Introduction to the Course

A. COURSE DESCRIPTION AND OBJECTIVE

New economies have emerged within the last two decades including digital models of transaction and disruptive innovation. Internet intermediaries generally are taking on a major role as facilitators of commercial and non-commercial transactions online. These include social networking platforms (e.g. Facebook and Twitter), multimedia sharing platforms (e.g. YouTube, Apple Music, Spotify), search engines and news aggregators (e.g. Yahoo and Google), content hosts and storage facilities (e.g. Dropbox) and many others. The Covid-19 pandemic has elevated the important role of these intermediaries as they provide a basis for remote interaction so as to avoid physical contact and proximity.

Laws have been adapted to deal with the roles and functions of such intermediaries and their effects. Regulators in every jurisdiction are faced with the challenge to manage the new economy and players, and to balance the interest of multiple parties, in the context of areas of law including intellectual property, data protection, privacy, cloud technology and cyber-security. Different types of safe harbour laws and exceptions have emerged to protect these intermediaries and putting in place special obligations; while some forms of protections have been augmented to protect the interests of other parties including content providers and creators as well as society at large. Students taking this course will examine the legal issues and solutions arising from transactions through the use of digital information, goods and services as well as via non-physical channels of communication and delivery.

The technological developments from Web 1.0 to 2.0 and the future of Web 3.0 with its impact on human interaction and B2B/B2C commerce as well as e-governance will be examined in the context of civil and criminal law, both in relation to the relevance of old laws and the enactment of new ones. In particular, this course examines the laws specifically arising from and relating to electronic transactions and interaction and their objectives and impact on the individual vis-à-vis other parties. Students will be taken through the policy considerations and general Singapore legislations and judicial decisions on the subject with comparisons and reference to foreign legislation where relevant.

In particular, electronic commerce and other forms of transactions will be studied with reference to the Electronic Transactions Act (2010) (recently amended on 19 March 2021) and the Singapore domain name framework; personal data privacy and protection will be studied with reference to the Personal Data Protection Act of 2012 (with the 1 February 2021 amendments) and the Spam Control Act (also amended w.e.f. 1 February 2021); the challenges and changes to tort law to deal with online tortious conduct will be analysed (e.g. cyber-harassment under the PHA and online defamation in the context of online communication); the rights and liabilities relating to personal uses of Internet content and user-generated content will be considered with reference to the Copyright Act (including relevant amendments in the Amendment Bill presented in Parliament in mid-2021) ; computer security and crimes will be studied with reference to the Computer Misuse Act (2017) and the Cybersecurity Act (2018); and last, but not least, Internet regulation under the Broadcasting Act and its regulations as well as the Protection from Online Falsehoods and Manipulation Act (2019) will be critically evaluated. You will note that there have been an acceleration in the enactment of ICT laws and amendments in recent years, which shows the renewed focus of the government and policy-makers when it comes to the digital economy and society (as we move towards a SMART Nation).

B. ASSESSMENT  METHOD AND GRADING DISTRIBUTION

Written Exam 60% (2 hour open book examination)

This course will be conducted online in a webinar format until further notice. Group project presentations will be conducted by the teams either online or from the seminar room and broadcasted live with a Q&A session following the presentations. Further details and instructions will be given after the groups are formed and scheduled by Session 3.

The main textbook is: Warren B. Chik & Saw Cheng Lim, Information and Communications Technology Law in Singapore (Academy Publishing, Law Practice Series, July 2020). You can purchase the book from Singapore Academy of Law Publishing (ask for the student discount).

Due to the rapid pace of development in the law in some areas of analysis, students will also be given instructions and pre-assigned readings via a dedicated blog one week before each lesson. Students need only refer to the SMU eLearn website for administrative information such as the Project Schedule and the Grade Book as well as to share project papers and presentation materials. Students will be expected to analyse legislative provisions and/or full cases as are indicated as required reading for each week.

·        E-library for homogeneous collection of study resources in form of e-books. There are thousands of e-books available with images, interactives, audios, and videos.

·        E-courses for online that contain topics from various subjects and lessons over such topics.

DIKSHA

It provides digital infrastructure for school education. It is an initiative of National Council of Education Research and Training (NCERT).

It provides the content by the following educational bodies:

·        CBSE

·        NIOS

·        State/UTs Boards

The content is available in multiple languages and can be accessed by scanning the QR code given in the school textbooks. There are e-pdfs and explanatory videos available on the app that are uploaded by various contributory teachers for the students.

E-pathshala

It is also developed by NCERT and CIET. It provides multi lingual access to numerous resources including audios, videos, epubs and flipbooks. This platform can be easily accessed through laptop, desktop, tablets and smart phones.

Digital textbooks for all the classes from 1st to 12th are available on e-pathsala. It in one of the best government e-learning website.

Moreover, it hosts various events where students can participate like workshops, contests and festivals.

SWAYAM

It is a National Online Education platform launched on July 9 2017 by Ministry of Human Resource Development (MHRD) to provide one integrated platform and portal for online courses.

SWAYAM stands for Study Webs of Active Learning for Young Aspiring Minds. It is a Massive open learning course (MOOC) platform under Digital India programme.

It covers 1st and 12th class syllabus as well as skill sector courses to ensure that every student in the country has access to the best quality higher education at the affordable cost.

It also provides courses for UG and PG courses.

SWAYAM PRABHA

32 high quality Educational channels through DTH are provided across the length and breadth of the country 24x7 basis.

It has curriculum-based course content covering diverse disciplines to make quality learning resources accessible to remote areas where internet connectivity is a challenge.

It is a lifeline for those students who cannot afford smart phones and internet.

At Graduate & Post-Graduate Level

e-PG Pathshala

It is Government e learning Websites for postgraduate courses. It was started by the Ministry of Education under NME-ICT (National Mission on Education through ICT) and the UGC.

On this platform e-content in almost 70 subjects across all disciplines of social science, arts, fine arts and humanities, natural and mathematical science and others are present.

There are high-quality text contents, illustrations, videos, tutorials, documents, PDFs, etc.

Under this initiative, three modules are present:

·        E-Adhyayan: Here, 700+ e-books are provided for Post-Graduation courses along with video content.

·        MOOC (Massive Open Online Courses): UGC-MOOCs produces courses for post graduate subjects. 

·        E-Pathya: It offers offline and distance-learning courses for postgraduate students. It is a software driven course/content package for higher education.

E-ShodhSindhu

It has been formed by merging three consortia initiatives, namely

·        UGC-INFONET Digital library Consortium

·        NLIST

·        INDEST-AICTE Consortium

It provides current as well as archival access to more than 10,000 core and peer-reviewed journal and a number of bibliographic, citation and factual databases in different disciplines from a large number of publishers and aggregators to its member institutions.

All academic institutions like central and state universities and colleges can avail of the services provided.

For Technical Courses

NAPTEL Online Certification

National Programme on Technology Enhanced Learning was established in 2014. It is a project funded by Ministry of Home Affairs Govt of India and managed by IIT Chennai. Other IIT institutions also contribute content to this government e-learning website.

It offers courses in Engineering, science, social sciences and humanities. Though, there is no course fee but fee is applicable to certification exams. There are 41 domains across 10 disciplines available on NAPTEL.

NAPTEL has been giving course level certificates and there have been quite a few students doing multiple courses from NAPTEL, which are not always connected. Hence, NAPTEL has linked various courses from different backgrounds that go together building on the foundations and then going in for the electives.

Virtual Labs

Virtual Labs is a Best Free eLearning Platform in India initiative of Ministry of Education under National Mission on Education through ICT.

It aims to provide remote access to virtual laboratories for students from science and engineering streams from both undergraduate and postgraduate levels. So that students can conduct experiments by arousing their curiosity.

It provides a complete Learning Management System where the students can avail the various tools for learning, video lectures, animated demonstrations and self-evaluation.

This consortium is conducted by IIT Delhi and has around 12 participating institutes. The project consists of 700+ web experiments and lab facilities under the supervision of experienced faculties

The medium of instruction is English. LL.B. [3-Year Programme]: This Programme is available to students who have a graduate degree in any discipline.

Post-Graduate Programmes in Law: One-Year LL.M Programme with an interdisciplinary approach and strong research orientation is offered with 7 specializations.

Diploma: 7 Part-time one year Diploma Programmes and 1 Post-Graduate Diploma Programmes are offered as value-addition. Students pursue these programmes alongside their Undergraduate or Postgraduate Programmes.

After initial assessment through elaborate psychometric tests, assessment and screening process; the students get training, orientation and experiential learning through systematic internships in industry, High Courts, Supreme Court and Non-governmental organizations. Eligibility and Intake Details

(Get Direct Admission Symbiosis Law School for 2020 Batch, Get Direct Law Admission in Christ University Bangalore for 2020 Session)

Standard XII (10+2) or equivalent examination passed from any recognized board with minimum 45% marks or equivalent grade (40% marks or equivalent grade for Scheduled Caste/Scheduled Tribes).

The total intake is 300 seats [inclusive of 120 seats of BA. LL.B (Honours) and 180 seats of BBA. LL.B (Honours)].

Separate Merit Lists for BBA. LL.B (Honours) and BA. LL.B (Honours) programme will be prepared and published. At the time of SLAT registration, it shall be mandatory for the candidates to clearly indicate the programme to which they wish to apply.

PS: It is suggested that the candidates who have studied arts/social sciences subjects for their qualifying examination may apply for BA. LL.B (Honours) programme. Similarly, those candidates who have studied commerce/accounts/mathematics/sciences may apply for BBA. LL.B (Honours) programme.

Further, the candidates are also free to make their own choice of section of the programme depending on their ability, interest and opportunity. Please note that these two programmes differ only in the First Degree contents (either Humanities OR Business Studies), whereas the Law courses are offered in both the programmes are the same. Graduates in both streams are eligible for diverse legal careers and opportunities in Corporate, Litigation, Civil Services, Advocacy, Judiciary, Academics, jobs in International Organizations, International Admissions and others.

List of Entrance Test (SET / SLAT / SITEEE / SEED) for Various Programs at Symbiosis

Every year Symbiosis conducts four entrance tests [namely Symbiosis Entrance Test (SET) / Symbiosis Law Admission Test (SLAT) / SIT Engineering Entrance Exam (SIT EEE) / Symbiosis Entrance Exam for Design (SEED)] for admission to its undergraduate programmes in Management, Law, Engineering, Mass Communication, Economics, Design, Liberal Arts, Computer Studies & Culinary Arts.

This year the four entrance tests will be held on 4 May 2019 (Saturday). The tests will be conducted in the Computer Based Test (CBT) mode simultaneously across 80 cities all over India.

Candidates aspiring to join an undergraduate degree programme offered by Symbiosis International (Deemed University) must appear for one (or more) of the four above-mentioned test(s).
