Monroe, GA – Injuries Reported on Truck Crash on Hwy 78 Ramp

Monroe, GA (January 25, 2020) – Monroe Police responded to the scene of a truck crash involving a passenger vehicle that led to injuries on a ramp.

The accident allegedly took place between a Ford Taurus and a commercial tanker truck. Police have not yet confirmed what circumstances led to the accident but claim that it happened on Highway 78 on the ramp headed toward Highway 138.

A 70-year-old victim in the Taurus was sent to an Athens hospital with a broken neck. He was severely injured but his condition is not yet known.

It's been almost four months since a crash claimed the life of a Miami woman and seriously injured her boyfriend.

Dillon Angulo, 27, and Naibel Benavides Leon, 22, were standing outside of their truck parked off Card Sound Road when they were hit by a car.

"They thought I was going to die at one point," said Angulo during an exclusive interview with NBC 6. "It's been rough."

He says he had a traumatic brain injury that has affected his memory. He says he doesn't remember the crash. But he remembers when he was told weeks later about the crash and that his girlfriend had died.

"At that moment finding out that my girlfriend passed away and I was in a severe accident was devastating," he said. "I was just overwhelmed with sadness."

Florida Highway Patrol is investigating the crash - which happened where Card Sound Road intersects with County Road 905, a popular route for people travelling to the Keys.

According to the FHP accident report, the driver of a 2019 Tesla Model S ran through a stop sign, a flashing red stop light and knocked down a traffic sign all before colliding into the couple, whose truck was parked 40 feet off the road.

The driver, George McGee from Boca Raton, can be heard on the body worn camera that he was driving in "cruise."

McGee could be referring to an optional feature that Tesla promotes on its website called "Traffic Aware Cruise Control," which allows the car to maintain a safe distance from the car in front.

It's one of many autopilot features that could come with the Tesla S. Others include automatic breaking and lane control.

FHP is investigating what if any autopilot features were in use at the time of the crash.

McGee can also be heard telling police he took his hands off the wheel to pick up a phone he dropped.

"I reached down, I didn't see it and when I popped up, I saw a black truck just happened so fast," he said.

McGee was allowed to leave the crash site that night without getting a ticket even though the police report lists that he operated the vehicle in a "reckless or aggressive manner."

He wasn't tested for alcohol or drugs either. FHP declined to comment on why and any other details of the crash saying the investigation is ongoing.

Angulo says he is angry because McGee hasn't faced any consequences.

"How can somebody be free three months after they've killed somebody and have caused so much pain in other people's lives," Angulo said. "To me, that's not right."

His attorney Rob Pelier echoes Angulo's frustration.

"It's a slap in the face to these victims," he said. "Mr. McGee's conduct that evening was not only remarkably selfish, irresponsible, reckless and in my belief, it was criminal."

The family of Benavides Leon declined to speak with NBC 6 but their lawyer, Todd Poses, wrote in a statement "they remain resolute and determined in their efforts to ensure both criminal and civil justice are served."

The Monroe County State Attorney hasn't filed any charges against McGee but said it recently met with FHP to discuss the crash.

McGee declined our request for an interview but his lawyer said it was a tragic accident and that their thoughts are with the families.

Pittsford, NY – Elderly Man Struck and Injured by Pickup Truck

Pittsford, NY (June 14, 2019) – A 92-year-old man was struck and seriously injured by a pickup truck in the town of Pittsford on Friday afternoon, June 14, according to police officials. The incident was stated to have happened at around 3:30 p.m. on Monroe Avenue.

Illegal Immigrant accused of killing NFL player in suspected DUI crash wants confession thrown out

INDIANAPOLIS, Ind. – The illegal immigrant accused of killing NFL player Edwin Jackson and an Uber driver in a suspected DUI crash says his constitutional rights were violated.

Edwin Jackson and Jeffrey Monroe were both killed by an accused drunk driver earlier this month.

The suspect’s attorney believes the arresting officer violated his constitutional rights, according to WXIN.

Pulling up to the crash scene where the two men were killed, an Indiana State trooper claims he spotted an impaired suspect trying to run away and the trooper asked that man if he had driven the truck that caused the crash.

Prosecutors say Manuel Orrego-Savala admitted he had been behind the wheel, but the defense claims the trooper asked if he “was the driver of the black truck without first reading and advising the defendant of his Miranda rights.” That could be a potential violation of the Fifth Amendment.

“I think it’s appropriate to file this and have a judge lay out the boundaries of what the proper questioning was and what the proper time was,” John Tompkins said.

Tompkins represents Orrego-Savala, who investigators say had a blood-alcohol level nearly three times the legal limit at the time of the crash. Records also show Orrego-Savala had twice been deported from the country before the crash.

“This is not a frivolous motion. I don’t think ultimately it’ll be successful for him,” attorney Jack Crawford said.

Crawford isn’t connected to the case, but he doesn’t find fault with how the trooper handled the initial response on scene.

Still, he says the defense wouldn’t be doing their job if they didn’t try to have the suspect’s admission thrown out and the suspect enjoys the same legal rights as any legal citizen.

“This was all in the nature of a preliminary officer investigation. It’s not protected by the 5th Amendment of the Constitution until the officer identifies the man as a true suspect in the crime,” Crawford said.

“It’s never a waste of time to enforce our constitutional rights,” said Tompkins. “If there’s a question about whether the suspect’s constitutional rights were violated, that is what the defense is supposed to do, bring it up to the judge.”

If the motion is granted, Orrego-Savala’s statements at the scene regarding his involvement in the crash would be ruled inadmissible during the trial, according to Torres.

In Marion County, Orrego-Savala faces two counts of failing to remain at the scene of an accident and two counts of causing death when operating a motor vehicle with an alcohol concentration of .15 or more. In a different case out of Boone County, he’s being charged with perjury, forgery, identity deception, false informing, and operating without a license.

Orrego-Savala, an undocumented immigrant who has been deported from the U.S. twice, is also facing a federal immigration charge.

Orrego-Savala denied his involvement in the crash during a court appearance on Feb. 6. He told a judge through an interpreter, “I don’t know why I’m here. I wasn’t driving that car.”

Orrego-Savala is expected to appear for a pretrial conference on March 27.

A hearing has not been set for a judge to hear the defense’s motion.

Prosecutor: Trump's comments on fatal crash 'ghoulish'

INDIANAPOLIS /February 7, 2018 (AP)(STL.News) — An Indiana prosecutor blasted President Donald Trump on Wednesday for politicizing the case of an immigrant charged in a drunken-driving crash that killed Indianapolis Colts linebacker Edwin Jackson and another man, saying his and others’ comments were “ghoulish and inappropriate.”

Marion County Prosecutor Terry Curry said his office would “vigorously prosecute” the case regardless of the suspect’s immigration status. Curry criticized Trump and others who cited the case as part of the nation’s immigration debate, noting that “two innocent men lost their lives in this horrible incident.”

Curry filed felony charges earlier in the day against the suspect, Manuel Orrego-Savala, a citizen of Guatemala who has twice been deported from the U.S. Orrego-Savala is accused of driving the pickup truck that hit Jackson and his Uber driver, 54-year-old Jeffrey Monroe, early Sunday in Indianapolis.

“We are disheartened that ghoulish and inappropriate public commentary has politicized this tragedy,” Curry, a Democrat, said in a statement. “Much of such commentary, including tweets by the president, fails to acknowledge that both Edwin Jackson and Jeffrey Monroe lost their lives on Sunday. We will simply seek justice on behalf of the families of those two victims.”

Trump drew added attention to the case on Twitter, calling the highway collision “disgraceful,” and prodded Democrats to work with him on illegal immigration and border security.

Orrego-Savala is charged with two counts each of causing death while driving intoxicated and leaving the scene of an accident. The two more serious counts each carry a maximum sentence of 20 years in prison.

The 37-year-old said little during his initial court hearing Wednesday, responding through an interpreter as a judge explained the proceedings and charges. The judge set his bond at $200,000 after entering a not guilty plea on his behalf.

Investigators said Orrego-Savala was living illegally in the U.S. at the time of Sunday’s crash. Late Tuesday, he was charged by federal prosecutors with illegal re-entry of a previously deported alien. He faces up to 10 years in prison in that case, which would be handled after any state charges are resolved.

His defense attorney, Jorge Torres, said Orrego-Savala’s immigration status has no bearing on the drunken-driving case and questioned whether his client could get a fair trial given his immigration issues. Torres said his client has been living and doing construction work in the Indianapolis area for several years.

“He’s very distraught to say the least,” Torres said. “He’s very confused.” Jackson’s family planned no response to Trump’s tweets about the crash and the suspect’s immigration status, according to a family spokesman.

“We’ll let the politicians do the politics while the family is just going to grieve and circle the wagons and try to heal from this tragic situation,” Atlanta attorney Daniel Meachum said Tuesday. “The family is in shock, as you can imagine.”

Prosecutors allege Orrego-Savala was driving the vehicle that crashed into Jackson and Monroe as the two men stood outside Monroe’s car early Sunday along Interstate 70 in Indianapolis. Monroe was transporting Jackson for Uber, the ride-sharing service, and had pulled over after the 26-year-old football player became ill, investigators said.

Orrego-Savala was arrested shortly after the crash. A blood test conducted at a hospital determined he had a blood-alcohol level of 0.19 percent, more than double Indiana’s legal limit for driving, according to court documents.

Orrego-Savala was deported in 2007 and again in 2009. In 2005, he was convicted for driving under the influence in Redwood City, California. He also has numerous other misdemeanor convictions and arrests in California and Indiana, said U.S. Immigration and Customs Enforcement spokeswoman Nicole Alberico.

In the 2005 case, he pleaded no contest to two separate drunken-driving offenses and was given a brief jail sentence, according to San Mateo County District Attorney Steve Wagstaffe.

Orrego-Savala remained jailed Wednesday in Indianapolis. Federal and county prosecutors spelled his last name as “Orrego-Zavala” in charging documents, but his attorney said his name is spelled Orrego-Savala, a spelling that’s listed among his aliases in the federal documents.

He appeared Tuesday before a judge who advised him of his rights. Orrego-Savala told the judge through an interpreter: “I wasn’t driving the car. I don’t know why I am here,” Indianapolis television station WRTV reported. A police news release did not mention the presence of anyone else in the pickup truck.
