1, Supreme Court to hear plea challenging premature release of Anand Mohan on May 8

Today, the Supreme Court of India agreed to hear a petition on May 8, 2023, challenging the Bihar Government’s decision to grant pre-mature release to former Bihar MP Anand Mohan. He was accused of the mob lynching of Gopalganj District Magistrate G Krishnaiah in 1994. The matter was presented before the Chief Justice of India DY Chandrachud by the Advocate Tanya Shree (Petitioner’s counsel) for urgent listing. CJI agreed to list the matter for hearing on May 8, 2023. The petition to be addressed by the top Court was filed by the widow of District Magistrate, Uma Krishnaiah. The District Magistrate was killed after an attack led by Mohan through a mob. As a result of this, Mohan was sentenced to life imprisonment whereas on 24th April he came out of jail after serving 14 years on the grounds of remission of a sentence given by the Bihar Government. According to the remission policy of Bihar state, a murder convict of an on-duty public servant was not eligible for premature release. This Bar was eliminated after amending the remission policy in April. Therefore, Uma Krishnaiah approached the Supreme Court challenging the circular issued on April 10 by the Bihar Home Department amending Rule 481(1)(a) of the Bihar Prison Manual 2012. She also challenged Anand Mohan’s premature release. Hearing all these issues, CJI ordered to list the matter for hearing on May 8.

Today, the Supreme Court bench comprising Justices Ahsanuddin Amanullah and MR Shah allowed the withdrawal petition seeking a ban on political parties using names and symbols with religious connotations. The petition was filed by the former chairman of the Uttar Pradesh Shia Central Board of Waqfs, Syed Waseem Rizvi. After hearing the matter today, the bench ordered, “The appearing counsel seeks permission to withdraw the present petition with the liberty to approach the High Court. The writ petition stands dismissed as withdrawn, with the above liberty. We have not expressed anything on merits in favor of any party.”

3, Calcutta High Court: Justice TS Sivagnanam appointed as Chief Justice

On May 01, 2023, the Central Government apprised the appointment of the senior-most judge of the Calcutta High Court, Justice TS Sivagnanam, as its Chief Justice. He was born on September 16, 1963, and started his practice in September 1986. Initially, he was appointed as an additional judge of the Madras High Court, and on March 29, 2011, he was made a permanent judge there. Further, he was transferred to the Calcutta High Court in October 2021. The date of his retirement is 15 September 2025.
In February 2023, Justice TS Sivagnanam’s name was recommended by the Supreme Court Collegium for appointment as the Chief Justice of Calcutta High Court. His name was recommended because the then Chief Justice, Justice Prakash Shrivastava was to resign from office on March 30. Since 31 March 2023, Justice Sivagnanam was serving as Acting Chief Justice of the High Court.

As Muslims in India continue to face threat calls by Hindu-right wing members, Dr Gregroy Stanton, the President of Genocide Watch has warned that something similar to the inhumane Rwandan genocide could happen in India if stern action isn’t taken by the Government of India.
“As the leader of India, he has an obligation to denounce this genocidal speech… Yet, Narendra Modi has not spoken against it,” he said. Gregory H. Stanton is a former Research Professor in Genocide Studies and Prevention at George Mason University in the US.
He is world-renowned for his work in the area of genocide studies. He is the founder and president of Genocide Watch, the founder and director of the Cambodian Genocide Project, and the Chair of the Alliance Against Genocide. From 2007 to 2009 he was the President of the International Association of Genocide Scholars.
Amnesty International USA, Genocide Watch, and 17 other human rights organisations in the USA expressed concern at the plight of Muslims in India during the Congressional Briefing.
Experts present at the meeting spoke about how the country is likely to witness mass violence and massacres of Muslims if the situation worsens.
Last month, a three-day ‘Dharam Sansad’ was organized in Haridwar, where members of Hindu-right wing members made genocide calls against Muslims.
The event was organised by Yati Narasinghanand, the priest of Dasna temple in Ghaziabad, who is known for his hate-spewing remarks against Muslims.
During his speech in Haridwar, Narsinghanand targeted Muslims and urged Hindus to take up weapons against them. “Swords look good on stage only. This battle will be won by those with better weapons,” the spiteful Yati had said.

On January 14, 2022, Uttarakhand police arrested Jitendra Narayan Tyagi alias Wasim Rizvi who also participated in the hate-speech conclave in Haridwar.
Former chairman of Uttar Pradesh Shia Central Waqf Board and a Hindutva supporter Syed Waseem Rizvi converted to Hinduism months ago.
Following the huge outrage against the Islamophobic event, the police had registered a case against Tyagi and others under Section 153A of the Indian Penal Code (IPC) (promoting enmity between different groups on grounds of religion, etc) in Haridwar police station.
Others who were booked were Dasna temple priest Yati Narsinghanand, Hindu Mahasabha general secretary Annapurna, Sindhu Sagar, Dharamdas, Parmananda, Anand Swaroop, Ashwini Upadhyay, Suresh Chahwan, and Prabodhanand Giri.
The arrest comes a d day after the Supreme Court issued notice to the Uttarakhand government in a petition seeking an independent inquiry into the anti-Muslim hate speech at the ‘Dharam Sansad’ in Haridwar and Delhi in December last year.
The bench headed by Chief Justice of India NV Ramana allowed the petitioners to approach local authorities with their plea to stop a similar event.
Following his arrest, Yati Narsinghanand threatened the police officers who came to arrest Tyagi saying “Tum sab maroge (You will all die)”.
Uttarakhand Police have summoned Yati Narsinghanand and another accused, Sadhvi Annapurna. In a video circulating on social media, police officers are seen requesting Narsinghanand to cooperate as they take Jitendra Tyagi into custody.
Seated in a car, he is seen asking the officers why Tyagi was being arrested. The officers explain that they have to make the arrest in connection with the cases filed against him.
“I am with him in all three cases. Did he do it alone?” Narsinghanand asks. The officers are seen asking him to get out of the car so they can proceed, but Narsinghanand appears adamant.

Lucknow (Uttar Pradesh) [India], Oct 29 (ANI): Uttar Pradesh Shia Central Waqf Board has blamed the Congress party and radical Muslim leaders for the Ayodhya land dispute being, what the board believed, entangled in legalities. "Due to some radical Muslims and politics of the Congress party, the issue of construction of the Ram Temple is stuck in courts,” the Shia body chief, Syed Waseem Rizvi, said on Monday. Rizvi's comments have come ahead of the Supreme Court hearing pleas challenging the Allahabad High Court ruling.  The 2010 verdict had divided the disputed land in Ayodhya into three parts for each of the parties- the Sunni Waqf Board, the Nirmohi Akhara and Ram Lalla. The Shia Central Waqf Board, under Rizvi, often takes a line, which is contrary to the majority Muslim view on the Ram Temple issue.  Last year, the board said it was in favour of a grand Ram Temple at the disputed site in Ayodhya. On Monday, Rizvi reiterated a somewhat similar sentiment.  "The God who decides the fate of mankind in the whole world is today waiting for a human court to decide on his own abode. This is a matter of shame for all human being all across the world," Rizvi asserted. The Supreme Court, on September 27, had declined to refer the Ayodhya land dispute case to a larger Constitutional bench, removing roadblocks for early hearing of the appeals that challenged the 2010 verdict.  The top court held that all religions and religious places need to be equally respected. "Ashoka's Edicts preach tolerance to faith of others," said Justice Ashok Bhushan as he read out the verdict. On Monday, a bench of Chief Justice Ranjan Gogoi and Justices Sanjay Kishan Kaul and K M Joseph are expected to hear the appeals filed in the matter. (ANI)

The Supreme Court on Monday asked the Centre to respond to the Shia Waqf Board chairman's plea seeking a ban on hoisting green flags with a crescent and a star at buildings and religious places across the country.
A bench of Justices A K Sikri and Ashok Bhushan asked the counsel for Shia Waqf Board chairman Syed Waseem Rizvi to serve a copy of the petition to Additional Solicitor General Tushar Mehta to enable him file a reply on behalf of the Centre.
Rizvi, in his plea, has claimed that green flags with a crescent and a star are "un-Islamic" and resemble the flag of a Pakistani political party.
He also claimed in his plea that during his visit to Mumbai and other places in the country, he saw flags on several buildings and religious structures, allegedly causing tension between the Hindu and Muslim communities.
The plea alleged that the flags resembled the flags of the Pakistan Muslim League, which belongs to an "enemy country".

Build Ram Mandir in Ayodhya, Masjid-e-Aman in Lucknow: Shia Waqf Board
The Shia Central Waqf Board offered a solution Monday to the Babri Masjid-Ram Janmabhoomi conflict in Ayodhya.
The Board submitted a draft proposal to the Supreme Court seeking an amicable resolution to the Ayodhya issue by calling for the construction of a 'Masjid-e-Aman' in Lucknow's Hussainabad area. 
Speaking to the media, Shia Central Waqf Board chairman Syed Waseem Rizvi said, "The draft for resolving the Ayodhya issue, prepared by the Shia Waqf Board, has been submitted to the Supreme Court on November 18." 
He called the proposal "the best" while saying that the board is the "mutawalli" (caretaker) of the Babri Mosque and "had suggested giving up its right over the land in Ayodhya".
Rizvi added, "The Board is of the view that instead of Ayodhya, a 'Masjid-e-Aman' be constructed in Lucknow's Hussainabad area and it has requested the government to provide one acre land for it."
Referring to the claims of the UP Sunni Central Waqf Board over the disputed site, Rizvi said the one-third land given by the Lucknow bench of the Allahabad High Court through its September 2010 judgement was to Muslims and not to the Sunni Waqf Board.
Rizvi had claimed that as the Sunni Waqf Board had lost the case of its registration in several courts, only the Shia Waqf board had a right to the mosque.
Rizvi, addressed the press conference along with Mahant Narendra Giri, chairman of the All India Akhara Parishad, alleged that the Shia Board's views on the matter were never put forward in a forceful manner because the lawyers deployed for the purpose were "fake".
"On perusal of the files of the board, we have found that the lawyers pursuing the matter had not even been given the "vakalatnama" by the board, Rizvi said. He also demanded that the government order an inquiry into it.
Rizvi said, "The Shia Waqf Board is being accused of becoming active on the Ayodhya dispute lately but the reality is that it had no knowledge that lawyers have been deployed in the court from its side...The government needs to inquire as to who had deployed counsels on behalf of the board who did not plead the case properly."
Giri said that a Ram temple in Ayodhya will be constructed soon and that an amicable settlement should be reached on the issue by talking to all the parties concerned.
