In his address, Kumar stressed that skilling in Andhra Pradesh is not merely about employment but about transforming lives. & Hon’ble Madam Justice Neena Bansal Krishna J
Order of the Delhi High Court as pronounced on 01.03.2024, ‘Additional District Judge has rightly concluded that it is the appellant who is responsible for acts of cruelty towards the respondent and had rejected the divorce petition. 34. Accordingly, there is no merit in the present Appeal, which is hereby dismissed.’
Subject: Divorce u/s 13(1) (ia) HMA. Divorce is sought by the husband on the ground of Cruelty.
Issue: Whether the respondent treated the petitioner with cruelty after the solemnization of marriage?
Husband’s Submission Seeking Divorce
The legal story that I am sharing with you is about the appellant-husband seeking Divorce from his wife on the ground of Cruelty inflicted upon him by the Respondent Wife. The allegation of the husband-appellant is she is casting aspersions on his character, on and off fights with him hurls abuses on him. Such conduct of the respondent has disturbed his peace of mind he is compelled to do all the household work including cooking and taking care of his children. The w married in the year 1982ife even had started living in a separate room in the house and is not fulfilling her marital obligations.
Wife’s Submission Opposing Divorce
Respondent-wife averred that it is not she rather it is her husband who has caused cruelty against her. They were married in the year 1982. They had two children from their marriage. The couple enjoyed their marital life for 10 years, till the coming of Ms. B. S., who happens to be the colleague, in the life of his husband-appellant. It is not she instead it is her husband who has started living in a separate room. The father of Ms. B. S. has also complained the same to the HOD of the Department where her daughter was working. Her submission was substantiated by the complaint lodged before the police by the father of Ms. B. S. that the appellant is ruining the life of their younger daughter. The elder sister of Ms. B. S. in evidence has also stated that the relationship of her sister to a very elderly man (appellant) has disturbed their family. The Respondent further submitted that the appellant had left the matrimonial home along with their children and started living in another locality and the neighbor of that locality has filed a complaint against the Appellant about his relationship with Ms. B.S. There was ample proof pointing towards the adulterous character of the appellant. One of the Known of the Respondent once went to the place of the Appellant and found Ms. B. S. was living as a wife and children were calling her mother.
Counter-submission by the Husband
The Husband in his counter reply denied all the allegations of the Respondent and said that she has appointed Ms. B. S. on the salary of Rs. 15,000/- as Governess to their children. And the allegation of the respondent has defamed him and he has filed suit for defamation against the Respondent.
The order passed by Add. Session Judge Dismissing Divorce
The Additional Session judge dismissed the Divorce application of the Appellant-Husband and observed that the relationship between the appellant and Ms. B.S. was of a nature that would cause one to believe that they had a relationship of husband and wife, which is unlawful, unauthorized, and not sanctioned by rule and custom and the possibility of a sexual relationship between them could not be overruled. Hence, the suspicion of the respondent was not held to be baseless and her conduct towards the appellant was not found to be cruel entitling him to a decree of divorce.
Appeal against order of Dismissal before The Delhi High Court by Husband
Aggrieved by the dismissal of his Divorce petition, the Husband filed an Appeal before the High Court of Delhi. The Delhi High Court perused the Evidence, documents, and submission of the Counsels for both parties and observed:
The appellant gave a fantastic explanation that she had shifted with him as a governess to take care of the children. He is paying her Rs.15,000/- per month for this job. Interestingly, Ms. B.S. was herself a government employee working in NEIPA and she being employed as a governess and even allegedly paid Rs.15,000/- is an explanation, which can be only termed as absurd as it can be.
The claim of the respondent of the appellant having developed a relationship outside the marriage is fully corroborated and supported not only by the oral testimony but also by the documents.
The overwhelming evidence on record reflects that indeed the appellant who got involved with Ms. B.S. in 1994 and left the house in August 1994 was the one who had committed the cruelty upon the respondent.
The respondent-wife cannot be penalized for making such allegations and protesting about the relationship which has a strong basis and foundation.
In fact, she had a justification to complain about the conduct of the appellant, and to take any view otherwise would indeed be committing cruelty upon the respondent.
in the light of the blatant conduct of the appellant is showing scant regard to his matrimonial relationship, are compelled to observe that despite it being a failed marriage of over 40 years, granting Divorce would be adding a premium to the wrong acts of the appellant.
While human emotions know no bounds and rules, the human sensibilities emanating from the mind should have prevailed for an educated person like the appellant to have reigned his affections for a third person, with scant regard for the respondent who had reposed complete faith by entering into the vows of marriage with him.

Unaware about initiation of CIRP against Corporate Debtor is not a ground to file claims at a belated stage case regarding – NCLT New Delhi Bench Court-V
A case analysis of  Toyota Financial Services India Ltd. Vs. Mr. Suresh Kumar Jain (Erstwhile RP) & Ors., decided by the National Company Law Tribunal (NCLT) on 10.09.2023. Introduction This case Toyota Financial Services India deals with the issue of whether a financial creditor can file its claim before the resolution professional (RP) after the approval of the resolution plan by the committee of creditors (CoC) and the NCLT on the ground that it was unaware of the initiation of the corporate insolvency resolution process (CIRP) against the corporate debtor. The NCLT held that such a claim cannot be entertained as it was filed at a belated stage and that the financial creditor failed to show due diligence in submitting its claim. Facts The appellant, Toyota Financial Services India Ltd., was a financial creditor of the corporate debtor, M/s. Shree Balaji Printopack Pvt. Ltd., which was engaged in the business of manufacturing and supplying corrugated boxes and cartons. The appellant had provided a loan facility to the corporate debtor for purchasing machinery and equipment. The corporate debtor had defaulted on its repayment obligations and the appellant had initiated recovery proceedings against it before the Debt Recovery Tribunal (DRT). Meanwhile, another financial creditor of the corporate debtor, M/s. Edelweiss Asset Reconstruction Company Ltd., had filed an application under Section 7 of the Insolvency and Bankruptcy Code, 2016 (IBC) before the NCLT for initiating CIRP against the corporate debtor. The NCLT had admitted the application and appointed an interim resolution professional (IRP) on 27.01.2020. The IRP had made a public announcement inviting claims from all creditors of the corporate debtor on 31.01.2020. The appellant did not submit its claim before the IRP within the stipulated time period. The IRP was later confirmed as the RP by the CoC, which was constituted on 14.02.2020. The RP had prepared an information memorandum containing all relevant information about the corporate debtor and invited resolution plans from prospective resolution applicants. The CoC had approved a resolution plan submitted by M/s. Shree Balaji Packaging Industries on 27.11.2020 with 100% voting share. The NCLT had also approved the resolution plan on 18.12.2020 and passed an order for its implementation. The appellant had filed its claim before the RP on 22.12.2020, claiming an amount of Rs. 1,77,64,524 along with interest as its financial debt. The appellant had also filed an application before the NCLT under Section 60(5) of the IBC, seeking directions to the RP to accept its claim and to modify the resolution plan accordingly. The appellant had contended that it was unaware of the initiation of CIRP against the corporate debtor as it did not receive any notice or communication from the IRP or the RP despite being a secured creditor. The appellant had also contended that it came to know about the CIRP only after receiving a copy of the order passed by the NCLT on 18.12.2020 approving the resolution plan. The appellant had further contended that it had a valid charge over the assets of the corporate debtor and that its claim was not barred by limitation as it had filed a suit for recovery before the DRT within three years from the date of default. The RP had opposed the application and submitted that the appellant’s claim was filed at a belated stage after the approval of the resolution plan by both CoC and NCLT and that it could not be entertained as per Section 31(1) of IBC which provides that once a resolution plan is approved by NCLT, it shall be binding on all stakeholders involved in CIRP. The RP had also submitted that the appellant’s claim was barred by limitation as per Section 18(1)(b) of Limitation Act, 1963 which provides that filing a suit for recovery does not extend limitation period for filing an application under IBC. The RP had further submitted that the appellant was not diligent in submitting its claim as it did not respond to the public announcement made by IRP or check the website of IBBI or NCLT where all details of CIRP were available. Issue with initiation of CIRP The main issue before NCLT was whether the appellant’s claim could be accepted by RP at a belated stage after approval of resolution plan by CoC and NCLT on the ground that it was unaware of initiation of CIRP against corporate debtor. Legal Provisions of CIRP The relevant legal provisions for this issue are: - Section 7 of IBC, which provides for initiation of CIRP by a financial creditor against a corporate debtor who has defaulted on its debt. - Section 13 of IBC, which provides for public announcement of CIRP by IRP inviting claims from all creditors of corporate debtor. - Section 15 of IBC, which provides for constitution of CoC comprising all financial creditors of corporate debtor. - Section 29 of IBC, which provides for preparation of information memorandum by RP containing all relevant information about corporate debtor for formulating a resolution plan. - Section 30 of IBC, which provides for submission and approval of resolution plan by RP and CoC respectively. - Section 31 of IBC, which provides for approval and implementation of resolution plan by NCLT and its binding effect on all stakeholders involved in CIRP. - Section 60(5) of IBC, which provides for jurisdiction of NCLT to entertain any application or proceeding by or against corporate debtor or corporate person or resolution professional or liquidator as the case may be. - Section 18(1)(b) of Limitation Act, 1963, which provides that filing a suit for recovery does not extend limitation period for filing an application under IBC. Analysis The NCLT analysed the case law on this issue and observed that: - The Supreme Court in Committee of Creditors of Essar Steel India Limited Vs. Satish Kumar Gupta & Ors. held that once a resolution plan is approved by NCLT, it shall be binding on all stakeholders involved in CIRP and that no claims can be entertained after such approval. - The Supreme Court in Babulal Vardharji Gurjar Vs. Veer Gurjar Aluminium Industries Pvt. Ltd. held that the limitation period for filing an application under IBC is three years from the date of default and that filing a suit for recovery does not extend such period. - The NCLAT in Binani Industries Limited Vs. Bank of Baroda & Anr. held that the purpose of making public announcement is to make all the interested parties/stakeholders aware of the initiation of CIRP of the corporate debtor so as to enable them to submit their claim and facilitate in preparing the information memorandum which is issued subsequently, after the collection and collation of claims of the operational and financial creditors so as to provide the resolution applicant all relevant information so that the resolution applicant can make a legally and financially sound resolution plan for the corporate debtor as is required under Section 29 of IBC. Based on these precedents, the NCLT held that the appellant’s claim could not be accepted by RP at a belated stage after approval of resolution plan by CoC and NCLT on the ground that it was unaware of initiation of CIRP against corporate debtor. The NCLT further held that: - The appellant’s claim was barred by limitation as per Section 18(1)(b) of Limitation Act, 1963 as it had filed its application under IBC more than three years after the date of default and that filing a suit for recovery before DRT did not extend such period. - The appellant failed to show due diligence in submitting its claim before RP as it did not respond to the public announcement made by IRP or check the website of IBBI or NCLT where all details of CIRP were available. - The appellant could not rely on the ground that it did not receive any notice or communication from IRP or RP despite being a secured creditor as it was not mandatory for IRP or RP to issue individual notice to each creditor and that public announcement was sufficient to inform all creditors about CIRP. Conclusion of CIRP against corporate debtor. The NCLT concluded that there was no merit in the application filed by appellant and that RP had rightly rejected its claim as it was filed at a belated stage. KOCHI: Activist Girish Babu (47) was found dead in his home in Kalamassery on Monday morning.
According to the police, the preliminary investigation behind the death suggests he died after a cardiac arrest. Girish was undergoing treatment for health-related issues, which he also published through a Facebook post last month. The police reached Girish’s house and started the inquest proceedings.
Girish has been living with his family in Kalamassery and it was his wife who found him dead in the bedroom this morning, police said. “It seems like a case of cardiac arrest. However, we can reach a final conclusion only based on the autopsy report,” said a police officer.
Several public interest petitions filed by Girish have created a political stir in Kerala. The cases, including the Palarivattom flyover scam and the ‘monthly payments’ allegations against Veena Vijayan, daughter of Chief Minister Pinarayi Vijayan, hogged headlines recently.
He moved to the Vigilance Court in Muvattupuzha, seeking an investigation into the alleged bribe paid by Cochin Minerals and Rutile Ltd. (CMRL) to Veena Vijayan. However, the court rejected the petition recently. Following this, he moved the High Court to hear the case. Girish’s death came while the court was about to consider his petition today.
Girish, who sought the probe citing revelations by the Income Tax Interim Board of Settlement (ITIBS), New Delhi, named the CM, and UDF leaders Ramesh Chennithala, P K Kunhalikutty, and V K Ebrahimkunju in the petition, claiming they, too, received bribes from CMRL. Veena’s company, Exalogic Solutions, CMRL, its MD S N Sasidharan Kartha, chief financial officer K S Suresh Kumar, chief general manager P Suresh Kumar, and cashier K M Vasudevan were also been named in the plea

Background:
This Writ was filed by the Petitioner mother praying for directing the Respondent State to produce his daughter before the Court.
Fact:
1.    It was submitted by the petitioner mother that her daughter was friendly to Suraj who was living in their neighborhood.
2.    He #allured her into #love and #affection and made physical relations with her. He had also made #illicitvideos making them #viral on #Instagram repeatedly. She further averred that her #daughter who is a #minor, could not understand the #gravity of her #actions.
3.    An #FIR u/s #463* IPC was lodged by the mother against the Respondent on 20.09.2023.
4.    Petitioner had also submitted that she has not spoken to her daughter after 08.10.2023 and she has repeatedly requested the police to help her come in contact with her daughter.
5.    She was informed that her daughter is safe and enjoying family life with her husband.
6.    She also submits that her daughter being a minor has been raped multiple times by the accused and therefore, she is approaching this Court to save her daughter from the clutches of respondent No. 3-accused.
Submission of the State
1.    The accused is in judicial custody and the missing girl has been recovered and her statement under Section #164 Cr. P.C. has been recorded.
2.    The victim/girl is pregnant by six weeks.
Courts observation
1.    The girl informed the Court that she is 6 weeks’ pregnant and want to go with her parents.
2.    Parents of the girl informed the Court that that this is #not the #firsttime that their minor daughter has been #allured or is carrying pregnancy and this time, they #do #notwish to #takeher to their #house.
3.    Since the victim girl was #recovered hence the #prayer of the petitioner is #satisfied.
4.    As the parents of the girl refused to take their daughter with them, as such, Court directed SI from Bharatnagar Police Station to bring the the minor girl to #NirmalChhaya*, Jail Road, New Delhi.
Section 463*IPC - Whoever makes any false document or false electronic record or part of a document or electronic record, with intent to cause damage or injury], to the public or to any person, or to support any claim or title, or to cause any person to part with property, or to enter into any express or implied contract, or with intent to commit fraud or that fraud may be committed, commits forgery.
