The Trust Deed yearly review is designed to take stock of your financial situation to see whether you can afford to make higher payments to your creditors or whether your payments should remain the same.
Of course, if your financial situation has got worse, your Trustee will need to know. In the case of financial emergencies, it may be possible for your Trust Deed payments to actually be postponed temporarily.
What questions will be asked?
Before your annual review is due, your Trustee will you a letter, to ask you to fill in an income and expenditure form and provide the supporting paperwork. This will allow the Trustee to clearly assess your financial situation.
You will have to work out your monthly outgoings and note down your income. Make sure to include all your household bills as you are responsible for including mortgages or rent payments. If you pay the bills jointly with your partner, you’ll need to list your half of the bills.

How to work out your monthly expenditure.

For any expenditure like this, the best way to get the average monthly cost is to total your annual bill and then divide it by 12. If you pay your rent weekly then multiply your rent payment by 4.33 to attain the monthly figure.
Gas, electric and phone bills will most probably vary month to month depending on how much you use. The same goes for fuel and everyday groceries. To obtain an accurate figure, total up your bills over the previous year and divide by 12 to get an average for each one of these costs.
Try and supply accurate figures for your annual review, it’s important to keep track of your bills every month from the beginning of your Trust Deed process. Setting up a simple spreadsheet with all your bills listed will make the review very easy!
The documents will you need to submit?
Along with the income and expenditure form with your current financial details, you will usually need to supply your payslips for the period, and probably your bank statements. This is so your Trustee will be able to see if any of your regular payments have altered, for example, if your home mortgage or rent payments have increased or decreased and whether there have been any changes to your salary.
What happens if your financial situation has changed?
Based on the information you submitted for your Trust Deed annual review, your Trustee will assess your current financial position and will contact you, within a few weeks, if your monthly payments have to change or remain the same. Your Trustee is legally obliged to return as much money as possible to your creditors, so if you can afford to pay a bit more, you’ll then have to increase your payments.
Obviously, if you don’t agree with the outcome of your financial review, then speak to your Trustee as soon as possible and present your case for why you think his/her decision is incorrect. It might be that you can provide more supporting information or that you missed something from the income and expenditure form the first time around.
