#but i don't actually know the complete law on text messages as evidence

ok but what about an emotionally charged scene full of sexual tension in a courtroom where they’re speaking in that intense, not-really-yelling way at the denouement of their layered, complex relationship
i just realised how vague this sounds to anybody who doesn’t know what’s going on - so its a lawyer au where steve’s kid peter is on trial for a crime he didn’t commit, and steve’s called his ex tony to represent him
//
“Let me - let me get this straight, my son’s ex boyfriend was dating the boy that was killed, the guy that Peter is now being accused of killing and you didn’t think to tell me?”
Tony clenches his jaw, “Peter is my client. I couldn’t legally give you that information without jeopardising his confidentiality”
“He’s my son!” Steve roars, “fuck your confidentiality I deserved to know damnit!”
“He asked me not to tell you Steve,” Tony says in a softer tone, almost apologetic, “I’m sorry but I couldn’t break confidentiality”
“Hey look - murder is a common law offence, and its a crime of specific intent. The fact that Peter and the victim are eskimo brothers isn’t enough to prove specific intent; and I can get the text messages dismissed from evidence on account of the way that they were obtained and the fact that Peter -”
Steve holds up his hands, “Hold up, text messages? What text messages?”
Tony’s eyes widen for a moment, because he schools his expression into something more neutral, “The prosecution found text messages between Peter and the victim the night he went missing. But Peter swears that he lost his phone a couple days back so I can probably get it dismissed; or argue it out in court”
Steve scoffs, “Is there anything else you’re keeping from me Tony?”
There’s a flash of hurt in Tony’s features, but its gone so quickly that Steve’s convinced he imagined it.
“Nothing else that I can confirm or deny at this moment. Steve, I’m bound by client confidentiality please tell me you understand that”
“You know,” Steve says conversationally, “I thought I was doing the right thing by bringing you in on this case, because you’re the best damn lawyer I know. But I forgot how much you ruin things with your secrets. I should’ve known better after Harvard”
The minute the words leave his mouth, Steve wants to take them back.
Tony’s face hardens, and he slaps his files shut, and this time - Steve isn’t imagining the hurt in his eyes, “I was discussing the case with you as a courtesy Mr. Rogers,” he says coolly, “but I think you’ve overstayed your welcome. You can see yourself out”
Steve gets up from his chair, buttoning up his blazer, and nods - unsure of how to fix what he just broke. He looks back one final time before the elevator doors open, but Tony isn’t looking back at him; he’s poring over the case files.
From where he’s standing, Steve thinks he can make out the faintest glimmer of wetness on Tony’s cheek and for the second time in twenty years - he finds himself walking away from the love of his life
