Super Cassettes Industries Pvt. Ltd. filed a case of copyright infringement against M/S M. World TV News. The plaintiff is a Cassette Company under the brand T-Series. Whereas the defendant is a cable connection provider. The plaintiff came to know about the infringement through a telecast by the defendant’s cable service. Thereafter, the plaintiff sent a legal notice to restrain the activity but the same was refused by the defendants. The defendant continued to broadcast the copyrighted work. Hence, the present suit was filed by Super Cassettes against M/S M. World TV News.
The Copyright Act says that the copyright in a work would be infringed whenever any person does anything within the exclusive domain of the copyright holder. Evidence was presented on behalf of the plaintiff in support of copyright infringement. The testimony of the witnesses has gone unchallenged and therefore, it was proved that the defendant has infringed the copyright of the plaintiff.
The plaintiff company is engaged in the business of manufacturing and marketing audio cassettes, video cassettes, compact discs, television, CD player, etc. They do business under the brand T-Series. T-Series is a famous brand of Bollywood Music and Indi-Pop songs. Plaintiff is the owner of the large industry of copyright works comprising inter-alia of cinematographic films, sound recording, underlying musical and literary works.
The defendant is a ground cable carrying on the business of providing cable television services to various subscribers having operation throughout India including the State of Gujarat including Amreli under the logo/picture "M World TV Cinema", "M World TV HD Saregama" having around 2,50,000/- connections.
On June 2018, the plaintiff came to know that defendant through a cable TV Channel "M World TV Cinema", "M WorldTV HD Saregama" is broadcasting to the public audio-visual clips of various songs in which the plaintiff owned copyrights. Songs like "Bandook Meri Laila", "A Gentleman", “Sab Jhute 2 Piya Ayena", "Dil Chori Sada”, “Kehoon Tumhein", "Soniye Dil Nahi Lagda" etc. were communicated to the public without the prior permission/license from the plaintiff. The plaintiff alleged that the defendant with bad intention and ulterior motives have removed/overshadowed T-Series logo while broadcasting the contents on its channel. The plaintiff repeatedly notified defendants to purchase a license but they overlooked the given option. The defendant also neglected the Summon of Court.
Plaintiff prayed for a decree of an injunction to restrain the streaming of the infringed songs. Additionally, the plaintiff claimed punitive damages. According to the records of the court, a letter was sent to the defendant on 2nd June 2018, for obtaining a license to stream the songs of the plaintiff. Thereafter, the defendant continued to run the song without any license from 2nd June 2018 to 14th September 2018. On 6th September 2019, the Court declared that the defendant is guilty of infringement and an injunction was issued to restrain the cable company.
