Aiyah! I am surprised that you are selling a fan-book about Pokémon! I mean, did you not once turn down having your edesigns be put in a Pokémon hack because you were worried about any legal issues? What is different wi the book?

Firstly, I’m not selling a fan-book personally, I’m helping promote it since I was one of the collaborating artists featured in the zine. The profits are going to the Ocean Conservancy charity and aren’t profiting any specific individual. I did a piece in my art-style but it doesn’t feature my redesigns at all.

There’s a large difference between illustrations and rom-hacks. There’s been a history of Nindendy cracking down hard on rom-hacks because there’s an argument that it being a playable game, it infringes onto the primary product it is based on, being video games.

If something happens and the rom-hack is hit with some kind of legal action, I don’t want to be affiliated and also brought into the legal action. I think an argument can be made that zines, illustrations and art prints do not cross that boundary of threatening the official product since its a much more transformative state than a rom-hack. There's a hypothetical problem a game would be mistaken for an official product, a problem that zines don't have.

I know I’m a Z-grade artist and I know most rom-hack projects don’t even get off the ground so I’m probably being overly cautious about a problem that would probably never happen, but I’d just rather be safe. Not to mention most people who ask me are people I don’t know very well. They seem very nice and polite and I’m flattered they’d ask, but also if I give the okay to use my designs I technically don’t know how they’ll use it in the future based on a one-time agreement over social media. I don’t think a lot of my designs are suited for a rom-hack unless it goes full into my art style and I don’t want anyone to make that because it would take too long and I wouldn’t want them to risk legal action either.

tl;dr - Using my designs versus me contributing fan art is a different ask, and a charity-zine is more transformative than a rom-hack.

I used one of those "draw the squad" templates of some people in a boat and now I have edesigns for the entire cast of the comic I plan to make.
