, the statute of limitations is two to three years from the date of the accident, but this can vary depending on the state and the type of claim.
Conclusion
Personal injury claims can be complex and require the expertise of an experienced attorney. If you have been injured in an accident, seeking medical attention, gathering evidence, and consulting with a personal injury lawyer as soon as possible is essential. An attorney can guide you through the legal process, negotiate with insurance companies, and represent you in court if necessary. Remember that there is a statute of limitations on personal injury claims, so acting quickly to protect your legal rights is essential.

Steps to Take Filing a Motor Vehicle Accident Claim in NJ
Tumblr media
Motor vehicle accidents in New Jersey can be distressing and life-altering experiences. When you or a loved one is involved in a car crash, it's important to understand the steps to take when filing a motor vehicle accident claim. These steps are essential for ensuring your rights are protected, seeking compensation for damages, and navigating the complex legal and insurance processes. In this blog, we'll guide you through the crucial steps involved in filing a motor vehicle accident claim in New Jersey.
Step 1: Ensure Safety and Seek Medical Attention
Immediately after an accident, the safety and well-being of all involved parties should be the top priority. Ensure that everyone is out of harm's way and call for medical assistance if necessary. It's essential to get a medical evaluation even if you don't appear to be seriously injured, as some injuries may not manifest immediately but could have long-term consequences.
Step 2: Contact Law Enforcement
In New Jersey, it is generally required to report any accident involving injuries, fatalities, or property damage exceeding $500 to the local law enforcement agency. Contact the police and request an officer to come to the scene of the accident. They will prepare a police report, which is an important document for your accident claim.
Step 3: Gather Evidence
While at the accident scene, collect as much information as possible. This includes:
Exchange Information: Obtain contact and insurance information from all parties involved in the accident. This information is vital for the insurance claim process.
Witness Statements: If there are witnesses to the accident, collect their contact information and statements. Their testimony can be invaluable in establishing fault.
Photographs: Take pictures of the accident scene, vehicle damage, road conditions, and any visible injuries. Visual evidence can be compelling in proving your case.
Step 4: Seek Medical Treatment
Even if your injuries seem minor, it's important to see a healthcare professional promptly. This not only ensures your health but also creates a medical record of your injuries, which is crucial for your claim. Delayed medical treatment can weaken your case, as insurance companies may question the severity and cause of your injuries.
Step 5: Notify Your Insurance Company
Report the accident to your insurance company as soon as possible. Even if you are not at fault, your insurance company needs to be informed. Be prepared to provide them with the basic details of the accident. Avoid making any statements or admissions to the insurance adjuster that could be used against you later.
Step 6: Consult an Attorney
Consider consulting with a skilled motor vehicle accident attorney in New Jersey. An experienced attorney can provide invaluable guidance through the claim process, help you understand your rights, and ensure that you receive fair compensation. They can also assist in dealing with insurance companies and navigating legal complexities.
Step 7: Determine Fault and Liability
In New Jersey, the concept of comparative negligence is used to determine liability. This means that fault can be distributed among multiple parties involved in the accident. New Jersey follows a modified comparative negligence rule, where you can recover damages if you are less than 50% at fault. Your attorney will help investigate the accident, gather evidence, and establish fault, which is crucial for determining the compensation you are entitled to.
Step 8: File a Personal Injury Claim
If you've sustained injuries in the accident, you may be eligible to file a personal injury claim to seek compensation for medical expenses, pain and suffering, lost wages, and more. Your attorney will guide you through the process of filing a personal injury claim, ensuring that it is properly documented and filed within the statute of limitations in New Jersey, which is typically two years from the date of the accident.
Step 9: Negotiate with Insurance Companies
Insurance companies will often attempt to settle motor vehicle accident claims quickly and for the least amount possible. Your attorney will negotiate with the insurance companies on your behalf, ensuring that you receive a fair settlement that covers your damages. If the initial settlement offer is inadequate, your attorney will work to secure a better outcome, even if it requires litigation.
Step 10: Prepare for Litigation (if Necessary)
If a fair settlement cannot be reached through negotiation, your attorney may recommend pursuing a lawsuit. This involves initiating legal proceedings, presenting your case in court, and letting a judge or jury determine the compensation you are entitled to. Litigation can be a lengthy and complex process, but your attorney will guide you through every step.
Conclusion
Filing a motor vehicle accident claim in New Jersey is a multifaceted process that requires careful attention to detail, a deep understanding of the law, and the ability to navigate insurance negotiations. By following the steps outlined in this blog and enlisting the expertise of a qualified motor vehicle accident attorney in New Jersey, you can maximize your chances of obtaining fair compensation for your injuries, damages, and losses. It's crucial to act promptly, protect your rights, and seek the support you need to effectively address the aftermath of a motor vehicle accident.
