I Am Not A Lawyer, but here’s what I got from the analysis in this paper:

1) Using art for training data is probably fair use in the U.S. and EU.

2) It is unsure if anyone owns the copyright to the art created by AI.

As for point 1, I’ll just note that fair use has been whittled away for decades, so it’s really just “Fair use if the artist isn’t rich enough to have lawyers on retainer” like everything else.

On point 2, there definitely needs to be law written to clarify the status of generative AI as an art tool.

AI is not a person or even close, so it cannot own the copyright.

The person submitting the prompt is basically commissioning art from the AI, and is not the creator for purposes of automatically owning the copyright for works created.

The company or person who made the AI might own the copyright and be able to sell it to the prompter, but things are pretty wild and wooly and the EULAs might not be enough (where they even exist) to define this.

If you get something out of a prompt and then add to it (like @tkingfisher did with her AI comics, adding captions and sometimes specific foreground figures), that’s a transformative work and generates a new copyright...but unless ownership of the AI piece can be clarified, the legitimacy of the transformative work is called into question.

Make no mistake, taking other people’s work and mashing it up in some way is recognized as a copyrightable work, and has been for a long time. Collages, homages (even when they’re basically Roy Theftenstein stuff), etc. But in those cases, a human was doing the mashing, not an automated system. (I’ll leave aside some of the weirder Dada works for now, because those exist to screw with everyone.)

Now, Congress is not going to be doing anything useful any time soon, but the EU might set a precedent that corporations will have to follow.
