Last month, a court in Kenya issued a landmark ruling against Meta, owner of Facebook and Instagram. The US tech giant was, the court ruled, the “true employer” of the hundreds of people employed in Nairobi as moderators on its platforms, trawling through posts and images to filter out violence, hate speech and other shocking content. That means Meta can be sued in Kenya for labor rights violations, even though moderators are technically employed by a third party contractor.
Social media giant TikTok was watching the case closely. The company also uses outsourced moderators in Kenya, and in other countries in the global south, through a contract with Luxembourg-based Majorel. Leaked documents obtained by the NGO Foxglove Legal, seen by WIRED, show that TikTok is concerned it could be next in line for possible litigation.
“TikTok will likely face reputational and regulatory risks for its contractual arrangement with Majorel in Kenya,” the memo says. If the Kenyan courts rule in the moderators’ favor, the memo warns “TikTok and its competitors could face scrutiny for real or perceived labor rights violations.”
The ruling against Meta came after the tech company tried to get the court to dismiss a case brought against it and its outsourcing partner, Sama, by the South African moderator, Daniel Motaung, who was fired after trying to form a union in 2019.
Motaung said the work, which meant watching hours of violent, graphic, or otherwise traumatizing content daily, left him with post-traumatic stress disorder. He also alleged that he hadn’t been fully informed about the nature of the work before he’d relocated from South Africa to Kenya to start the job. Motaung accuses Meta and Sama of several abuses of Kenyan labor law, including human trafficking and union busting. Should Motaung’s case succeed, it could allow other large tech companies that outsource to Kenya to be held accountable for the way staff there are treated, and provide a framework for similar cases in other countries.
“[TikTok] reads it as a reputational threat,” says Cori Crider, director of Foxglove Legal. “The fact that they are exploiting people is the reputational threat.”
TikTok did not respond to a request for comment.
In January, as Motaung’s lawsuit progressed, Meta attempted to cut ties with Sama and move its outsourcing operations to Majorel—TikTok’s partner.
In the process, 260 Sama moderators were expected to lose their jobs. In March, a judge issued an injunction preventing Meta from terminating its contract with Sama and moving it to Majorel until the court was able to determine whether the layoffs violated Kenyan labor laws. In a separate lawsuit, Sama moderators, some of whom spoke to WIRED earlier this year, alleged that Majorel had blacklisted them from applying to the new Meta moderator jobs, in retaliation for trying to push for better working conditions at Sama. In May, 150 outsourced moderators working for TikTok, ChatGPT, and Meta via third-party companies voted to form and register the African Content Moderators Union.
Majorel declined to comment.
The TikTok documents show that the company is considering an independent audit of Majorel’s site in Kenya. Majorel has sites around the world, including in Morocco, where its moderators work for both Meta and TikTok. Such an exercise, which often involves hiring an outside law firm or consultancy to conduct interviews and deliver a formal assessment against criteria like local labor laws or international human rights standards, “may mitigate additional scrutiny from union representatives and news media,” the memo said.
Paul Barrett, deputy director of the Center for Business and Human Rights at New York University, says that these audits can be a way for companies to look like they’re taking action to improve conditions in their supply chain, without having to make the drastic changes they need.
“There have been instances in a number of industries where audits have been largely performative, just a little bit of theater to give to a global company a gold star so that they can say they're complying with all relevant standards,” he says, noting that it’s difficult to tell in advance whether a potential audit of TikTok’s moderation operations would be similarly cosmetic.
Meta has conducted multiple audits, including in 2018, contracting consultants Business for Social Responsibility to assess its human rights impact in Myanmar in the wake of a genocide that UN investigators alleged was partially fueled by hate speech on Facebook. Last year, Meta released its first human rights report. The company has, however, repeatedly delayed the release of the full, unredacted copy of its human rights impact report on India, commissioned in 2019 following pressure from rights groups who accused it of contributing to the erosion of civil liberties in the country.
The TikTok memo says nothing about how the company might use such an assessment to help guide improvements in the material conditions of its outsourced workers. “You'll note, the recommendations are not suddenly saying, they should just give people access to psychiatrists, or allow them to opt out of the toxic content and prescreen them in a very careful way, or to pay them in a more equal way that acknowledges the inherent hazards of the job,” says Crider. “I think it's about the performance of doing something.”
Barrett says that there is an opportunity for TikTok to approach the issue in a more proactive way than its predecessors have. “I think it would be very unfortunate if TikTok said, ‘We’re going to try to minimize liability, minimize our responsibility, and not only outsource this work, but outsource our responsibility for making sure the work that's being done on behalf of our platform is done in an appropriate and humane way.’”

Amid the implementation struggles of crypto project Worldcoin in Kenya, Worldcoin CEO Alex Blania has been accused by the Kenyan lawmakers of data fraud saying the project’s arrival to Kenya looks like “a gang of criminals who are coming to harvest data from young people.” Worldcoin Faces Scrutinization From Kenyan Lawmakers Kenyan lawmakers and authorities continue to scrutinize the controversial Worldcoin project in the country, resulting in Worldcoin CEO Alex Blania having to answer to lawmakers on Wednesday, September 6, 2023. Blania’s questioning comes amidst the suspension of Worldcoin activities in the country by the Kenyan government on August 2, 2023. The CEO had to appear before the Kenyan parliamentary ad hoc committee, a 17-member committee set up by the Kenyan government to investigate the operations of the American-based Cryptocurrency firm Worldcoin, to respond to allegations of illegal operations and data mining in the country. The project sparked concerns in the country when the Kenyan authorities discovered that it was not officially registered and over 350,000 Kenyans had signed up for Worldcoin and scanned their eyeballs with the project in exchange for free $49 worth of WLD tokens valued 7000 Kenyan shillings.  However, CEO Alex Blania responded to these allegations claiming that the project has been connected with the Kenyan’s Office of the Data Commissioner Immaculate Kassait since April 2022, having the firm registered as a data controller, not a limited company. In addition, he stated that the firm was under no obligation to get registered under Kenyan laws, so the firm had to work with local partners who had that obligation. Blania further defended the project saying Worldcoin is solving a critical challenge on the internet: proof-of-personhood and that the project had abided by all the country’s data and registration requirements. “We wish to emphasize the Worldcoin project’s long-term commitment to Kenya. Our commitment to the people of Kenya is genuine, and we have at all times endeavored to operate honestly, compliantly, and above all, transparently,” Blania opined. “All the personal and biometric data collected in Kenya is securely stored on servers either in the US, Italy, Germany, Poland, or South Africa.” Worldcoin’s chief legal officer Thomas Scott also told the Kenyan parliamentary ad hoc committee that Worldcoin was not mining data from Kenyans for malicious activities after the committee implied that worldcoin was duping Kenyans into surrendering critical identifying Information without guarantees on the use and Security of the data collected. However, Kenya’s regulator has given the firm a one-year ban, and the company only be allowed to operate again once it undergoes a Security audit, allows the government access to the collected data, registers with the Business Registration Services (BRS), and establishes a local representative. Susan told her fellow lawmakers that initial inquiries found the company’s iris scanning technology potentially exposed hundreds of thousands of Kenyans to health Risks.  She further added that there may be Kenyans out there already experiencing different complications or changes in their bodies after undergoing the scan. Therefore, she recommends that individuals seek medical help if they develop any abnormal conditions. Samantha Ngina Uhuru’s Youthful Niece Who Bagged Sh84 Million COVID-19 Tender
As the famous saying goes, One Man’s Meat is Another Man’s Poison.
While the rest of the world battled the unprecedented COVID-19 pandemic and its life-changing effects, a select few local and global entrepreneurs took advantage of the global gloom to turn around their fortunes and enjoy abnormal profits.
Despite businesses being some of the worst-hit victims of the deadly outbreak, some innovators, manufacturers, contractors and e-commerce investors collectively shared some of the biggest chunks of Coronavirus millions which circulated as nations rushed to respond to a virus which, in many ways, somewhat sparked a new world order.
Here in Kenya, a long list of companies that were previously grappling with brutal impacts of the harsh economic conditions suddenly roared back to life thanks to lucrative government tenders which saw them cash in millions.
According to Daily Nation, Uhuru Kenyatta received roughly Sh223 billion from several international players as part of his COVID-19 warchest.
The money was wired to Central Bank within 60 days and as the publication further revealed, Kenya Medical Supplies Authority (KEMSA) was the highest recipient of the funds since the government solely trusted the institution with the procurement of medical equipment.
Once the ‘great’ news hit the streets, some of the country’s biggest tenderpreneurs pitched camp at KEMSA offices yearning for a piece of the gigantic pie.
During the heat of the moment, some even chartered planes to China to physically fly in COVID-19 medical supplies while others prefered to wait for the goods (personal protective gear, ventilators and other medical items) to land in Nairobi, then snap them up in bulk.
A different group chose the strategy of waylaying nations at the airport and diverting them to private warehouses, waiting for the procurement whistle to be blown.
Records show that between the time Ministry of Health announced that the virus had come into the country and June 4, one State agency channelled close to Sh2 billion to nine companies for the government’s response to the pandemic.
This period of rushed resolutions gave some government ministries and county officials the perfect cover to break procurement laws, and order goods worth billions of shillings in bulk from little known companies and briefcase entities, some of which lacked the capacity to deliver.
The supply of PPEs and masks proved to be the most lucrative for companies, with many selling a single PPE kit for Sh9,000 and one KN95 mask for Sh700.
One such incident which stood out is that of one Ivy Minyow Onyango (barely 30 years old), who on January 22 (weeks before the pandemic’s first case was reported in Africa) walked into the companies registry and enrolled an entity named Kilig Limited.
Several weeks later, her company was handpicked and handed a Sh4 billion offer to supply hundreds of thousands of Personal Protective Equipment (PPEs), with each kit set to be delivered at an inflated cost of Sh9,000, from the then market price of Sh4,500, according to recent revelations in Parliament.
In another incident which somehow vindicates former Prime Minister Raila Odinga’s profound declaration during a 2016 press conference, another one of the firms reported to have received the mouth-watering tenders is Ziwala Limited, a firm deeply associated with members of President Uhuru Kenyatta’s family.
For a quick refresh of the mind, in October 2016, the then NASA Leader Raila Odinga called a press conference at his Capitol Hill Office where he sensationally accused President Uhuru Kenyatta’s extended family of being involved in the alleged Sh5.2 billion scandal at the Ministry of Health which was then under investigation (and has never been resolved to this day).
In front of the glaring cameras, Raila cited internal audit reports of the Ministry of Health (MOH) to show that Sandales International Ltd, which had been paid Sh41 million by Ministry of Health was owned by President Uhuru’s sister Ms Nyokabi Muthama, cousin Ms Kathleen Kihanya and Mr Samson Kamiri as directors.
“This scandal is President Kenyatta’s. He must deal with it as such. He must tell the country what he knows when he knew it and what he did when he knew it!” thundered an angry Odinga.
His words from four years ago are now once again as relevant.
According to the companies registry, Ziwala Limited is owned by Samantha Ngina Muthama (daughter to the President’s younger sister Nyokabi Muthama) and June Nduta Kinyua.
The firm was awarded a Sh84million tender to supply 120,000 pieces of KN95 masks, with KEMSA procuring the masks at an inflated price of about Sh700 per piece.
The retail price at the time was Ksh 500 per piece.
Samantha Ngina and June Nduta Kinyua Besides being cousins, Kathleen Kihanya and her cousin Nyokabi Muthama are also closely linked to the Kenyatta Trust. At the organisation, Nyokabi is a director while Kathleen is a mentor with President Uhuru as a Patron.
June Nduta Kinyua is Kathleen Kihanya’s daughter while Samantha Ngina Muthama is Nyokabi Muthama’s daughter.
On its official company website, ziwala.co.ke notes that the company is privately owned and managed.
Its directors are listed as June Kinyua and Njau Muriuki, both of whom are cousins as their mothers Mumbi (Muriuki’s mother) and Kathleen (June Kinyua’s mother) are siblings.
June and Njau are, therefore, niece and nephew to President Uhuru Kenyatta.
However, according to official search at the Company Registry dated 16th July 2020, the current directors and shareholders of Ziwala Limited are Samantha Ngina Muthama with 400 Shares and June Nduta Kinyua with 600 Shares.
Both also interestingly share a common address: P.O. Box 19495 GPO Nairobi.
How the daughters June Nduta Kinyua (Kathleen’s daughter) and Samantha Ngina Muthama (Nyokabi’s Daughter) bagged such a lucrative deal in a state agency has set tongues wagging, with many Kenyans worried that the critical Health sector might indeed be the first family’s preferred cash cow.
Also worth noting is that this fresh scandal involving Uhuru’s nieces and nephews comes barely a month after another family member Peter Kihanya suddenly increased his shareholding in betting firm SportPesa just days after the gambling industry giant regained its license and sports betting taxes were waived by Treasury Cabinet Secretary Ukuru Yattani.
Peter Kihanya is an uncle to both June Nduta Kinyua and Njau Muriuki being the elder brother to their mothers Kathleen and Mumbi Kihanya.
June is named after their late grandmother Grace Nduta, mother to Josphat Muiruri Kihanya, their patriarch, who passed on in 2016.
On the father’s side, June Kinyua is the daughter of Ernest Kinyua Kamau (Director of Tea Holdings Ltd based in Limuru) whose father is former nominated MP Jackson Kamau Chege as per court documents filed in 2007.
June Kinyua, a University of Buckingham graduate, appears to be the eldest of the three cousins who are linked to Zimala Limited.
From photos which have been circulating online, its rather evident she has already started a family.
Njau Muriuki also went to United Kingdom for further studies and graduated around 2015.
Samantha Ngina Muthama’s social media accounts reveal she is barely past her mid-twenties.
However, according to official search at the Company Registry dated 16th July 2020, the current directors and shareholders of Ziwala Limited are Samantha Ngina Muthama with 400 Shares and June Nduta Kinyua with 600 Shares.

In May, Health CS Mutahi Kagwe vowed to crush cartels in the Ministry of Health, but some very senior employees of the government who were perceived to be part of the cartels refused to be transferred. Seemingly, they enjoy protection from higher authorities, and Kagwe seems to have given up.
Despite the Ethics and Anti-corruption Commission (EACC) launching investigations into the Covid-19 billions, the investigations might not see the light of the day, like we have seen previously in scandals involving the first family.
It remains to be seen how the State House will react to this latest alleged scandal involving members of the first family.
In 2018, President Uhuru promised Kenyans that he will spare no one in the fight against graft.
“You can be my brother or my sister or my closest political ally but if you are corrupt we will fight you,” he then sensationally pledged.
But if the handling of the scandal involving Kathleen Kihanya and Nyokabi Muthama and their company Limited is any precedent, nothing will be done to Ngina Muthama, June Kinyua and Njau Muriuki or their company Zamala Limited.
Other firms that have landed multi-million-shilling contracts at KEMSA include Accenture Kenya Limited, whose ownership we could not verify with certainty as we could not find any company registered by that exact name at the company registry.
The mystery firm is among those that were awarded contracts, whose budgets were not covered by the Kemsa budget, putting them at the centre of the ongoing fraud investigations.
Abyssinia Group of Industries (AGI), like others, was awarded a contract to supply 30,000 pieces of N95 face masks at a cost of Sh900 each which saw the company make Sh27 million.
The name of the firm’s directors could not be found since its record does not exist on the online public portal of the registrar of companies.

The BBC worked with the International Consortium of Investigative Journalists (ICIJ), the Guardian, Finance Uncovered and other media outlets to identify in the leaked files the individuals behind overseas companies that owned property in England and Wales.
Owning real estate through an offshore firm is legal, and there is no suggestion of wrongdoing in simply using a foreign company to purchase property.
However, the UK government recently raised its own assessment of the money laundering risk for the property market from "medium" to "high".
The greatest level of risk is where there are "difficulties in determining the ultimate beneficial owners", according to a Home Office report in December 2020.
It comes as a number of world leaders - including the King of Jordan and the ruling family of Azerbaijan - have featured in the Pandora Papers leak after buying property in the UK using offshore companies.

Her identity as the buyer of properties in London was hidden because they were bought through anonymous companies based in the British Virgin Islands, a tax haven.
The purchases included a £15m apartment in Mayfair and a new home for their daughter near Buckingham Palace, bought for £10.6m in 2016.
The buying spree took place in the months after the Greens sold BHS for a token sum to a one-time bankrupt who had no retail experience. The chain collapsed, leading to the loss of 11,000 jobs and vacant sites in town centres.
The downfall also led to an outcry when it emerged the business had left a black hole of up to £571m in its pension fund.
Through their lawyers, both Sir Philip and Lady Green declined to answer detailed questions, suggesting that these were private matters.

Gennadiy Bogolyubov is a Ukrainian billionaire who is under investigation by the FBI for money laundering.
He and his business partner are accused of defrauding the bank they founded of more than £1bn.
Court documents included in the Pandora Papers reveal him to be the ultimate owner of a collection of UK properties likely to be worth over £400m, including a building on Trafalgar Square.
They are held via a network of companies, some offshore, that hide the identity of the owners.
Mr Bogolyubov is the co-founder of PrivatBank, Ukraine's largest lender.
The bank was nationalised in 2016 after regulators found a £4bn hole in its balance sheets.
PrivatBank has been pursuing Mr Bogolyubov and his business partner Igor Kolomoisky through court action in England and the US, trying to reclaim more than £2bn relating to the money lost during their leadership.
In 2020 the US Department of Justice sought to seize commercial properties in Texas, Ohio and Kentucky from the pair, suspecting that they were "acquired using funds misappropriated from Privatbank". The court cases are ongoing.
Mr Bogolyubov's assets are currently subject to a worldwide freeze, secured in court by PrivatBank in 2017.
In 2016 he decided to leave the country and settle in Switzerland, partly for "tax reasons".
Lawyers for Mr Bogolyubov declined to comment as legal action is ongoing.

Mikhail Gutseriev is a Russian oligarch who was sanctioned by the UK in August for his close relationship with Belarus President Alexander Lukashenko. The Pandora Papers reveal that his son owns a multi-million pound office block through a secret offshore company, purchased for more than £40m.

Mr Gutseriev is the founder of Safmar Group, a Russian conglomerate with interests in oil, coal, property and retail.
Following the crackdown on human rights and democracy in Belarus in 2020, the UK and EU have recently brought in sanctions against President Lukashenko, along with Mr Gutseriev and other close associates.
The British government has accused the Belarusian regime of continuing to "crush democracy and violate human rights".
It described Mr Gutseriev as "a prominent Russian businessman who is one of the main private investors in Belarus and a longstanding associate of Alexander Lukashenko". It added that he had "provided support for the government of Belarus, including through use of his business interests".
Mr Gutseriev is no longer involved in Safmar, which is now part-owned by his son, Said, a British citizen.
Said Gutseriev's representatives told the BBC he did not have "any business links with his father".His lavish wedding made headlines in 2016 - it featured performances by Jennifer Lopez and Enrique Iglesias and was reported to have cost £1bn.
What is the UK government doing?
Plans for a register of foreign companies owning UK property were first announced in 2016 by then Prime Minister David Cameron, so that "corrupt individuals and countries will no longer be able to move, launder and hide illicit funds through London's property market, and will not benefit from our public funds".
Draft legislation was published two years later and "progress" on changing the law was promised in the 2019 Queen's Speech.
Earlier this year, following the G7 summit, the government reiterated its commitment to create a public register of overseas entities who own UK real estate.
However, the law has still not been introduced to Parliament and was not listed as one of the government's legislative priorities at this year's Queen's Speech.
Labour MP Margaret Hodge told the BBC that when in government David Cameron and his Chancellor George Osborne "promised us that they would create a public register of beneficial ownership here in the UK... but we've been waiting since 2016 for that promise to be enacted".
She added: "It's ready, it's sitting there, it's not complicated... but it has yet to emerge... so it's a scandal that that's not happened."
The government says it is cracking down on money laundering with tougher laws and enforcement, and that it will introduce a register of offshore companies owning UK property when parliamentary time allows.

Ukraine's President Volodymyr Zelensky participated in a network of offshore companies, co-owned with his long-time friends and TV business partners, the Guardian revealed on Sunday.
These firms held assets including apartments near London's Regent's Park.

Russian businessman Victor Fedotov's companies have given £900,000 to MPs. He purchased a Hampshire manor house through a network of offshore companies. Files in the Pandora Papers suggest he made millions from a project that became mired in allegations of corruption. Mr Fedotov's lawyers said "there is no evidence whatsoever" he behaved improperly.

For years, researchers have tracked a group of hackers-for-hire that targeted US-based Net Neutrality and anti-Exxon campaigners. Now Citizen Lab has identified the cybermercenaries behind these "Dark Basin" attacks: Belltrox, a New Delhi company.

As the report highlights, Belltrox is just one high-profile, sloppy actor in a large, shadowy industry of hacks-for-hire.
These cybermercenaries work for corporations and wealthy individuals as personal dirty tricks squads, attacking government officials, activists, and journalists who threaten to expose their wrongdoing and corruption.
