Property paperwork is required for the sale and acquisition of your asset. But, if you've misplaced them, here's what you need to do to request duplicates.
If you want to buy or sell your home, you must have the original documents for the transaction to go successfully. Naturally, the seller must retain all of this paperwork in a secure location. However, catastrophe can strike and you may misplace or lose your original paperwork. As a result, you will need to devote considerable work and resources to collecting duplicate papers.
Make an FIR – The owner should go to the police station and file an FIR (First Information Report) saying that the original paperwork for the property has been misplaced, lost, or stolen. He or she is required to receive a copy of the complaint. Even if the property is mortgaged and the bank misplaces the documentation, the owner must file an FIR. The buyer should ask the seller for a copy of the FIR. Based on the police complaint, the owner can apply to the housing society for a duplicate share certificate, which can be obtained by applying to the society meeting. If the application is approved during the management committee meeting, the housing society may charge a fee to issue a copy of the share certificate.
Send out a notice – To report the documents missing, the owner must also post a notice in both an English daily newspaper and a regional newspaper. The owner can place such notice and use it to summon any property claimants within 15 days of the notice appearing in the publication.
Create a task on stamp paper – The owner must obtain an assurance on stamp paper stating that the original documents have been lost. The undertaking should include the property's specifics, what was printed in the notice, and the police complaint number. It should also indicate unequivocally that all of the details stated in the endeavor are correct. After that, the document should be attested, notarized, and registered with a notary.
Request duplicate copies – The registrar's office, which keeps records of all transactions in its jurisdiction, can provide a copy of the original selling deed. The owner must submit copies of the police complaint, the housing society's share certificate, the newspaper notices, and the undertaking to the deputy registrar's office. He or she will also be asked to pay the applicable fees. Following that, a copy of the sale deed will be issued. If the property is older, it is advisable to obtain a title report of the document to ensure that it is free of encumbrances. To receive this paperwork, go to the deputy registrar's office, which will have all of the property's details.
