He could tell, just by the way that they were looking at him, that a question was coming. He was used to it, it came with the job description. But ever since the election, it had only been one single question. 'Can they do that?' And in the beginning, he gave the long legal constitutional explanation for it. Then, he was getting tired of it, and started summarizing it and ending with a joke — it didn't work well; he wasn't a man of jokes. Now he was just exhausted of it. He was looking for excuses to actively avoid people.
So when he saw two people talking to each other, whispering, before glancing at him, he knew. He knew and he wanted to avoid this entirely. "Quick, talk to me so they don't do it." He gestured towards Anne Kane, and turned his body to her. "I can't take them asking about the election anymore."

He found peace and quietness in this little bench almost hidden behind a wall, under a tree. He was still amazed by the size of the estate; Justice Cooper had invited him to a "small gathering", so Foster wasn't aware that he was walking into the modern equivalent of a ball in Pemberley.
So when he hears footsteps coming from behind, he almost wants to jump away and keep running, but he takes a good look at who is coming and breathes out, relieved. "Oh, God." He nods and then drags back on his cigarette. "I thought it was someone else." He explained; somewhow, he always found Michael unsettling. "I'm not running away," He cleared up, a little too eager to make that distinction.

Whenever he had an appointment with the CIA Director Foster knew that thing would not be as easy as expected. Sure, he had some background with countercyberterrorism, yes, but that was hardly the reason why they had him there. He was extra careful in those appointments. Still, he opened his door to welcome Alexander Ward. He offered a hand for him to shake, and then gestured at the empty chair. "Welcome, Mr. Ward, please, take a seat." He knew that there would be a lot of guards outside, and he wondered if this was a bad omen of any kind.

Finally, they were coming to inauguration. While America was upside down thanks to the election, it was coming to a hint of normality — if there ever was such a thing. As the last appointed to the court, he had been elected to swear in the Vice President, and he agreed that it was a huge honor. Did he wish it had been someone other than Silas Sanford? Probably, but it wouldn't stop him from doing his job as it was expected. Still, he welcomed the man into his office, precisely in their scheduled appointment hour. Foster was disgustingly on time, all of the time. "First of all, congratulations, Mr. Vice President-elected," he felt a bit silly with the whole title, it was rather long and unsual, but Foster was nothing if not polite and appropriate. "Thank you for coming and meeting me. We don't have much to go over, but from what I've heard, you like to plan ahead." Thankfully, both of them had qualified staffers that knew what to do.

He completely missed the name of the charity, or if he was here for himself or for his wife; there was a point in the recent past that the invitations got so specific for charities for causes he didn't even know it was a problem before, that he just signed got his assistant to check and decided if he should show up. Apparently, this one was worth it.
And then he caught himself in a situation, being locked inside the bathroom stall. It was so fancy that it didn't had a lock. Was it electronic? Voice activated? Bluetooth? Finger print? He didn't know. But now he had a problem. He was too dignified to cry for help, yes, and he had texted his wife to send someone to help, so he just sat on top of the toilet and waited.

Foster was far from warm. Perhaps that word was never used to describe him. Yet, he was kind, he was welcoming — in his own cold and distant way. Maybe that's why he ended up befriending Susan Hunter. She was promoted to FBI Director and while Foster wasn't sure if she had the strong hand the job needed, he was glad that he wasn't the one who had to make the call.
It was a surprise to him that now that he enjoyed her company. What he considered a weakness before was now the thing he admired in her. She didn't seem like the rest of DC, even after the job.
"How are you today?" He asked, crossing his leg and drinking from his coffee, trying to make it as if this was just two friends having a coffee together, and not two major government officials surrounded by security that didn't pretend to blend in.

"Well, that wasn't awkward." Foster said, finally taking a seat as their guest left. They had just been introduced at this country club, to each other. The kind hearted guest probably wasn't aware that Foster replaced Andreas' mother in the Supreme Court, so they had met before. They could've have handled that with more grace. Still, Foster smiled. "It's good to see you."

tl; dr: a decisive and independent associate justice. very interested in the attention that third party is receiving, and is determined to keep politics off his court. while he understands the law as black and white — as anything can be — politics has nuance. He never wanted a hand in it.

Aditional headcanons
He was somewhat popular in NY for his work as ADA, because he had a reputation of being ruthless in court — and he was. Was just as ruthless as a judge and still is. He can be kind of terrifying while in court, regardless of the side he is on.
Outside of that he is kinda charming, in a Dad kind of way. The one who will begrudingly drive you to the nice club in town, and then pick you up later on even if you’re drunk. Will likely lecture you, but you know it’s in a nice way.
Never had children and never really wanted them. He and his wife decided that early on, and they are very dedicated to their careers. Very supportive of each other, they have supported each other publicly and in private.
They also have a secretly open marriage that they keep it very discreet. She had a long relationship to one of her grad students, and almost considered ending their marriage, but they managed to get throught that, although both of them are aware that they might not be married for the rest of their lives.
