A Case of Superstition and Property Rights
Court often comes across situations where I think judges might feel like holding their heads. Whenever a case is presented to the court, the court has to make a decision one way or another. But by dealing with such cases, the productive time of the court is blown on trivial matters.
E Shakthi Murugan v. The District Collector Chengalpattu & 6 others
Writ Petition 2384/2024
Before High Court of Madras
Heard by Hon’ble Mr. Justice N Anand Venkatesh J on 02.02.2024.
Well coming to the point this is a case where Petitioner E Shakthi Murugan owner of his property was forbidden from enjoying his property.
Reason, a stone was erected in front of his property covered with Green Cloth and it was projected as a Deity.
Petitioner tried to remove the Implanted Stone.
But it was resisted by the Seventh Respondent - Kumaresan from removing the stone.
Help of police was sought.
But as usual no help came to rescue the petitioner.
Ultimately Article 226 of the Constitution of India was resorted to by knocking the door of the High Court.
Court on perusing the Photograph annexed with the petition found that the Stone covered with green cloth was planted in front of the property of the Petitioner.
Normally property related issues are dealt by Civil Court.
Court observed it would be a funny situation if the petitioner approaches the Civil Court for such a frivolous issue.
Respondent-Kumaresan will claim that the stone must be treated as an idol and the petitioner will state that it is merely a stone and not an idol.
It will become impossible for the Court to decide whether it is a stone or it has uplifted itself into the status of an idol.
Isn’t it??
It will be a waste of judicial time.
Court observed it is unfortunate that people still believe in superstition.
To close the matter Hon’ble Court directed Assistant Commissioner of Police, Pallavaram Range, Chengalpattu to act upon the complaint of the petitioner and get the stone planted in the entrance of the property removed within a week from the date of receipt of the order copy.

IPL Founder Lalit Modi Lived Like A Rockstar Movie Coming Out Soon Based On This Book
New Delhi: S-class Mercedes cars had to be made available in Dharamsala and Nagpur when now-fugitive Lalit Modi went to those cities during his stint as IPL commissioner as he wouldn’t ride any other model, says a new book. In “Maverick Commissioner: The IPL-Lalit Modi Saga”, Boria Majumdar also writes that once Modi had left the country in May 2010 the hotel had sent a bill amount to the BCCI that remained unpaid and the board, which by then had no sympathy left for him, refused to clear it. According to the author, these are examples why the IPL continued to be hated by many. Despite the cricket and the growing brand value, vulgar displays of opulence were always going to be an eyesore, he says. “Lalit, who was riding high on success, failed to see the writing on the wall and suffice it to say became a victim of his own success in the long term. In fact, for him these things were a necessity. Glamour and opulence were at the very core of the league’s existence and for Lalit, his actions were integral to making the IPL what it had turned out to be,” he writes. The success of the first two seasons of IPL meant Lalit Modi had gained in prominence and it was all evident from his high-flying lifestyle, Majumdar argues. “The grapevine has it that for a game in Dharamsala which Lalit attended, his office had booked two S-class Mercedes cars from Delhi which travelled to Himachal before he landed there. He wouldn’t ride any other model and such extravagance had become routine with Lalit,” he writes. This wasn’t the only occasion when something as bizarre as this had happened, the author says. “On another occasion when he travelled to Nagpur to meet (Shashank Venkatesh) Manohar and watch an IPL game, his office had called up to arrange for an S-class Mercedes. On being told the model wasn’t available in Nagpur they booked a car from Hyderabad, which was driven all the way to the orange city for Lalit to use,” he writes. Booking an entire floor of a five-star hotel for himself had become second nature and no one in the BCCI had the courage to object, the book, published by Simon & Schuster, says. “Was he paying for the hotel from his own funds or was it all at BCCI’s expense? Such questions weren’t asked and if someone did, he would invoke the ire of the establishment. To question Lalit Modi had become synonymous with questioning the IPL and with the league generating record monies for the BCCI, no criticism of any sort was welcome,” Majumdar writes. The book goes on to describe how the IPL, which was perhaps the biggest gamble of Lalit Modi’s life, turned out to be the biggest success story ever, making him a cult in the echelons of global sport. “And in creating the IPL, Modi ended up giving a new life to cricket in India and beyond. Cricketers found a new voice and marketers a new investment opportunity. Broadcasters found a magic product and the BCCI found its golden goose. “While Modi had to give it all up in a few years and leave India for good, his imprint has stayed on making him one of the most talked about figures ever in Indian cricket administration,” it says. Majumdar says while there aren’t straight responses to many questions surrounding Lalit Modi and the unsolved mysteries at key points in his life, it is important to deep dive and seek some of these answers. “In doing so, we end up discovering a man who was a genius as well as a maverick. His actions can’t always be described in black and white and that’s what adds to the aura of Lalit Modi,” he says. “Maverick Commissioner” is soon planned to be made into a film by Vibri Motion Pictures. On Monday, 7 June, Tamil Nadu was set to become the first state to ban conversion therapy in India. A Madras HC ruling this week put the spotlight on LGBTQ rights, as Justice N Anand Venkatesh recommended a range of measures while hearing S Sushma v Commissioner of Police — the case of a lesbian couple from Madurai who had eloped to Chennai and were being harassed by their families. The families had filed police complaints, following which the petitioners approached the court for protection.
Upholding the rights of LGBTQ individuals under Article 21 of the Constitution, Justice Venkatesh's order prohibits “any attempts to medically cure or change the sexual orientation of LGBTIQA+ people to heterosexual or the gender identity of transgender people to cisgender,” the Indian Express reported. The court said action would be taken against professionals who carried out any form of conversion therapy.
Last May, conversion therapy was back in the headlines in India when a 21-year-old from Kerala died by suicide. Anjana Harish, a bisexual woman, said she had been forced to undergo conversion therapy by her family — a programme that began with her being assaulted and sedated, then placed in isolation, followed by a course of heavy medication. In a video posted to Facebook, she said, “My own family did this to me, that’s what saddens me the most". Two months after sharing her narrative, she was dead.
Earlier this week, a 23-year-old lesbian woman from Tamil Nadu, Pavithra, spoke with a German news publication about her family's attempts to force her to undergo conversion therapy. This included visits to a general physician followed by a consultation with a psychiatrist who advised Pavithra to watch porn videos depicting heterosexual intercourse. Pavithra's family also took her to a quack who "prescribed" rum as medication, and an unidentified tablet. She finally fled from her home and has been living with her partner Mary.
The same report also quotes Rajashree Raju, a member of the Kerala-based LGBTQ activism group Queerala, as saying that instances of individuals being forced to undergo conversion therapy had doubled during the pandemic-induced lockdown.
Incidentally, Queerala has been petitioning for conversion therapy to be declared illegal in India since October 2020, after Anjana Harish's death. Queerala members approached the Kerala High Court for a decision on the same, and the state's chapter of the Indian Psychiatric Society issued a statement to the effect that “offering conversion therapy… amount(s) to human rights violation and may invite legal action".What is the medical position on conversion therapy in India? The Indian Psychiatric Society issued an official statement in 2018 — coinciding with the Supreme Court's ruling reading down Section 377 and decriminalising homosexuality in India — tasking members to ‘stop considering homosexuality as an illness’.The IPS' president Dr Ajit Bhide asserted that there was no need to "castigate, punish or ostracise" individuals for being homosexuals, which was seen by the queer community as a directive against mental health and medical professionals who might otherwise practice conversion therapy.

11 Years of A Wednesday. (05/09/2008)
A Wednesday is a thriller film written and directed by Neeraj Pandey. It stars Naseeruddin Shah and Anupam Kher. Set between 2 pm and 6 pm on a Wednesday, the film depicts an about-to-retire police commissioner (Anupam Kher) narrating a sequence of events that unfolded on a particular Wednesday. The awareness of the incident exists only in his mind and in those of several individuals who were involved, willingly and unwillingly, and how those events affected the lives of all the concerned people.
It was the inspiration for Tamil movie Unnaipol Oruvan , Telugu movie Eeenadu (with Kamal Hassan in the role played by Naseeruddin Shah in the original and Mohanlal and Daggubati Venkatesh playing the role acted by Anupam Kher in the original in Tamil and Telugu respectively), and also the Hollywood movie A Common Man (directed by Chandran Rutnam with actor Ben Kingsley portraying the role played by Naseeruddin Shah and Ben Cross portraying the role played by Anupam Kher. Although the film has a quite resembles with 1950's drama thriller Seven Days to Noon.
Box Office India declared it a hit. Critics praised the movie for its effective storyline and its twist ending. Subsequently, it won a number of awards including the Indira Gandhi Award for Best Debut Film of a Director at the 56th National Film Awards.

Pegasus India List

Motorcyclist’s death had triggered angry protests near Hinkal flyover in Mysuru; police release video explaining the sequence of events on Monday
Thirteen persons have been arrested in connection with the attack on policemen and damage done to a PCR vehicle after a motorcyclist, while reportedly evading checking by traffic police, was run over by a tipper-truck on the Outer Ring Road near Hinkal flyover here on Monday. Based on the videos of the mob going berserk that were circulated on various social media platforms, the Vijayanagar police, acting on the three complaints, including two from the policemen, arrested 13 people and sent them to judicial custody on Tuesday. They are searching for four more persons believed to be behind the incident. A traffic police sub-inspector attached to V.V. Puram Traffic Police Station and a police constable were beaten up and the Police Control Room (PCR) van that rushed to the spot to control the situation was damaged by the crowds following the death of 46-year-old civil contractor Devaraj, a resident of Bogadi here. Speaking to The Hindu, Deputy Commissioner of Police A.N. Prakash Gowda said the 13 arrested persons had been booked under various sections and three criminal cases had been registered in Vijayanagar police station over Monday’s incident. The cases had been booked under IPC Sections 353, 332, 307, 143, 144, 148, 149 and 341, he said. Police gave the names of the arrested as Venkatesh, Vinay, Madhu, Dandappa, Raghu, Swami, Arun, Somashekar, Akshay, Srikanth, Vasanthkumar, Mariswamy and Mohan. The accused are aged between 25 and 35. The tipper-truck driver, Dhananjaya, has also been arrested while the truck owner Bharat and a few others are absconding. Meanwhile, the police on Monday night released a video where a person, named Suresh, claiming to be a friend of the deceased and who was riding pillion on the motorcycle, explaining about the incident. In the video, the person says there is no connection between the incident and the traffic police conducting vehicle checking. “Both of us were wearing helmet, and Devaraj had all documents with him. A few metres before the place where the police were conducting checking, a tipper-truck hit the bike from behind and I was rendered unconscious. When I gained my consciousness, I asked for Devaraj and I was told about the incident,” he said, giving a clean chit to the traffic police who were blamed for the incident. Through this video, the police countered the accusations against them and argued that the mob linked the accident with the police conducting checking which was untrue. The two policemen who were attacked by the mob were being treated in a hospital. Mr Gowda said the jurisdictional police are further investigating the incident. Also, the police have also clarified that the police vehicle that was damaged in the violence had insurance and the social media post alleging that the insurance for the vehicle had been expired was false. Mr. Gowda said the PCR vehicle KA-55 G-0430, a Maruti Ertiga LDI model, has been insured till the midnight of December 19, 2021 and it is insured in the name of Commissioner of Police, Mysuru. The insurance cover has been given by the Karnataka Government Insurance Department (KGID), Motor branch, Bengaluru, he further said. Source link Read the full article

A Wednesday is a thriller film written and directed by Neeraj Pandey. It stars Naseeruddin Shah and Anupam Kher.
