A fresh motion on notice seeking to stop the inauguration of Bola Tinubu as Nigeria’s next President on May 29 has been instituted at the Court of Appeal in Abuja. The suit marked CA/CV/259/2023 was instituted by Ambrose Owuru, who is a past presidential candidate and constitutional lawyer who ran for the presidency under the platform of the Hope Democratic Party in 2019. Listed as respondents in the motion on notice are the President, Major General Muhammadu Buhari (retd.), the Attorney-General of the Federation and Minister of Justice, Abubakar Malami, and the Independent National Electoral Commission as 1st to 3rd respondents respectively. Owuru in the suit is praying the Court of Appeal to prohibit President Buhari, the AGF and INEC from inaugurating the 2023 President-elect on May 29, claiming that he was the valid winner of the 2019 election and had not spent his tenure as required by law. Consequently, he is seeking to stop any other move towards the inauguration of Tinubu or anybody else as successor to Buhari. Among other things, Owuru maintained that Buhari had been usurping his tenure of office since 2019 because the Supreme Court had not determined his petition filed in 2019 wherein he challenged Buhari’s victory. In his motion on notice marked CA/CV/259/2023 Owuru applied for “An order of prohibitory injunction compelling Buhari, AGF and INEC, their servants, agents and privies to preserve and give due cognizance and abstain from any further undertaking or engaging in any act of usurpation of adjudged acquired Constitutional rights and mandate as the winner of the 2019 presidential election.” He also applied for another order placing on notice that any form of inauguration, organised by Buhari on May 29, 2023 remains and is viewed as an “interim placeholder” administration arranged pending the hearing and determination of his substantive appeal on the constitutional interpretation thereof. The motion is supported with an eight-paragraph affidavit praying the Court of Appeal for an expeditious hearing before the inauguration of Tinubu. The affidavit deposed to by an Abuja-based legal practitioner, Adebayo Anafowode, and filed at the Court of Appeal in Abuja, expressed apprehension that Owuru’s suit against Buhari would be rendered nugatory unless given a quick hearing. It read in part, “That the applicant (Owuru) is the adjudged 1st in time constitutional winner of the February 16, 2019, presidential election reserves the right of first refusal over any later presidential election returns in the face of usurpation of adjudged acquired constitutional rights.” No date has been fixed for the hearing of the suit yet Read the full article

The House of Representatives Ad hoc Committee investigating the alleged loss of over $2.4 billion in revenue from illegal sale of 48 million barrels of crude oil in 2015, has summoned Minister of Finance, Zainab Ahmed, Secretary to the Government of the Federation (SGF), Boss Mustapha, and the Attorney General of the Federation (AGF), Abubakar Malami, to appear before as part of its ongoing investigation. The panel is also probing all oil exports and sales from 2014 till date, with the invitees expected to provide details of remittances into the Federation Account and come up with recommendations for legislative work on the Whistle Blower Protection Bill current before the lower legislative chamber. The panel which issued the sum­mon on Tuesday, April 11, at an investigative hearing on the subject matter also slammed Oriental Energy Limited with a one-week ultima­tum to provide all necessary details regarding its involvement in crude oil lifting and sales within the peri­od under review. Chairman of the committee, Mark Gbillah, said their focus was on the alleged sale of crude in China, which was reportedly not remitted and other matters contained in the panel’s terms of reference. He clarified: “We are looking at the issues that have to do with allegations of 48 million of crude oil barrels sold in China. We are looking at the issue of crude oil export in general from Nigeria for the period under review. We are also looking at the whistleblower revelations and recoveries, which the Federal Government publicly attested to. “It’s unfortunate that the Minister of Finance and the Attorney General of the Federation are not here. “This is a formal request from the committee that they should appear before us, as they have received formal invitations. And a lot of what we have to investigate regarding the whistleblower policy is saddled within the Ministry of Finance and the Attorney General of the Federation (Office). “There are responses received from the Accountant General’s Office, which show that the Minister of Finance has been approving payments to whistleblowers in percentages at variance with what the policy says they should be paid.” “There have been allegations of the Attorney General being involved also in the receipt of funds from outside the country without these funds being remitted into the Federation Account in line with provisions of the Constitution. “There have been allegations that there has been expenditure from these recoveries in complete violation of provisions of the Constitution.” Gbillah went on: “The Central Bank of Nigeria (CBN) made a formal response to this committee, indicating that. You see agencies make expenditure from their Treasury Single Accounts (TSAs) without recourse to the CBN. “This is something alarming the CBN declared before us. We are aware of constitutional provisions that state all revenue accruing to the federation must be paid into the Federation Account.” The Speaker, Femi Gbajabiamila, earlier restated the resolve of the Ninth Assembly to pass the Whistle Blower Protection Bill, urging the panel to expeditiously submit its report. “The recommendation of the committee after its investigation, will no doubt, guide the House in making an informed decision in considering the Whistle-Blower Bill currently before it,” he added. Breaking: Emefiele’s Request To Restrain Electoral Body, INEC, Over Presidential Ambition Rejected By Court The Governor of Central Bank of Nigeria, (CBN), Godwin Emefiele’s request to restrain the Independent National Electoral Commission (INEC) and the Attorney General of the Federation, (AGF), Abubakar Malami, from preventing him to pursue his presidential ambition while in office as head of the apex bank has been flatly refused by a Federal High Court in Abuja, SaharaReporters reports. Emefiele had in a suit marked FHC/ABJ/CS/610/2022 and filed on May 5 asked the court to declare him eligible to participate in the 2023 presidential election. In the suit filed through Chief Mike Ozekhome (SAN), he is praying for a declaration that he is not bound to resign to participate in a primary election to select a presidential candidate.   The CBN Governor is the sole plaintiff in the suit, with the Independent National Electoral Commission (INEC) and the Attorney-General of the Federation as respondents.   He also prayed the court to determine whether Section 84(12) of the Electoral Act 2022 is not inconsistent with Section 137 (1)(G) of the 1999 Constitution.
