Terms of Service
Introduction This Terms of Service ("Agreement", "Terms of Use") is a contract between you and ("Tight Live", "Service", "us" "our" and "we") and governs your use of the Tight Live mobile application and website services (the "Service"). By using the Services, you agree to be bound by the following Terms of Service (the "Terms of Service"), whether or not you register as a member ("Member"). We may occasionally modify this Agreement, and such modification shall be effective upon posting on the mobile application and website. We may update you on our changes through your email or notify you through mobile apps or websites. You agree to be bound by any changes to this Agreement when you use the Service after posting any such modification. This Agreement includes Service's policy for acceptable use and content posted on the mobile application and website, your rights, obligations, and restrictions on using the mobile application and website. If you are under the age of 18, you may not download or use our Services. We do not knowingly collect or maintain information from children under age 18. If you are under 18, you must get your parent or guardian to read and agree to our Privacy Policy. Please, choose carefully the information you post on our Services and the information you provide to other Members. Your Service profile may not include the following items: nude, violent, or offensive images or texts. The information posted by other Service Members may contain inaccurate, inappropriate, or offensive materials, products, or services and Service assumes no responsibility or liability for this material. We reserve the right, in its sole discretion, to reject, refuse to post or remove any posts (including email) by you, or to restrict, suspend, or terminate your access to all or any part of the mobile application and website and/or Services at any time, for any or no reason, with or without prior notice, and without liability. 1. General We reserve the right to change these Terms of Service at any time. We will notify you within the app. You are responsible for keeping yourself apprised of any such changes if you dismiss these notifications. If you object to any Terms of Service or any subsequent changes or you become dissatisfied with our Services in any way, your only option is to delete your account. Your continued use of our Services after we post revised Terms of Service means that you agree to the revisions. You must be at least 18 years old to download our Services. By requesting to use or using our Services, you represent and warrant that you are not required to register as a sex offender with any government entity. Our Services are free, but your Internet provider's or mobile operator's fees and rates may still apply. However, we do have in-app purchases that you can buy if you want to use some of our extra features. You further acknowledge and agree that by clicking on a button labeled "SUBMIT", "I ACCEPT", "I AGREE" or similar links or buttons, you are submitting a legally binding electronic signature and are entering into a legally binding contract. You acknowledge that your electronic submissions constitute your agreement and intent to be bound by this Agreement. Pursuant to any applicable statutes, regulations, rules, ordinances, or other laws, including without limitation the United States Electronic Signatures in Global and National Commerce Act, P.L. 106-229 (the "E-Sign Act") or other similar statutes, you hereby agree to the use of electronic signatures, contracts, orders, and other records and electronic delivery of notices, policies, and records of transactions initiated or completed through the Service. Furthermore, you hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction that require an original signature, delivery, or retention of non-electronic records, or payments or the granting of credits by other than electronic means. 2. Your Account You can also choose to provide profile information like a photo, info, name, sexual interests, or other data. You can read more on our Privacy Policy, which has detailed information on what information is used. 3. Information About How You Use the Services We may collect information about your actions on the Services. This may include information such as the pages and profiles you view, how you use the Services and your subscriptions on the Services. It can also include the various functions and features that you use, such as the connections you make, other friends or contacts you invite to the Services and profile searches you perform, how often you log in and with what/ which platform you log in from, your IP address and how many profiles you have created, or your use of our applications. Read more on our Privacy Policy. 4. Content Posted on the Mobile Application 1. You understand and agree that our Services may review and delete any content, message, photo, profile, video, sound (collectively, "Content") that is in the sole judgment of us. 2. You are solely responsible for the content you publish or display (hereinafter, "post") on the Service or any material or information you transmit to other Members. 3. By posting any Content to the public areas of the mobile application and website, you hereby grant us the non-exclusive, fully paid, worldwide license to use, reproduce, publicly perform and display such Content on the mobile application and website, including without limitation distributing part or all of the mobile application and website in any media formats and through any media channels. You represent and warrant that: (i) you own the Content posted by you on the mobile application and website or otherwise have the right to grant the license outlined in this section, and (ii) your Content does not violate the privacy rights, publicity rights, copyright rights, or other intellectual property rights of any person. You agree to pay all royalties and fees owing to any person because of any Content you post on the mobile application and website. 4. The following is a partial list of the kind of Content that is illegal or prohibited on the mobile application and website. We reserve the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. The following is a list of examples of User Content that is illegal or prohibited on the Service: 1) is patently abusive and offensive to the online community, such as User Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual, harasses or advocates harassment of another person; 2) infringes, violates, or misappropriates any third-party right and/or applicable law in any other way, including, but not limited to, any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; promotes information that is objectionable, inaccurate, false, defamatory, discriminatory, misleading, or encourages illegal activities or conduct that is objectionable, abusive, threatening, obscene, discriminating, defamatory or libelous; 3) contains inflammatory religious commentaries or inaccurate or misleading quotations of religious texts; 4) promotes an illegal or unauthorized copy of another person's copyrighted work or protected by other intellectual property rights, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated images, audio or video, or links to pirated images, audio or video files; 5) contains realistic portrayals of people or animals being killed, maimed, tortured, or abused, or content that encourages violence, including images of lethal weapons; 6) is threatening or promoting any terrorism or terrorist activities; 7) contains restricted or password-only access pages, or pages requesting other Members to enter their personal or financial information, or hidden pages or images (those not linked to or from another accessible page); 8) provides material that exploits people under the age of 18 sexually or violently, or solicits personal information from anyone under the age of 18; 9) promotes or advocates for commercial sexual services, commercial sexual services involving people under the age of 18, human trafficking or other non-consensual sexual acts; 10) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; 11) engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes; 12) has features of pornographic or adult content, including, but not limited, content that represents a sexual act, naked genitals, or other graphic material; and/or 13) provides images of unaccompanied minors. We may prohibit providing, posting, and transmitting to other Members any kind of User Content depicting smoking, drinking alcohol, naked bodies (that do not necessarily constitute pornographic or adult content), and any other User Content. We may investigate and take appropriate legal action in our sole discretion against anyone who violates this provision, including, without limitation, removing the offending communication from the Service and terminating the access and membership of such violators. We reserve the right to change or ask Members to change any inaccurate, misleading, or false User Content or profile information of the Members. Suppose information provided to Tight Live, or another Member, only subsequently becomes inaccurate, misleading, or incorrect. In that case, you will promptly notify Tight Live of such a change, and you will take all reasonably necessary measures to correct the information. 5. You must use the Service in a manner consistent with any and all applicable laws and regulations. 6. You may not include in your publicly accessible Member profile any telephone numbers, street addresses, last names, URLs, usernames from any social platforms, or email addresses. 7. You may not engage in advertising to or solicitation of any Member to buy or sell any products or services through the Service. You may not transmit any chain letters or junk emails to other Members. Although we cannot monitor the conduct of its Members off the mobile application and website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, we reserve the right to restrict the number of messages which a Member may send to other Members in any period to a number which we deem appropriate in its sole discretion. 8. You may not attempt to impersonate another user or a person. 5. Prohibited Activities We reserve the right to investigate, suspend and/or terminate your account if you have misused the Service or behaved in a way we regard as inappropriate or unlawful, including actions or communications that occur off the Service but involve users you meet through the Service. The following is a partial list of the type of actions you may not engage in regarding the Service. You will not: · impersonate any person or entity. · solicit money from any users. · harm, stalk, or otherwise harass another. · impersonate, or misrepresent your relationship with, any person or entity (this includes pretending to be minor if you are not) · upload or transmit any Content that you do not have a right to make available or that infringes any patent, trademark, trade secret, copyright, privacy, or other proprietary rights of any party. · express or imply that we endorse any statements you make without our specific prior written consent. · illegally use the Service or to commit an illegal act. · access the Service in a jurisdiction in which it is unlawful or unauthorized. · ask or use users to conceal any illegally gained money or products' identity, source, or destination. · use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents. · upload or transmit software viruses or any other harmful computer code, files, or programs, or use any data mining, robots, or similar data gathering or extraction methods. · collect usernames and/or email addresses of users by electronic or other means to send unsolicited email or unauthorized framing of or link to the Service. · interfere with or disrupt the Service or the servers or networks connected to the Service. · transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware, or telecommunications equipment. · forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted to or through the Service (either directly or indirectly through the use of third-party software). · "frame" or "mirror" any part of the Service, without our prior written authorization. · use meta tags or code or other devices containing any reference to our Services or the Service (or any trademark, trade name, service mark, logo, or slogan of our Services) to direct any person to any other mobile application and website for any purpose. · modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service any software used on or for the Service, or cause others to do so. · post, use, transmit or distribute directly or indirectly (e.g. screen scrape) in any manner or media any content or information obtained from the Service other than solely in connection with your use of the Service in accordance with this Agreement. · register accounts or post Content automatically, systematically, or programmatically. · Create unnecessary amounts of accounts. If we determine you have created various accounts to spam, misinterpret, or other malicious reasons, we reserve the right to terminate your account without notice. We reserve the right to freeze/ban your account if we see that your actual location is different from the location you provided or your IP address changes continuously, varying between countries. You agree that all information that you submit upon creating your account, including information submitted from your Facebook account, is accurate and truthful. You have the right to post the Content on the Service and grant the license to Tight Live. You understand and agree that we may monitor or review any Content you post as part of a Service. We may delete any Content, in whole or in part, that in our sole judgment violates this Agreement or may harm the reputation of the Service. Considering Tight Live allowing you to use the Services, you agree that we, our affiliates, and our third-party partners may place advertising on the Services. By submitting suggestions or feedback to us regarding our Services, you agree that we may use and share such feedback for any purpose without compensating you. You agree that we may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary, such as to (i) comply with legal process; (ii) enforce this Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of the Company or any other person. 6. Your Interactions with Other Users Though we strive to encourage a respectful user experience, it is not responsible for the conduct of any user on or off of the Services. You agree to use caution in all interactions with other users, particularly if you decide to communicate off the Service or meet in person. You should not provide your financial information (for example, your credit card or bank account information), wire, or otherwise send money to other users. You are solely responsible for your interactions with other Members. We reserve the right but have no obligation to monitor disputes between you and other Members. 7. No Spam Policy You may not engage in any activity involving spam on our Services. Violations of this policy may result in immediate termination of service and legal action against any spammer. Accordingly, you may not upload, post, email, transmit or otherwise make available junk mail, commercial advertisements, or any other form of commercial solicitation on our Services. Violations of this policy could subject you or your agents to civil and criminal penalties. 8. Modifying the Services and Termination We are constantly striving to improve the Services and bring you the additional functionality that you will find helpful. This means we may add new product features or enhancements from time to time and remove some features, and if these actions do not materially affect your rights or obligations, we may not provide you with notice before taking them. We may even suspend the Services entirely, in which event we will notify you in advance unless extenuating circumstances, such as safety or security concerns, prevent us from doing so. You may terminate your account at any time, for any reason. We may terminate your account at any time without notice if we believe that you have violated this Agreement. 9. Eligibility Membership in the Service is void where prohibited. Using the mobile application and website and the Service, you represent and warrant that all registration information you submit is truthful and accurate. You represent and warrant that you are 18 years of age or older and that your use of the Service shall not violate any applicable laws or regulations. Your profile may be deleted without warning if it is found that you are misrepresenting your age. Your Membership is solely for your personal use, and you shall not authorize others to use your account, including your profile or email address. You are solely responsible for all Content published or displayed through your account, including any email messages and your interactions with other members. The Tight Live and/or Services are intended solely for users, who are;
· (1) eighteen (18) years of age or older;
· (2) not a convicted sex offender;
· (3) not accused or convicted of any human trafficking or modern slavery crime; and
· (4) not a ward, lacking legal capacity, or legally not permitted, by any means, to use the Tight Live or Services by the laws of the country they are residing in.
Any use of, registration, or access to the Tight Live or Services by a person who does not fulfill the eligibility requirements above is unauthorized, unlicensed, and in violation of these Terms of Service. Tight Live may terminate your account, delete any content or information that you have posted on the Services, and/or prohibit you from using or accessing the Tight Live or Services (or any portion, aspect, or feature of the Services) for any reason or no reason, at any time in its sole discretion, with or without notice, including without limitation if it believes that you do not fulfill the eligibility requirements above. 10. Subscriptions and Virtual Currency 10.1 Subscriptions You may purchase different subscription packages in one-month packets. Payment will be charged to your iTunes or Google account for all mobile subscriptions when you confirm your purchase. Your subscription will renew automatically unless you switch off the auto-renew feature at least 24 hours before the end of your current subscription. This is because your account may be charged for renewal within 24 hours before the end of your current subscription period. You can manage your subscription and switch off auto-renewal by accessing your iTunes or Google account settings. You may not cancel your current subscription during the subscription period, although you may cancel automatic renewal at any time. If you purchase a subscription packet with an introductory price, at renewal, you will be charged with the original price, which will be higher. If you have already used a free trial, you can not use it again, and you will be charged the full price. Both Apple and Google may facilitate "50% OFF" of subscription products for first-time users, and we take advantage of that ability. For example, we offer a free initial week to our first-time VIP subscribers from time to time. Eligibility for any such trial is limited to users who have not previously subscribed to our VIP subscription through a current or prior Tight Live account. If you are a previous subscription subscriber and try to claim a discount, you should be aware that Apple or Google may recognize your ineligibility. If so, you may not receive a discount but instead may be charged immediately for your first subscription month. This is a feature controlled by the Apple App Store or the Google Play Store, depending on which platform you use for our Services. Purchases of Subscriptions are non-refundable and non-transferable, even if they expire or are discontinued. We may change the purchase price for Subscriptions at any time and the features included in Subscriptions. We reserve the right to stop issuing Subscriptions at any time and to set expiration dates for Subscriptions. Subscriptions may not be redeemed for any sum of money or monetary value. 10.2 Payment Method Tight Live's Paid Services Tight Live's Paid Services may be purchased through your accounts with certain third parties, such as your Apple iTunes account or your Google Play account (a "Third Party Account"). If you purchase any Paid Services through a Third-Party Account, billing for these Paid Services will appear through your Third-Party Account. You should review the Third-Party Account's Terms of Service, which we do not control. 10.3 Cancellation of Subscriptions If you purchase a subscription through a third-party account, you will need to cancel your subscription through that third-party and in accordance with that third party's terms of Service. If you cancel your subscription, your subscription benefits will continue until the end of your then-current subscription term, but your subscription will not be renewed after that term expires. You will not be entitled to a prorated refund of any portion of the subscription fees paid for the then-current subscription term. 10.4 Term/Fees This Agreement shall remain in full force and effect while you use the mobile application and website and/or the Service. We may terminate your membership for any reason, at any time, without notice. If we terminate your Membership in the Service, you shall not be entitled to a refund of any unused portion of subscription fees, if any. Even after membership is terminated, this Agreement will remain in effect. Our Services' Terms of Service and/or subscription fees, if provided to you at registration, are subject to change if needed. By using the Service and becoming a Member, you acknowledge that we reserve the right to charge for the Service and have the right to terminate a Member's Membership, should a Member breach this Agreement or fail to pay for the Service if necessary required by this Agreement. Standard usage charges for SMS, MMS, and other data charges may apply and may be billed on your wireless service bill or deducted from your prepaid balance. 11. Disclaimers We are not responsible for any incorrect or inaccurate Content posted on the mobile application and website or in connection with the Service provided, whether caused by users of the mobile application and website, Members, or by any of the equipment or programming associated with or utilized in the Service. We are not responsible for the online or offline conduct of any user of the mobile application and website or Member of the Service. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, any user or Member communication. Our Services are not responsible for any problems or technical malfunction of any telephone network or lines, online computer systems, wireless phones or other devices, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any mobile application and website or a combination thereof, including any injury or damage to users and/or Members or to any person's computer related to or resulting from participation or downloading materials in connection with the mobile application and website and/or in connection with the Service. Under no circumstances shall Service be responsible for any loss or damage, including personal injury or death, resulting from the use of the mobile application and website or the Service or from any Content posted on the mobile application and website or transmitted to Members, or any interactions between users of the mobile application and website, whether online or offline. The mobile application and website and the Service are provided "AS-IS" and Service expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Service cannot guarantee and does not promise any specific results from using the mobile application and website and/or the Service. We take no responsibility for third-party advertisements posted on this Service's mobile application and website or through the Service, nor does it take any responsibility for the goods or services provided by its advertisers. 12. U.S. Export Controls Software from this mobile application and website (the "Software") is further subject to United States export controls. No Software may be downloaded from the mobile application and website or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other country to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list. 13. Disputes You agree that any dispute relating in any way to these Terms of Service or Service, including without limitation your or third-parties' access to or use of our Services, will be resolved by binding arbitration and not through litigation in any court (except in small claims court if the claim is within the court's jurisdiction and proceeds on an individual basis). Claims are subject to arbitration, regardless of what they are based on or whether they seek legal or equitable remedies. Arbitration applies to any and all such claims or disputes, whether they arose in the past, may currently exist, or may occur in the future. 14. Indemnity You agree to indemnify and hold Service, its subsidiaries, affiliates, officers, agents, and other partners and employees harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above. 15. No Agency There is no agency, partnership, joint venture, employee-employer, or franchisor-franchisee relationship between Tight Live and any User of the Service. 16. Non-commercial Use by Members The mobile application and website are for the personal use of Members only and may not be used in connection with any commercial endeavors except those specifically endorsed or approved by the management of our Services. Illegal and/or unauthorized use of the mobile application and website will be investigated. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of membership privileges. Service will take appropriate legal action for any illegal or unauthorized use of the mobile application and website. 17. Customer Service Service provides assistance and guidance through its customer care representatives. When communicating with our customer care representatives, you agree not to be abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive, or not to behave inappropriately. Suppose we feel that your behavior towards any of our customer care representatives or other employees is at any time threatening or offensive. In that case, we reserve the right to terminate your account immediately. 18. Disclaimer of Warranties You use Tight Live at your sole risk. We do not guarantee that our Services will always be safe, secure, or error-free or that our Services will always function without disruptions, delays, or imperfections. We make no warranty that our Services will meet your requirements, or Tight Live will be uninterrupted, timely, secure, and error-free. We make no warranty that the results obtained from us will be accurate or reliable. We make no warranty that the quality of products, Services, information, material, or purchased features obtained through our Services will meet your expectations. Any downloaded or received material through our Services is done at your own risk. You will be solely responsible for any damage to your or others' devices directly or indirectly from downloading any such material. Some jurisdictions do not allow the exclusion of such warranties or the limitation of liability for incidental or consequential damages. Some of the limitations of the warranty may not apply to you. In such cases, the warranties and liability will be limited to the fullest extent permitted by applicable law. 19. Copyright Policy a. Proprietary Rights Tight Live provides you a revocable, limited, non-exclusive, royalty-free, non-sublicensable, non-transferable license to use the Service. You may not post, transmit, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. You acknowledge and agree that Tight Live owns, licenses, or otherwise retains all proprietary rights in the Service and all intellectual property thereon and therein. Those rights include but are not limited to, database rights, copyright, design rights (whether registered or unregistered), patents, trademarks (whether registered or unregistered), and other similar rights, wherever existing in the world, together with the sole and exclusive right to apply for the protection of the same on behalf of Tight Live and its licensors. The Service contains the copyrighted material, trademarks, and other proprietary information of Tight Live and its licensors. Except for that information in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. b. Our Actions in Cases of Intellectual Property Rights Infringement We do not tolerate infringing activity on or through the Service anyhow. If we have any reasons to believe in good faith that User Content and/or any kind of information violates intellectual property rights of a third party by being made available on or through the Service, upon notice from an intellectual property owner or his or her agent, we: (i) remove or disable access to the material; and (ii) remove any User Content uploaded to the Service by "repeat infringers". "Repeat infringer" is a Member that has uploaded User Content to or through the Service and about whom Tight Live has received more than two takedown notices compliant under applicable law with respect to such User Content. However, we may terminate the account of Member after receipt of a single notification of claimed infringement. c. Procedure for Reporting Claimed Infringement If you believe that any content made available on or through the Service infringes your intellectual property right, please promptly send a written "Notification of Claimed Infringement" containing the following information to the designated agent identified below. Tight Live may share your Notification of Claimed Infringement with the Member that is a possible infringer, and you consent to make such disclosure by Tight Live. Your communication must include substantially the following: 1. A physical or electronic signature of a person authorized to act on behalf of the owner of the material(s) that has/have been allegedly infringed; 2. Identification of the material allegedly being infringed, or, if a single notification covers multiple materials, then a representative list of such works; 3. Identification of the specific material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Tight Live to locate the material on the Service; 4. Information reasonably sufficient to permit Tight Live to contact you, such as your name, address, telephone number, and email address; 5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright or other intellectual property owner, its agent, or the law; and 6. Under penalty of perjury, a statement that the information in the Notification of Claimed Infringement is accurate and truthful, and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. You should consult with your lawyer and/or review applicable law regarding copyright or other intellectual property infringement to confirm your obligations to provide a valid notice of claimed infringement. d. Designated Agent Contact Information The designated agent of Tight Live for receipt of Notifications of Claimed Infringement can be contacted at email: [email protected] e. False Notifications of Claimed Infringement or Counter Notifications Tight Live reserves the right to seek damages from any party that submits a false notification in violation of the law, as provided for by applicable law. 20. Safety and Security We do not currently conduct criminal background screenings on our Members. However, we reserve the right to conduct any criminal background check we deem appropriate at any time and use available public records. By agreeing to these Terms of Service, you hereby authorize any such check. 21. Limitation of Liability Except where otherwise inapplicable or prohibited by law, you expressly understand and agree that, to the fullest extent permitted by law, the released parties shall not be liable to you for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Tight Live has been advised of the possibility of such damages), resulting from: (a) the use, attempted use, or the inability to use the Service; (b) the cost of procurement of substitute goods and services resulting from any data, information, or services obtained or messages received or transactions entered into through, from, or as a result of the Service; (c) unauthorized access to or alteration of your transmissions or data; (d) statements or conduct of any user or third party on the Service; (e) your reliance on content or data made available by us; or (f) any other matter relating to the Service. Even if Tight Live is found liable under any theory, Tight Live liability and your exclusive remedy will be limited to the greater fees you have paid to Tight Live or $100. This limitation of liability shall apply for all claims, regardless of whether Tight Live was aware of or advised in advance of the possibility of damages or such claims. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Other This Agreement is accepted upon your use of the mobile application and website and is further affirmed by you becoming a Member of the Service. Tool owned by Fabric and acquired by Google is used for usage statistics. Firebase, operated by Google, is also used for usage analytics purposes. 3rd Party Conversion Tracking Tools: AppsFlyer, Google Conversion Tracking APIs, and Facebook Conversion tracking APIs are used for user conversion tracking. Crash Detection Tools: We use Crashlytics tools owned by Fabric for crash detection. It facilitates the maintenance and improvement of the Services. All your crash data is collected anonymously. 3.2 Online Advertising We use third-party advertising services like Google's ad services(DFP, Admob, AdX), Facebook Audience Network to deliver online advertisements to our end users within our Services, including mobile applications and websites. The ads may be based on information we know about you, as detailed in Section 2.2 Data From Others, and information that these ad service providers know about you based on their tracking data. The ads can be found on your recent activity or activity over time and across other services and may be personalized to your likes and interests. Suppose you wish to receive information relating to another user, such as a copy of any messages you received from them through our service. In that case, the other user will have to contact our Privacy Officer to provide their written consent before the information is released. Also, we may not be able to accommodate specific requests to object to the processing of personal information, notably where such requests would not allow us to provide our service to you anymore. For instance, we cannot provide our service if we do not have your date of birth. · Uninstall: You can stop all information collected by an app by uninstalling it using the standard uninstall process for your device. If you uninstall the app from your mobile device, the unique identifier associated with your device will continue to be stored. If you re-install the application on the same mobile device, we will be able to re-associate this identifier from your previous transactions and activities. · Accountability: In certain countries, including the European Union, you have a right to complain to the appropriate data protection authority if you have concerns about how we process your personal information. Data Retention We keep your personal information only as long as we need it for legitimate business purposes and as applicable law permits. To protect the safety and security of our users on and off our Services, we implement a safety retention window of six months following account deletion unless there is a technical difficulty. During this period, some of your account information will be retained, although the account will, of course, not be visible on the Services anymore. In practice, we delete or anonymize your information upon the deletion of your account (following the safety retention window) or after 5 years of continuous inactivity. An account is considered inactive when the Application of the Member has not established contact with Tight Live's servers (including due to deactivation of the geolocation process), and the Member has not used the Application. In any event, the Account of a Premium Member is not considered inactive. Unless: · we must keep it to comply with applicable law (for instance, some "traffic data" is kept for one year to comply with statutory data retention obligations) as well as to prevent bot systems that are abusing the system; · we must keep it to evidence our compliance with applicable law (for instance, records of consents to our Terms, Privacy Policy, and other similar consents are kept for five years); · there is an outstanding issue, claim, or dispute requiring us to keep the relevant information until it is resolved, or · the information must be kept for our legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, information may need to be kept to prevent a user who was banned for unsafe behavior or security incidents from opening a new account. Correspondence with our Customer Support team will be retained for longer to allow us to deal with any subsequent queries you may have but will usually be deleted within 6 years if there are no queries. Anonymized information about activity on our Services is retained for more extended periods for statistical and product research purposes, but this is not attributable to an individual once the profile has been deleted. Keep in mind that even though our systems are designed to carry out data deletion processes according to the above guidelines, we cannot promise that all data will be deleted within a specific time frame due to technical constraints. 9. Data Protection and Security We work hard to protect you from unauthorized access to or alteration, disclosure, or destruction of your personal information. As with all technology companies, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information will always remain secure. Your password is an essential part of our security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe your password or account has been compromised, you should change it immediately and contact support@Tight Live.ai with any concerns. We regularly monitor our systems for possible vulnerabilities and attacks and regularly review our information collection, storage, and processing practices to update our physical, technical, and organizational security measures. We may suspend your use of all or part of the Services without notice if we suspect or detect any breach of security. If you believe that your account or information is no longer secure, please notify us immediately. We are not responsible for virus protection outside our service network. We are also not responsible for the damage or destruction of user data. We will pursue every detected attack by hackers, etc., under civil law and, if necessary, by the prosecution. In case of a breach, we will notify; the EU representatives, our DPO, and our users who were or potentially were affected by the breach within 72 hours of the attack. We will announce it on our webpage. 10. Age and children's privacy Our Services are restricted to users who are 18 years of age or older. We do not permit users under the age of 18 on our platform, and we do not knowingly collect personal information from anyone under the age of 18. If you suspect that a user is under 18, please use the reporting mechanism available through the service. Suppose we become aware that a child, minor, or anyone under 18 has registered with us and provided us with personal data. In that case, we will take steps to terminate that person's registration and delete their profile information from our Services. If we do delete a Profile because you violated our no children rule, we may retain basic account and profile information to ensure that you do not try to get around our rules by creating a new profile. 10.1. What information do we collect from Younger Users? When a Younger User registers for Tight Live, we collect only limited information, including username, password, and birthday. We may also collect certain information automatically from the user's device, including internet or other network activity information such as device ID, IP address, web browser type, and version, country-level location, and specific app activity data. 10.2. How do we use the information we collect? We use the information we collect to provide and support our services. For example, we use usernames and passwords to authenticate Younger Users. We may use the information to protect the security or integrity of the user and our service; perform analytics and troubleshoot, and ensure legal or regulatory compliance. The information collected will not be used for any commercial purposes (including but not limited to: advertising and marketing) and will not be shared with third parties for any commercial purposes. Younger Users cannot publicly share personal information, including videos or profile information. 10.3. The security of your information We take steps to ensure that your information is treated securely and in accordance with this policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your information, for example, by encryption, we cannot guarantee the security of your data transmitted through the Service; any transmission is at your own risk. We will not sell the information of Younger Users to third parties. 11. International Transfer Policy In order to provide the Services to you, we must transfer your data to our servers and process it there. By visiting or using our Services, you consent to the storage of your data on servers. If you are using the Services, you consent to the transfer, storage, and processing of your data. Specifically, personal data collected in Switzerland and the European Economic Area ("EEA") is transferred and stored outside those areas.
