Le 2 août 1970, le SMIC a été créé par Jacques Chaban-Delmas. Il est revalorisé en chaque début d’année.
Qui est concerné par le SMIC ?
Le SMIC s’applique à l’ensemble des salariés en France métropolitaine, mais également dans les départements d’outre-mer : la Guadeloupe, la Guyane, la Martinique, La Réunion, Mayotte, La Nouvelle-Calédonie, La Polynésie française, Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, les Terres Australes et Antarctiques Françaises et les îles de Wallis-et-Futuna.
Différences entre le SMIC 35h et 39h
Le SMIC pour 35h correspond au salaire minimum pour la durée légale du travail en France, soit 151,67 heures travaillées par mois.
Le SMIC pour 39h est égal au SMIC pour la durée légale (35h) plus 4 heures supplémentaires par semaine majorées à 25%, soit 169 heures travaillées par mois. Voir notre article sur la durée du travail.
Différence entre le SMIC brut, net et chargé

Controverses sur le SMIC
Du fait, d’un montant relativement élevé par rapport au salaire minimum des autres pays industrialisés, le SMIC français est un frein à la localisation d’emplois industriels sur le territoire. Il serait générateur d’un chômage élevé en France. Les autorités, conscientes du problème, ont essayé par des lois successives de limiter le cout du travail des SMICARDS par des réductions de charges sociales (loi Fillon par exemple).
