Temporary Foreign Worker Program fills labour market gaps in Canada

The Temporary Foreign Worker Program seeks to address the Canadian labour shortage.
When Canadian firms cannot locate employees with the necessary skill set among Canadians or permanent residents, they might use the Temporary Foreign Worker Program (TFWP) in Canada to get the required skills from overseas.
Why TFWP -
The purpose of TFWP is a program designed to help bridge the gaps in the Canadian labour market. The declining birth rate is not helping the situation. More Canadians are reaching the retirement age, and not enough is being added to the labour market. This gap is steadily increasing.
Shortages result when there are not enough Canadian citizens or permanent residents to fill vacant positions. An employer may file a Labour Market Impact Assessment (LMIA) to Employment and Social Development Canada (EDSC); if no one in Canada has the relevant skills to fill the post, the employer may recruit a foreign worker to come to Canada and fill the position provided the LMIA results are good or neutral.
LMIA
An LMIA gives EDSC the knowledge it needs to assess if there is an actual need to hire a foreign worker and whether doing so will positively, neutral, or adversely impact the Canadian labor market. TFWP request meets rejection if it turns out that there are Canadians or permanent residents qualified for the position and looking for work.
Requirements for Advertising
An employer must take several steps to demonstrate that they have attempted to identify and hire a candidate from within Canada before being qualified for an LMIA.
Advertisement for the job in question must run at least four weeks across the Canadian labor market.
The Canada Job Bank must post the job.
Employers must show that at least two extra     recruitment strategies have been used, such as specialized websites, local     job fairs, or local media.
Employers must also certify that they are aware it is against the law to fire or reduce the working hours of their current Canadian employees.
Depending on the type of job opening, there can be exceptions to these guidelines; therefore, it's essential to seek advice from a professional to ensure you're adhering to the rules of required advertising.
LMIAs with high and low wage
There are two reasons to recruit a TFW, and these two factors may affect the type of LMIA an employer must file. They must apply through the high-wage position stream for highly specialized employment that pays at least as much as the province median wage.
Employers looking to fill low-wage employment must submit applications through the low-wage position stream. This stream is used to hire temporary manufacturing, agriculture, or tourism employees. Most low-wage positions have a 20 percent cap, meaning that no more than 20 percent of the workforce can be TFWs. Depending on the industry, the cap may increase to 30%.
How to obtain a TFWP and move to Canada
After being hired by an employer, a TFW must submit their work permit application to Immigration, Refugees and Citizenship Canada (IRCC) with the LMIA number, a copy of the LMIA, a job offer letter, and a contract. Processing times for the IRCC can differ.
TFWP work permits are "closed" work permits, which means that while an employee is in Canada, they may not be able to work for another employer and will only be able to do so for the duration of their contract.

On 22nd April 2022, thousands of temporary foreign nationals heaved a slight sigh of relief when IRCC announced some of its plans for the near future and offered some solace to foreign workers who were closing in on the expiry of their work status in Canada
Honourable Sean Fraser, Canada’s Minister of Immigration, Refugees, and Citizenship, came out with a long due, announcement that The Express Entry invitations will resume to Federal Skilled Workers (FSW) and Canadian Experience Class (CEC) candidates by “early July.” What is noteworthy here is that a similar announcement was also made earlier in the year when it was announced that these Express Entry draws would start sometime in the spring of 2022. This fresh announcement now pushes back the restart of these draws to summertime.
Minister Fraser also announced that Post-Graduation Work Permit (PGWP) holders would be eligible for an open work permit extension of 18 months from Immigration, Refugees, and Citizenship Canada (IRCC).

The latest data on the labour market in Canada released by Statistics Canada show that the employment rate for recent immigrants is at an all time high!
Overall, unemployment in Canada declined 0.2 percentage points to 5.3 percent, the lowest level since comparable records began in 1976. Statistics Canada measures the unemployment rate as a percentage of the labour force. Provinces relaxed public health regulations throughout the reference week.
“With the unemployment rate at such a low level, practically every industry is experiencing labour shortages, including those in the hospitality business that has yet to recover fully,” says Nathan Janzen, Assistant Chief Economist at RBC Economics.

How to Renew a PR Card

Canada's permanent residents are issued PR cards, making it easier for individuals to return to Canada following their trips abroad, easing their return to Canada after overseas travels. PR cards are renewable ONLY in Canada. Canadian PR Renewal is necessary since PR Cards have an expiration date, and you must apply for a new one before the old one expires. 
Don't be alarmed if you find yourself in this situation where your PR card has expired. 
Expiry of the PR card does not mean that your PR (permanent resident) status has expired. Permanent Residence (PR) Status stays in effect until the cancellation procedure is initiated. 
There are various methods for resolving the issue of an expired PR card, depending on your circumstances. Several factors determine the strategy to use:
When your PR card expires within the next 730 days & you reside in Canada.

Are you in Canada
Are you traveling overseas?
 When outside Canada without a valid PR Card, a PR Travel Document (PRTD) is required to return to Canada. 
The main reason for this is that you will have to pick up your PR Card in Canada if you apply for one. 
As a result, only one option is PRTD.
Eligibility
You are eligible if you have spent at least 730 days in Canada in the last five years. 
To reclaim your PR status or renew your PR card, you must be present physically in Canada for a least 730 days out of five years.
You can obtain a new PR card if your current PR card has expired or will expire within nine months and you meet the eligibility criteria. The majority of new PR cards expire after five years.
Documents Required for a PR Card Application
The expired PR needs to be handed over to the PRCC officer on receiving the new PR card.
Other documents listed in the documentation checklist include 
a copy of your passport or a travel document
Photos (as per the application specifications).

What is a Labour Market Impact Assessment (LMIA)?

LMIA stands for A Labor Market Impact Assessment is a document provided by Employment and Social Development Canada (ESDC) that certifies that the job in question cannot be filled by a Canadian citizen or permanent resident, resulting in the need to hire a foreign national. The online LMIA application makes it easy for any Canadian employer to identify potential employees and start hiring.
For foreign workers in Canada or Canadian companies looking to review the employment criteria and laws controlling the hiring process, the LMIA online application is a great resource.
Positive and negative LMIAs are the two types of LMIA. If your LMIA is positive, you will be able to hire a foreign worker. A negative LMIA will not be granted until and until the Canadian government finds a solution.
Under the eight (8) primary streams, Canadian firms can apply for a Labour Market Impact Assessment (LMIA) to hire a foreign worker. The type of LMIA you choose is essential. It will identify which conditions must be met, such as an employer's eligibility, job postings, and which application forms must be filed.
LMIA Streams / 8 Types of LMIA
1.      Low-wage LMIA: If a foreign worker's wage is less than the provincial or territorial median hourly wage. Here are the application forms for low-wage jobs.
2.      High-wage LMIA: Temporary workers, such as Business Owners, are paid at or above the provincial or territorial median hourly rate. 
3.      Agricultural workers LMIA: Only hire foreign workers for primary agriculture activities on the farm. 
4.      Seasonal agricultural workers LMIA: To hire individuals from authorized nations to do primary agriculture activities on the farm
5.      LMIA to support a permanent residence (PR) application: Only for high-wage positions in the National Occupational Classification's ( (NOC)  Skill Type and Level A and B.
6.      Dual intent LMIA: It serves two purposes: it assists with both PR and work permit applications.
7.      LMIA for Global Talent Stream: Under this stream, 1) innovative organizations in Canada can hire unique and specialized foreign nationals referred by designated referral partners, or 2) Canadian employers hire for in-demand highly-skilled professions included on the Global Talent Occupations List.
8.      LMIA for in-home caregivers: In the private household, Canadians can hire foreign caregivers to care for children, seniors, or those with documented medical requirements.

Canada changes Temporary Foreign Worker Program to address workforce shortage

Canada has announced they are changing their Foreign Worker Program, or Temporary Foreign Worker Program (TFWP), to address its workforce shortage. The nation is experiencing a high labour demand and much lower worker supply, which has impacted its economy.
The TFW Program permits employers in Canada to recruit a foreign worker when no Canadians or permanent residents are present.
The labour market in Canada is stricter than it was before the pandemic, with the job vacancy rate reaching an all-time high in the third quarter of 2021. According to Statistics Canada, low-wage occupations contribute to much of the unmet demand, with the following industries having the most vacancies in November 2021:
1.       130,070 vacancies in accommodation and food services
2.       In health care and social support, there are 119,590 job vacancies.
3.       103,990 employment opportunities in the retail trade.
4.       Manufacturing has 81,775 employment opportunities.
Approximately 5,000 posts in the Global Talent Stream and 23,000 positions in the High-Wage Stream were approved by the TFW Program in 2021. Together, these programs contribute to around 21% of all LMIA posts allowed for that year.
Each year, about 50,000 and 60,000 foreign agricultural laborers arrive in Canada, making up more than 60% of all foreign workers hired through the TFW Program.
From October 27 to December 20, 2020, ESDC held consultations on Minimum Requirements for Employer-Provided Accommodations. Many stakeholders, including provincial/territorial governments, municipalities, fire chiefs, public health units, businesses, industry associations, unions/labour groups, and foreign governments, submitted around 150 written responses. Migrant worker support organizations submitted applications on behalf of around 675 migrant employees.

Canadian Immigration in 2022: What has changed?

Canada’s Immigration Levels Plan for 2022-2024 was recently announced. Since the plan arrived, people seem to be more confused than relieved. On one hand, Canada is looking to land 431000 new Permanent Residents in the current year and on the other hand, the allocation adjustments done to the various categories are slightly confusing to many people. For example, according to the plan announced last year, Canada was targeting 110500 new PRs in 2022 under the Federal High Skilled category (which includes FSW, FST & CEC under The Express Entry system) and this number was brought down to 55900 according to the recently announced plan.
Similarly, we can also see an allocation of 40000 under the heading of Federal Economic Public Policies done in the new plan which is basically meant to accommodate Temporary Public Policies like The TR to PR pathway that was released last year. While this number seems encouraging, we must not forget that close to 90000 applications were submitted in 2021 under The TR to PR pilot last year which have all not received a decision yet. So, the figure of 40000 may not be indicative of new applications that would be accepted, instead, it’s an inventory of applications with IRCC that are waiting to be processed.
This is largely because, as per a Self-Confessed data released in December, IRCC had an overall 1.8 million applications waiting to be processed under various immigration programs and the adjustment was done to limit the number of new applications coming in while allowing IRCC to work on reducing the backlog and keeping the overall planned numbers like what was previously announced.
In a nutshell, 2022 may not see FSW and CEC draws happening to everyone’s liking and we also don’t have any concrete information that indicates a definite probability of a TR to PR style of the program coming out this year. Immigration minister Sean Fraser did announce earlier, in the month that some version of Occupation-specific programs or draws might happen soon, but no concrete timelines or specifics were announced.
One of the issues that were completely ignored by IRCC is a plan for all the Temporary Residents who are in Canada. These are individuals who have probably spent thousands of dollars to come to Canada either as students or as workers and are currently on Work permits. Such applicants whose Work Permits are likely to expire in the weeks or months to come are currently dealing with a lot of unanswered questions and have doubts that should have been addressed by IRCC. What is the transition plan for them? or What is the plan for them to continue living in Canada on a Legal status until they get an opportunity to apply for their PRs?
Let us discuss an example: For somebody whose work permit to pr Canada was about to expire in September and if a CEC draw came out between now and September, this would allow the applicant to submit his/her PR application and subsequently apply for a Bridging Open Work Permit but for the same individual if no CEC draw happens before September, the applicant is left with very few options. Such an applicant can either leave Canada and go back to one’s home country or look for a Job Offer through an LMIA based Closed Work Permit or apply for a Visitor’s visa to continue staying in Canada. But overall, there is still a cloud of ambiguity as to what the future holds and also what are some of the things that one can do to sail through these tough times.
IRCC might still allow a Work Permit Extension Canada for Temporary Residents through a Temporary public policy as was done last year but until that happens these are some of the things one should do:
Apply for a visitor visa if you don't have one. Even as a worker or as a student, a visitor visa is required if one intends to leave and return to Canada but in the scenario that is building up, if you have a Visitor visa and your temporary status is about to expire, the visitor visa would help you to return to Canada or continue staying in Canada as a visitor.
Secondly, talk to your Employers to find out if they would be willing to support your employees through an LMIA in a scenario where your PGWP is about to expire. This would allow you to apply for a Closed Work Permit to continue working with the same employer.
Finally, don’t rely on CEC or “TR to PR” alone to get you your permanent status in Canada. Find out about the various Provincial programs that are currently active across Canada. For example, If you are in Ontario try to determine your eligibility under the various Ontario Immigrant Nominee Program (OINP) streams. If you feel that you are eligible under one of the Job offer streams, you must next try to determine if your employer meets the requirements. It’s important to talk to the employer and confirm that they are willing to support you on your PNP application. We meet clients all the time who haven’t created an Expression of Interest on the Provincial website despite being employed with an eligible employer and meeting all the eligibility requirements and had they taken the right steps in a timely fashion, they could have successfully submitted their PR applications a long time ago.
A fact that we must all be prepared to accept is that with the announcement of this New Immigration Levels Plan, life in 2022 for a lot of PR aspirants may not be as easy as it was in 2021. One must be prepared to put in that extra effort to make sure that one stands out and is one of those individuals who end up receiving their PRs this year.
Unfortunately, there is no One-Size-Fits-All solution that can work for everyone. Every individual is different with their own unique Credentials, and everyone must come up with a plan unique to one’s own circumstances. In fact, having more than one plan is also not a bad idea to make sure that if your Plan-A fails then your Plan-B or Plan-C are still there to help you receive your Permanent Resident status.

Let us explain what a Super visa is. Super Visa is a visitor visa (PG-1) specially designed for parents & grandparents that allows them to stay in Canada for up to 2 years status v/s up to 6 months stay authorization for TRV holders.
This Application comes with some mandates:
Applicants’ Medical Clearance from an IRCC Panel Physician
1 year of Insurance from a Canadian company for at least $100,000 covering the applicant
Inviter’s Low Income Cut Off (LICO) requirement to be met – Minimum income level to sustain yourself and your dependent
Why Super visa?
If you meet the income requirements, you are a PR resident and have the required insurance, and you are in command. A properly vetted Super Visa Application commands the highest success probability (barring any medical/criminality/misrepresentation concerns).
In contrast, when applying for a visitor visa, the onus of granting the Visa lies in the judgment of the Immigration officer. His/ her judgment of your financial viability, assurance that you are going on a temporary visit only, travel history, surety of return to your country of origin, etc. – the balance of probabilities comes into play.
Therefore, if you are applying for parents, Grandparents, or in-laws – a Super Visa is the option to go for.
Why Temporary Resident Visa (TRV) over Super Visa?
There are two reasons when a TRV may be a go-to option while applying for parents’ temporary residence in Canada:
 If the inviter does not meet the Super Visa’s LICO requirements.
Any medical condition that could add to the burden of Canadian Healthcare or could cause harm to society could make a person inadmissible to Canada. While Inadmissibility may be on various accounts, the concern is health issues for parents & grandparents.
